81	81	BE IT RESOLVED BY THE SENATE AND THE HOUSE OF RE PRESENTATIVES OF THE
82	82	1ST SESSION OF THE 58TH OKLAHOMA LEGISLATURE:
83	83	SECTION 1. The Secretary of State shall refer to the people for
84	84	their approval or rejection, as and in the manner provide d by law,
85	85	the following proposed amendment to Section 40 of Article X of the
86	86	Oklahoma Constitution to read as follows:
87	87	Section 40. A. There is hereby created a trust fund to be
88	88	known as the “Tobacco Settlement Endo wment Trust Fund”. The trust
89	89	fund principal shall consist of the portion of monies which a re
90	90	received by the State o f Oklahoma on or after Jul y 1, 2001, pursuant

143	143	companies as provided by su bsection B of this section, and any other
144	144	monies that may be appropriated or otherwise dire cted to the trust
145	145	fund by the Legislature.
146	146	B. 1. Deposits into the trust fund from monies which are
147	147	received by the State of Oklahoma pursuant to any settlement wi th or
148	148	judgment against any tobacco company or companies shall be based on
149	149	the following schedule:

160	160	2. Deposits into the trust fund in subsequent fiscal years
161	161	shall never be less t han seventy-five percent (75%) of the payments
162	162	Beginning July 1, 2023, fifteen percent (15%) of the payments shall
163	163	be deposited in a revolving fund established by the Le gislature
164	164	solely for the purpose of receiving the pa yments. Monies in the
165	165	revolving fund shall be expended solely for the purpose of providing

217	217	a tax credit each year to residents of this state who have filed an
218	218	income tax return for the tax year , except for those residents who
219	219	were inmates in the custody o f the Department of Corrections, and
220	220	for the purpose of administrative costs incurred by the Oklahom a Tax
221	221	Commission in providing the credits . The Tax Commission shall
222	222	determine eligibility for the credits, create calculation and
223	223	disbursement methodology of the credits, and may take such actions
224	224	as are necessary to implement the p rovisions of this subse ction.
225	225	3. The monies received by the State of Oklahoma pursuant to any
226	226	settlement with or judgment agai nst any tobacco company or companies
227	227	after June 30, 2001, not deposited into the trust fund as provided
228	228	in this section or into the revolving fund as au thorized in this
229	229	section, shall be deposited into a special fund established by the
230	230	Legislature solely f or the purpose of receiving the payments;
231	231	provided, the Legislature may, by law, direct a certain portion of
232	232	such monies to the Office of the Attorney G eneral. The special fund
233	233	shall be subject to legislative appropriations.
234	234	C. There is hereby created th e Board of Investors of the
235	235	Tobacco Settlement Endow ment Trust Fund. The Board of Investors
236	236	shall have the duty of investing monies in the trust fund, subject
237	237	to restrictions and limitations provided by law for and in
238	238	accordance with laws applicable to th e investment of monies in state
239	239	retirement funds.

295	295	3. An appointee of the Speaker of the House of Represe ntatives;
296	296	4. An appointee of the President Pro Temp ore of the Senate; and
297	297	5. An appointee of the State Auditor and Inspector.
298	298	The initial appointees s hall serve staggered terms of office as
299	299	provided for by law. Thereafter, appointees shall serve four -year
300	300	terms of office. No more than two appointees sha ll be appointed
301	301	from any single congressional district. All appointed members shall
302	302	have demonstrated expertise in public or private inves tment funds
303	303	management.
304	304	D. There is hereby created the Board of Directors of the
305	305	Tobacco Settlement Endowment Trust Fund. The Board of Directors
306	306	shall consist of seven (7) members, one appointed by each of the
307	307	following appointing authorities:
308	308	1. The Governor;
309	309	2. The President Pro Tempore of the Senate;
310	310	3. The Speaker of the House of Representatives;
311	311	4. The Attorney General;
312	312	5. The State Treasurer;
313	313	6. The State Auditor and Inspector; and
314	314	7. The State Superinte ndent of Public instruction.

366	366	The initial appointed members shall serve staggered terms of
367	367	office as provided for by law. Thereafter, the appointed members of
368	368	the Board of Directors shall serve seven -year terms of office. At
369	369	least one appointee shall be a ppointed from each congressional

371	371	any single congressional district. Not more than four a ppointees
372	372	shall be members of the same political party. An appointee shall
373	373	have been a member of th e political party to which the appointe e
374	374	belongs for at least one (1) year prior to the date of appointm ent.
375	375	Appointees shall have demonstrated expertise i n public or private
376	376	health care or programs related to or for the benefit of children or
377	377	senior adults.
378	378	The Board of Directors shall meet a t least one time each
379	379	calendar quarter.
380	380	E. Earnings from the tru st fund, including but not limited to
381	381	interest, dividends, and realized capital gains from investments of
382	382	the trust fund shall be expended as provided i n subsection F of this
383	383	section for the following purposes:
384	384	1. Clinical and basic research and treatment efforts in
385	385	Oklahoma for the purpose of enhancing ef forts to prevent and combat
386	386	cancer and other tobacco -related diseases;
387	387	2. Cost-effective tobacco pr evention and cessation programs;
388	388	3. Programs other than those specified in paragraph 1 of this
389	389	subsection designed to maintain or improve the health of Okl ahomans

442	442	with particular emphasis on such programs for children;
443	443	4. Programs and services for the benefit of the children of
444	444	Oklahoma, with particular emphasis on common and higher educatio n,
445	445	before- and after-school and pre-school programs, substance abuse
446	446	prevention and treatment progra ms and other programs and services
447	447	designed to improve the health and quality of life of children;
448	448	5. Programs designed to enhance the health and well -being of
449	449	senior adults; and
450	450	6. Authorized administrative expenses of the Office of the
451	451	State Treasurer and the Board of Directors.
452	452	F. Each fiscal year, the Board of Directors may expend the
453	453	amount of earnings which actually accrued to the trust fund during
454	454	the preceding fiscal year. Any amount not so expended shall remain
455	455	in the trust fund. The Board sha ll direct specific expenditures to
456	456	be made for the purposes specified in subsection E of this section.
457	457	G. The Legislature may enact laws to further impleme nt the
458	458	provisions of this section.
459	459	SECTION 2. The Ballot Title for the prop osed Constitutional
460	460	amendment as set forth in SECTION 1 of this resolution shall be in
461	461	the following form:

516	516	This measure would amend Section 40 of Article 10 of the
517	517	Oklahoma Constitution. It would lower the percentage of money
518	518	received by the state from to bacco manufacturers that is
519	519	deposited in the Tobacco Settlement Endowment Trust Fund from
520	520	seventy-five percent (75%) to sixty-three and seventy-five
521	521	hundredths percent (63.75%). It would cause fifteen percent
522	522	(15%) of money received by the state from toba cco manufacturers
523	523	each year to be deposited into a fund created by the
524	524	Legislature. The fund would be used to provide tax credits to
525	525	Oklahoma residents who file an income tax return for the tax
526	526	year, except for inmates in the custody of the Department of
527	527	Corrections. The Oklahoma Tax Commission would dete rmine
528	528	eligibility and calculate the payment s and would be allowed to
529	529	take other necessary action to carry out this measure.
