8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. NEW LAW A new s ection of law to be codified
8585 in the Oklahoma Statut es as Section 1-1981 of Title 63, unless there
8686 is created a duplication in numbering, reads as follows:
8787 A. As used in this section:
8888 1. “Home care agency”, “home care agency administrator” and
8989 “home health aide” shall have the same meaning as provided by
9090 Section 1-1961 of Title 63 of the Oklahoma Statutes;

142142 2. “Long-term care administrator ” shall have the same meaning
143143 as provided by Section 330.51 of Title 63 of the Oklahoma Statutes;
144144 3. “Long-term care facility” means:
145145 a. a nursing facility, specialized facility or
146146 residential care home as defined by Section 1 -1902 of
147147 Title 63 of the Oklahoma Statutes ,
148148 b. an adult day care center as defi ned by Section 1-872
149149 of Title 63 of the Oklahoma Statutes ,
150150 c. skilled nursing care provided in a distinct part of a
151151 hospital as defined by Section 1-701 of Title 63 of
152152 the Oklahoma Statutes ,
153153 d. an assisted living center as defined by Section 1 -
154154 890.2 of Title 63 of the Oklaho ma Statutes,
155155 e. the nursing care component of a continuum of care
156156 facility as defined under the Conti nuum of Care and
157157 Assisted Living Act,
158158 f. the nursing care compone nt of a life care community as
159159 defined by the Long-term Care Insurance Act, or
160160 g. a residential care home as defined by Section 1 -820 of
161161 Title 63 of the Oklahoma Statutes ;
162162 3. “No call/no show” means the absence of an employee from work
163163 without notifying the employer; and
164164 4. “Nurse aide” means any person who provides, for
165165 compensation, nursing care or health-related services to residents

217217 in a nursing facility, a special ized facility, a reside ntial care
218218 home, continuum of care facility, assisted living center or an adult
219219 day care center and who is not a licensed health professional. Such
220220 term also means any person who provides such services to individuals
221221 in their own homes as an employee or c ontract provider of a home
222222 health or home care agency, or as a contract provider of the
223223 Medicaid State Plan Personal Care Program .
224224 B. The State Department of Health shall create, maintain and
225225 make available to long-term care administrators, home care agency
226226 administrators, hospice administrators, hospital administrators and
227227 designees of such administrators an electronic database for looking
228228 up occurrences of no call/no show by certified nurse aides and hom e
229229 health aides, disciplinary action imposed including, but not limited
230230 to, disciplinary action imposed under subsection C of this section
231231 and occurrences of refusal to reimburse the costs described in
232232 subsection D of this section . The database shall be se archable by
233233 name of the employee. The database shall be read-only for
234234 administrators and designees, and all information contained in the
235235 database shall be entered by the Department. If allowed under
236236 federal law and regulation, the Department may use the registry
237237 created under Section 1-1951 of Title 63 of the Oklahoma Statutes to
238238 implement the provisions of this section. The database shall not be
239239 subject to the Oklahoma Open Records Act and shall, except for the
240240 purposes of this section and, if applicable, such other purposes as

292292 are authorized for the re gistry created under Section 1 -1951 of
293293 Title 63 of the Oklahoma Statutes , be confidential.
294294 C. When a long-term care administrator, home care agency
295295 administrator, hospice administrator, hospital administr ator or
296296 designee of such administrator reports an occurrence of no call/no
297297 show to the Department, the Department shall investigate the claim.
298298 If the claim is substantiated, the De partment shall record the
299299 occurrence of no call/no show in the file of the certified nurse
300300 aide or home health aide in the dat abase. The Department shall
301301 issue a warning to a certified nurse aide or h ome health aide who
302302 commits a first no call/no show. The Department shall suspend for a
303303 period not to exceed ninety (90) calendar days the certification of
304304 a certified nurse aide o r home health aide if he or she commits a
305305 second no call/no show within three (3) years after the first
306306 occurrence. The Department shall revoke the certification of a
307307 certified nurse aide or home health a ide if he or she commits a
308308 third no call/no show within the same three-year period. The
309309 Department shall record all disciplinary action imposed by the
310310 Department in the database created under this section. The
311311 Department may allow a certified nurse aide or home health aide
312312 whose certification has been revoked under this subsection to
313313 reapply for certification afte r a period to be determined by the
314314 Department. The Department may permanently revoke certification
315315 upon the second revo cation. Any certified nurse aide or home health

367367 aide who is aggrieved by a disciplinary action taken by the
368368 Department under this subsection may appeal the action as provided
369369 by the Administrative Procedures Act .
370370 D. A long-term care administrator , home care agency
371371 administrator, hospice administrator or hospital admin istrator may
372372 require a certified nurse aide or home health aide whose
373373 certification was or is currently being financed by the long-term
374374 care facility, home care agency, hospice agency or hospital at which
375375 the certified nurse aide or home health aide is currently employed
376376 who commits a no call/no show to reimburse the facility or agency
377377 that financed or is financing the cer tification for any costs
378378 incurred by the facility or agency related to the certification. If
379379 the certified nurse aide or home health aide refuses to reimburse
380380 such costs, the administrator or designee may report such refusal to
381381 the Department and the Department shall record such informatio n in
382382 the file of the certified nurse aide or home health aide in the
383383 database created under this section.
384384 SECTION 2. This act shall become effective November 1, 2021.
