79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. NEW LAW A new s ection of law to be codified
81	81	in the Oklahoma Statutes as Sec tion 1-502.5 of Title 63, unless
82	82	there is created a duplication in numbering, reads as follows:
83	83	A. The State Department of Health or an agent of the Department
84	84	shall not enter immunization records or other data of an individual
85	85	into any database or system including, but not limite d to, the
86	86	Oklahoma State Immunization Information System without the prior
87	87	written informed consent of the individual or, in the case of a
88	88	minor child, the prior written informed consent of the minor child’s
89	89	parent or guardian.

141	141	B. The State Department of Health or an agent of the Department
142	142	shall not share any immunization records or other data of an
143	143	individual entered into any database or system including, but not
144	144	limited to, the Oklahoma State Immunization Information System
145	145	including but not limited to immunization records or immunization
146	146	status, with a health care provider or health insurer without the
147	147	prior written informed consent of the individual or, in the case of
148	148	a minor child, the pri or written informed consent of the mi nor
149	149	child’s parent or guardian .
150	150	C. If a parent or guardian has granted informed consent to the
151	151	entering of immunization records or other data of such parent or
152	152	guardian’s minor child into any database or system includi ng, but
153	153	not limited to, the Oklahoma State Immunization Information System ,
154	154	the parent or guardian may, at any time, request the deletion of all
155	155	immunization records or other data of the minor child from the
156	156	system. Upon receipt of such a request, the Dep artment shall
157	157	promptly delete all immunization records and other data of the minor
158	158	child from the system and shall delete or destroy any other files or
159	159	records of the minor child stored by the Department.
160	160	SECTION 2. It being immediately ne cessary for the preservation
161	161	of the public peace, health or safety, an emergency is here by
162	162	declared to exist, by reason whereof this act s hall take effect and
163	163	be in full force from and after its passage and approval.
