7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 10 O.S. 2011, Section 406, as last
7777 amended by Section 1, Chapter 368, O.S.L. 2019 (10 O.S. Supp. 2020,
7878 Section 406), is amended to read as follows:
7979 Section 406. A. 1. Except as provided in pa ragraph 2 of this
8080 subsection, the Department of Hum an Services shall have authority at
8181 any reasonable time to investigate a nd examine the conditions of any
8282 child care facility in which a licensee or applicant hereunder
8383 receives and maintains children, and shall have authority at any
8484 time to require the fac ility to provide information pertaining to
8585 children in its care.
8686 2. When the Department of Human Services is reviewing the star
8787 rating of a child care program with a capacity of fifty or more, the

139139 comprehensive visit to inspect and examine the program sha ll be
140140 scheduled with the administration of the program at least one (1)
141141 week in advance of the visit, if requested by the child care
142142 facility.
143143 B. 1. The State Department of Health may visit any licensee or
144144 applicant at the request of the Department to ad vise on matters
145145 affecting the health of children and to inspect the sani tation of
146146 the buildings used for their care.
147147 2. The State Fire Marshal may visit any licensee or applicant
148148 at the request of the Dep artment to advise on matters affecting the
149149 safety of children and to inspect the condition of the buildings
150150 used for their care.
151151 C. 1. Upon receipt of a complaint against any child care
152152 facility alleging a violation of the provisions of the Oklahoma
153153 Child Care Facilities Licensing Act, or any licensing s tandard
154154 promulgated by the Department, the Department shall conduct a fu ll
155155 investigation. If upon investigation, it is determined that there
156156 are reasonable grounds to believe that a facility is in violati on of
157157 the Oklahoma Child Care Facilities Licensing Act or of any standard
158158 or rule promulgated pursuant thereto, the Departm ent shall:
159159 a. document the complaint,
160160 b. provide the complaint allegations in writing to the
161161 facility involved and, upon written requ est by the

213213 child care facility, provide a summary o f the facts
214214 used to evaluate the completed complaint, and
215215 c. document the facility’s plan for correcting any
216216 substantiated violations.
217217 2. If the Department determines there has been a violation and
218218 the violation has a direct impact on the health, safety o r well-
219219 being of one or more of the children cared for by the facility, t he
220220 Department shall notify the facility and require correction of the
221221 violation.
222222 3. The Department shall notify the facility that fa ilure to
223223 correct the confirmed violation can result in the revocation of the
224224 license, the denial of an application for a li cense, the issuance of
225225 an emergency order or the filing of an injunction pursuant to the
226226 provisions of Section 409 of this title.
227227 4. If the facility refuses to correct a violation or fails to
228228 complete the plan of correction, the Department may issue an
229229 emergency order, revoke the license, or deny the application for a
230230 license. Nothing in this section or Section 407 of this title shall
231231 be construed as preventing the Department from den ying an
232232 application, revoking a license, or issuing an emergency order f or a
233233 single violation of this act, or the rules of the Department as
234234 provided in Section 404 of this title.
235235 D. Upon the completion o f the investigation of a complaint
236236 against any child care facility alleging a violation of the

288288 provisions of the Oklahoma C hild Care Facilities Licensing Act or
289289 any licensing standard promulgated thereto by the Department, the
290290 Department shall clearly desi gnate its findings on the first page of
291291 the report of the investigation. The findings shall state whether
292292 the complaint was substantiated or unsubstantiated . The findings
293293 shall identify the employee who is the subject of the complaint , but
294294 shall not identify the licensee of the child care facility unless
295295 the licensee was the su bject of the complaint or unless otherwise
296296 deemed appropriate by the Department .
297297 E. Information obtained by the Department or Oklahoma Child
298298 Care Services concerning a report of a violation of a licensing
299299 requirement, or from any l icensee regarding children or their
300300 parents or other relatives shall be deemed confidential and
301301 privileged communications, shall be properly safeguarded, and shall
302302 not be accessible to anyone except as her ein provided, unless upon
303303 order of a court of compe tent jurisdiction. Provided, however, this
304304 provision shall not prohibit the Department from providing a summary
305305 of allegations and findings of an investigation involving a child
306306 care facility that does no t disclose identities but that permits
307307 parents to evaluate the facility.
308308 F. The Department shall promulgate rules to estab lish and
309309 maintain a grievance process that shall include an anonymous
310310 complaint system for reporting and investigating complaints or
