77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 3A O.S. 2011, Section 264, is
79	79	amended to read as follows:
80	80	Section 264. A. The organization licensee that is located in a
81	81	county with a population of greater than six hundred thousand
82	82	(600,000) according to the most recent federal decennial census
83	83	shall, for each year it conducts au thorized gaming:
84	84	1. Conduct annually a race meeting restricted to Thoroughbred
85	85	horses that provides no fewer than six h undred (600) races for
86	86	Thoroughbred horses; and
87	87	2. Conduct annually a race meeting restricted to Quarter Horse,
88	88	Paint and Appaloosa hor ses that provides no fewer than five hundred

140	140	(500) races for Quarter Horse, Paint and Appaloosa horses within a
141	141	period of twelve (12) consecutive weeks.
142	142	B. Each organization licensee that is located in a county with
143	143	a population of fewer than four hundred thousand (400,000) according
144	144	to the most recent federal decennial census shall be required, for
145	145	each year it conducts a uthorized gaming, to conduct annually no less
146	146	than two hundred seventy (270) races for Thoroughbred horses, no
147	147	fewer than two hundred se venty (270) races for Quarter Horses, and
148	148	no fewer than sixty (60) races for Paint and Appaloosa horses .
149	149	C. An organization licensed pursuant to Section 208.2 of Title
150	150	3A of the Oklahoma Statutes this title shall in order to be eligible
151	151	to receive money pursuant to the provision of subsection K in
152	152	Section 4 263 of this act title, conduct annually no less than four
153	153	hundred (400) total races, which shall include conducting n o fewer
154	154	than an average of four (4) races per day for Thoroughbred horses or
155	155	such lesser number of races approved b y the Oklahoma Horse Racing
156	156	Commission pursuant to subsection D of this section .
157	157	D. Notwithstanding the provisions of subsection H of Sectio n 4
158	158	263 of this act title, the Oklahoma Horse Racing Commission shall
159	159	approve, upon joint application of the organization licensee and the
160	160	official horsemen’s representative organization that represents th e
161	161	horsemen for a given breed of horses participating in a given race
162	162	meeting, a reduction or increase in the number of races to be
163	163	conducted as prescribed in this section. Any agreed -upon change to

215	215	the number of races shall include specifying the number o f races to
216	216	be conducted each race day and the calendar days that the rac es will
217	217	be conducted. For purposes of any agreement entered into pursuant
218	218	to this section, a race day shall be not less than seven (7) races
219	219	nor more than twelve (12) races unless all of the races on a
220	220	particular day are time trial races. The organizatio n licensees and
221	221	the elected horsemen ’s representative organization shall use their
222	222	best efforts to establish race meets with the number of races that
223	223	is reasonable in light of the avai lable purse money, the racing
224	224	calendar of all organization licensees ope rating pursuant to this
225	225	act section, and the number of races run at similar facilities in
226	226	surrounding markets.
227	227	E. Notwithstanding anything in this section to the contrary,
228	228	the requirements set forth in this section shall become effective
229	229	with the first race meeti ng that commences at each organization
230	230	licensee following the initial six (6) months that the organization
231	231	licensee commences authorized gaming as authorized by this act the
232	232	State-Tribal Gaming Act.
233	233	F. Horse racing may be curtailed without penalt y as a result of
234	234	acts of God, war or terrorism which render an organization
235	235	licensee’s facility unusable for horse racing for a significant
236	236	portion of such organization licensee ’s race meeting. Acts of God,
237	237	war or terrorism include natural disasters and other events which
238	238	are beyond an organization licensee ’s reasonable control including,

293	293	SECTION 2. This act shall become effective July 1, 2021.
294	294	SECTION 3. It being immediately necessary for the preserva tion
295	295	of the public peace, health or safety, an emergency is hereby
296	296	declared to exist, by reason whereof thi s act shall take effect and
297	297	be in full force from and after its passage and approval.
