81	81	BE IT ENACTED BY THE PEOPLE OF THE STATE OF O KLAHOMA:
82	82	SECTION 1. NEW LAW A new section of law not to be
83	83	codified in the Oklahoma Statutes reads as follows:
84	84	This act shall be known and may be cited as the “Election
85	85	Integrity Act of 2021”.
86	86	SECTION 2. AMENDATORY 26 O.S. 2011, Section 21 -102, is
87	87	amended to read as follows:
88	88	Section 21-102. A. The Secretary of the State Election Board
89	89	is authorized to adopt procedures and take any other actions
90	90	consistent with existing law to protect the state ’s proprietary

142	142	interest in computer progr ams and software, training materials,
143	143	publications and any other documents developed as part of a unitary,
144	144	unified, integrated system of election administration for the State
145	145	of Oklahoma.
146	146	B. Beginning July 1, 2021, the Secretar y of the State Election
147	147	Board shall take an inventory of all current vendors contracted or
148	148	utilized by the state for the administration of elections pursuant
149	149	to subsection A of this section. The inventory list shall be used
150	150	to comply with the provisions o f subsection C of this secti on.
151	151	C. All computer programs and software used for election
152	152	administration of this state shall be open source and provided by
153	153	private companies and not publicly held companies. No elected
154	154	official or candidate for any office, nor any person related within
155	155	a third degree of consanguinity, shall have any interest, financial
156	156	or otherwise, in any company, entity or product used for the
157	157	administration of elections. Any person who is the owner of a
158	158	product, software, company or othe r entity that contracts or
159	159	provides any service to this state for the administration of
160	160	elections shall be a United States citizen whose ownership stake is
161	161	fifty-one percent (51%) or greater .
162	162	No computer, product or software may be used or contracted for
163	163	which allows data related to a person ’s vote to be counted,
164	164	tabulated or processed in any way outside of the state in which the
165	165	vote was cast.

217	217	Any existing contract for a product or service shall continue
218	218	until expiration, unless the state may cancel withou t penalty. Any
219	219	new contract or use for a product or service shall comply with the
220	220	provisions of this section.
221	221	SECTION 3. This act shall become effective July 1, 2021.
222	222	SECTION 4. It being immediately necessary for the pres ervation
223	223	of the public peace, health or s afety, an emergency is hereby
224	224	declared to exist, by reason whereof this act shall take effect and
225	225	be in full force from and after its passage and approval.
