75	75	BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:
76	76	SECTION 1. NEW LAW A new section of law to be codified
77	77	in the Oklahoma Statutes as Section 160.23 of Title 17, unless there
78	78	is created a duplication in nu mbering, reads as follows:
79	79	A. Beginning January 1, 2022, the re shall be a fee of one cent
80	80	($0.01) per kilowatt of total nameplate gener ating capacity for
81	81	commercial wind energy equipment, as defined pursuant to Section
82	82	160.13 of Title 17 of the Oklaho ma Statutes. The fee shall be paid
83	83	to the Corporation Commission on January 1, of each year by the
84	84	owner of the commercial wind en ergy equipment.
85	85	B. All fees not paid on January 1 shall be considered
86	86	delinquent and the Corporation Commission shall a ssess a penalty to
87	87	be paid by owners of commercial wind energy equipme nt of one percent

141	141	C. All fee revenues and penalty interest collected by the
142	142	Corporation Commission purs uant to subsections A and B of this
143	143	section shall be deposited in the Education Reform Revolving Fund of
144	144	the State Department of Education.
145	145	SECTION 2. This act shall become effective November 1, 2021.
