87	87	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
88	88	SECTION 1. AMENDATORY 2 O.S. 2011, Section 6-185, is
89	89	amended to read as follows:
90	90	Section 6-185. A. The Oklahoma Meat Inspection Act shall apply
91	91	to:
92	92	1. All carcasses or parts of carcasses of cattle, bison, sheep,
93	93	swine, goats, horses, mules , and other equines or the meat or meat

146	146	act, capable of use as human food, which may be brought into any
147	147	slaughtering, meat-canning, salting, packing, rendering , or similar
148	148	establishment, where inspection under the Oklahoma Meat Inspe ction
149	149	Act is maintained. Examination and inspection shall be made before
150	150	the carcasses or parts thereof shall be allowed to enter into any
151	151	department wherein the same are to be treated and pre pared for meat
152	152	food products; and
153	153	2. All such products which, after having been issued from any
154	154	such slaughtering, meat -canning, salting, packing, rendering, or
155	155	similar establishment, shall be returned t o the same or to any
156	156	similar establishment where suc h inspection is maintained.
157	157	B. The Board may limit the entry o f carcasses, parts of
158	158	carcasses, meat and meat food products, and other ma terials, unless
159	159	otherwise exempt by law, into any establishment at which inspection
160	160	under the Oklahoma Meat inspection Act is maintained, under the
161	161	conditions as it may prescribe to assure that allowing the entry of
162	162	such articles into such inspected establishments will be consistent
163	163	with the purposes of the Oklahoma Meat Inspection Act.
164	164	SECTION 2. NEW LAW A new section of l aw to be codified
165	165	in the Oklahoma Statutes as Section 215.1 of Title 2, unless there
166	166	is created a duplication in numb ering, reads as follows:
167	167	This act shall be known and may be cited as the “Calf Fry Direct
168	168	Sales Act”.

220	220	SECTION 3. NEW LAW A new section of law to be codif ied
221	221	in the Oklahoma Statutes as Section 215.2 of Title 2, unless there
222	222	is created a duplication in numb ering, reads as follows:
223	223	A. As used in this section:
224	224	1. “Ambient temperature” means the atmospheric temperature
225	225	surrounding or encircling the product and container;
226	226	2. “Beef producers” means any person that has an ownership
227	227	interest in cattle;
228	228	3. “Calf fry” or “calf fries” means raw calf testicles that are
229	229	produced by castration of young male cattle for human consumption as
230	230	a part of a domestic cattle raising operation or cattle
231	231	slaughterhouse facility;
232	232	4. “Consumer” means any person using the product for human food
233	233	and human consumption including, but not limited to, commercial
234	234	restaurants and caterers;
235	235	5. “Container” means any receptacle or packagin g in which the
236	236	product is dispensed to consumers;
237	237	6. “Expiration date” means the date the products are to be
238	238	removed from sale to consumers; and
239	239	7. “Pack-date” means the date that the product was placed in
240	240	the container to sell.
241	241	B. 1. Oklahoma beef producers may sell ungraded, uninspected
242	242	and unmarked raw calf fries from their own herd production when
243	243	selling such product direct to a consumer as provided in this

295	295	section. Raw calf fries shall be exempt from the Oklahoma Meat
296	296	Inspection Act.
297	297	2. Slaughterhouses may sell raw calf fries direct to consumers
298	298	as provided in this sec tion.
299	299	3. Nothing in this section shall prohibit the retail sale of
300	300	raw calf fries produced by a beef producer or obtained direct from a
301	301	slaughterhouse by a consumer for human consumption in this state.
302	302	4. Raw calf fries sold under this section shall be produced
303	303	from calves raised and maintained by the beef producer or processed
304	304	at the slaughterhouse from which the product is sold direct to the
305	305	consumer in this state.
306	306	5. Interstate commerce of raw calf fries is prohibited under
307	307	this section.
308	308	C. A producer of raw calf fries shall follow these minimal
309	309	standards when selling the product direct to a consumer:
310	310	1. Raw calf fries sold for human food or human consumption
311	311	shall be frozen immediately upon production or refrigerated at an
312	312	ambient temperature of forty-five degrees (45°) Fahrenheit or lower
313	313	within five (5) hours of production;
314	314	2. Raw calf fries stored by the beef producer or slaughterhouse
315	315	that are intended for direct sale to the consumer as human food
316	316	shall be held at a constant temperature in accordance with paragraph
317	317	1 of this subsection;

369	369	3. Raw calf fries to be stored for sale as human food shall be
370	370	labeled with the following statement: “Keep frozen or refrigerated
371	371	at or below 45 degrees Fahrenheit ”;
372	372	4. Raw calf fries shall not be sold for human consumption after
373	373	five (5) hours from production without proper freezing or
374	374	refrigeration as provided in paragraph 1 of this subsection;
375	375	5. Producers of raw calf fries shall not be responsible for the
376	376	quality of the product if all handling procedures in this subsection
377	377	are followed prior to the sale of the product to a consumer;
378	378	6. At retail locations selling raw calf fries, a sign furnished
379	379	by the Oklahoma Department of Agric ulture, Food, and Forestry
380	380	stating the proper pr ocedure for storage and handling of calf fries
381	381	shall be permanently displayed at a location easil y seen by
382	382	consumers and persons handling the product;
383	383	7. The producer of raw calf fries to be sold for human
384	384	consumption must use a clean container to package and label the
385	385	product;
386	386	8. The producer and packager of raw calf fries shall affix a
387	387	pack-date and expiration date to each container of p roduct offered
388	388	for sale, except when a consumer is presen t in person at the
389	389	production location with a personal container to collect, purchase
390	390	and transport the product;

442	442	9. The producer of raw calf fries to be sold for human
443	443	consumption may sell the product by the half-dozen, dozen or in
444	444	cases of thirty (30) dozen or more as desired; and
445	445	10. For purposes of this section, the retail sale of raw calf
446	446	fries is limited to retail sales within the jurisdiction of this
447	447	state by Oklahoma beef producers and s laughterhouses.
448	448	D. 1. A pack-date may be in a three -digit Julian date or a
449	449	calendar date.
450	450	2. An expiration date shall be used on the container, the date
451	451	shall be preceded by “EXP”, “sell by” or “use through”.
452	452	3. Frozen raw calf fries shall expire ninety (90) days aft er
453	453	initial freezing and unfrozen fresh calf fries shall expire three
454	454	(3) days after processing when consistently held at an ambient
455	455	temperature of forty-five degrees (45°) Fahrenhei t or lower.
456	456	E. 1. Any person that sells at retail, advertises or displays
457	457	for sale or offers for sale raw, calf fries direct to consumers for
458	458	human consumption without having complied with the provisions o f
459	459	this section shall, upon conviction, be guilty of a misdemeanor.
460	460	2. Nothing in this section shall prohibit a commercial
461	461	restaurant or licensed caterer from serving or selling for human
462	462	consumption cooked calf fries to consumers whether or not such
463	463	product was purchased directly from a beef producer or
464	464	slaughterhouse under this section.
