83	83	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
84	84	SECTION 1. NEW LAW A new s ection of law to be codified
85	85	in the Oklahoma Statut es as Section 1-1981 of Title 63, unless there
86	86	is created a duplication in numbering, reads as follows:
87	87	A. As used in this section:
88	88	1. “Home care agency”, “home care agency administrator” and
89	89	“home health aide” shall have the same meaning as provided by
90	90	Section 1-1961 of Title 63 of the Oklahoma Statutes;

142	142	2. “Long-term care administrator ” shall have the same meaning
143	143	as provided by Section 330.51 of Title 63 of the Oklahoma Statutes;
144	144	3. “Long-term care facility” means:
145	145	a. a nursing facility, specialized facility or
146	146	residential care home as defined by Section 1 -1902 of
147	147	Title 63 of the Oklahoma Statutes ,
148	148	b. an adult day care center as defi ned by Section 1-872
149	149	of Title 63 of the Oklahoma Statutes ,
150	150	c. skilled nursing care provided in a distinct part of a
151	151	hospital as defined by Section 1-701 of Title 63 of
152	152	the Oklahoma Statutes ,
153	153	d. an assisted living center as defined by Section 1 -
154	154	890.2 of Title 63 of the Oklaho ma Statutes,
155	155	e. the nursing care component of a continuum of care
156	156	facility as defined under the Conti nuum of Care and
157	157	Assisted Living Act,
158	158	f. the nursing care compone nt of a life care community as
159	159	defined by the Long-term Care Insurance Act, or
160	160	g. a residential care home as defined by Section 1 -820 of
161	161	Title 63 of the Oklahoma Statutes ;
162	162	3. “No call/no show” means the absence of an employee from work
163	163	without notifying the employer; and
164	164	4. “Nurse aide” means any person who provides, for
165	165	compensation, nursing care or health-related services to residents

217	217	in a nursing facility, a special ized facility, a reside ntial care
218	218	home, continuum of care facility, assisted living center or an adult
219	219	day care center and who is not a licensed health professional. Such
220	220	term also means any person who provides such services to individuals
221	221	in their own homes as an employee or c ontract provider of a home
222	222	health or home care agency, or as a contract provider of the
223	223	Medicaid State Plan Personal Care Program .
224	224	B. The State Department of Health shall create, maintain and
225	225	make available to long-term care administrators, home care agency
226	226	administrators, hospice administrators, hospital administrators and
227	227	designees of such administrators an electronic database for looking
228	228	up occurrences of no call/no show by certified nurse aides and hom e
229	229	health aides, disciplinary action imposed including, but not limited
230	230	to, disciplinary action imposed under subsection C of this section
231	231	and occurrences of refusal to reimburse the costs described in
232	232	subsection D of this section . The database shall be se archable by
233	233	name of the employee. The database shall be read-only for
234	234	administrators and designees, and all information contained in the
235	235	database shall be entered by the Department. If allowed under
236	236	federal law and regulation, the Department may use the registry
237	237	created under Section 1-1951 of Title 63 of the Oklahoma Statutes to
238	238	implement the provisions of this section. The database shall not be
239	239	subject to the Oklahoma Open Records Act and shall, except for the
240	240	purposes of this section and, if applicable, such other purposes as

293	293	Title 63 of the Oklahoma Statutes , be confidential.
294	294	C. When a long-term care administrator, home care agency
295	295	administrator, hospice administrator, hospital administr ator or
296	296	designee of such administrator reports an occurrence of no call/no
297	297	show to the Department, the Department shall investigate the claim.
298	298	If the claim is substantiated, the De partment shall record the
299	299	occurrence of no call/no show in the file of the certified nurse
300	300	aide or home health aide in the dat abase. The Department shall
301	301	issue a warning to a certified nurse aide or h ome health aide who
302	302	commits a first no call/no show. The Department shall suspend for a
303	303	period not to exceed ninety (90) calendar days the certification of
304	304	a certified nurse aide o r home health aide if he or she commits a
305	305	second no call/no show within three (3) years after the first
306	306	occurrence. The Department shall revoke the certification of a
307	307	certified nurse aide or home health a ide if he or she commits a
308	308	third no call/no show within the same three-year period. The
309	309	Department shall record all disciplinary action imposed by the
310	310	Department in the database created under this section. The
311	311	Department may allow a certified nurse aide or home health aide
312	312	whose certification has been revoked under this subsection to
313	313	reapply for certification afte r a period to be determined by the
314	314	Department. The Department may permanently revoke certification
315	315	upon the second revo cation. Any certified nurse aide or home health

367	367	aide who is aggrieved by a disciplinary action taken by the
368	368	Department under this subsection may appeal the action as provided
369	369	by the Administrative Procedures Act .
370	370	D. A long-term care administrator , home care agency
371	371	administrator, hospice administrator or hospital admin istrator may
372	372	require a certified nurse aide or home health aide whose
373	373	certification was or is currently being financed by the long-term
374	374	care facility, home care agency, hospice agency or hospital at which
375	375	the certified nurse aide or home health aide is currently employed
376	376	who commits a no call/no show to reimburse the facility or agency
377	377	that financed or is financing the cer tification for any costs
378	378	incurred by the facility or agency related to the certification. If
379	379	the certified nurse aide or home health aide refuses to reimburse
380	380	such costs, the administrator or designee may report such refusal to
381	381	the Department and the Department shall record such informatio n in
382	382	the file of the certified nurse aide or home health aide in the
383	383	database created under this section.
384	384	SECTION 2. This act shall become effective November 1, 2021.
