7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 3A O.S. 2011, Section 264, is
7979 amended to read as follows:
8080 Section 264. A. The organization licensee that is located in a
8181 county with a population of greater than six hundred thousand
8282 (600,000) according to the most recent federal decennial census
8383 shall, for each year it conducts au thorized gaming:
8484 1. Conduct annually a race meeting restricted to Thoroughbred
8585 horses that provides no fewer than six h undred (600) races for
8686 Thoroughbred horses; and
8787 2. Conduct annually a race meeting restricted to Quarter Horse,
8888 Paint and Appaloosa hor ses that provides no fewer than five hundred

140140 (500) races for Quarter Horse, Paint and Appaloosa horses within a
141141 period of twelve (12) consecutive weeks.
142142 B. Each organization licensee that is located in a county with
143143 a population of fewer than four hundred thousand (400,000) according
144144 to the most recent federal decennial census shall be required, for
145145 each year it conducts a uthorized gaming, to conduct annually no less
146146 than two hundred seventy (270) races for Thoroughbred horses, no
147147 fewer than two hundred se venty (270) races for Quarter Horses, and
148148 no fewer than sixty (60) races for Paint and Appaloosa horses .
149149 C. An organization licensed pursuant to Section 208.2 of Title
150150 3A of the Oklahoma Statutes this title shall in order to be eligible
151151 to receive money pursuant to the provision of subsection K in
152152 Section 4 263 of this act title, conduct annually no less than four
153153 hundred (400) total races, which shall include conducting n o fewer
154154 than an average of four (4) races per day for Thoroughbred horses or
155155 such lesser number of races approved b y the Oklahoma Horse Racing
156156 Commission pursuant to subsection D of this section .
157157 D. Notwithstanding the provisions of subsection H of Sectio n 4
158158 263 of this act title, the Oklahoma Horse Racing Commission shall
159159 approve, upon joint application of the organization licensee and the
160160 official horsemen’s representative organization that represents th e
161161 horsemen for a given breed of horses participating in a given race
162162 meeting, a reduction or increase in the number of races to be

215215 the number of races shall include specifying the number o f races to
216216 be conducted each race day and the calendar days that the rac es will
217217 be conducted. For purposes of any agreement entered into pursuant
218218 to this section, a race day shall be not less than seven (7) races
219219 nor more than twelve (12) races unless all of the races on a
220220 particular day are time trial races. The organizatio n licensees and
221221 the elected horsemen ’s representative organization shall use their
222222 best efforts to establish race meets with the number of races that
223223 is reasonable in light of the avai lable purse money, the racing
224224 calendar of all organization licensees ope rating pursuant to this
225225 act section, and the number of races run at similar facilities in
226226 surrounding markets.
227227 E. Notwithstanding anything in this section to the contrary,
228228 the requirements set forth in this section shall become effective
229229 with the first race meeti ng that commences at each organization
230230 licensee following the initial six (6) months that the organization
231231 licensee commences authorized gaming as authorized by this act the
232232 State-Tribal Gaming Act.
233233 F. Horse racing may be curtailed without penalt y as a result of
234234 acts of God, war or terrorism which render an organization
235235 licensee’s facility unusable for horse racing for a significant
236236 portion of such organization licensee ’s race meeting. Acts of God,
237237 war or terrorism include natural disasters and other events which
238238 are beyond an organization licensee ’s reasonable control including,

291291 earthquakes, hail, floods, fire, pandemics, war, riots, civil
292292 commotion and bombing or other terrorists attacks.
293293 SECTION 2. This act shall become effective July 1, 2021.
294294 SECTION 3. It being immediately necessary for the preserva tion
295295 of the public peace, health or safety, an emergency is hereby
296296 declared to exist, by reason whereof thi s act shall take effect and
297297 be in full force from and after its passage and approval.
