81	81	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHO MA:
82	82	SECTION 1. NEW LAW A new sect ion of law to be codified
83	83	in the Oklahoma Statutes as Section 5029.1 of Title 63, unless there
84	84	is created a duplication in numbering, reads as follows:
85	85	When a recipient of the state Medicaid program enters the
86	86	custody of the Department of Corrections and b ecomes ineligible to
87	87	receive certain services through the state Medicaid program, the
88	88	Oklahoma Health Care Authority may suspend, but shall not terminate,
89	89	the coverage of the recipient under the stat e Medicaid program,
90	90	unless the recipient becomes ineligib le due to a reason other than

142	142	solely being in the custody of the Department . Upon the release of
143	143	the recipient from the custody of the Department, the Authority may
144	144	conduct an eligibility determination and terminate coverage if the
145	145	recipient is found to no longer qualify. If the recipient is found
146	146	to qualify, the Authority shall fully reinstate the recipient’s
147	147	coverage under the state Medicaid p rogram. The Department shall
148	148	notify the Authority when the Department receives into its cu stody a
149	149	recipient of the state Medicaid program. The Authority shall seek
150	150	any federal approval necessary to implement this section.
151	151	SECTION 2. This act shall become effec tive July 1, 2021.
152	152	SECTION 3. It being immediately necessary for the pre servation
153	153	of the public peace, health or safety, an emergency is hereby
154	154	declared to exist, by reason whereof this act shall take effect and
155	155	be in full force from and a fter its passage and approval.
