159159 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
160160 SECTION 1. NEW LAW A new section of law to be codified
161161 in the Oklahoma Statutes as Section 1265 of Title 22, unless there
162162 is created a duplication in numbering, reads as follows:
163163 This act shall be known and may be cited as the "Electronic
164164 Communication and Device Privacy Act ".
165165 SECTION 2. NEW LAW A new section of law to be codified
166166 in the Oklahoma Statutes as Section 1265.1 of Title 22, unless there
167167 is created a duplication in numbering, reads as follows:
168168 For purposes of this act, the following definitions apply:
169169 1. "Adverse result" means any of the following:
170170 a. danger to the life or physical safety of an
171171 individual,
172172 b. flight from prosecution ,
173173 c. destruction of or tampering with evidence,
174174 d. intimidation of potential witnesses, or
175175 e. serious jeopardy to an investigation or undue delay of

228228 2. "Authorized possessor " means the possessor of an electronic
229229 device when that person is the owner of the device or has been
230230 authorized to possess the device by th e owner of the device;
231231 3. "Electronic communication " means the transfer of signs,
232232 signals, writings, images, sounds, data or intelligence of any
233233 nature in whole or in part by a wire, radio, electromagneti c,
234234 photoelectric, or photo-optical system;
235235 4. "Electronic communication information " means any information
236236 about an electronic communication or the use of an electronic
237237 communication service including, but not limit ed to, the contents,
238238 sender, recipients, format, or location of the sender or recipients
239239 at any point during the communication, the time or date the
240240 communication was created, sent, or received or any information
241241 pertaining to any individual or device part icipating in the
242242 communication including , but not limited to, an IP address.
243243 Electronic communication information does not include subscriber
244244 information as defined in this act;
245245 5. "Electronic communication service " means a service that
246246 provides to its subscribers or users the ability to send or receive
247247 electronic communications including any service that acts as an
248248 intermediary in the transmission of electronic communications, or
249249 stores electronic communication information;
250250 6. "Electronic device" means a device that stores, generates or
251251 transmits information in electronic form;

303303 7. "Electronic device information" means any information stored
304304 on or generated through the operation of an electronic device
305305 including the current and prior locations of the dev ice.
306306 8. "Electronic information " means electronic communication
307307 information or electronic device information;
308308 9. "Government entity" means a department or agency of the
309309 state or a political subdivision thereof, or an individual acting
310310 for or on behalf of the state or a political subdivision th ereof;
311311 10. "Service provider" means a person or en tity offering an
312312 electronic communication service;
313313 11. "Specific consent" means consent provided directly to the
314314 government entity seeking information including, bu t not limited to,
315315 when the government en tity is the addressee or intended recipient or
316316 a member of the intended audience of an electronic communication.
317317 Specific consent does not require that the originator of the
318318 communication have actual knowledge that an addressee, intended
319319 recipient or member of the specific audience is a government entity;
320320 and
321321 12. "Subscriber information " means the name, street address,
322322 telephone number, email address or similar contact information
323323 provided by the subscriber to a service provider to establish or
324324 maintain an account or communication channel, a subscriber or
325325 account number or identifier, the length of service, and the types
326326 of services used by a user of or subscriber to a service provider.

378378 SECTION 3. NEW LAW A new section of law to be codified

381381 A. Except as provided in this section, a government entity
382382 shall not do any of the fol lowing:
383383 1. Compel the production of or access to electronic
384384 communication information from a service provider;
385385 2. Compel the production of or access to electronic device
386386 information from any person or entity other than the aut horized
387387 possessor of the dev ice;
388388 3. Access electronic device information by means of physical
389389 interaction or electronic communication with the electronic device.
390390 This section does not prohibit the intended recipient of an
391391 electronic communication from voluntarily disclosing electro nic
392392 communication information conc erning that communication to a
393393 government entity;
394394 B. A government entity may compel the production of or access
395395 to electronic communication information from a service provider, or
396396 compel the production of or access to ele ctronic device information
397397 from any person or entity other than the authorized posses sor of the
398398 device only under the following circumstances:
399399 1. Pursuant to a lawful warrant issued pursuant to the Oklahoma
400400 Statutes or federal law and subject to subsectio n D of this section;

452452 2. Pursuant to a wiretap order issued pursuant to the Oklahoma
453453 Statutes or federal law;
454454 3. Pursuant to an order for electronic reader records issued
455455 pursuant to Oklahoma Statutes or federal law; or
456456 4. Pursuant to a subpoena issued p ursuant to existing state law
457457 provided that the information is not sought for the pur pose of
458458 investigating or prosecuting a criminal offense, and that compelling
459459 the production of or access to the information via the subpoena is
460460 not otherwise prohibited by state or federal law. Nothing in this
461461 paragraph shall be construed to expand any au thority under state law
462462 to compel the production of or access to electronic information.
463463 C. A government entity may access electronic device information
464464 by means of physical interaction or electronic comm unication with
465465 the device only as follows:
466466 1. Pursuant to a warrant issued pursuant to the Oklahoma
467467 Statutes or federal law and subject to subsection D of this section;
468468 2. Pursuant to a wiretap order issued pursuant to the Oklahoma
469469 Statutes or federal la w;
470470 3. With the specific consent of the aut horized possessor of the
471471 device;
472472 4. With the specific consent of the owner of the device, only
473473 when the device has been reported as lost or stolen;

525525 5. If the government entity, in good faith, believes that an
526526 emergency involving danger of death or serious physic al injury to
527527 any person requires access to th e electronic device information;
528528 6. If the government entity, in good faith, believes the device
529529 to be lost, stolen, or aband oned; provided, that the entity shall
530530 only access electronic device information in or der to attempt to
531531 identify, verify, or contact the owner or aut horized possessor of
532532 the device; or
533533 7. Except where prohibited by state or federal law, if the
534534 device is seized from an inmate's possession or found in an area of
535535 a correctional facility under the jurisdiction of the Department of
536536 Corrections where inmates have access and the device is not in the
537537 possession of an individual and the device is not known or believe d
538538 to be the possession of an auth orized visitor. Nothing in this
539539 paragraph shall be construed to supersede or override the Oklahoma
540540 Statutes or rules promulgated by the Department of Corrections for
541541 electronic devices.
542542 D. Any warrant for electronic infor mation shall comply with the
543543 following:
544544 1. The warrant shall describe with particul arity the
545545 information to be seized by specifying the time periods covered and,
546546 as appropriate and reasonable, the target individuals or accounts,
547547 the applications or servic es covered, and the types of information
548548 sought;

600600 2. The warrant shall require that any information obtained
601601 through the execution of the warrant that is unrelated to the
602602 objective of the warrant shall be sealed and not subject to further
603603 review, use or disclosure without a court order. A court shall
604604 issue such an order upon a finding th at there is probable cause to
605605 believe that the information is relevant to an active investigation,
606606 or review, use or disclosure is r equired by state or federal law;
607607 and
608608 3. The warrant shall comply with al l other provisions of state
609609 and federal law includi ng any provisions prohibiting, limiting or
610610 imposing additional requirements on the use of search warrants. If
611611 directed to a service provider, the warrant shall be accompan ied by
612612 an order requiring the ser vice provider to verify the authenticity
613613 of electronic information that it produces by providing an affidavit
614614 that complies with the requirements set forth in the Oklahoma
615615 Evidence Code. Admission of that information into evidence shall be
616616 subject to the Oklahoma Evidence Code.
617617 E. When issuing any warran t or order for electronic
618618 information, or upon the petition from the target or recipient of
619619 the warrant or order, a court may, at its discretion, do any or all
620620 of the following:
621621 1. Appoint a special maste r charged with ensuring that only
622622 information necessary to achieve the objective of the warrant or
623623 order is produced or accessed; and

675675 2. Require that any information obtained through the execution
676676 of the warrant or order t hat is unrelated to the objective of the
677677 warrant be destroyed as soon as feasible af ter the termination of
678678 the current investigation and any related investigations or
679679 proceedings.
680680 F. A service provider may voluntarily disclose electronic
681681 communication information or subscriber informatio n when that
682682 disclosure is not otherwise prohibited by state or federal law.
683683 G. If a government entity receives electronic communication
684684 information voluntarily prov ided pursuant to subsection F of this
685685 section, it shall destroy that information within ninety (90) days
686686 unless one or more of the following c ircumstances apply:
687687 1. The entity has or obtains the specific consent of the sender
688688 or recipient of the electronic communications about which
689689 information was disclosed;
690690 2. The entity obtains a court orde r authorizing the retention
691691 of the information. A court shall issue a retention order upon a
692692 finding that the conditions justifying the initial voluntary
693693 disclosure persist, in which case the court shall authorize the
694694 retention of the information only for so long as those conditions
695695 persist, or there is p robable cause to believe that the information
696696 constitutes evidence that a crime has been committed; or
697697 3. The entity reasonably believes that the information relates
698698 to child pornography and the informati on is retained as part of a

751751 and related crimes.
752752 H. If a government entity obtains electronic information
753753 pursuant to an emergency involving danger of deat h or serious
754754 physical injury to a person that requires access to the electronic
755755 information without delay, the entity shall, within three (3) days
756756 after obtaining the electronic information, file with the
757757 appropriate court an application for a warrant or o rder authorizing
758758 obtaining the electronic information or a motion seeking approval o f
759759 the emergency disclosure that shall set forth the facts giving rise
760760 to the emergency, and if applicable, a request supported by a sworn
761761 affidavit for an order delaying notification under paragraph 1 of
762762 subsection B of Section 4 of this act. The court shall promptly
763763 rule on the application or motion . Upon a finding that the facts
764764 did not give rise to an emergency or upon rejecting the warrant or
765765 order application on any o ther ground, the court shall order the
766766 immediate destruction of all information obta ined, and immediate
767767 notification pursuant to sub section A of Section 4 of this act, i f
768768 such notice has not already been given.
769769 I. This section does not limit the authority of a government
770770 entity to use an administrative, grand jury, trial, or civil
771771 discovery subpoena to do any of the following:

823823 1. Require an originator, addressee, or intended recipient of
824824 an electronic communication to disclose any electronic communication
825825 information associated with that communication;
826826 2. Require an entity that provides electronic communications
827827 services to its officers, directors, employees or agents for the
828828 purpose of carrying out their duties, to disclose electronic
829829 communication information associated with an electro nic
830830 communication to or from an officer, director, employee or agent of
831831 the entity; or
832832 3. Require a service provider to provide subscriber
833833 information.
834834 SECTION 4. NEW LAW A new section of law to be codified
835835 in the Oklahoma Statutes as Section 1265.3 of Title 22 , unless there
836836 is created a duplication in numbering, reads as follows:
837837 A. Except as otherwise provided in this section, any government
838838 entity that executes a warrant, or obtains electronic in formation in
839839 an emergency pursuan t to Section 3 of this act, shall serve upon, or
840840 deliver to by registered or first -class mail, electronic mail or
841841 other means reasonably calculated to be effective, the identified
842842 targets of the warrant or emergency request , a notice that informs
843843 the recipient that information about the recipient has been
844844 compelled or requested, and states with reasonable specificity the
845845 nature of the government investigation under which the information
846846 is sought. The notice shall include a copy of the warrant or a

899899 The notice shall be provided contemporaneously with the execution of
900900 a warrant, or, in the case of an emergency, within three (3) days
901901 after obtaining the electr onic information.
902902 B. 1. When a warrant is sought or electronic information is
903903 obtained in an emergency under Section 3 of this act, the government
904904 entity may submit a request supported by a sworn affidavit for an
905905 order delaying notification and prohibiti ng any party providing
906906 information from notifying any other party that information h as been
907907 sought. The court shall issue the order if the court determines
908908 that there is reason to believe that notification may have an
909909 adverse result, but only for the peri od of time that the court finds
910910 there is reason to believe that the notification may have that
911911 adverse result, and not to exceed ninety (90) days.
912912 2. The court may grant extensions of the delay of up to ninety
913913 (90) days each on the same grou nds as provided in paragraph 1 of
914914 this subsection.
915915 3. Upon expiration of the period of delay of t he notification,
916916 the government entity shall serve upon, or deliver to by registered
917917 or first-class mail, electronic mail, or other means reasonably
918918 calculated to be effect ive as specified by the court iss uing the
919919 order authorizing delayed notification, th e identified targets of
920920 the warrant, a document that includes the information described in
921921 subsection A of this section , a copy of all electronic information

973973 obtained or a summary of that information inclu ding, at a minimum,
974974 the number and types of records disclosed, the date and time when
975975 the earliest and latest records were created, and a statement of the
976976 grounds for the court 's determination to grant a delay in notifying
977977 the individual.
978978 C. If there is no identified target of a warrant or emergency
979979 request at the time of its issuance, the government entity shall
980980 submit to the Department of Public Safety within three (3) days of
981981 the execution of the warrant or issuance of t he request all of the
982982 information required in subsection A of this section . If an order
983983 delaying notice is obta ined pursuant to subsection B of this
984984 section, the government entity shall submit to the Department upon
985985 the expiration of the period of delay o f the notification all of the
986986 information required in paragraph 3 of subsection B of this section.
987987 The Department shall publish all those reports on its website within
988988 ninety (90) days of receipt. The Department may redact names or
989989 other personal identifying information from the reports .
990990 D. Except as otherwise provided in this sectio n, nothing in
991991 this act shall prohibit or limit a service provider or any other
992992 party from disclosing information about any request or demand for
993993 electronic information.
994994 SECTION 5. NEW LAW A new section of law to be codified

10481048 A. Any person in a trial, hearing or proceedi ng may move to
10491049 suppress any electronic info rmation obtained or retained in
10501050 violation of the Fourth Amendment to the United States Constitution
10511051 or of this act. The motion shall be made, determined, and be
10521052 subject to review in accordance with the procedures set forth in the
10531053 Oklahoma Statutes.
10541054 B. The Attorney General may commence a civil action to compel
10551055 any government entity to comply wit h the provisions of this act .
10561056 C. An individual whose information is targeted by a warrant,
10571057 order or other legal process that is inconsistent with this act or
10581058 the United States Constitution, or a service provider or any other
10591059 recipient of the warrant, order or other legal process may petition
10601060 the issuing court to void or modify the warrant, order or process,
10611061 or to order the destruction of any information obtained in violation
10621062 of this act or the United States Consti tution.
10631063 D. An Oklahoma or foreign corporation, and its officers,
10641064 employees and agents are not subject to any cause of action for
10651065 providing records, information, fa cilities or assistance in
10661066 accordance with the terms of a warrant, court order, statutory
10671067 authorization, emergency certification or wiretap order issued
10681068 pursuant to this act .
10691069 SECTION 6. This act shall become effective November 1, 20 21.
