77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 51 O.S. 2011, Section 24A.5, as
79	79	last amended by Section 1, Chapter 202, O.S.L. 2017 (51 O.S. Supp.
80	80	2020, Section 24A.5), is amended to read as follows:
81	81	Section 24A.5. All records of public bodies and public
82	82	officials shall be open to any person for inspection, copy ing, or
83	83	mechanical reproduction during regular business hours; provid ed:
84	84	1. The Oklahoma Open Records Act, Sections 24A.1 th rough 24A.30
85	85	of this title, does not apply to recor ds specifically required by
86	86	law to be kept confidential including:
87	87	a. records protected by a state evidentiary privilege
88	88	such as the attorney -client privilege, the work

143	143	body lawfully closed to the public s uch as executive
144	144	sessions authorized under the Oklahoma Open Meeting

146	146	c. personal information within driver records as de fined
147	147	by the Driver’s Privacy Protection Act, 18 Un ited
148	148	States Code, Sections 2721 through 2725,
149	149	d. information in the files of the Board of Medicolegal
150	150	Investigations obtained pursuant to Sections 94 0 and
151	151	941 of Title 63 of the Oklahoma Statutes that may be
152	152	hearsay, preliminary unsubstantiated investigati on-
153	153	related findings, or confidential medical information,
154	154	or
155	155	e. any test forms, question banks and answer keys
156	156	developed for state licensure examinat ions, but
157	157	specifically excluding test preparation materi als or
158	158	study guides;
159	159	2. All Social Security number s included in a record may be
160	160	confidential regardless of the person ’s status as a public employee
161	161	or private individual and may be redacted or delete d prior to
162	162	release of the record by the public body;

214	214	3. Any reasonably segregable portion of a record cont aining
215	215	exempt material shall be provided after deletion of the exempt
216	216	portions; provided, however, the Department of Public Safety shall
217	217	not be required to assemble for the requesting person specific
218	218	information, in any format, from driving records relatin g to any
219	219	person whose name and date of birth or whose driver license number
220	220	is not furnished by the requesting person.
221	221	The Oklahoma State Bureau of In vestigation shall not be required
222	222	to assemble for the r equesting person any criminal history records
223	223	relating to persons whose names, dates of birth, and other
224	224	identifying information req uired by the Oklahoma State Bureau of
225	225	Investigation pursuant to admin istrative rule are not furnished by
226	226	the requesting person;
227	227	4. Any With respect to a request for a record which contains
228	228	individual records of persons, and the cost of copying, reproducin g
229	229	or certifying each individual record is otherwise prescribed by
230	230	state law, the cost m ay be assessed for each individual re cord, or
231	231	portion thereof requested as prescribed by state law. Otherwise, a
232	232	public body may charge a fee only for recovery of the r easonable,
233	233	direct costs of record copying, or mechanical reproduction ;
234	234	5. With respect to a request to a law enforcement ag ency for a
235	235	photograph or other per sonal identifying information obtained during
236	236	the course of an arrest, each record shall be consid ered an

288	288	individual record with costs assessed by the law enforcement agency
289	289	in the amounts set forth in paragraph 6 of this section;
290	290	6. Notwithstanding any state or local pro vision to the
291	291	contrary, in no instance shall the record copying fee exceed twenty -
292	292	five cents ($0.25) per page for records having the dimensions of
293	293	eight and one-half (8 1/2) by fourteen (14) inches or smal ler, or a
294	294	maximum of One Dollar ($1.00) per copied page for a certified copy.
295	295	However, if the request:
296	296	a. is solely for commercial purpose, or
297	297	b. would clearly cause excessive disruption of the
298	298	essential functions of the public body,
299	299	then the public body may charge a reasonable fee to recover the
300	300	direct cost of record search and copying; however, publication in a
301	301	newspaper or broadcas t by news media for news purposes shall not
302	302	constitute a resale or use of a record for trade or commercial
303	303	purpose and charges for providing copies of e lectronic data to the
304	304	news media for a news purpose shall not exceed the direct cost of
305	305	making the copy. The fee charged by the Department of Public Safety
306	306	for a copy in a computerized format of a record of the Department
307	307	shall not exceed the direct cost of making the copy unle ss the fee
308	308	for the record is otherwise set by law.
309	309	Any public body establishing f ees under this act shall post a
310	310	written schedule of the fees at its principal office and with the
311	311	county clerk.

363	363	In no case shall a search fee be charged when the release of
364	364	records is in the public interest , including, but not limited to,
365	365	release to the news media, scholars, authors and taxpayers seeking
366	366	to determine whether those entrusted with the affairs of the
367	367	government are honestly, faithfully , and competently performing
368	368	their duties as public servants.
369	369	The fees shall not be used for the purpose of di scouraging
370	370	requests for information or as obstacles to disclosure of requested
371	371	information;
372	372	5. 7. The land description trac t index of all recorded
373	373	instruments concerning real property required to be kept by the
374	374	county clerk of any county shall be available for inspection or
375	375	copying in accordance with the provisions of the Oklahoma Open
376	376	Records Act; provided, however, the index shall not be copied or
377	377	mechanically reproduced for the purpose of sale of the information;
378	378	6. 8. A public body must provide prompt, reasonable access to
379	379	its records but may establish reasonable procedures which protect
380	380	the integrity and organization of i ts records and to prevent
381	381	excessive disruptions of its essential functions. A delay in
382	382	providing access to records shall be limited s olely to the time
383	383	required for preparing the requested documents and the avoidance of
384	384	excessive disruptions of the public body’s essential functions. In
385	385	no event may production of a current request for records be
386	386	unreasonably delayed until after completio n of a prior records

439	439	request. Any public body which makes th e requested records
440	440	available on the Internet shall meet the obligation of providing
441	441	prompt, reasonable access to its records as requi red by this
442	442	paragraph; and
443	443	7. 9. A public body shall designate certain persons who are
444	444	authorized to release records of t he public body for inspection,
445	445	copying, or mechanical reproduction. At least one person shall be
446	446	available at all times to release rec ords during the regular
447	447	business hours of the public body.
448	448	SECTION 2. This act shall become effective No vember 1, 2021.
