AS INTRODUCED 
 
An Act relating to wind energy; providing a fee for 
commercial wind energy equipment; providing date for 
payment of fee; providing interes t penalty for 
delinquent payments; requiring the Corporation 
Commission to deposit fee and penalty revenue in the 
Education Reform Revol ving Fund; providing for 
codification; and providing an effective date. 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 160.23 of Title 17, unless there 
is created a duplication in nu mbering, reads as follows: 
A.  Beginning January 1, 2022, the re shall be a fee of one cent 
($0.01) per kilowatt of total nameplate gener ating capacity for 
commercial wind energy equipment, as defined pursuant to Section 
160.13 of Title 17 of the Oklaho ma Statutes.  The fee shall be paid 
to the Corporation Commission on January 1, of each year by the 
owner of the commercial wind en ergy equipment. 
B.  All fees not paid on January 1 shall be considered 
delinquent and the Corporation Commission shall a ssess a penalty to 
be paid by owners of commercial wind energy equipme nt of one percent

(1%) of the total amount due on the last day of each month until the 
fee is paid. 
C.  All fee revenues and penalty interest collected by the 
Corporation Commission purs uant to subsections A and B of this 
section shall be deposited in the Education Reform Revolving Fund of 
the State Department of Education. 
SECTION 2.  This act shall become effective November 1, 2021.
