AS INTRODUCED 
 
An Act relating to the Oklahoma Health Care 
Authority; authorizing suspension of Medicaid 
coverage under certain conditio ns; prohibiting 
termination of coverage except under certain 
condition; authorizing eligibility det ermination upon 
release from custody of the Department of 
Corrections; providing for reinstatement or 
termination of coverage; requiring certain 
notification; directing the Authority to seek certain 
federal approval; providing for codification; 
providing an effective date; and declaring an 
emergency. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHO MA: 
SECTION 1.     NEW LAW     A new sect ion of law to be codified 
in the Oklahoma Statutes as Section 5029.1 of Title 63, unless there 
is created a duplication in numbering, reads as follows: 
When a recipient of the state Medicaid program enters the 
custody of the Department of Corrections and b ecomes ineligible to 
receive certain services through the state Medicaid program, the 
Oklahoma Health Care Authority may suspend, but shall not terminate, 
the coverage of the recipient under the stat e Medicaid program, 
unless the recipient becomes ineligib le due to a reason other than

solely being in the custody of the Department .  Upon the release of 
the recipient from the custody of the Department, the Authority may 
conduct an eligibility determination and terminate coverage if the 
recipient is found to no longer qualify.  If the recipient is found 
to qualify, the Authority shall fully reinstate the recipient’s 
coverage under the state Medicaid p rogram. The Department shall 
notify the Authority when the Department receives into its cu stody a 
recipient of the state Medicaid program.  The Authority shall seek 
any federal approval necessary to implement this section. 
SECTION 2.  This act shall become effec tive July 1, 2021. 
SECTION 3.  It being immediately necessary for the pre servation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof this act shall take effect and 
be in full force from and a fter its passage and approval.
