8181 BE IT RESOLVED BY THE SENATE AND THE HOUSE OF RE PRESENTATIVES OF THE
8282 1ST SESSION OF THE 58TH OKLAHOMA LEGISLATURE:
8383 SECTION 1. The Secretary of State shall refer to the people for
8484 their approval or rejection, as and in the manner provide d by law,
8585 the following proposed amendment to Section 40 of Article X of the
8686 Oklahoma Constitution to read as follows:
8787 Section 40. A. There is hereby created a trust fund to be
8888 known as the “Tobacco Settlement Endo wment Trust Fund”. The trust
8989 fund principal shall consist of the portion of monies which a re
9090 received by the State o f Oklahoma on or after Jul y 1, 2001, pursuant

142142 to any settlement with or judgment against any tobacco company or
143143 companies as provided by su bsection B of this section, and any other
144144 monies that may be appropriated or otherwise dire cted to the trust
145145 fund by the Legislature.
146146 B. 1. Deposits into the trust fund from monies which are
147147 received by the State of Oklahoma pursuant to any settlement wi th or
148148 judgment against any tobacco company or companies shall be based on
149149 the following schedule:

160160 2. Deposits into the trust fund in subsequent fiscal years
161161 shall never be less t han seventy-five percent (75%) of the payments
162162 Beginning July 1, 2023, fifteen percent (15%) of the payments shall
163163 be deposited in a revolving fund established by the Le gislature
164164 solely for the purpose of receiving the pa yments. Monies in the
165165 revolving fund shall be expended solely for the purpose of providing

217217 a tax credit each year to residents of this state who have filed an
218218 income tax return for the tax year , except for those residents who
219219 were inmates in the custody o f the Department of Corrections, and
220220 for the purpose of administrative costs incurred by the Oklahom a Tax
221221 Commission in providing the credits . The Tax Commission shall
222222 determine eligibility for the credits, create calculation and
223223 disbursement methodology of the credits, and may take such actions
224224 as are necessary to implement the p rovisions of this subse ction.
225225 3. The monies received by the State of Oklahoma pursuant to any
226226 settlement with or judgment agai nst any tobacco company or companies
227227 after June 30, 2001, not deposited into the trust fund as provided
228228 in this section or into the revolving fund as au thorized in this
229229 section, shall be deposited into a special fund established by the
230230 Legislature solely f or the purpose of receiving the payments;
231231 provided, the Legislature may, by law, direct a certain portion of
232232 such monies to the Office of the Attorney G eneral. The special fund
233233 shall be subject to legislative appropriations.
234234 C. There is hereby created th e Board of Investors of the
235235 Tobacco Settlement Endow ment Trust Fund. The Board of Investors
236236 shall have the duty of investing monies in the trust fund, subject
237237 to restrictions and limitations provided by law for and in
238238 accordance with laws applicable to th e investment of monies in state
239239 retirement funds.

291291 The Board of Investors shall consist of five (5) members as

293293 1. The State Treasurer who shall be the chair;
294294 2. An appointee of the Governor;
295295 3. An appointee of the Speaker of the House of Represe ntatives;
296296 4. An appointee of the President Pro Temp ore of the Senate; and
297297 5. An appointee of the State Auditor and Inspector.
298298 The initial appointees s hall serve staggered terms of office as
299299 provided for by law. Thereafter, appointees shall serve four -year
300300 terms of office. No more than two appointees sha ll be appointed
301301 from any single congressional district. All appointed members shall
302302 have demonstrated expertise in public or private inves tment funds
303303 management.
304304 D. There is hereby created the Board of Directors of the
305305 Tobacco Settlement Endowment Trust Fund. The Board of Directors
306306 shall consist of seven (7) members, one appointed by each of the
307307 following appointing authorities:
308308 1. The Governor;
309309 2. The President Pro Tempore of the Senate;
310310 3. The Speaker of the House of Representatives;
311311 4. The Attorney General;
312312 5. The State Treasurer;
313313 6. The State Auditor and Inspector; and
314314 7. The State Superinte ndent of Public instruction.

366366 The initial appointed members shall serve staggered terms of
367367 office as provided for by law. Thereafter, the appointed members of
368368 the Board of Directors shall serve seven -year terms of office. At
369369 least one appointee shall be a ppointed from each congressional
370370 district, and not more than two appointees shall be appointed from
371371 any single congressional district. Not more than four a ppointees
372372 shall be members of the same political party. An appointee shall
373373 have been a member of th e political party to which the appointe e
374374 belongs for at least one (1) year prior to the date of appointm ent.
375375 Appointees shall have demonstrated expertise i n public or private
376376 health care or programs related to or for the benefit of children or
377377 senior adults.
378378 The Board of Directors shall meet a t least one time each
379379 calendar quarter.
380380 E. Earnings from the tru st fund, including but not limited to
381381 interest, dividends, and realized capital gains from investments of
382382 the trust fund shall be expended as provided i n subsection F of this
383383 section for the following purposes:
384384 1. Clinical and basic research and treatment efforts in
385385 Oklahoma for the purpose of enhancing ef forts to prevent and combat
386386 cancer and other tobacco -related diseases;
387387 2. Cost-effective tobacco pr evention and cessation programs;
388388 3. Programs other than those specified in paragraph 1 of this
389389 subsection designed to maintain or improve the health of Okl ahomans

441441 or to enhance the provision of health care services to Oklahomans,
442442 with particular emphasis on such programs for children;
443443 4. Programs and services for the benefit of the children of
444444 Oklahoma, with particular emphasis on common and higher educatio n,
445445 before- and after-school and pre-school programs, substance abuse
446446 prevention and treatment progra ms and other programs and services
447447 designed to improve the health and quality of life of children;
448448 5. Programs designed to enhance the health and well -being of
449449 senior adults; and
450450 6. Authorized administrative expenses of the Office of the
451451 State Treasurer and the Board of Directors.
452452 F. Each fiscal year, the Board of Directors may expend the
453453 amount of earnings which actually accrued to the trust fund during
454454 the preceding fiscal year. Any amount not so expended shall remain
455455 in the trust fund. The Board sha ll direct specific expenditures to
456456 be made for the purposes specified in subsection E of this section.
457457 G. The Legislature may enact laws to further impleme nt the
458458 provisions of this section.
459459 SECTION 2. The Ballot Title for the prop osed Constitutional
460460 amendment as set forth in SECTION 1 of this resolution shall be in
461461 the following form:

516516 This measure would amend Section 40 of Article 10 of the
517517 Oklahoma Constitution. It would lower the percentage of money
518518 received by the state from to bacco manufacturers that is
519519 deposited in the Tobacco Settlement Endowment Trust Fund from
520520 seventy-five percent (75%) to sixty-three and seventy-five
521521 hundredths percent (63.75%). It would cause fifteen percent
522522 (15%) of money received by the state from toba cco manufacturers
523523 each year to be deposited into a fund created by the
524524 Legislature. The fund would be used to provide tax credits to
525525 Oklahoma residents who file an income tax return for the tax
526526 year, except for inmates in the custody of the Department of
527527 Corrections. The Oklahoma Tax Commission would dete rmine
528528 eligibility and calculate the payment s and would be allowed to
529529 take other necessary action to carry out this measure.
