7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 51 O.S. 2011, Section 24A.5, as
7979 last amended by Section 1, Chapter 202, O.S.L. 2017 (51 O.S. Supp.
8080 2020, Section 24A.5), is amended to read as follows:
8181 Section 24A.5. All records of public bodies and public
8282 officials shall be open to any person for inspection, copy ing, or
8383 mechanical reproduction during regular business hours; provid ed:
8484 1. The Oklahoma Open Records Act, Sections 24A.1 th rough 24A.30
8585 of this title, does not apply to recor ds specifically required by
8686 law to be kept confidential including:
8787 a. records protected by a state evidentiary privilege
8888 such as the attorney -client privilege, the work

142142 b. records of what transpired during meetings of a public
143143 body lawfully closed to the public s uch as executive
144144 sessions authorized under the Oklahoma Open Meeting
145145 Act,
146146 c. personal information within driver records as de fined
147147 by the Driver’s Privacy Protection Act, 18 Un ited
148148 States Code, Sections 2721 through 2725,
149149 d. information in the files of the Board of Medicolegal
150150 Investigations obtained pursuant to Sections 94 0 and
151151 941 of Title 63 of the Oklahoma Statutes that may be
152152 hearsay, preliminary unsubstantiated investigati on-
153153 related findings, or confidential medical information,
154154 or
155155 e. any test forms, question banks and answer keys
156156 developed for state licensure examinat ions, but
157157 specifically excluding test preparation materi als or
158158 study guides;
159159 2. All Social Security number s included in a record may be
160160 confidential regardless of the person ’s status as a public employee
161161 or private individual and may be redacted or delete d prior to
162162 release of the record by the public body;

214214 3. Any reasonably segregable portion of a record cont aining
215215 exempt material shall be provided after deletion of the exempt
216216 portions; provided, however, the Department of Public Safety shall
217217 not be required to assemble for the requesting person specific
218218 information, in any format, from driving records relatin g to any
219219 person whose name and date of birth or whose driver license number
220220 is not furnished by the requesting person.
221221 The Oklahoma State Bureau of In vestigation shall not be required
222222 to assemble for the r equesting person any criminal history records
223223 relating to persons whose names, dates of birth, and other
224224 identifying information req uired by the Oklahoma State Bureau of
225225 Investigation pursuant to admin istrative rule are not furnished by
226226 the requesting person;
227227 4. Any With respect to a request for a record which contains
228228 individual records of persons, and the cost of copying, reproducin g
229229 or certifying each individual record is otherwise prescribed by
230230 state law, the cost m ay be assessed for each individual re cord, or
231231 portion thereof requested as prescribed by state law. Otherwise, a
232232 public body may charge a fee only for recovery of the r easonable,
233233 direct costs of record copying, or mechanical reproduction ;
234234 5. With respect to a request to a law enforcement ag ency for a
235235 photograph or other per sonal identifying information obtained during
236236 the course of an arrest, each record shall be consid ered an

288288 individual record with costs assessed by the law enforcement agency
289289 in the amounts set forth in paragraph 6 of this section;
290290 6. Notwithstanding any state or local pro vision to the
291291 contrary, in no instance shall the record copying fee exceed twenty -
292292 five cents ($0.25) per page for records having the dimensions of
293293 eight and one-half (8 1/2) by fourteen (14) inches or smal ler, or a
294294 maximum of One Dollar ($1.00) per copied page for a certified copy.
295295 However, if the request:
296296 a. is solely for commercial purpose, or
297297 b. would clearly cause excessive disruption of the
298298 essential functions of the public body,
299299 then the public body may charge a reasonable fee to recover the
300300 direct cost of record search and copying; however, publication in a
301301 newspaper or broadcas t by news media for news purposes shall not
302302 constitute a resale or use of a record for trade or commercial
303303 purpose and charges for providing copies of e lectronic data to the
304304 news media for a news purpose shall not exceed the direct cost of
305305 making the copy. The fee charged by the Department of Public Safety
306306 for a copy in a computerized format of a record of the Department
307307 shall not exceed the direct cost of making the copy unle ss the fee
308308 for the record is otherwise set by law.
309309 Any public body establishing f ees under this act shall post a
310310 written schedule of the fees at its principal office and with the
311311 county clerk.

363363 In no case shall a search fee be charged when the release of
364364 records is in the public interest , including, but not limited to,
365365 release to the news media, scholars, authors and taxpayers seeking
366366 to determine whether those entrusted with the affairs of the
367367 government are honestly, faithfully , and competently performing
368368 their duties as public servants.
369369 The fees shall not be used for the purpose of di scouraging
370370 requests for information or as obstacles to disclosure of requested
371371 information;
372372 5. 7. The land description trac t index of all recorded
373373 instruments concerning real property required to be kept by the
374374 county clerk of any county shall be available for inspection or
375375 copying in accordance with the provisions of the Oklahoma Open
376376 Records Act; provided, however, the index shall not be copied or
377377 mechanically reproduced for the purpose of sale of the information;
378378 6. 8. A public body must provide prompt, reasonable access to
379379 its records but may establish reasonable procedures which protect
380380 the integrity and organization of i ts records and to prevent
381381 excessive disruptions of its essential functions. A delay in
382382 providing access to records shall be limited s olely to the time
383383 required for preparing the requested documents and the avoidance of
384384 excessive disruptions of the public body’s essential functions. In
385385 no event may production of a current request for records be
386386 unreasonably delayed until after completio n of a prior records

438438 request that will take substantially longer than the current
439439 request. Any public body which makes th e requested records
440440 available on the Internet shall meet the obligation of providing
441441 prompt, reasonable access to its records as requi red by this
442442 paragraph; and
443443 7. 9. A public body shall designate certain persons who are
444444 authorized to release records of t he public body for inspection,
445445 copying, or mechanical reproduction. At least one person shall be
446446 available at all times to release rec ords during the regular
447447 business hours of the public body.
448448 SECTION 2. This act shall become effective No vember 1, 2021.
