8989 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9090 SECTION 1. NEW LAW A new section of law to be codified
9191 in the Oklahoma Statutes as Section 5-5.1 of Title 2, unless there
9292 is created a duplication in numb ering, reads as follows:
9393 This act shall be known and may be cited as the “Oklahoma Food
9494 Freedom Act”.

146146 SECTION 2. NEW LAW A new sectio n of law to be codified
147147 in the Oklahoma Statutes as Sect ion 5-5.2 of Title 2, unless there

149149 As used in the Oklahoma Food Freedom Act:
150150 1. “Delivery” shall mean the transfer of a product resulting
151151 from a transaction between a producer and an informed end consumer.
152152 The delivery may occur by the producer ’s designated agent at a farm,
153153 ranch, farmers market, home, office or any l ocation agreed to
154154 between the producer and the informed end consumer;
155155 2. “Home Consumption” shall mean food products consumed within
156156 a private home, or food from a private home that is only consumed by
157157 family members, employees or nonpaying guests;
158158 3. “Homemade” shall mean food that is prepared or processed in
159159 a private home kitchen, that is not licensed, inspected or
160160 regulated;
161161 4. “Informed end consumer” shall mean a person who is the last
162162 person to purchase any product, who does not resell the product and
163163 who has been informed that the pro duct is not licensed, regulated or
164164 inspected;
165165 5. “Process” shall mean operations a producer pe rforms in the
166166 making or treatment of the producer ’s food or drink products;
167167 6. “Producer” shall mean any person who grows, harvests,
168168 prepares or processes any f ood or drink products on the person ’s

221221 7. “Transaction” shall mean the exchange of buying and selling.
222222 SECTION 3. NEW LAW A new section of law to be codified
223223 in the Oklahoma Statutes as Section 5-5.3 of Title 2, unless there
224224 is created a duplication in numbering, reads as follows:
225225 A. Homemade food products produced, sold and consumed in
226226 compliance with the Oklahoma Food Freedom Act shall be exempt from
227227 state licensure, permitting, inspection, packaging a nd labeling
228228 requirements, except as otherwise provided in this act .
229229 B. Transactions under this act shall:
230230 1. Be directly between the producer and the informed end
231231 consumer;
232232 2. Only be for home consumption;
233233 3. Occur only in Oklahoma ;
234234 4. Not involve interstate commerce;
235235 5. Not involve the s ale of meat products, except:
236236 a. the sale of poultry products, provided:
237237 (1) the producer slaughters no more than one thousand
238238 (1,000) poultry of their own raising during any
239239 one (1) calendar year,
240240 (2) the producer does not engage in buying or selling
241241 poultry products other than those produced fro m
242242 poultry of their own raising, and
243243 (3) the poultry product is not adulterated or
244244 misbranded,

296296 b. the sale of live animals,
297297 c. the sale of portions of live animals before slaughter
298298 for future delivery,
299299 d. the sale of domestic rabbit meat, and
300300 e. the sale of farm-raised fish, provided the fish is
301301 raised in compliance with Section 6 -311 et seq. of
302302 Title 2 of the Oklahoma S tatutes; and
303303 6. Only occur at farm ers markets, farms, ranches, producer’s
304304 homes or offices or any location the producer and the informed en d
305305 consumer agree to.
306306 C. Except for raw, unprocessed fruits and vegetables, food
307307 shall not be sold or used in any commercial food establishment
308308 unless the food has been labeled, licensed, packaged, regulated or
309309 inspected as required by law.
310310 D. The provisions of the Oklahoma Food Freedom Act shall not
311311 prohibit the sale of homemade food for home cons umption from a
312312 retail space located at the ranch, farm or home where the food is
313313 produced. A retail space selling home made food under the provisions
314314 of the Oklahoma Food Freedom Act shall inform the end consumer that
315315 the homemade food has not been inspected and shall display a sign
316316 indicating that the homemade food has not been inspected. If the
317317 retail space is in any wa y associated with a commercial food
318318 establishment or offers for sale any inspected product, the retail
319319 space selling homemade food shall comply with rules adopted by the

371371 Oklahoma Department of Agriculture, Food, and Forestry which shall
372372 require:
373373 1. That the retail space be physically separated fr om the
374374 commercial food establishment with a separate door and separate cash
375375 register or point of sale;
376376 2. That each separate space shall include signs or other
377377 markings clearly indicating which spaces are offering inspected
378378 items for sale and which spaces are uninspected;
379379 3. Coolers, freezers and warehouse or other storage areas shall
380380 be separated to prohibit the intermingling of inspected and
381381 uninspected products; and
382382 4. Any other requirements specified by the Department to ensure
383383 the sale of homemade f oods is made to an informed end consumer.
384384 E. The producer shall inform the end consumer that any food
385385 product or food sold at a farmers market or through ranch, farm or
386386 home based sales pursuant to th e provisions of the Oklahoma Food
387387 Freedom Act is not certified, labeled, licensed, packaged, regulated
388388 or inspected.
389389 F. The provisions of the Oklahoma Food Freedo m Act shall not be
390390 construed to:
391391 1. Impede the State Department of Health in any investigation
392392 of foodborne illness;
393393 2. Change the requirements f or brand inspection or animal

446446 3. Preclude an agency from providing assistance, consultation
447447 or inspection, at the request of the producer.
448448 SECTION 4. NEW LAW A new se ction of law to be codified
449449 in the Oklahoma Statutes as Section 5-5.4 of Title 2, unless there
450450 is created a duplication in numb ering, reads as follows:
451451 A. The provisions of the Oklahoma Food Freedom Act shall not be
452452 construed to prevent the sale of prepared foods in compliance with
453453 the Home Bakery Act of 2013.
454454 B. The Oklahoma Department of Agriculture, Food, and Forestry
455455 may promulgate rules to enforce the provisions of the Oklahoma Food
456456 Freedom Act.
457457 SECTION 5. It being immediately necessary f or the preservation
458458 of the public peace, health or safety, an emergency is hereby
459459 declared to exist, by reason whereof this act shall take effect and
460460 be in full force from and after its passage and approval.
