79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 74 O.S. 2011, Section 2242, is
81	81	amended to read as follows:
82	82	Section 2242. The following offices and positions in the
83	83	Beginning July 1, 2021, employees of the Oklahoma Tourism and
84	84	Recreation Department shall be in the unclassified service and shall
85	85	not be subject to the Merit System of Personnel Administration :
86	86	1. The Executive Director, the Deputy Director, directors of
87	87	the divisions of the Department and administrative assistant of
88	88	each, and not more than four positions involved in the executive
89	89	management of the Department;

141	141	2. All positions in the Traveler Response Info rmation Program;
142	142	3. All professional or managerial posit ions whose principal
143	143	function is one of the following:
144	144	a. marketing and promotion of travel and tourism to and
145	145	within the state,
146	146	b. promoting the state as a viable location for producing
147	147	motion pictures and television programs and for
148	148	recording music,
149	149	c. developing, producing, and on -air broadcasting of
150	150	“Discover Oklahoma”, the weekly promotional television
151	151	program,
152	152	d. not more than fifteen positions performing financial
153	153	management functions for the D epartment,
154	154	e. not more than five positions performing hum an
155	155	resources functions for the Department, and
156	156	f. not more than two positions performing information
157	157	services functions for the Department;
158	158	4. Any position associated with the development and produc tion
159	159	of “Oklahoma Today” magazine; and
160	160	5. Any position in the Division of State Parks utilized in the
161	161	operation and administration of state resorts, cabins, lodges, and
162	162	golf courses. An employee of the Oklahoma Tourism and Recreation
163	163	Department who is in the Merit System of Personnel Administration on
164	164	July 1, 2021, may elect to retain their merit classifica tion until

216	216	such position is vacated , abolished or the employee elects
217	217	unclassified status. Any position changed from a merit position to
218	218	unclassified service within the Oklahoma Tourism and Recreation
219	219	Department on or after July 1, 2021, shall require a thirty-day
220	220	written notice be given to the current employee filling such
221	221	position.
222	222	SECTION 2. This act shall become effective July 1, 2021.
223	223	SECTION 3. It being immediately necessa ry for the preservation
224	224	of the public peace, health or safety, an emergency is hereby
225	225	declared to exist, by reason whereof thi s act shall take effect and
226	226	be in full force from and after its passage and app roval.
