232 | 232 | | signals, writings, images, sounds, data or intelligence of any |

233 | 233 | | nature in whole or in part by a wire, radio, electromagneti c, |
---|
234 | 234 | | photoelectric, or photo-optical system; |
---|
235 | 235 | | 4. "Electronic communication information " means any information |
---|
236 | 236 | | about an electronic communication or the use of an electronic |
---|
237 | 237 | | communication service including, but not limit ed to, the contents, |
---|
238 | 238 | | sender, recipients, format, or location of the sender or recipients |
---|
239 | 239 | | at any point during the communication, the time or date the |
---|
240 | 240 | | communication was created, sent, or received or any information |
---|
241 | 241 | | pertaining to any individual or device part icipating in the |
---|
242 | 242 | | communication including , but not limited to, an IP address. |
---|
243 | 243 | | Electronic communication information does not include subscriber |
---|
244 | 244 | | information as defined in this act; |
---|
245 | 245 | | 5. "Electronic communication service " means a service that |
---|
246 | 246 | | provides to its subscribers or users the ability to send or receive |
---|
247 | 247 | | electronic communications including any service that acts as an |
---|
248 | 248 | | intermediary in the transmission of electronic communications, or |
---|
249 | 249 | | stores electronic communication information; |
---|
250 | 250 | | 6. "Electronic device" means a device that stores, generates or |
---|
251 | 251 | | transmits information in electronic form; |

309 | 309 | | state or a political subdivision thereof, or an individual acting |

310 | 310 | | for or on behalf of the state or a political subdivision th ereof; |

311 | 311 | | 10. "Service provider" means a person or en tity offering an |
---|
312 | 312 | | electronic communication service; |
---|
313 | 313 | | 11. "Specific consent" means consent provided directly to the |
---|
314 | 314 | | government entity seeking information including, bu t not limited to, |
---|
315 | 315 | | when the government en tity is the addressee or intended recipient or |
---|
316 | 316 | | a member of the intended audience of an electronic communication. |
---|
317 | 317 | | Specific consent does not require that the originator of the |
---|
318 | 318 | | communication have actual knowledge that an addressee, intended |
---|
319 | 319 | | recipient or member of the specific audience is a government entity; |
---|
320 | 320 | | and |
---|
321 | 321 | | 12. "Subscriber information " means the name, street address, |
---|
322 | 322 | | telephone number, email address or similar contact information |
---|
323 | 323 | | provided by the subscriber to a service provider to establish or |
---|
324 | 324 | | maintain an account or communication channel, a subscriber or |
---|
325 | 325 | | account number or identifier, the length of service, and the types |
---|
326 | 326 | | of services used by a user of or subscriber to a service provider. |

382 | 382 | | shall not do any of the fol lowing: |

383 | 383 | | 1. Compel the production of or access to electronic |

384 | 384 | | communication information from a service provider; |
---|
385 | 385 | | 2. Compel the production of or access to electronic device |
---|
386 | 386 | | information from any person or entity other than the aut horized |
---|
387 | 387 | | possessor of the dev ice; |
---|
388 | 388 | | 3. Access electronic device information by means of physical |
---|
389 | 389 | | interaction or electronic communication with the electronic device. |
---|
390 | 390 | | This section does not prohibit the intended recipient of an |
---|
391 | 391 | | electronic communication from voluntarily disclosing electro nic |
---|
392 | 392 | | communication information conc erning that communication to a |
---|
393 | 393 | | government entity; |
---|
394 | 394 | | B. A government entity may compel the production of or access |
---|
395 | 395 | | to electronic communication information from a service provider, or |
---|
396 | 396 | | compel the production of or access to ele ctronic device information |
---|
397 | 397 | | from any person or entity other than the authorized posses sor of the |
---|
398 | 398 | | device only under the following circumstances: |

460 | 460 | | not otherwise prohibited by state or federal law. Nothing in this |

461 | 461 | | paragraph shall be construed to expand any au thority under state law |
---|
462 | 462 | | to compel the production of or access to electronic information. |

463 | 463 | | C. A government entity may access electronic device information |
---|
464 | 464 | | by means of physical interaction or electronic comm unication with |
---|
465 | 465 | | the device only as follows: |

466 | 466 | | 1. Pursuant to a warrant issued pursuant to the Oklahoma |
---|
467 | 467 | | Statutes or federal law and subject to subsection D of this section; |

617 | 617 | | E. When issuing any warran t or order for electronic |

757 | 757 | | appropriate court an application for a warrant or o rder authorizing |

758 | 758 | | obtaining the electronic information or a motion seeking approval o f |

759 | 759 | | the emergency disclosure that shall set forth the facts giving rise |
---|
760 | 760 | | to the emergency, and if applicable, a request supported by a sworn |
---|
761 | 761 | | affidavit for an order delaying notification under paragraph 1 of |
---|
762 | 762 | | subsection B of Section 4 of this act. The court shall promptly |
---|
763 | 763 | | rule on the application or motion . Upon a finding that the facts |
---|
764 | 764 | | did not give rise to an emergency or upon rejecting the warrant or |
---|
765 | 765 | | order application on any o ther ground, the court shall order the |
---|
766 | 766 | | immediate destruction of all information obta ined, and immediate |
---|
767 | 767 | | notification pursuant to sub section A of Section 4 of this act, i f |

---|
769 | 769 | | I. This section does not limit the authority of a government |

912 | 912 | | 2. The court may grant extensions of the delay of up to ninety |
---|
913 | 913 | | (90) days each on the same grou nds as provided in paragraph 1 of |

984 | 984 | | section, the government entity shall submit to the Department upon |

985 | 985 | | the expiration of the period of delay o f the notification all of the |
---|
986 | 986 | | information required in paragraph 3 of subsection B of this section. |

987 | 987 | | The Department shall publish all those reports on its website within |
---|
988 | 988 | | ninety (90) days of receipt. The Department may redact names or |
---|
989 | 989 | | other personal identifying information from the reports . |
---|
990 | 990 | | D. Except as otherwise provided in this sectio n, nothing in |
---|
991 | 991 | | this act shall prohibit or limit a service provider or any other |
---|
992 | 992 | | party from disclosing information about any request or demand for |
---|
993 | 993 | | electronic information. |

1048 | 1048 | | A. Any person in a trial, hearing or proceedi ng may move to |

1051 | 1051 | | or of this act. The motion shall be made, determined, and be |

1054 | 1054 | | B. The Attorney General may commence a civil action to compel |
---|
1055 | 1055 | | any government entity to comply wit h the provisions of this act . |

1056 | 1056 | | C. An individual whose information is targeted by a warrant, |
---|
1057 | 1057 | | order or other legal process that is inconsistent with this act or |
---|
1058 | 1058 | | the United States Constitution, or a service provider or any other |
---|
1059 | 1059 | | recipient of the warrant, order or other legal process may petition |
---|
1060 | 1060 | | the issuing court to void or modify the warrant, order or process, |
---|
1061 | 1061 | | or to order the destruction of any information obtained in violation |
---|
1062 | 1062 | | of this act or the United States Consti tution. |
---|
1063 | 1063 | | D. An Oklahoma or foreign corporation, and its officers, |
---|
1064 | 1064 | | employees and agents are not subject to any cause of action for |
---|
1065 | 1065 | | providing records, information, fa cilities or assistance in |
---|
1066 | 1066 | | accordance with the terms of a warrant, court order, statutory |
---|
1067 | 1067 | | authorization, emergency certification or wiretap order issued |
---|
1068 | 1068 | | pursuant to this act . |
---|
1069 | 1069 | | SECTION 6. This act shall become effective November 1, 20 21. |
