67	67	2, Chapter 187, O.S.L. 2013 (63 O.S. Supp. 2020,

69	69	eliminating certain preemption; authorizing adoption
70	70	of certain regulations; defining term; prohibiting
71	71	certain local laws from being less stringent than
72	72	state law; broadening prov isions to apply to vapor
73	73	products; updating statutory reference ; and providing
74	74	an effective date.

79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 63 O.S. 2011, Section 1 -1527, as
81	81	amended by Section 2, Chapter 187, O.S.L . 2013 (63 O.S. Supp. 2020,
82	82	Section 1-1527), is amended to read as follows:
83	83	Section 1-1527. The State Legislature by adopting this act the
84	84	Smoking in Public Places Act intends to preempt any other regulation
85	85	promulgated to control smoking in public places and to standardize
86	86	laws that authorize governmental subdivisions may to adopt
87	87	regulations to control or prohibit smoking or vaping in public
88	88	places. As used in this section, “public place” shall have the same
89	89	meaning as provided by Section 1-1522 of this title. Cities and

141	141	towns may enact and enforce laws prohibiting and penalizing conduct
142	142	under provisions of this act, but the provisions of such laws shall
143	143	be the same as provided in this act and the enforcement provisions
144	144	under such laws shall not the Smoking in Public Places Act . Such
145	145	laws may be more, but not less, stringent than those of this act ;
146	146	provided, however, that cities . Cities and towns shall be
147	147	authorized to enact laws restricting smoking or vaping on properties
148	148	owned or operated by the resp ective governing bodies. Nothing in
149	149	this section shall be constru ed as to prevent county or municipal
150	150	governments, at the discretion of the respective governing bodies,
151	151	from prohibiting smoking in or on property owned or opera ted by the
152	152	respective governing bodies.
153	153	SECTION 2. This act shall become effec tive November 1, 2021.
