151151 SECTION 1. AMENDATORY 62 O.S. 2011, Section 3103, as

154154 Section 3103. As used in the Oklahoma Pension Legislation
155155 Actuarial Analysis Act:
156156 1. "Amendment" means any amendment, includin g a substitute
157157 bill, made to a retirement bill by any committee of the House or
158158 Senate, any conferenc e committee of the House or Senate or by t he
159159 House or Senate;
160160 2. "RB number" means that number preceded by the letters "RB"
161161 assigned to a retirement bill by the respective staffs of the
162162 Oklahoma State Senate and the Oklahoma House of Representatives when
163163 the respective staff office prepares a ret irement bill for a member
164164 of the Legislature;
165165 3. "Legislative Actuary" means the firm or entity that enters
166166 into a contract with the Legislative Service Bureau pu rsuant to
167167 Section 452.15 of Title 74 of the Oklahom a Statutes to provide the
168168 actuarial services and other duties provided for in the Oklahoma
169169 Pension Legislation Actuarial Analysis Act;
170170 4. "Nonfiscal amendment" means an amendment to a retirement
171171 bill having a fiscal impact, which amendment does not change any
172172 factor of an actuarial investigation specified in subsection A of
173173 Section 3109 of this title;
174174 5. "Nonfiscal retirement bill " means a retirement bill:

226226 a. which does not affect the cost or funding fact ors of a
227227 retirement system, or
228228 b. which affects such factors only in a manner which does
229229 not:
230230 (1) grant a benefit increase under the retirement
231231 system affected by the bill,
232232 (2) create an actuarial accrued liability for or
233233 increase the actuarial accrued lia bility of the
234234 retirement system affected by the bil l, or
235235 (3) increase the normal cost of the retirement system
236236 affected by the bill,
237237 c. which authorizes the purchase by an acti ve member of
238238 the retirement system, at the actuarial cost for the
239239 purchase as computed pursuant to the statute in effect
240240 on the effective date of the measure allowing such
241241 purchase, of years of service for purposes of reaching
242242 a normal retirement date in t he applicable retirement
243243 system, but which cannot be used in order to compute
244244 the number of years of service for purposes of
245245 computing the retirement benefit for the member,
246246 d. which provides for the computation of a service -
247247 connected disability retiremen t benefit for members of
248248 the Oklahoma Law Enforcement Retirement System
249249 pursuant to Section 2-305 of Title 47 of the Oklahoma

301301 Statutes if the members were unable to complete twenty
302302 (20) years of service as a result of the disability,
303303 e. which requires membership in the defined benef it plan
304304 authorized by Section 901 et seq. of Title 74 of the
305305 Oklahoma Statutes for persons whose first el ected or
306306 appointed service occurs on or after November 1, 2018,
307307 if such persons had any prior service in the Oklahoma
308308 Public Employees Retirement Syste m prior to November
309309 1, 2015,
310310 f. which provides for a o ne-time increase in retirement
311311 benefits if the incr ease in retirement benefits is not
312312 a permanent increase in the gross annual retirement
313313 benefit payable to a member or benef iciary, occurs
314314 only once pursuant to a single statutory authorization
315315 and does not exceed:
316316 (1) the lesser of two percent (2%) of the gross
317317 annual retirement benefit of the member or One
318318 Thousand Dollars ($1,000.00) and requires that
319319 the benefit may only be provided if the funded
320320 ratio of the affected retirement system would not
321321 be less than sixty percent (60%) but not greater
322322 than eighty percent (80%) after the benefit
323323 increase is paid,

378378 requires that the benefit may only be provided if
379379 the funded ratio of the affected retirement
380380 system would be greater than eighty percent (80%)
381381 but not greater than one hundred percent (1 00%)
382382 after the benefit incre ase is paid,
383383 (3) the lesser of two percent (2%) of the gross
384384 annual retirement benefit of the member or O ne
385385 Thousand Four Hundred Dollars ($1,400.00) and
386386 requires that the benefit may only be provided if
387387 the funded ratio of the affected retirement
388388 system would be greater than one hundred percent
389389 (100%) after the benefit increase is paid, or
390390 (4) the greater of two percent (2%) of the gross
391391 annual retirement benefit of the volunteer
392392 firefighter or One Hundred Dollars ($100.00) for
393393 persons who retired from the Oklahoma
394394 Firefighters Pension and Retirement System a s
395395 volunteer firefighters and who did not retire
396396 from the Oklahoma Firefighters Pension and
397397 Retirement System as a paid firefighter.

449449 As used in this subparagraph, "funded ratio" means the
450450 figure derived by dividing the actuarial value of
451451 assets of the applicable retirement system by the
452452 actuarial accrued li ability of the applicable
453453 retirement system, or
454454 g. which modifies the disability pension standard for
455455 police officers who a re members of the Oklahoma P olice
456456 Pension and Retirement System as provided by Sec tion 3
457457 of this act,
458458 h. which modifies the postretir ement earnings limit
459459 pursuant to Section 17-116.10 of Title 70 of the
460460 Oklahoma Statutes, or
461461 i. which modifies the postretirement prov isions of the
462462 minimum salary schedule , pursuant to subsection F of
463463 Section 18-114.14 of Title 70 of the Oklahoma
464464 Statutes.
465465 A nonfiscal retirement bill shall include any retiremen t bill that
466466 has as its sole purpose the appropriation or distribution or
467467 redistribution of mo nies in some manner to a retirement system for
468468 purposes of reducing the unfunded liability of such system or the
469469 earmarking of a portion of the revenue from a tax to a retirement
470470 system or increasing the percentage of the revenue earmarked from a
471471 tax to a retirement system;

523523 6. "Reduction-in-cost amendment" means an amendment to a
524524 retirement bill having a fiscal impact which reduces the cost of the
525525 bill as such cost is determined by the actuarial investigation for
526526 the bill prepared pursuant to Section 3109 of this title;
527527 7. "Retirement bill" means any bill or jo int resolution
528528 introduced or any bill or joint reso lution amended by a member of
529529 the Oklahoma Legislature which creates or amends any law directly
530530 affecting a retirement system. A retirement bill sh all not mean a
531531 bill or resolution that impacts the revenu e of any state tax in
532532 which a portion of the revenu e generated from such tax is earmarked
533533 for the benefit of a retirement system;
534534 8. "Retirement bill having a fiscal impact " means any
535535 retirement bill creating or establishing a retirement system and any
536536 other retirement bill other than a nonfiscal retireme nt bill; and
537537 9. "Retirement system" means the Teachers' Retirement System of
538538 Oklahoma, the Oklahoma Public Employees Retirement System, the
539539 Uniform Retirement System for Justices and Judges, the Oklahoma
540540 Firefighters Pension and Retirement System, the Okl ahoma Police
541541 Pension and Retirement System, the Oklahom a Law Enforcement
542542 Retirement System, or a retirement system established after January
543543 1, 2006.
544544 SECTION 2. AMENDATORY 70 O.S. 2011, Section 17-116.10,
545545 as last amended by Sectio n 2, Chapter 270, O.S.L. 2017 (70 O.S.

598598 Section 17-116.10. A. Subject to the requir ements of Section
599599 6-101.2 of this title and any other appl icable requirements of law,
600600 a member with twenty-five (25) or more years of service may enter
601601 into postretirement employment with a public sch ool of Oklahoma and
602602 still receive monthly retirement benefits subject to the following
603603 limitations:
604604 1. A retired member is not eligible to be employed by the
605605 public schools of Oklahoma, in any capacity, for sixty (60) calendar
606606 days between the retiree's last day of preretirement public
607607 education employment and any postretirement public education
608608 employment. For purposes of this section, the term "last day of
609609 preretirement employment" shall mean the last day the employee is
610610 required to be physically presen t on the job to complete the terms
611611 of the employment contract or agreement. An employee on paid leave
612612 is still considered to be employed for purposes of this sec tion.
613613 Employment under any conditions during this time, volunteer services
614614 for the purpose of obtaining a paid position at a later date, or
615615 payment at a later time for services performed during th is time
616616 period shall cause the forfeiture of all retirement benefits
617617 received during the period ;
618618 2. Unless otherwise provided in paragraph 3 of this sub section,
619619 earnings from the public scho ols may not exceed one -half (1/2) of
620620 the member's final average salary used in computing retirement
621621 benefits, or the Earning s Limitation for employees allowed by the

674674 members under the age of s ixty-two (62) years, the limit on allowed
675675 earnings from the publi c schools of Oklahoma for employment for the
676676 performance of duties ordinarily performed by classified or
677677 nonclassified personnel shall be the lesser of F ifteen Thousand
678678 Dollars ($15,000.00) o r one-half (1/2) of the member 's final average
679679 salary used in computing retirement benefits unless the earnings
680680 limitation allowed by the Social Security Administration would be
681681 greater than Fifteen Thousand Dollars ($ 15,000.00). For retired
682682 members sixty-two (62) years of age or older the limit on allowed
683683 earnings from the public schools of Oklahoma for the performance of
684684 duties ordinarily performed by classified or nonclassified personnel
685685 shall be the lesser of Thirt y Thousand Dollars ($30,000.00) or one -
686686 half (1/2) of the member 's final average salary used in computin g
687687 retirement benefits. For purposes of this paragraph, the following
688688 shall apply:
689689 a. earnings shall mean "regular annual compensation " as
690690 defined in paragraph (25) of Section 17-101 of this
691691 title, and shall include any payment by a public
692692 school for services rendered by a retired member who
693693 is employed for any pu rpose whatsoever. Supplemental
694694 retirement payments paid by a former public school
695695 employer pursuant to subsection 9 of Section 17 -105 of

747747 this title or other state law shall not be considered
748748 as earnings,
749749 b. the Earnings Limitation for employees allowed by the
750750 Social Security Administration to workers between the
751751 age of sixty-two (62) years and six ty-five (65) years
752752 shall apply to retired members below the age of sixty -
753753 two (62) years,
754754 c. the limit on allowed earnings from the public schools
755755 shall be automatically adjusted effective the first
756756 day of January of each year to reflect the current
757757 Earnings Limitation for employees as determin ed from
758758 time to time by the Social Security Administration,
759759 d. the earnings limit for the calendar year in which a
760760 member retires shall be one-twelfth (1/12) of the
761761 annual limit multiplied by the number of months the
762762 member is eligible to work and receive payments from
763763 the public schools of Oklahoma,
764764 e. earnings in excess of the maximum limit on allowed
765765 earnings from public sch ools of Oklahoma shall result
766766 in a loss of future retirement benefits for the year
767767 the postretirement employment was performed of On e
768768 Dollar ($1.00) for each One Dollar ($1.00) earned over
769769 the maximum allowed earnings amount,

821821 f. for those members age seven ty (70) years and over, the
822822 earnings in excess of the maximum limit allowed
823823 earnings from public schools of Oklahoma shall be one -
824824 half (1/2) the member's final average salary used in
825825 computing retirement benefits. However, any retired
826826 member receiving ben efits from the Retirement System
827827 who reached age seventy (70) years prior to July 1,
828828 1991, shall not be restricted by the earnings l imits
829829 pursuant to this subparagraph until January 1, 1994.
830830 To qualify for the provisions of this subparagraph,
831831 the member must be employed less than one -half (1/2)
832832 time compared to other full -time employees in similar
833833 positions;
834834 3. Notwithstanding paragr aph 2 of this subsection, a retired
835835 classified or nonclassified m ember who has been retired for thirty -
836836 six (36) or more mont hs and who is employed by a public school to
837837 perform duties ordinarily performed by classified or nonclassified
838838 personnel shall be a ble to receive annualized earnings from the
839839 public school with no reduction in retirement benefits regardless of
840840 the amount of annualized earnings. For a period of three (3) years
841841 beginning July 1, 2017, members who h ave retired as of July 1, 2017,
842842 as active classroom teachers, who have been retired and receiving a
843843 benefit for at least one (1) year, and who have not been emplo yed by
844844 any public school during that one -year period, shall be eligible to

896896 be reemployed as an active classroom teacher in common or career
897897 tech school districts, with no limitations on earnings. The one-
898898 year period starts with the retiree 's last day of preretirement
899899 public education employment. Members returning under this section
900900 shall not be subject to any earning limitations foll owing the end of
901901 the three-year period described in this paragrap h. Members
902902 returning under this section shall only be empl oyed pursuant to a
903903 temporary contract; and
904904 4. A member shall be considered to be employed by a school
905905 district to perform the dutie s ordinarily performed by classified or
906906 nonclassified personnel if the member is hired by the school
907907 district in the member 's individual capacity to perform the duties
908908 or if the member performs the duties through emplo yment with a
909909 proprietorship, partnersh ip, corporation, limited liability company
910910 or partnership, or a ny other business structure that has agreed or
911911 contracted to provide the services to the school district ;
912912 3. For the first year a retired member is employ ed full-time by
913913 a public school distri ct, the maximum compensation amount shall be
914914 Thirty-six Thousand Six Hundred One Dollars ($36,601.00). For all
915915 years of service after the first twelve (12) months after a member
916916 retires from the System, there shall be no minimum salary
917917 requirement and the provisions of Section 18 -114.14 of this title

970970 district to a retired member of the System for full -time employment;
971971 and
972972 4. For the second and subsequent years that a retired member is
973973 employed full-time by a public school district, the maximum
974974 compensation amount shall be Fifty Thousand Dollars ($50,000.00) and
975975 the provisions of Section 18 -114.14 of this title shall not be
976976 applicable to compensation paid by a public school district for
977977 full-time employment to a retired member of the System .
978978 B. A public school district that employs a retired member shall
979979 be required to make contributions to the System for the retired
980980 member in an amount as required in Sect ion 17-108.1 and in paragraph
981981 3 of subsection B of Section 17 -116.2 of this title. A retired
982982 member employed pursuant to the provisions of this section shall not
983983 accrue any additional service credit in the Teachers ' Retirement
984984 System of Oklahoma resulting from performance of postretirement

988988 regardless of whether the member is receiving his or her retirement
989989 benefit or not and shall not depend upon any election the member
990990 might exercise to suspend or delay receipt of the retirement benefit
991991 amount.
992992 C. For purposes of this section, postretirement employment of

10531053 Oklahoma must fully comply with all the provisions of the rules
10541054 promulgated by the Board of Trustees pursuant to this section in
10551055 order to continue receivi ng his or her monthly retirement benefit.

12771277 B. 1. When determining the Minimum Salary Schedule, "fringe

12901290 employment or, if already employed by th e district, no later than
12911291 thirty (30) days prior to the date the district elects to provide
12921292 retirement benefits such that the teacher 's salary would be less
12931293 than the minimum salary schedule.

13451345 C. Any of the degrees referred to in this section shall be from
13461346 a college recognized by the State Board of Education. The Board
13471347 shall accept teaching experience from out -of-state school districts
13481348 that are accredited by the state board of education or appropriate
13491349 state accrediting agency for the districts. The Board s hall accept
13501350 teaching experience from out-of-country schools that are accredited
13511351 or otherwise endorsed by the appropriate national or regional
13521352 accrediting or endorsement authority. Out -of-country certification
13531353 documentation in a language other than English shall be analyzed by
13541354 an educational credential evaluation servi ce in accordance with
13551355 industry standards and guidelines and approved by the State
13561356 Department of Education. The person seeking to have credit granted
13571357 for out-of-country teaching experience sha ll be responsible for all
13581358 costs of the analysis by a credential evaluation service. The Board
13591359 shall accept teaching experience from primary and se condary schools
13601360 that are operated by the United States Department of Defense or are
13611361 affiliated with the Unite d States Department of State.
13621362 D. For the purpose of state salar y increments and retirement,
13631363 no teacher shall be granted credit for more than five (5) years of
13641364 active duty in the military service or out -of-state or out-of-
13651365 country teaching experience as a c ertified teacher or its
13661366 equivalent. Nothing in this section sha ll prohibit boards of
13671367 education from crediting more years of experience on district salary
13681368 schedules than those allowed for state purposes.

14201420 E. The State Board of Education shall recognize, fo r purposes
14211421 of certification and salary increments, all the years of experience
14221422 of a:
14231423 1. Certified teacher who teaches in the educational program o f
14241424 the Department of Corrections, beginning with fiscal year 1981;
14251425 2. Vocational rehabilitation counselor und er the Department of
14261426 Human Services if the counselor was employe d as a certified teacher
14271427 by the State Department of Education when the Division of Vocational
14281428 Rehabilitation was transferred from the State Board of Career and
14291429 Technology Education or the Stat e Board of Education to the Oklahoma
14301430 Public Welfare Commission o n July 1, 1968;
14311431 3. Vocational rehabilitation counselor which were completed
14321432 while employed by the Department of Human Services if such counselor
14331433 was certified as a teacher or was eligible for certification as a
14341434 teacher in Oklahoma;
14351435 4. Certified teacher w hich were completed while employed by the
14361436 Department of Human Services Child Study Center at University
14371437 Hospital, if the teacher was certified as a teacher in Oklahoma; and
14381438 5. Certified school psychologist or psychometrist which were
14391439 completed while emplo yed as a doctoral intern, psychological
14401440 assistant, or psychologist with any agency of the State of Oklahoma
14411441 if the experience primarily involved work with persons of school - or
14421442 preschool-age and if the person was, at the time the experience was

14961496 F. The provisions of this section shall not apply to teachers
14971497 who have retired from the Teachers ' Retirement System of Oklahoma
14981498 and who have entered into postretirement employment with a public
14991499 school in Oklahoma and are still receiving a monthly reti rement
15001500 benefit.
15011501 G. If a person employed as certified personnel, as defined in
15021502 Section 26-103 of this title, by a school district during the 2017-
15031503 2018 school year was receiv ing a salary above the step level
15041504 indicated by the State Minimum Salary Schedule fo r the 2017-2018
15051505 school year, the person shall receive a salary increase amount equal
15061506 to the amount indicated in subsection A of this section for the step
15071507 level indicated for the person, provided they remain employed by the
15081508 same district, unless the hours o r the duties of the certified
15091509 personnel are reduced proportionately.
15101510 SECTION 4. NEW LAW A new section of law to be codified
15111511 in the Oklahoma Statutes as Section 6-101.6c of Title 70, unless
15121512 there is created a duplication in numbering, read s as follows:
15131513 A. A school district, as defined in Section 1 -108 of Title 70
15141514 of the Oklahoma Statutes, that employs a retired member of the
15151515 Teachers' Retirement System of Oklahoma shall not be subject to any
15161516 provisions of law related to pre-termination procedur es.

15681568 B. 1. All postretirement employment contracts shall be for a
15691569 period agreed to by the school d istrict and the retired member of
15701570 the System, not to exceed twelve (12) months. No school district
15711571 shall be obligated to rehire a retired member with whom the dis trict
15721572 has previously entered into a postretirement employment contract.
15731573 2. A school district shall not have any legal obligation to
15741574 enter into any postretirement employment contract with a retired
15751575 member of the System .
15761576 SECTION 5. Section 1 of this act shall become effective Oct ober
15771577 1, 2021.
15781578 SECTION 6. Sections 2, 3 and 4 of this act shall become
15791579 effective November 1, 20 21.
