8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
8282 SECTION 1. AMENDATORY 21 O.S. 2011, Section 1835, is
8383 amended to read as follows:
8484 Section 1835. A. Whoever shall willfully or maliciously enter
8585 the garden, yard, pasture or fie ld of another after being exp ressly
8686 forbidden to do so or without permission by the owner or lawful
8787 occupant thereof when such property is posted shall be deemed guilty
8888 of trespass and upon conviction thereof shall be fined in any sum
8989 not to exceed Two Hun dred Fifty Dollars ($250.00); provided, that

142142 registered professional engin eers for the purpose of land surveying
143143 in the performance of their professional services; and, provided
144144 further, that anyone who willfully or malic iously enters any such
145145 garden, yard, pasture or field, and therein commits or attempts to
146146 commit waste, theft, or damage shall be deemed guilty of a
147147 misdemeanor and upon conviction thereof shall be fined in any sum
148148 not less than Fifty Dollars ($50.00) nor more than Five Hundred
149149 Dollars ($500.00), or by confinement in the county jail for not less
150150 than thirty (30) days nor more than s ix (6) months, or both such
151151 fine and imprisonment. For purposes of this section, “posted” means
152152 exhibiting signs to read as fol lows: “PROPERTY RESTRICTED”; “POSTED
153153 - KEEP OUT”; “KEEP OUT”; “NO TRESPASSING”; or similar signs which
154154 are displayed. Property that is fenced or not fenced must have such
155155 signs placed conspicuously and at all places where en try to the
156156 property is normally expected.
157157 B. No provisions of this act section shall conflict with
158158 Section 5-202 or 6-304 of Title 29 of the Oklaho ma Statutes.
159159 C. Whoever shall willfully enter the pecan grove of another
160160 without the prior consent of the o wner or occupant thereof to so do
161161 shall be deemed guilty of trespass and up on conviction thereof shall
162162 be fined in any sum not to exceed Twenty -five Dollars ($25.00);
163163 provided, that anyone who willfully enters any such pecan grove and
164164 therein commits or at tempts to commit waste, theft , or damage shall
165165 be deemed guilty of a misdem eanor and upon conviction thereof shall

220220 D. Whoever shall willfully or maliciously enter upon property
221221 owned or managed by the Grand River Dam Authority without permission
222222 when such property is posted shall be deemed guilty of mis demeanor
223223 trespass and upon conviction t hereof shall be fined in any sum not
224224 to exceed Two Hundred Fifty Dollars ($250.00); provided, that this
225225 provision shall not apply to registered land surveyors and
226226 registered professional engineers for the purpose of l and surveying
227227 in the performance of the ir professional services; and, provi ded
228228 further, that anyone who willfully or maliciously enters upon
229229 property owned or managed b y the Grand River Dam Authority without
230230 permission and therein commits or attempts to co mmit waste, theft,
231231 or damage shall be d eemed guilty of misdemeanor trespass , and upon
232232 conviction thereof shall be fined in any sum not less than Fif ty
233233 Dollars ($50.00) nor more than Five Hundred Dollars ($500.00), or by
234234 confinement in the county jail for n ot less than thirty (30) days

293293 E. Notwithstanding the provisions of this section, the
294294 Governor’s Mansion and its grounds and appurtenances s hall not be
295295 required to be posted wi th signs warning against trespass. Any
296296 person who shall willfully or mal iciously enter the g rounds of the
297297 Governor’s Mansion within the State Capitol Park, as defined in
298298 Section 1811.4 of Title 74 of the Oklahoma Statut es, except at a
299299 place where entry to the property is normally expected shall be
300300 deemed guilty of a misdemeano r and upon convictio n shall be fined in
301301 a sum not more than Five Hundred Dollars ($500.00), or by
302302 confinement in the county jail for not less than thirty (30) days
303303 nor more than six (6) months, or by both fine and imprisonment.
304304 F. Notwithstanding the pro visions of this section, a peace
305305 officer as defined by Section 99 of this title or any government
306306 employee may only enter a garden, yard, pasture, field or other land
307307 of another that is posted in acc ordance with this section with the
308308 permission of the prope rty owner, with a search warrant authorizing
309309 search of the property , or to respond to an emergency that pres ents
310310 an immediate threat to life, property or publi c health.
311311 SECTION 2. AMENDATORY 21 O.S. 2011, Section 1835.2 , as
312312 last amended by Section 1, Chapter 185, O.S.L. 2018 (21 O.S . Supp.

365365 Section 1835.2. A. Notwithstanding the pro visions of Section
366366 1835 of this title, the foll owing provisions apply to private land
367367 that is primarily devoted to farming, ranching, or forest ry
368368 purposes:
369369 1. Except as provided in this section, whoever w illfully enters
370370 private land of another that is pri marily devoted to farmi ng,
371371 ranching, or forestry purposes without permission by the su rface
372372 owner, surface lessee, hunting lessee , or lawful occupant thereof
373373 shall be deemed guilty of trespass and, upon co nviction thereof,
374374 shall be fined in any sum not les s than Seven Hundred Fi fty Dollars
375375 ($750.00) nor more than Two Thousand Dollars ($2,00 0.00), and in
376376 addition, the court shall order restitution for actual damages
377377 incurred. Persons convicted of a second o r subsequent offense under
378378 this paragraph shall be guilty of a misdemeanor and shall be
379379 punished by a fine in any sum not less than One T housand Five
380380 Hundred Dollars ($1,500.00) nor more than Tw o Thousand Five Hundred
381381 Dollars ($2,500.00), or by confinement in the county jail for not
382382 less than thirty (30) d ays nor more than six ( 6) months, or by both
383383 such fine and imprisonment, and in additi on, the court shall order
384384 restitution for actual damages incurred;
385385 2. The provisions of paragraph 1 of this subsection shall not
386386 apply to peace officers as defined in Se ction 99 of this title or
387387 any federal, state, o r local government employees engaged in the
388388 performance of their duties, or except that peace officers or

440440 government employees may only enter private land wit h the permission
441441 of the property owner or wi th a search warrant authorizin g the
442442 search of the property. The provisions of paragraph 1 of this
443443 subsection shall not apply to any firefighters, emergency medical
444444 personnel, or public utility employees engaged in addressing an
445445 emergency that presents an imminen t danger to health, saf ety, or the
446446 environment in the performance of their duties, or to parties
447447 engaged in oil and gas operations, which s hall include, without
448448 limitation, exploration, drilling, productio n and sales activities,
449449 under authority of mineral ownership, an oil and g as lease, seismic
450450 agreement or permit, gas gathering, purchase, transportation, or
451451 treating contracts, Corporation C ommission order, or other lawful
452452 authority from persons entitled t o give the same. The provisions of
453453 paragraph 1 of this subsection shall n ot prohibit railroad emp loyees
454454 and emergency equipment from ent ering such land to restore rail
455455 service following an accident, derailment or natural disaster; nor
456456 the entrance of util ity employees or contractors while acting in the
457457 scope of their employment ; nor employees or contr actors of valid
458458 easement or license hol ders while acting in the scope of their
459459 employment;
460460 3. The following persons may enter such land of another unless
461461 forbidden to do so, either orally or in writing, by th e owner or
462462 lawful occupier thereof: registered land surveyors and registered
463463 professional engineers for the purpose of land surveying in th e

516516 delivery, selling a product or service, conducting a s urvey or poll,
517517 working on behalf of a candidate for political office, or who
518518 otherwise have a legitimate reason for entering and who, immed iately
519519 upon entering, seek to conduct such business; and
520520 4. Anyone who willfully or maliciously enters any such land of
521521 another and therein commits or attempts to commit waste, theft, or
522522 damage shall be deemed guilty of a misdemeanor and, upon conviction
523523 thereof, shall be fined not less than One Thousand Dollars
524524 ($1,000.00), or by confinement in the county jail for not less than
525525 thirty (30) days nor more than six (6 ) months, or by both such fine
526526 and imprisonment, and in addition, the court shall order rest itution
527527 for actual damages incurred. Persons convicted of a secon d or
528528 subsequent offense under this paragraph shall be guilty of a
529529 misdemeanor and shall be punishe d by a fine of not less than Two
530530 Thousand Five Hundred Dollars ($2,500.00), or by confinemen t in the
531531 county jail for not less than thirty (30) days nor more t han six (6)
532532 months, or by both such fine and impris onment, and in addition , the
533533 court shall order restitution for actual damages.
534534 B. This section shall not be construed to prohibit acts tha t
535535 are permitted pursuant to Section 5 -202 or 6-304 of Title 29 of the
536536 Oklahoma Statutes.
537537 C. 1. It shall be an affir mative defense to prose cution under
538538 paragraph 1 of subsection A of this section that t he accused had

590590 express or implied permission or legal authority to be on the
591591 property.
592592 2. If an accused reasonably bel ieved he or she was upon
593593 property for which they ha d permission to be upon , it shall be an
594594 affirmative defense to prosecution under parag raph 1 of subsection A
595595 of this section that the accus ed had with him or her, on his or her
596596 person, written permission f rom the surface owner, surface lessee,
597597 hunting lessee, or lawful occupant to be upon such person ’s land
598598 while the accused was upon any ad joining property. This defense
599599 shall not be availabl e to the accused if:
600600 a. the accused has previously pled guilty, no lo
601601 contendere, or has been convicted of any act of
602602 trespass or has been fo und civilly liable of an y act
603603 of trespass, or
604604 b. the accused, while the accused was upon the adjoining
605605 property, does not have with him or her, on his or her
606606 person, the written perm ission specified in this
607607 paragraph.
608608 SECTION 3. AMENDATORY 22 O.S. 2011, Section 1221, as
609609 amended by Section 1, Chapter 75, O.S.L. 2014 (22 O.S. Supp. 2020,
610610 Section 1221), is amended to read as follows:
611611 Section 1221. A. A search warrant is an order i n writing, in
612612 the name of the state, signed by a magistrate, directed to a pe ace

665665 before the magistrate.
666666 B. For purposes of Sections 1221 through 1241 of this title,
667667 the term “personal property” or “property” shall mean items and
668668 information that can be analyzed, seen, weighed, measured, felt or
669669 touched or that are in any oth er manner perceptible to the senses ,
670670 and that are privately owned . Property includes private l and, which
671671 shall mean land that is used or occupied , or fenced, posted with
672672 signs to prevent trespassing at places where entry to the property
673673 is normally expected, or conspicuously marked a s private.
674674 SECTION 4. This act shall become effec tive November 1, 2021.
