77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 17 O.S. 2011, Section 160.14, is
79	79	amended to read as follows:
80	80	Section 160.14. A. The owner of a wind energy facility shall
81	81	be responsible, at its expense, for the proper deco mmissioning of
82	82	the facility upon abandonment or the end of the useful life of the
83	83	commercial wind energy equipment in the wind energy facility.
84	84	B. Proper decommissioning of a wind energy facility shall
85	85	include:
86	86	1. Removal of wind turbines, towers, buildi ngs, cabling,
87	87	electrical components, foundations and any other associated
88	88	facilities, to a depth of thir ty (30) inches below grade; and

140	140	2. Disturbed earth being graded and reseeded or otherwise
141	141	restored to substantia lly the same physical condition as exis ted
142	142	prior to the construction of the wind energy facility by the owner,
143	143	excluding roads, unless the land owner specifically requests in
144	144	writing that the roads or other land surface areas be restored.
145	145	C. The decommissioning of the wind energy facility, or
146	146	individual pieces of commercial wind energy equipment, shall be
147	147	completed as follows:
148	148	1. By the owner of the wind energy facility within twelve (12)
149	149	months after abandonment or the end of the useful life of the
150	150	commercial wind energy equipment in the wind energy facility; and
151	151	2. Any material removed pursuant to this subsection that cannot
152	152	be recycled shall be removed from the state within ninety (90) days
153	153	after the completion of decommissioning ; and
154	154	3. If the owner of the wind energy facility fails to com plete
155	155	the decommissioning within the period prescribed in paragraph
156	156	paragraphs 1 and 2 of this subsection, the Corporation Commission
157	157	shall take such measures as are necessary to complete the
158	158	decommissioning and shall impose a fine of no more than Five Hun dred
159	159	Dollars ($500.00) per day for each day the decommissioning is not
160	160	completed, to be deposited into the Corporation Comm ission Revolving
161	161	Fund created in Section 180.7 of this title.
