8787 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8888 SECTION 1. AMENDATORY Section 1, Chapter 82, O.S.L. 2020
8989 (2 O.S. Supp. 2020, Section 6-182.1), is amended to read as follows:
9090 Section 6-182.1. A. Upon approval by the United States
9191 Department of Agriculture, the Oklahoma Department of Agriculture,
9292 Food, and Forestry may establish standards for Oklah oma producers
9393 that market and sell beef and bison in intrast ate commerce.

145145 B. The Department is authorized to promulgate rules regarding
146146 slaughter facilities that to implement the provisions of this
147147 section and provide for the following:
148148 1. Establish standards Standards that allow for flexibility in
149149 beef and bison inspection, including, but not limited to,
150150 establishing the minimum number of inspectors at a facility and the
151151 use;
152152 2. Standards for the use of technologies to digitally remotely
153153 inspect meat;
154154 2. 3. Establish standards Standards for the labeling of beef
155155 and bison products sold in intrastate commerce;
156156 3. 4. Establish standards Standards for the number of head of
157157 cattle and bison over which processed in a facility that shall
158158 require the facility to pay for a state on-site inspector; and
159159 4. 5. Establish any Any other standards necessary to increase
160160 the ability of producers to market and sell beef and bison in
161161 intrastate commerce.
162162 C. Any rules promulgated pur suant to this section shall ensure
163163 that food safety will not be compromised in any way and will ensure
164164 that consumers are protected.
165165 D. For purposes of this section:
166166 1. “Intrastate commerce” means business that is transacted only
167167 within the jurisdictional boundarie s of this state;

219219 2. “Intrastate processor ” means a slaughter facility that
220220 produces meat food products or meat by -products from cattle or bison
221221 for wholesale or retail sales in intrastate commerce i n this state
222222 and whose calendar year production is ten thousand head of cattle or
223223 bison or less. Such term includes a mobile slaughter facilit y that
224224 processes cattle or bison for intrastate commerce in this state; and
225225 3. “Technologies” means the use of one or more systems,
226226 cameras, computers, recording devices, projectors, videos, satellite
227227 devices or other electronic, fiber-optic or digital means to
228228 actually view, check and inspect meat and meat processes from a
229229 remote location in real time.
230230 E. All intrastate processors shall have a Department inspector,
231231 a contract Department-certified inspector or shall operate with
232232 remote technologies that allow inspection during the slaughter,
233233 processing and butchering of cattle or bison. The cost of
234234 technologies and inspections shall be paid by the meat processor.
235235 Processing facilities that process more th an ten thousand head of
236236 cattle or bison in a calendar y ear shall be required to have and pay
237237 for on-site inspectors certified by the Department.
238238 F. Cooperative agreemen ts may be facilitated by counties,
239239 municipalities, extension services, intrastate processors and/or
240240 livestock producers to pay the costs of retaining contract
241241 Department-certified inspectors.

293293 G. 1. Persons who provide inspections for intrastate
294294 processors remotely or on-site for the Department and person s
295295 certified by the Department to provide contract inspections for
296296 intrastate processors sha ll:
297297 a. possess the necessary qualifications required of the
298298 United States Department of Agriculture Food Safety
299299 and Inspection Service for meat inspectors,
300300 b. have ten (10) or more years of experience in meat
301301 processing and possess certification by a relevant
302302 food safety course provided by the Oklahoma Department
303303 of Career and Technology Education or an accredited
304304 university, or
305305 c. possess a bachelor’s degree in animal science or other
306306 related field approved by the Department and possess
307307 the American Meat Science Associat ion Meat Evaluation
308308 Certification or complete the twenty-day Basic
309309 Livestock Slaughter Inspection Training Course of the
310310 United States Department of A griculture Food Safety
311311 and Inspection or other relevant training
312312 certification approved by the Department .
313313 2. Persons who meet the qualifications provided in paragraph 1
314314 of this subsection shall be certified by the Department to contract
315315 with intrastate processors and conduct on-site inspections or remote
316316 inspections.

368368 H. 1. Intrastate processers who utiliz e remote inspectors
369369 shall provide uninterrupted technolog ies at the facility that allow
370370 for live-feed actual viewing of the cattle and bison from their
371371 entry at the facility to the end of processing , except while the
372372 carcass is placed in cold storage . Technologies utilized must
373373 provide an accurate time stamp with live-feed remote viewing and
374374 filming for the entirety of the process.
375375 2. Before slaughter, live-feed remote viewing of the cattle and
376376 bison shall be high resolution and with enough lighting to show any
377377 discoloration, spots on the hide or any other known markers
378378 routinely used by on-site certified inspectors to identify illness
379379 or injury and to show the ability of the animal to walk under its
380380 own power without assistance .
381381 3. Live-feed remote viewing angles and resolution of the
382382 technologies must provide close actual viewing of the hooves, mouth,
383383 nose, eyes, udders, hair and hide, and the whole o f the body in a
384384 manner sufficient to allow the remote inspe ctor to determine a
385385 potential illness or injury. The technologies may allow the remote
386386 inspector the ability to adjust the viewing angle or enhan ce the
387387 resolution and/or view of the animal.
388388 4. Slaughter of the animal must be live-feed viewing in a
389389 manner sufficient to allow the remote inspector to determine whether
390390 the process was conducted in compliance with humane slaughter
391391 regulations.

443443 5. Processing of the carcass during suspension, exsanguina tion,
444444 hide removal, splitting and evisceration must allow remote viewing
445445 of the entire process and viewing angles that may show multiple
446446 carcasses or processing operations ; provided, the overall remote
447447 viewing is sufficient to allow the remote inspector to determine
448448 compliance with regulations .
449449 6. Butchering process of the carcass must allow remote viewing
450450 of the entire butchering process and viewing from angles that may
451451 show multiple carcasses or butcheri ng and processing operations;
452452 provided, overall remote viewing is sufficient to allow the remote
453453 inspector to determine compliance with reg ulations.
454454 7. Intrastate processors shall utilize technologies that provide
455455 the remote inspectors with temperature readings of the carcass,
456456 processing rooms and cold storage as required by regulations.
457457 Temperature readings shall be accompanied wit h an accurate time of
458458 measurement that is synchronized with the required live-feed
459459 viewing.
460460 I. 1. All packaging of meat food products or meat by-products
461461 produced by intrastate processors shall have an attached label
462462 prominently displayed that states: “Inspected by ODAFF only for sale
463463 in Oklahoma.” Labels shall include batch number s that are provided
464464 to the Department.

516516 2. Intrastate processors may place a brand label on the pa ckage
517517 that is agreed upon by the i ntrastate processor and the l ivestock
518518 producer that provide d the cattle or bison.
519519 J. In addition to intrastate processing of beef and bison as
520520 provided in this section, the Department is authorized to promulgate
521521 rules to allow the intrastate processing of pork and chicken in a
522522 manner substantially similar to the provisions of this section
523523 including use of technologies, remote inspections, contract
524524 Department certified inspectors and on-site Department inspectors,
525525 and the number of on-site inspectors required for processing certain
526526 numbers of animals and fowl at a facility.
527527 SECTION 2. This act shall become effective July 1, 2021.
528528 SECTION 3. It being immediately necessary for the preservation
529529 of the public peace, healt h or safety, an emergency is hereby
530530 declared to exist, by reason whereof thi s act shall take effect and
531531 be in full force from and after its passage and approval.
