8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF O KLAHOMA:
8282 SECTION 1. NEW LAW A new section of law not to be
8383 codified in the Oklahoma Statutes reads as follows:
8484 This act shall be known and may be cited as the “Election
8585 Integrity Act of 2021”.
8686 SECTION 2. AMENDATORY 26 O.S. 2011, Section 21 -102, is
8787 amended to read as follows:
8888 Section 21-102. A. The Secretary of the State Election Board
8989 is authorized to adopt procedures and take any other actions

142142 interest in computer progr ams and software, training materials,
143143 publications and any other documents developed as part of a unitary,
144144 unified, integrated system of election administration for the State
145145 of Oklahoma.
146146 B. Beginning July 1, 2021, the Secretar y of the State Election
147147 Board shall take an inventory of all current vendors contracted or
148148 utilized by the state for the administration of elections pursuant
149149 to subsection A of this section. The inventory list shall be used
150150 to comply with the provisions o f subsection C of this secti on.
151151 C. All computer programs and software used for election
152152 administration of this state shall be open source and provided by
153153 private companies and not publicly held companies. No elected
154154 official or candidate for any office, nor any person related within
155155 a third degree of consanguinity, shall have any interest, financial
156156 or otherwise, in any company, entity or product used for the
157157 administration of elections. Any person who is the owner of a
158158 product, software, company or othe r entity that contracts or
159159 provides any service to this state for the administration of
160160 elections shall be a United States citizen whose ownership stake is
161161 fifty-one percent (51%) or greater .
162162 No computer, product or software may be used or contracted for
163163 which allows data related to a person ’s vote to be counted,
164164 tabulated or processed in any way outside of the state in which the
165165 vote was cast.

217217 Any existing contract for a product or service shall continue
218218 until expiration, unless the state may cancel withou t penalty. Any
219219 new contract or use for a product or service shall comply with the
220220 provisions of this section.
221221 SECTION 3. This act shall become effective July 1, 2021.
222222 SECTION 4. It being immediately necessary for the pres ervation
223223 of the public peace, health or s afety, an emergency is hereby
224224 declared to exist, by reason whereof this act shall take effect and
225225 be in full force from and after its passage and approval.
