6767 An Act relating to prevention and control o f disease;

7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new s ection of law to be codified
8181 in the Oklahoma Statutes as Sec tion 1-502.5 of Title 63, unless
8282 there is created a duplication in numbering, reads as follows:
8383 A. The State Department of Health or an agent of the Department
8484 shall not enter immunization records or other data of an individual
8585 into any database or system including, but not limite d to, the
8686 Oklahoma State Immunization Information System without the prior
8787 written informed consent of the individual or, in the case of a
8888 minor child, the prior written informed consent of the minor child’s
8989 parent or guardian.

141141 B. The State Department of Health or an agent of the Department
142142 shall not share any immunization records or other data of an
143143 individual entered into any database or system including, but not
144144 limited to, the Oklahoma State Immunization Information System
145145 including but not limited to immunization records or immunization
146146 status, with a health care provider or health insurer without the
147147 prior written informed consent of the individual or, in the case of
148148 a minor child, the pri or written informed consent of the mi nor
149149 child’s parent or guardian .
150150 C. If a parent or guardian has granted informed consent to the
151151 entering of immunization records or other data of such parent or
152152 guardian’s minor child into any database or system includi ng, but
153153 not limited to, the Oklahoma State Immunization Information System ,
154154 the parent or guardian may, at any time, request the deletion of all
155155 immunization records or other data of the minor child from the
156156 system. Upon receipt of such a request, the Dep artment shall
157157 promptly delete all immunization records and other data of the minor
158158 child from the system and shall delete or destroy any other files or
159159 records of the minor child stored by the Department.
160160 SECTION 2. It being immediately ne cessary for the preservation
161161 of the public peace, health or safety, an emergency is here by
162162 declared to exist, by reason whereof this act s hall take effect and
163163 be in full force from and after its passage and approval.
