39-A. As used in this section:

41-1. “Agent” means any person charged with the respons ibility of
42-navigating and operating the personal delivery device, as defined in
43-this section. Agent does not mean a person who req uests or receives
44-the services of a personal delivery device;

48-2. “Personal delivery device ” means an electronically powered
49-device:

51-a. primarily operated on sidewalks and crosswalks,
52-
53-b. intended primarily for the transport of cargo and
54-goods on public rights-of-way,
55-
56-c. whose weight of the device is not greater than five
57-hundred fifty (550) pounds, not including property
58-being transported, and
59-
60-d. equipped with automated driving technology, including
61-software and hardware, that enables the operation of
62-the device with remote support and supervision;
63-
64-Personal delivery device shall not mean a motor vehicle and shall
65-not be classified as such.
66-
67-3. “Personal delivery de vice operator” means a person or the
68-person’s agent who monitors or exercises physical control over the
69-navigation system and operation of a personal delivery device.

71-SECTION 2. NEW LAW A new sect ion of law to be codified
72-in the Oklahoma Statutes as Section 1801 of Title 47, unless there
73-is created a duplicatio n in numbering, reads as foll ows:

75-A. Notwithstanding any other law of this state , a personal
76-delivery device may operate on any sidewalk, crosswalk, road or
77-street of any county or municipality in this state.

79-B. A personal delivery device shall have a unique identifying
80-device number and identifies the name and contact information of the
81-personal device operator.

83-C. A personal delivery de vice shall:

85-1. Not unreasonably interfere with motor vehicles or traffic;
86-
87-2. Not obstruct public rights of way;
88-
89-3. Obey all traffic and pedestrian control signals and devices;

93-4. Not operate at a speed of more than ten (10) miles per hour
94-on the sidewalk;

96-5. Be equipped with a system that enables the device to come to
97-a controlled stop;

99-6. Be equipped with lights on the front and rear of the device
100-that are visible and recognizable under norm al atmospheric
101-conditions on all sides of the device from at least five hundred
102-(500) feet from the device; and
103-
104-7. Not transport hazardous material regulated under the
105-Hazardous Materials Transportation A ct (49 U.S.C. § 5103) and are
106-required to be placarded under 49 CFR Part 172, Subpart F .

113-licensing and registration requirements under the laws of this

116-B. A personal delivery device ope rator shall maintain an
117-insurance policy that provides g eneral liability coverage of at
118-least One Hundred Thousand Dollars ($100,000.00) for damages arising
119-from the operation of the device .

121-SECTION 4. NEW LAW A new section of law to be codified
122-in the Oklahoma Statutes as Section 1803 of Title 47, unless there
123-is created a duplication i n numbering, reads as follows:

125-A. Except as otherwise provided by law, a political subdivision
126-shall not enact or enforce an ordinance or resolution relating to
127-any of the following :

129-1. The design, manufacture, maintenance, certification,
130-licensing, registration, taxation, assessment or insurance
131-requirements of a personal delivery device; and

138-B. A political subdivision shall have the authority to prohibit
139-the operation of personal delivery devices within certain districts
140-or within their entire jurisdiction.
