7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 74 O.S. 2011, Section 840 -5.5, as
7979 last amended by Section 1, Chapter 365 , O.S.L. 2019 (74 O.S. Supp.
8080 2020, Section 840-5.5), is amended to read as follows:
8181 Section 840-5.5. A. The following offices, positions, and
8282 personnel shall be in the unclassified se rvice and shall not be
8383 placed under the classified service:
8484 1. Persons chosen by popular vote or appointment to fill an
8585 elective office, and their employees, except the employees of the
8686 Corporation Commission, the Sta te Department of Education and the
8787 Department of Labor;

142142 3. All judges, elected or appointed, and their employees;
143143 4. Persons employed with o ne-time, limited duration, federal or
144144 other grant funding that is not co ntinuing or indefinitely
145145 renewable. The length of the unclass ified employment shall not
146146 exceed the period of time for which that specific federal funding is
147147 provided;
148148 5. All officers and employees of The Oklahoma State System of
149149 Higher Education, State B oard of Education and Oklahoma Department
150150 of Career and Techno logy Education;
151151 6. Persons employed in a professional or scientific capacity to
152152 make or conduct a temporary and special i nquiry, investigation, or
153153 examination on behalf of the Legislature or a committee thereof or
154154 by authority of the Governor. These appo intments and authorizations
155155 shall terminate on the first day of the regular legislat ive session
156156 immediately following the appointment, if not terminated earlier.
157157 However, nothing in this paragr aph shall prevent the reauthorization
158158 and reappointment of any such person. Any such appointment shall be
159159 funded from the budget of the appointin g authority;

293293 administering programs in the Oklahoma Hi ghway Safety
294294 Office, within full-time employee limitations of the
295295 Department, employed with federal funding that is
296296 continuing or indefinitely renewable. The
297297 authorization for such positions shall be terminated
298298 if the federal funding for positions is disc ontinued;
299299 provided, any person appointed to a position prescribed in
300300 subparagraph d, e or f of this paragraph shall have a right of
301301 return to the classified commissioned position without any loss of
302302 rights, privileges or benefits immediately upon completio n of the
303303 duties in the unclassified commissioned position;
304304 10. Professional trainees only during the prescribed length of
305305 their course of training or extension study;
306306 11. Students who are employed on a part -time basis, which shall
307307 be seventy-five percent (75%) of a normal forty -hour work week or
308308 thirty (30) hours per week, o r less, or on a full-time basis if the
309309 employment is pursuant to a cooperative education program such as
310310 that provided for under Title I IV -D of the Higher Education Act of
311311 1965 (20 U.S.C. 1087a-1087c), as amended, and who are regularly

364364 a. an institution of higher learning within The Oklahoma
365365 State System of Higher Education,
366366 b. an institution of higher learning qualified to become
367367 coordinated with The Oklahoma State System of Higher
368368 Education. For purposes of this section, a student
369369 shall be considered a regularly enrolled student if
370370 the student is enrolled in a minimum of five (5) hours
371371 of accredited graduate courses or a minimum of t en
372372 (10) hours of accredited undergradu ate courses;
373373 provided, however, the student shall only be required
374374 to be enrolled in a minimum of six (6) hours of
375375 accredited undergraduate courses during the summer, or
376376 c. high school students regularly enrolled in a high
377377 school in Oklahoma and regularly attending classes
378378 during such time of enrollment;
379379 12. The spouses of pe rsonnel who are employed on a part-time
380380 basis to assist or wor k as a relief for their spouses in the
381381 Oklahoma Tourism and Recreation Department;
382382 13. Service substitute attendants who are needed to replace
383383 museum and site attendants who are unavoidably abs ent. Service
384384 substitutes may work as part-time or full-time relief for absentees
385385 for a period of not more than four (4) weeks per year in the
386386 Oklahoma Historical Society sites and mus eums; such substitutes will

18661866 E. The appointing authority of agencies participa ting in the
18671867 statewide information systems project may establish unclas sified
18681868 positions and appoint unclassified employees to the project as
18691869 needed. Additional unclassified positions may be established, if
18701870 required, to appoint an unclassified employee to p erform the duties
18711871 of a permanent classified employee who is temporaril y absent from a
18721872 classified position as a result of assignment to this proje ct. All
18731873 unclassified appointments und er this authority shall expire no later
18741874 than December 31, 2007, and all u nclassified positions established
18751875 to support the project shall be abol ished. Both the positions and
18761876 appointments resulting from this authority s hall be exempt from any
18771877 agency FTE limitations and any limits imposed on the number of
18781878 unclassified positions a uthorized. Permanent classified employees
18791879 may request a leave of abse nce from classified status and accept an
18801880 unclassified appointment and compe nsation with the same agency under
18811881 the provisions of this subsection; provided, the leave shall expire
