77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 26 O.S. 2011, Section 3 -101, as
79	79	last amended by Section 1, Chapter 110, O.S.L. 2018 (26 O.S. Supp.
80	80	2020, Section 3-101), is amended to read as follows:
81	81	Section 3-101. A. No election required to be conducted by an y
82	82	county election board shall be scheduled for a day other than
83	83	Tuesday.
84	84	B. Except as otherwise provided by law, no regular or special
85	85	election to fill an elective of fice shall be held by any county,
86	86	school district, technology center school district, mun icipality,
87	87	fire protection district or other political subdivision authorized
88	88	to call elections except as follows:

156	156	1. The second Tuesday of January, Februa ry, May, June, July,
157	157	August, September, October and November and the first Tues day in
158	158	March and April in odd -numbered years; provided, a municipality with
159	159	a population in excess of two hundred fifty thousa nd (250,000)
160	160	persons, according to the most recent federal decennial census, may
161	161	also hold an election on the second Tuesday of De cember in odd-
162	162	numbered years; and

218	218	D. In the event that a regular or special election date occurs
219	219	on an official state holiday, the election shall be schedu led for
220	220	the next following Tuesday. In the event t hat any day of a
221	221	candidate filing period occurs on a Saturday, Sunday or any of ficial
222	222	state holiday, that day of the filing period shall be scheduled for
223	223	the next business day.
224	224	E. Notwithstanding any othe r provision of law or any provision
225	225	of a municipal charter, any municipality, school district,
226	226	technology center district, county, rural fire protection district,
227	227	or any other entity seeking to hold a regular or specia l election to
228	228	be conducted by a county election board on the same date as a
229	229	regular or special federal or state election, shall file the
230	230	resolution calling for the elec tion with the county election board
231	231	secretary no later than seventy -five (75) days prior to the election
232	232	date. A candidate fi ling period of three (3) days, if so required
233	233	by the resolution, shall begin no later than ten (10) days following
234	234	the deadline to file the resolution with the secretary of the county
235	235	election board; provided, the fili ng period for such municipal
236	236	office may be scheduled on the same dates as the filing peri od for
237	237	state or federal office to be filled at such election.
