7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new section of law to be codified
7979 in the Oklahoma Statutes as Section 1 -1003.1 of Title 63, unless
8080 there is created a duplication in number ing, reads as follows:
8181 A. This act shall be known and may be cited as the "Safe Sleep
8282 Act".
8383 B. For the purposes of this section:
8484 1. "Childcare facility" shall have the same meaning as provided
8585 by Section 402 of Title 10 of the Oklahoma Statutes;
8686 2. "Crib" means a bed or containment designated to accommodate

139139 3. "Crib bumper pad" means a pad or pads resting directly above
140140 the mattress in a crib, running the surface area of the crib or
141141 along the length of any of the interior sides of the crib;
142142 4. "Distributor" means any person who delivers to a person
143143 other than the purchaser, for the purpose of retail sale;
144144 5. "Importer" means the owner of one or more crib bumper pads
145145 at the time of entry in to this state from another state or from
146146 outside the United States who owns such c rib bumper pads
147147 specifically for business purposes;
148148 6. "Manufacturer" means any person who makes and places into
149149 the stream of commerce a crib bumper pad as defined by this section;
150150 7. "Person" means a natural person, firm, corporation, limited
151151 liability company, association or an employee or agent of a natural
152152 person or an entity included in this definition;
153153 8. "Place of public accommodation " means any inn, hotel, motel,
154154 motor court or other establishment that provides lodg ing to
155155 transient guests. Such term shall not include an establishment
156156 treated as an apartment building for purposes of any state or local
157157 law or regulation or an establishment located within a building t hat
158158 contains not more than five rooms for rent or hi re and that is
159159 actually occupied as a residence by the proprietor of such

212212 9. "Retailer" means any person, partnership, corporation or
213213 association engaged in the business of making sales at retail within
214214 this state;
215215 10. "Secondhand dealer" means a person who sells as a primary
216216 source of income reconditioned, remanufactured, refurbished,
217217 previously owned or consignment items. Such term shall not include
218218 the initial consumer or someone who p urchases a children's product
219219 or durable juvenile pr oduct primarily for personal u se but who
220220 subsequently sells the product; and
221221 11. "Wholesaler" means every person, partnership, corporation
222222 or association engaged in the business of making sales at wholes ale
223223 within this state.
224224 C. 1. No manufacturer, impo rter, distributor, wholesaler,
225225 retailer or secondhand dealer shall sell, lease, offer for sale or
226226 offer for lease in this state any crib bumper pad as an accessory to
227227 a crib or as a separate item, whether such sale, lease or offer for
228228 sale or lease is cond ucted by a manufacturer, impor ter, distributor,
229229 wholesaler, retailer or secondhand dealer with a physical presence
230230 in this state or via an online platform.
231231 2. No manufacturer, importer, distributor, whol esaler, retailer
232232 or secondhand dealer shall sell, le ase, offer for sale or offer f or
233233 lease in this state any mesh crib liner intended for placement
234234 between a crib mattress and one or more of the crib 's inner sides
235235 that does not comply with consumer product safety standards

287287 governing such liners by the Unite d States Consumer Product Safe ty
288288 Commission pursuant to Section 104 of the Consumer Product Safety
289289 Improvement Act of 2008, 15 U.S.C. 2056a (2011), for the purpose of
290290 ensuring sufficient permeability and breathability so as to prevent
291291 infant suffocation.
292292 3. In the absence of standards described in paragraph 2 of this
293293 subsection, no manufacturer, importer, distributor, wholesaler,
294294 retailer or secondhand dealer shall, beginning three (3) years after
295295 the effective date of this act, sell, lease, offer for sale or offer
296296 for lease in this st ate any mesh crib liner.
297297 D. 1. No childcare facility or place of public accommodation
298298 shall use or have on the premises any crib bumper pads unless a
299299 medical professional h as determined that use of crib bumper pads is
300300 medically necessary for a particular child using a crib in such
301301 childcare facility or place of public accommodation.
302302 2. No childcare facility or place of public accommodation
303303 shall, unless a medical profession al has determined that use of mesh
304304 crib liners is medically necessary for a partic ular child using a
305305 crib in such childcare facility or place of public accommodation,
306306 use or have on the premises any mesh crib liner intended for
307307 placement between a crib mat tress and one or more of the crib 's
308308 inner sides that does not comply with consumer product safety
309309 standards governing such liners by the United States Consumer
310310 Product Safety Commission pursuant to Section 104 of the Consumer

362362 Product Safety Improvement Act of 2008, 15 U.S.C. 2056a (2011), for
363363 the purpose of ensuring sufficient permeabil ity and breathability so
364364 as to prevent infant suffocation.
365365 3. In the absence of standards described in paragraph 2 of this
366366 subsection, no childcare facility shall, beginning three (3) years
367367 after the effective date of this ac t, use or have on the premises
368368 any mesh crib liner, unless a medical professional has determined
369369 that use of mesh crib liners is medically necessary for a particular
370370 child using a crib in such childcare f acility or place of public
371371 accommodation.
372372 4. The Department of Human Services sha ll notify childcare
373373 facilities of the provisions of this act in plain, non -technical
374374 language. Such notice shall be given to every childcare facility
375375 upon the effective date of this act or as soon as practicable
376376 thereafter, and such notice shall also be g iven to each applicant
377377 for licensure pursuant to Section 405 of Title 10 of the Oklahoma
378378 Statutes.
379379 E. The Director of Human Services shall promulgate rules to
380380 implement the provisions of this act.
381381 SECTION 2. This act shall become effective November 1, 2021.
