79	79	BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTA TIVES OF THE
80	80	1ST SESSION OF THE 58TH OKLAHOMA LEGISLATURE:
81	81	SECTION 1. The Secretary of State shall refer to the people for
82	82	their approval or rejection, as and in the manner provided by law,
83	83	the following proposed amendment to Section 4 of Article VII-B of
84	84	the Oklahoma Constitution to read as follows:
85	85	Section 4. When a vacancy in any Jud icial Office, however
86	86	arising, occurs or is ce rtain to occur, the Judicial Nominating
87	87	Commission shall choose determine that all const itutional and
88	88	statutory qualifications for office are met, investigate criminal
89	89	and financial backgrounds and submit to the Governor and the Chief

141	141	Justice of the Suprem e Court three (3) nominees a list of all
142	142	applicants, each of whom has previously notifie d the Commission in
143	143	writing that he or she will serve as a Judicial Officer if
144	144	appointed. At the time of submission of th e list of applicants to
145	145	the Governor and the C hief Justice of the Supreme C ourt, the
146	146	Commission shall include with the list a merit score for each
147	147	applicant of one (1) through ten (10) with ten (10) being the
148	148	highest score. Scores shall remain confide ntial information
149	149	available only as necessary for purposes of appointment and
150	150	confirmation. The Governor or the Ch ief Justice of the Supreme
151	151	Court may request from the Commission additional information or
152	152	documentation for any applicant regarding any appl icant's merit
153	153	score. The Governor shall appoint o ne (1) of the nominees
154	154	applicants to fill the vacancy, but if he or she fails to do so
155	155	within sixty (60) days , the Chief Justice of the Supreme Court shall
156	156	appoint one (1) of the nominees, the appointment to be applicants.
157	157	Any appointment to Judicial Offi ce shall be subject to the advice
158	158	and consent of the Senate. The appointment and con firmation shall
159	159	be certified by the Secretary of State.
160	160	SECTION 2. The Ballot Title for the propo sed Constitutional
161	161	amendment as set forth in SECTION 1 of this resolution shall be in
162	162	the following form:

218	218	THE GIST OF THE PROPOSITIO N IS AS FOLLOWS:
219	219	This measure amends Section 4 of Article 7-B of the Oklahoma
220	220	Constitution. This measure changes the selection process for
221	221	filling vacancies for the Supreme Court and Court of Criminal
222	222	Appeals. The change in selection of justices and judges would
223	223	require the Judicial Nominating Commission to submit t o the
224	224	Governor a list of all applicants for t he office. The
225	225	Commission shall also include a merit ranking. The Governor
226	226	would select one of the applicant s. The selection would have to
227	227	be confirmed by the Senate.
