39	40		amending 74 O.S. 2011, Section 840 -5.5, as last

50	51		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	52		SECTION 1. AMENDATORY 74 O.S. 2011, Section 840-5.5, as
52	53		last amended by Section 1, Chapter 365, O.S.L. 2019 (74 O.S. Supp.
53	54		2020, Section 840-5.5), is amended to read as follows:
54	55		Section 840-5.5. A. The following offices, positions, and
55	56		personnel shall be in the unclassified ser vice and shall not be
56	57		placed under the classified servi ce:
57	58		1. Persons chosen by popular vote or app ointment to fill an
58	59		elective office, and their employees, except the emp loyees of the
59	60		Corporation Commission, the State Department of Education and the
60	61		Department of Labor;

88	90		also one principal as sistant or deputy and one executive secretary
89	91		for each state agency;
90	92		3. All judges, elected or appointed, and their employees;
91	93		4. Persons employed with on e-time, limited duration, federal or
92	94		other grant funding that is not continuing or indefinitely
93	95		renewable. The length of the unclassified employment shall not
94	96		exceed the period of time for which that specific federal funding is
95	97		provided;
96	98		5. All officers and employees of The Oklahoma State System of
97	99		Higher Education, State Board of Education and Oklahom a Department
98	100		of Career and Technology Education;
99	101		6. Persons employed in a professional or scientific capacity to
100	102		make or conduct a temporary and special in quiry, investigation, or
101	103		examination on behalf of the L egislature or a committee thereof or
102	104		by authority of the Governor. These appointments and authorizations
103	105		shall terminate on the first day of the regular legislative session
104	106		immediately following the a ppointment, if not terminated earlier.
105	107		However, nothing in this paragraph shall prevent the reautho rization
106	108		and reappointment of any such person. Any such appointment sha ll be
107	109		funded from the budget of the appointing authority;

109	111		8. Temporary employees employed to work le ss than one thousand
110	112		(1,000) hours in any twe lve-month period, and seasonal employees

190	194		v. a maximum of seven positions for the purpose of
191	195		administering programs in the Oklahoma Hig hway Safety
192	196		Office, within full-time employee limitatio ns of the
193	197		Department, employed with federal f unding that is
194	198		continuing or indefinitely renewable. The
195	199		authorization for such positions shall be terminated
196	200		if the federal funding for positions is disco ntinued;
197	201		provided, any person appointed to a position p rescribed in
198	202		subparagraph d, e or f of this p aragraph shall have a right of
199	203		return to the classified commissioned pos ition without any loss of
200	204		rights, privileges or benefits immediately upon completion of the
201	205		duties in the unclassified commissioned positio n;
202	206		10. Professional trainees only during the prescribed length of
203	207		their course of training or extension study;
204	208		11. Students who are employed on a part -time basis, which shall
205	209		be seventy-five percent (75%) of a normal forty-hour work week or
206	210		thirty (30) hours per week, or less, or on a full -time basis if the
207	211		employment is pursuant to a cooperative education program such as
208	212		that provided for under Title I IV -D of the Higher Education Act of
209	213		1965 (20 U.S.C. 1087a-1087c), as amended, and who are regularly
210	214		enrolled in:

238	243		State System of Higher Education,
239	244		b. an institution of higher learning qualified to become
240	245		coordinated with The Oklahoma State System of Higher
241	246		Education. For purposes of this section, a s tudent
242	247		shall be considered a regularly enroll ed student if
243	248		the student is enrolled in a minimum of five (5) hours
244	249		of accredited graduate courses or a minimum of ten
245	250		(10) hours of accredited undergradua te courses;
246	251		provided, however, the student shall only b e required
247	252		to be enrolled in a minimum of six (6) hours of
248	253		accredited undergraduate courses during the summer, or
249	254		c. high school students regularly enrolled in a high
250	255		school in Oklahoma and regularly a ttending classes
251	256		during such time of enrollment;
252	257		12. The spouses of personnel who are employed on a part-time
253	258		basis to assist or work as a relief for their spouses in the
254	259		Oklahoma Tourism and Recreation Department;
255	260		13. Service substitute attendants who a re needed to replace
256	261		museum and site attendants who are unavoidably absent. Service
257	262		substitutes may work as part-time or full-time relief for absentees
258	263		for a period of not more than four (4) weeks per year in the
259	264		Oklahoma Historical Society sites and muse ums; such substitutes will

1293	1319		unclassified appointment and compensation with the same agency under
1294	1320		the provisions of this subsection; provided, the leave shall expire
1295	1321		no later than December 31, 2007. Employees accepting the
1296	1322		appointment and comp ensation shall be entitled to participate
1297	1323		without interruption in any benefit programs available to classified
1298	1324		employees, including retirement and insurance programs. Immediately
1299	1325		upon termination of an unclassified appointment pursuant to this
1300	1326		subsection, an employee on assignment from the classified s ervice
1301	1327		shall have a right to be restored to the classified service and
1302	1328		reinstated to the former job family level and compensation plus any
1303	1329		adjustments and increases in salary or benefits which the employee
1304	1330		would have received but for the leave of absence.
