75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 10 O.S. 2011, Section 406, as last
77	77	amended by Section 1, Chapter 368, O.S.L. 2019 (10 O.S. Supp. 2020,
78	78	Section 406), is amended to read as follows:
79	79	Section 406. A. 1. Except as provided in pa ragraph 2 of this
80	80	subsection, the Department of Hum an Services shall have authority at
81	81	any reasonable time to investigate a nd examine the conditions of any
82	82	child care facility in which a licensee or applicant hereunder
83	83	receives and maintains children, and shall have authority at any
84	84	time to require the fac ility to provide information pertaining to
85	85	children in its care.
86	86	2. When the Department of Human Services is reviewing the star
87	87	rating of a child care program with a capacity of fifty or more, the

139	139	comprehensive visit to inspect and examine the program sha ll be
140	140	scheduled with the administration of the program at least one (1)
141	141	week in advance of the visit, if requested by the child care
142	142	facility.
143	143	B. 1. The State Department of Health may visit any licensee or
144	144	applicant at the request of the Department to ad vise on matters
145	145	affecting the health of children and to inspect the sani tation of
146	146	the buildings used for their care.
147	147	2. The State Fire Marshal may visit any licensee or applicant
148	148	at the request of the Dep artment to advise on matters affecting the
149	149	safety of children and to inspect the condition of the buildings
150	150	used for their care.
151	151	C. 1. Upon receipt of a complaint against any child care
152	152	facility alleging a violation of the provisions of the Oklahoma
153	153	Child Care Facilities Licensing Act, or any licensing s tandard
154	154	promulgated by the Department, the Department shall conduct a fu ll
155	155	investigation. If upon investigation, it is determined that there
156	156	are reasonable grounds to believe that a facility is in violati on of
157	157	the Oklahoma Child Care Facilities Licensing Act or of any standard
158	158	or rule promulgated pursuant thereto, the Departm ent shall:
159	159	a. document the complaint,
160	160	b. provide the complaint allegations in writing to the
161	161	facility involved and, upon written requ est by the

213	213	child care facility, provide a summary o f the facts
214	214	used to evaluate the completed complaint, and
215	215	c. document the facility’s plan for correcting any
216	216	substantiated violations.
217	217	2. If the Department determines there has been a violation and
218	218	the violation has a direct impact on the health, safety o r well-
219	219	being of one or more of the children cared for by the facility, t he
220	220	Department shall notify the facility and require correction of the
221	221	violation.
222	222	3. The Department shall notify the facility that fa ilure to
223	223	correct the confirmed violation can result in the revocation of the
224	224	license, the denial of an application for a li cense, the issuance of
225	225	an emergency order or the filing of an injunction pursuant to the
226	226	provisions of Section 409 of this title.
227	227	4. If the facility refuses to correct a violation or fails to
228	228	complete the plan of correction, the Department may issue an
229	229	emergency order, revoke the license, or deny the application for a
230	230	license. Nothing in this section or Section 407 of this title shall
231	231	be construed as preventing the Department from den ying an
232	232	application, revoking a license, or issuing an emergency order f or a
233	233	single violation of this act, or the rules of the Department as
234	234	provided in Section 404 of this title.
235	235	D. Upon the completion o f the investigation of a complaint
236	236	against any child care facility alleging a violation of the

288	288	provisions of the Oklahoma C hild Care Facilities Licensing Act or
289	289	any licensing standard promulgated thereto by the Department, the
290	290	Department shall clearly desi gnate its findings on the first page of
291	291	the report of the investigation. The findings shall state whether
292	292	the complaint was substantiated or unsubstantiated . The findings
293	293	shall identify the employee who is the subject of the complaint , but
294	294	shall not identify the licensee of the child care facility unless
295	295	the licensee was the su bject of the complaint or unless otherwise
296	296	deemed appropriate by the Department .
297	297	E. Information obtained by the Department or Oklahoma Child
298	298	Care Services concerning a report of a violation of a licensing
299	299	requirement, or from any l icensee regarding children or their
300	300	parents or other relatives shall be deemed confidential and
301	301	privileged communications, shall be properly safeguarded, and shall
302	302	not be accessible to anyone except as her ein provided, unless upon
303	303	order of a court of compe tent jurisdiction. Provided, however, this
304	304	provision shall not prohibit the Department from providing a summary
305	305	of allegations and findings of an investigation involving a child
306	306	care facility that does no t disclose identities but that permits
307	307	parents to evaluate the facility.
308	308	F. The Department shall promulgate rules to estab lish and
309	309	maintain a grievance process that shall include an anonymous
310	310	complaint system for reporting and investigating complaints or
