7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new section of law to be codified
8181 in the Oklahoma Statut es as Section 42.1 of Title 85A, unless there
8282 is created a duplication in numbering, reads as follows:
8383 A. For each policy of workers ’ compensation insurance issued or
8484 renewed in this state on or after November 1, 202 1, there may be
8585 granted by the insurer a reduction in the premium for the policy not
8686 to exceed five percent (5%) if the insured has been certified by the
8787 State Department of Education to the Workers’ Compensation
8888 Commission and Insurance Commission as a participant in the

140140 Apprenticeships, Internships and Mentorships (AIM) Act of 2016 and
141141 has notified its insurer in writing of such certification.
142142 B. If granted, the premium discount provided by this section
143143 may be applied to an insured’s policy of workers’ compensation
144144 insurance at the discretion of the insured’s insurer pro rata as of
145145 the date the insured receives the certification and shall continue
146146 for as long as the insured maintains the certification; provided,
147147 however, that an insurer shall not be req uired to credit the actual
148148 amount of the premium discount to the account of the insure d until
149149 the final premium audit under the policy. Certification of an
150150 insured shall be required for each year in which a premium discoun t
151151 is granted.
152152 C. If it is determined that an insured misrepresented its
153153 qualifications for certification pursuant to Section 2 of this act,
154154 the workers’ compensation insurance policy of the insured may be
155155 subject to an additional premium for the purposes of reimbursement
156156 of a previously granted premium discount and to cancellat ion in
157157 accordance with the provisions of th e policy.
158158 D. At the discretion of the insured ’s insurer if granting a
159159 premium reduction, each insurer shall make an annual report , in
160160 accordance with rules promulgated by the Insurance Commissioner , to
161161 the Insurance Commissioner illustrating the total do llar amount of
162162 the premium discounts applied pursuant to this section.

214214 E. The Insurance Commissioner and the State Department of
215215 Education shall conduct a study to deter mine the impact of the
216216 premium discounts pro vided pursuant to this se ction in encouraging
217217 employers to provide apprenticeships, internships and mentorships
218218 for students.
219219 F. The Insurance Commissioner may promulgate rules necessary
220220 for the implementation and enfo rcement of this section.
221221 SECTION 2. NEW LAW A new section of law to be codified
222222 in the Oklahoma Statutes as Section 42. 2 of Title 85A, unless there

224224 A. An employer that has be en certified as a participant in the
225225 Apprenticeships, Internships and Mentorships (AIM) Act of 2016
226226 pursuant to this section may be eligible for a premium discount
227227 under the employer’s workers’ compensation insurance policy p ursuant
228228 to Section 1 of this act if the State Department of Education
229229 certifies to the Workers’ Compensation Commission and the Insurance
230230 Commissioner that the employer:
231231 1. Has entered into a training ag reement with one or mo re AIM
232232 students and the student’s parent or guardian in accordance with AIM
233233 requirements;
234234 2. Has developed, in accordance with AIM requirements, a
235235 detailed training plan for the AIM student that focuses on
236236 development of technical skills and emplo yability skills;

288288 3. Assigns a mentor to each AIM student and assists in
289289 monitoring the progress of the st udent; provided, a mentor may be
290290 assigned to more than one student;
291291 4. Provides workers ’ compensation insurance coverage for each
292292 AIM student;
293293 5. Complies with all federal, state and local laws and
294294 regulations regarding the employment of students; and
295295 6. Complies with the rules of th e State Department of Education
296296 regarding AIM placement.
297297 B. A self-insured employer or an employer member of a group
298298 self-insurance association that provides AIM placements for one or
299299 more AIM students substantially in accor dance with this section may
300300 be certified by the Sta te Department of Education to Workers’
301301 Compensation Commission and the Insurance Commission as an AIM
302302 employer in compliance with this act.
303303 SECTION 3. This act shall become effective Novem ber 1, 2021.
