8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHO MA:
8282 SECTION 1. NEW LAW A new sect ion of law to be codified
8383 in the Oklahoma Statutes as Section 5029.1 of Title 63, unless there
8484 is created a duplication in numbering, reads as follows:
8585 When a recipient of the state Medicaid program enters the
8686 custody of the Department of Corrections and b ecomes ineligible to
8787 receive certain services through the state Medicaid program, the
8888 Oklahoma Health Care Authority may suspend, but shall not terminate,
8989 the coverage of the recipient under the stat e Medicaid program,
9090 unless the recipient becomes ineligib le due to a reason other than

142142 solely being in the custody of the Department . Upon the release of
143143 the recipient from the custody of the Department, the Authority may
144144 conduct an eligibility determination and terminate coverage if the
145145 recipient is found to no longer qualify. If the recipient is found
146146 to qualify, the Authority shall fully reinstate the recipient’s
147147 coverage under the state Medicaid p rogram. The Department shall
148148 notify the Authority when the Department receives into its cu stody a
149149 recipient of the state Medicaid program. The Authority shall seek
150150 any federal approval necessary to implement this section.
151151 SECTION 2. This act shall become effec tive July 1, 2021.
152152 SECTION 3. It being immediately necessary for the pre servation
153153 of the public peace, health or safety, an emergency is hereby
154154 declared to exist, by reason whereof this act shall take effect and
155155 be in full force from and a fter its passage and approval.
