228 | 228 | | individual records of persons, and the cost of copying, reproducin g |
---|
229 | 229 | | or certifying each individual record is otherwise prescribed by |
---|
230 | 230 | | state law, the cost m ay be assessed for each individual re cord, or |
---|
231 | 231 | | portion thereof requested as prescribed by state law. Otherwise, a |
---|
232 | 232 | | public body may charge a fee only for recovery of the r easonable, |
---|
233 | 233 | | direct costs of record copying, or mechanical reproduction ; |
---|
234 | 234 | | 5. With respect to a request to a law enforcement ag ency for a |
---|
235 | 235 | | photograph or other per sonal identifying information obtained during |
---|
236 | 236 | | the course of an arrest, each record shall be consid ered an |

291 | 291 | | contrary, in no instance shall the record copying fee exceed twenty - |

292 | 292 | | five cents ($0.25) per page for records having the dimensions of |
---|
293 | 293 | | eight and one-half (8 1/2) by fourteen (14) inches or smal ler, or a |
---|
294 | 294 | | maximum of One Dollar ($1.00) per copied page for a certified copy. |
---|
295 | 295 | | However, if the request: |
---|
296 | 296 | | a. is solely for commercial purpose, or |
---|
297 | 297 | | b. would clearly cause excessive disruption of the |
---|
298 | 298 | | essential functions of the public body, |
---|
299 | 299 | | then the public body may charge a reasonable fee to recover the |
---|
300 | 300 | | direct cost of record search and copying; however, publication in a |
---|
301 | 301 | | newspaper or broadcas t by news media for news purposes shall not |
---|
302 | 302 | | constitute a resale or use of a record for trade or commercial |
---|
303 | 303 | | purpose and charges for providing copies of e lectronic data to the |
---|
304 | 304 | | news media for a news purpose shall not exceed the direct cost of |
---|
305 | 305 | | making the copy. The fee charged by the Department of Public Safety |
---|
306 | 306 | | for a copy in a computerized format of a record of the Department |
---|
307 | 307 | | shall not exceed the direct cost of making the copy unle ss the fee |
---|
308 | 308 | | for the record is otherwise set by law. |
---|
309 | 309 | | Any public body establishing f ees under this act shall post a |
---|
310 | 310 | | written schedule of the fees at its principal office and with the |
---|
311 | 311 | | county clerk. |

369 | 369 | | The fees shall not be used for the purpose of di scouraging |

370 | 370 | | requests for information or as obstacles to disclosure of requested |

371 | 371 | | information; |
---|
372 | 372 | | 5. 7. The land description trac t index of all recorded |
---|
373 | 373 | | instruments concerning real property required to be kept by the |
---|
374 | 374 | | county clerk of any county shall be available for inspection or |
---|
375 | 375 | | copying in accordance with the provisions of the Oklahoma Open |
---|
376 | 376 | | Records Act; provided, however, the index shall not be copied or |
---|
377 | 377 | | mechanically reproduced for the purpose of sale of the information; |
---|
378 | 378 | | 6. 8. A public body must provide prompt, reasonable access to |
---|
379 | 379 | | its records but may establish reasonable procedures which protect |
---|
380 | 380 | | the integrity and organization of i ts records and to prevent |
---|
381 | 381 | | excessive disruptions of its essential functions. A delay in |
---|
382 | 382 | | providing access to records shall be limited s olely to the time |
---|
383 | 383 | | required for preparing the requested documents and the avoidance of |
---|
384 | 384 | | excessive disruptions of the public body’s essential functions. In |
---|
385 | 385 | | no event may production of a current request for records be |
---|
386 | 386 | | unreasonably delayed until after completio n of a prior records |
---|

443 | 443 | | 7. 9. A public body shall designate certain persons who are |

444 | 444 | | authorized to release records of t he public body for inspection, |
---|
445 | 445 | | copying, or mechanical reproduction. At least one person shall be |
---|
446 | 446 | | available at all times to release rec ords during the regular |
---|
447 | 447 | | business hours of the public body. |
---|
448 | 448 | | SECTION 2. This act shall become effective No vember 1, 2021. |
