89	89	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
90	90	SECTION 1. NEW LAW A new section of law to be codified
91	91	in the Oklahoma Statutes as Section 5-5.1 of Title 2, unless there
92	92	is created a duplication in numb ering, reads as follows:
93	93	This act shall be known and may be cited as the “Oklahoma Food
94	94	Freedom Act”.

146	146	SECTION 2. NEW LAW A new sectio n of law to be codified
147	147	in the Oklahoma Statutes as Sect ion 5-5.2 of Title 2, unless there
148	148	is created a duplication in numb ering, reads as follows:
149	149	As used in the Oklahoma Food Freedom Act:
150	150	1. “Delivery” shall mean the transfer of a product resulting
151	151	from a transaction between a producer and an informed end consumer.
152	152	The delivery may occur by the producer ’s designated agent at a farm,
153	153	ranch, farmers market, home, office or any l ocation agreed to
154	154	between the producer and the informed end consumer;
155	155	2. “Home Consumption” shall mean food products consumed within
156	156	a private home, or food from a private home that is only consumed by
157	157	family members, employees or nonpaying guests;
158	158	3. “Homemade” shall mean food that is prepared or processed in
159	159	a private home kitchen, that is not licensed, inspected or
160	160	regulated;
161	161	4. “Informed end consumer” shall mean a person who is the last
162	162	person to purchase any product, who does not resell the product and
163	163	who has been informed that the pro duct is not licensed, regulated or
164	164	inspected;
165	165	5. “Process” shall mean operations a producer pe rforms in the
166	166	making or treatment of the producer ’s food or drink products;
167	167	6. “Producer” shall mean any person who grows, harvests,
168	168	prepares or processes any f ood or drink products on the person ’s
169	169	owned or leased property; and

221	221	7. “Transaction” shall mean the exchange of buying and selling.
222	222	SECTION 3. NEW LAW A new section of law to be codified
223	223	in the Oklahoma Statutes as Section 5-5.3 of Title 2, unless there
224	224	is created a duplication in numbering, reads as follows:
225	225	A. Homemade food products produced, sold and consumed in
226	226	compliance with the Oklahoma Food Freedom Act shall be exempt from
227	227	state licensure, permitting, inspection, packaging a nd labeling
228	228	requirements, except as otherwise provided in this act .
229	229	B. Transactions under this act shall:
230	230	1. Be directly between the producer and the informed end
231	231	consumer;
232	232	2. Only be for home consumption;
233	233	3. Occur only in Oklahoma ;
234	234	4. Not involve interstate commerce;
235	235	5. Not involve the s ale of meat products, except:
236	236	a. the sale of poultry products, provided:
237	237	(1) the producer slaughters no more than one thousand
238	238	(1,000) poultry of their own raising during any
239	239	one (1) calendar year,
240	240	(2) the producer does not engage in buying or selling
241	241	poultry products other than those produced fro m
242	242	poultry of their own raising, and
243	243	(3) the poultry product is not adulterated or
244	244	misbranded,

297	297	c. the sale of portions of live animals before slaughter
298	298	for future delivery,
299	299	d. the sale of domestic rabbit meat, and
300	300	e. the sale of farm-raised fish, provided the fish is
301	301	raised in compliance with Section 6 -311 et seq. of
302	302	Title 2 of the Oklahoma S tatutes; and
303	303	6. Only occur at farm ers markets, farms, ranches, producer’s
304	304	homes or offices or any location the producer and the informed en d
305	305	consumer agree to.
306	306	C. Except for raw, unprocessed fruits and vegetables, food
307	307	shall not be sold or used in any commercial food establishment
308	308	unless the food has been labeled, licensed, packaged, regulated or
309	309	inspected as required by law.
310	310	D. The provisions of the Oklahoma Food Freedom Act shall not
311	311	prohibit the sale of homemade food for home cons umption from a
312	312	retail space located at the ranch, farm or home where the food is
313	313	produced. A retail space selling home made food under the provisions
314	314	of the Oklahoma Food Freedom Act shall inform the end consumer that
315	315	the homemade food has not been inspected and shall display a sign
316	316	indicating that the homemade food has not been inspected. If the
317	317	retail space is in any wa y associated with a commercial food
318	318	establishment or offers for sale any inspected product, the retail
319	319	space selling homemade food shall comply with rules adopted by the

372	372	require:
373	373	1. That the retail space be physically separated fr om the
374	374	commercial food establishment with a separate door and separate cash
375	375	register or point of sale;
376	376	2. That each separate space shall include signs or other
377	377	markings clearly indicating which spaces are offering inspected
378	378	items for sale and which spaces are uninspected;
379	379	3. Coolers, freezers and warehouse or other storage areas shall
380	380	be separated to prohibit the intermingling of inspected and
381	381	uninspected products; and
382	382	4. Any other requirements specified by the Department to ensure
383	383	the sale of homemade f oods is made to an informed end consumer.
384	384	E. The producer shall inform the end consumer that any food
385	385	product or food sold at a farmers market or through ranch, farm or
386	386	home based sales pursuant to th e provisions of the Oklahoma Food
387	387	Freedom Act is not certified, labeled, licensed, packaged, regulated
388	388	or inspected.
389	389	F. The provisions of the Oklahoma Food Freedo m Act shall not be
390	390	construed to:
391	391	1. Impede the State Department of Health in any investigation
392	392	of foodborne illness;
393	393	2. Change the requirements f or brand inspection or animal
394	394	health inspections; and

447	447	or inspection, at the request of the producer.
448	448	SECTION 4. NEW LAW A new se ction of law to be codified
449	449	in the Oklahoma Statutes as Section 5-5.4 of Title 2, unless there
450	450	is created a duplication in numb ering, reads as follows:
451	451	A. The provisions of the Oklahoma Food Freedom Act shall not be
452	452	construed to prevent the sale of prepared foods in compliance with
453	453	the Home Bakery Act of 2013.
454	454	B. The Oklahoma Department of Agriculture, Food, and Forestry
455	455	may promulgate rules to enforce the provisions of the Oklahoma Food
456	456	Freedom Act.
457	457	SECTION 5. It being immediately necessary f or the preservation
458	458	of the public peace, health or safety, an emergency is hereby
459	459	declared to exist, by reason whereof this act shall take effect and
460	460	be in full force from and after its passage and approval.
