5548 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
5649 SECTION 1. AMENDATORY 68 O.S. 2011, Section 2357.301, as
5750 amended by Section 1, Chapter 30, O.S.L. 2014 (68 O.S. Supp. 2020,
5851 Section 2357.301), is amended to read as follows:
5952 Section 2357.301. As used in Sections 2357.301 th rough 2357.304
6053 of this title:
6154 1. “Aerospace sector” means a private or public organization
6255 engaged in the manufacture of aerospace or defense hardware or
6356 software, aerospace maintenance, space maintenance, aerospace repair
6457 and overhaul, supply of parts to the aerospace industry, provision
6558 of services and support relating to the aerospace industry, research
59+and development of aerospace and space technology and systems, and
60+the education and training of aerospace and space personnel.
61+Aerospace sector shall include but not be limited to those aerospace

93-and development of aerospace and space technology and systems, and
94-the education and training of aerospace and space personnel.
95-Aerospace sector shall include but not be limited to those aerospace
9688 product and parts manufacturing activities defined or classified in
9789 the North American Industry Classification System (NAICS) Manual
9890 under U.S. Industry Group No. 3364 ;
9991 2. “Compensation” means payments in the form of contract labor
10092 for which the payor is required to provide a Form 1099 to the person
10193 paid, wages subject to withholding tax paid to a part -time employee
10294 or full-time employee, or salary or other remuneration.
10395 Compensation shall not include employer -provided retirement, medical
10496 or health-care benefits, reimbursement for travel, meals, lodging or
10597 any other expense;
10698 3. “Institution” means an institution within The Oklahoma State
10799 System of Higher Education or any o ther public or private college or
108100 university that is accredited by a nation al accrediting body;
109101 4. “Qualified employer” means a sole proprietor , general
110102 partnership, limited partnership, limited liability company,
111103 corporation, other legally recognized bus iness entity, or public
112104 entity whose principal business activity involves t he aerospace
113105 sector;
114106 5. “Qualified employee” means any person, regar dless of the
115107 date of hire, employed in this state by or contracting in this state
116108 with a qualified employer on o r after January 1, 2009, who has been
109+awarded an undergraduate or graduate degree from a qualified program
110+by an institution, and who was not em ployed in the aerospace sector
111+in this state immediately preceding employment or contracting with a

144-awarded an undergraduate or graduate degree from a qualified program
145-by an institution, and who was not employed in the aerospace sector
146-in this state immediately preceding employment or contracting with a
147138 qualified employer. Provided, the definition shal l not be
148139 interpreted to exclude any p erson who was employed in the aerospace
149140 sector, but not as a full -time engineer, prior to being awarded an
150141 undergraduate or graduate degree from a qualified program by an
151142 institution or any person who has been awarded a n undergraduate or
152143 graduate degree from a qualified program by an institution and is
153144 employed by a profess ional staffing company and assigned to work in
154145 the aerospace sector in this state;
155146 6. “Qualified program” means a program that has been accredited
156147 by the Engineering Accreditation Commis sion of the Accreditation
157148 Board for Engineering and Technology (ABET) and that awards an
158149 undergraduate or graduate degree; and
159150 7. “Tuition” means the average annual amount paid by a
160151 qualified employee for enrollment an d instruction in a qualified
161152 program. Tuition shall not include the cost of books, fees or room
162153 and board.
163154 SECTION 2. This act shall become effective November 1, 2021.
