77	77		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78		SECTION 1. AMENDATORY 74 O.S. 2011, Section 840 -5.5, as
79	79		last amended by Section 1, Chapter 365 , O.S.L. 2019 (74 O.S. Supp.
80	80		2020, Section 840-5.5), is amended to read as follows:
81	81		Section 840-5.5. A. The following offices, positions, and
82	82		personnel shall be in the unclassified se rvice and shall not be
83	83		placed under the classified service:
84	84		1. Persons chosen by popular vote or appointment to fill an
85	85		elective office, and their employees, except the employees of the
86	86		Corporation Commission, the Sta te Department of Education and the
87	87		Department of Labor;

139	139		2. Members of boards and commissions, and heads of ag encies;
140	140		also one principal assistant or deputy and one executi ve secretary
141	141		for each state agency;
142	142		3. All judges, elected or appointed, and their employees;
143	143		4. Persons employed with o ne-time, limited duration, federal or
144	144		other grant funding that is not co ntinuing or indefinitely
145	145		renewable. The length of the unclass ified employment shall not
146	146		exceed the period of time for which that specific federal funding is
147	147		provided;
148	148		5. All officers and employees of The Oklahoma State System of
149	149		Higher Education, State B oard of Education and Oklahoma Department
150	150		of Career and Techno logy Education;
151	151		6. Persons employed in a professional or scientific capacity to
152	152		make or conduct a temporary and special i nquiry, investigation, or
153	153		examination on behalf of the Legislature or a committee thereof or
154	154		by authority of the Governor. These appo intments and authorizations
155	155		shall terminate on the first day of the regular legislat ive session
156	156		immediately following the appointment, if not terminated earlier.
157	157		However, nothing in this paragr aph shall prevent the reauthorization
158	158		and reappointment of any such person. Any such appointment shall be
159	159		funded from the budget of the appointin g authority;
160	160		7. Election officials an d employees;
161	161		8. Temporary employees employed to work less than one thou sand
162	162		(1,000) hours in any twelve-month period, and seasonal em ployees

221	221		c. the Governor’s representative of the Oklahoma Highway
222	222		Safety Office who shal l be appointed by the Governor,
223	223		d. Highway Patrol Colonel,
224	224		e. Highway Patrol Lieutenant Colonel,
225	225		f. Highway Patrol Major,
226	226		g. Director of Finance,
227	227		h. noncommissioned pilots,
228	228		i. Information Systems Administrator,
229	229		j. Law Enforcement Telecommunications System Specialist,
230	230		k. Director of Driver Compliance,
231	231		l. Director of Transportation Division,
232	232		m. Director of the Oklahoma Highway Safety Office,
233	233		n. Civil Rights Administrator,

290	290		t. Human Resources Director,
291	291		u. Administrator of Department Services, and
292	292		v. a maximum of seven positions for the purpose of
293	293		administering programs in the Oklahoma Hi ghway Safety
294	294		Office, within full-time employee limitations of the
295	295		Department, employed with federal funding that is
296	296		continuing or indefinitely renewable. The
297	297		authorization for such positions shall be terminated
298	298		if the federal funding for positions is disc ontinued;
299	299		provided, any person appointed to a position prescribed in
300	300		subparagraph d, e or f of this paragraph shall have a right of
301	301		return to the classified commissioned position without any loss of
302	302		rights, privileges or benefits immediately upon completio n of the
303	303		duties in the unclassified commissioned position;
304	304		10. Professional trainees only during the prescribed length of
305	305		their course of training or extension study;
306	306		11. Students who are employed on a part -time basis, which shall
307	307		be seventy-five percent (75%) of a normal forty -hour work week or
308	308		thirty (30) hours per week, o r less, or on a full-time basis if the
309	309		employment is pursuant to a cooperative education program such as
310	310		that provided for under Title I IV -D of the Higher Education Act of
311	311		1965 (20 U.S.C. 1087a-1087c), as amended, and who are regularly
312	312		enrolled in:

364	364		a. an institution of higher learning within The Oklahoma
365	365		State System of Higher Education,
366	366		b. an institution of higher learning qualified to become
367	367		coordinated with The Oklahoma State System of Higher
368	368		Education. For purposes of this section, a student
369	369		shall be considered a regularly enrolled student if
370	370		the student is enrolled in a minimum of five (5) hours
371	371		of accredited graduate courses or a minimum of t en
372	372		(10) hours of accredited undergradu ate courses;
373	373		provided, however, the student shall only be required
374	374		to be enrolled in a minimum of six (6) hours of
375	375		accredited undergraduate courses during the summer, or
376	376		c. high school students regularly enrolled in a high
377	377		school in Oklahoma and regularly attending classes
378	378		during such time of enrollment;
379	379		12. The spouses of pe rsonnel who are employed on a part-time
380	380		basis to assist or wor k as a relief for their spouses in the
381	381		Oklahoma Tourism and Recreation Department;
382	382		13. Service substitute attendants who are needed to replace
383	383		museum and site attendants who are unavoidably abs ent. Service
384	384		substitutes may work as part-time or full-time relief for absentees
385	385		for a period of not more than four (4) weeks per year in the
386	386		Oklahoma Historical Society sites and mus eums; such substitutes will

1795	1795		B. If an agency has the authority to employ personnel i n the
1796	1796		following offices and positions, the appointing authorit y shall have
1797	1797		the discretion to appoint personnel to the unclassified service:
1798	1798		1. Licensed medical doctors, osteopathic ph ysicians, dentists,
1799	1799		psychologists, and nurses;

1861	1861		D. Notwithstanding any other sections of law, on the effective
1862	1862		date of this act, all newly hired state employees shall be in the
1863	1863		unclassified service an d shall not be placed under the classified
1864	1864		service except for those posi tions required by a federal grant or
1865	1865		funding requirement.
1866	1866		E. The appointing authority of agencies participa ting in the
1867	1867		statewide information systems project may establish unclas sified
1868	1868		positions and appoint unclassified employees to the project as
1869	1869		needed. Additional unclassified positions may be established, if
1870	1870		required, to appoint an unclassified employee to p erform the duties
1871	1871		of a permanent classified employee who is temporaril y absent from a
1872	1872		classified position as a result of assignment to this proje ct. All
1873	1873		unclassified appointments und er this authority shall expire no later
1874	1874		than December 31, 2007, and all u nclassified positions established
1875	1875		to support the project shall be abol ished. Both the positions and
1876	1876		appointments resulting from this authority s hall be exempt from any
1877	1877		agency FTE limitations and any limits imposed on the number of
1878	1878		unclassified positions a uthorized. Permanent classified employees
1879	1879		may request a leave of abse nce from classified status and accept an
1880	1880		unclassified appointment and compe nsation with the same agency under
1881	1881		the provisions of this subsection; provided, the leave shall expire

1935	1935		without interruption in any benef it programs available to classified
1936	1936		employees, including retirement and insurance programs. Immediately
1937	1937		upon termination of an unclassified appointment pursuant to this
1938	1938		subsection, an employee on assignment from the classified service
1939	1939		shall have a right t o be restored to the classified servic e and
1940	1940		reinstated to the former job family level and compensation plus any
1941	1941		adjustments and increases in salary or benefits which the employee
1942	1942		would have received but for the leave of absence.
1943	1943		SECTION 2. It being immediately necessary for the pr eservation
1944	1944		of the public peace, health or safety, an emergency is her eby
1945	1945		declared to exist, by reason whereof this act shall take effect and
1946	1946		be in full force from and after its passage and approval.
