77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 1 -1003.1 of Title 63, unless
80	80	there is created a duplication in number ing, reads as follows:
81	81	A. This act shall be known and may be cited as the "Safe Sleep
82	82	Act".
83	83	B. For the purposes of this section:
84	84	1. "Childcare facility" shall have the same meaning as provided
85	85	by Section 402 of Title 10 of the Oklahoma Statutes;
86	86	2. "Crib" means a bed or containment designated to accommodate

139	139	3. "Crib bumper pad" means a pad or pads resting directly above
140	140	the mattress in a crib, running the surface area of the crib or
141	141	along the length of any of the interior sides of the crib;
142	142	4. "Distributor" means any person who delivers to a person
143	143	other than the purchaser, for the purpose of retail sale;
144	144	5. "Importer" means the owner of one or more crib bumper pads
145	145	at the time of entry in to this state from another state or from
146	146	outside the United States who owns such c rib bumper pads
147	147	specifically for business purposes;
148	148	6. "Manufacturer" means any person who makes and places into
149	149	the stream of commerce a crib bumper pad as defined by this section;
150	150	7. "Person" means a natural person, firm, corporation, limited
151	151	liability company, association or an employee or agent of a natural
152	152	person or an entity included in this definition;
153	153	8. "Place of public accommodation " means any inn, hotel, motel,
154	154	motor court or other establishment that provides lodg ing to
155	155	transient guests. Such term shall not include an establishment
156	156	treated as an apartment building for purposes of any state or local
157	157	law or regulation or an establishment located within a building t hat
158	158	contains not more than five rooms for rent or hi re and that is
159	159	actually occupied as a residence by the proprietor of such

212	212	9. "Retailer" means any person, partnership, corporation or
213	213	association engaged in the business of making sales at retail within
214	214	this state;
215	215	10. "Secondhand dealer" means a person who sells as a primary
216	216	source of income reconditioned, remanufactured, refurbished,
217	217	previously owned or consignment items. Such term shall not include
218	218	the initial consumer or someone who p urchases a children's product
219	219	or durable juvenile pr oduct primarily for personal u se but who
220	220	subsequently sells the product; and
221	221	11. "Wholesaler" means every person, partnership, corporation
222	222	or association engaged in the business of making sales at wholes ale
223	223	within this state.
224	224	C. 1. No manufacturer, impo rter, distributor, wholesaler,
225	225	retailer or secondhand dealer shall sell, lease, offer for sale or
226	226	offer for lease in this state any crib bumper pad as an accessory to
227	227	a crib or as a separate item, whether such sale, lease or offer for
228	228	sale or lease is cond ucted by a manufacturer, impor ter, distributor,
229	229	wholesaler, retailer or secondhand dealer with a physical presence
230	230	in this state or via an online platform.
231	231	2. No manufacturer, importer, distributor, whol esaler, retailer
232	232	or secondhand dealer shall sell, le ase, offer for sale or offer f or
233	233	lease in this state any mesh crib liner intended for placement
234	234	between a crib mattress and one or more of the crib 's inner sides
235	235	that does not comply with consumer product safety standards

288	288	Commission pursuant to Section 104 of the Consumer Product Safety
289	289	Improvement Act of 2008, 15 U.S.C. 2056a (2011), for the purpose of
290	290	ensuring sufficient permeability and breathability so as to prevent
291	291	infant suffocation.
292	292	3. In the absence of standards described in paragraph 2 of this
293	293	subsection, no manufacturer, importer, distributor, wholesaler,
294	294	retailer or secondhand dealer shall, beginning three (3) years after
295	295	the effective date of this act, sell, lease, offer for sale or offer
296	296	for lease in this st ate any mesh crib liner.
297	297	D. 1. No childcare facility or place of public accommodation
298	298	shall use or have on the premises any crib bumper pads unless a
299	299	medical professional h as determined that use of crib bumper pads is
300	300	medically necessary for a particular child using a crib in such
301	301	childcare facility or place of public accommodation.
302	302	2. No childcare facility or place of public accommodation
303	303	shall, unless a medical profession al has determined that use of mesh
304	304	crib liners is medically necessary for a partic ular child using a
305	305	crib in such childcare facility or place of public accommodation,
306	306	use or have on the premises any mesh crib liner intended for
307	307	placement between a crib mat tress and one or more of the crib 's
308	308	inner sides that does not comply with consumer product safety
309	309	standards governing such liners by the United States Consumer
310	310	Product Safety Commission pursuant to Section 104 of the Consumer

363	363	the purpose of ensuring sufficient permeabil ity and breathability so

365	365	3. In the absence of standards described in paragraph 2 of this
366	366	subsection, no childcare facility shall, beginning three (3) years
367	367	after the effective date of this ac t, use or have on the premises
368	368	any mesh crib liner, unless a medical professional has determined
369	369	that use of mesh crib liners is medically necessary for a particular
370	370	child using a crib in such childcare f acility or place of public
371	371	accommodation.
372	372	4. The Department of Human Services sha ll notify childcare
373	373	facilities of the provisions of this act in plain, non -technical
374	374	language. Such notice shall be given to every childcare facility
375	375	upon the effective date of this act or as soon as practicable
376	376	thereafter, and such notice shall also be g iven to each applicant
377	377	for licensure pursuant to Section 405 of Title 10 of the Oklahoma
378	378	Statutes.
379	379	E. The Director of Human Services shall promulgate rules to
380	380	implement the provisions of this act.
381	381	SECTION 2. This act shall become effective November 1, 2021.
