7777 BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE
7878 1ST SESSION OF THE 58TH OKLAHOMA LEGISLATURE:
7979 SECTION 1. Pursuant to Section 3 of Article V of the Oklahoma
8080 Constitution, there is hereby ordered the following legislative
8181 referendum which shall be filed with the Secretary of State and
8282 addressed to the Governor of the state, who shall submit the same to
8383 the people for their approval or rejection at the next General
8484 Election.
8585 SECTION 2. AMENDATORY 63 O.S. 2011, Section 683.8, is
8686 amended to read as follows:
8787 Section 683.8. A. The Governor shall have general direction

140140 shall be responsible for carrying out the p rovisions of the Oklahoma
141141 Emergency Management Act of 2003. In the event of an emergency that
142142 exceeds local capability, the Governor may assume direct operational
143143 control over all or any part of the emergency management functions
144144 within this state.
145145 B. The Governor shall have general direction and control of
146146 emergency management within the state and all officers, boards,
147147 agencies, individual or groups established under the Emergency
148148 Operations Plan. The Governor shall have the authority pursuant to
149149 the Oklahoma Emergency Management Act of 2003 to establish such
150150 offices, boards, agencies, or positions as may be necessary to carry
151151 into effect the Emergency Operations Plan.
152152 C. The Governor is author ized to cooperate with the federal
153153 government, with other st ates, and with private agencies in all
154154 matters pertaining to the emergency management of this state and of
155155 the nation.
156156 D. To effect the policy and purpose of the Oklahoma Emergency
157157 Management Act of 2003, the Governor is further authorized and
158158 empowered to:
159159 1. Make, amend, and rescind the necessary orders and rules to
160160 carry out the provisions of the Oklahoma Emergency Management Act of
161161 2003 within the limits of authority conferred upon the Govern or
162162 herein, with due consideration of the emergency managemen t plans of
163163 the federal government; provided, such orders shall not effect or

215215 cause to effect any business in the state to be deemed essential or
216216 nonessential;
217217 2. Cause to be prepa red and updated annually a comprehensive
218218 plan and program for emergency mana gement of this state, such plans
219219 and programs to be integrated into and coordinated with the plans of
220220 the federal government and of other states to the fullest possible
221221 extent, and to coordinate the preparation of plans and programs for
222222 emergency management by the political subdivisions of this state;
223223 3. Procure supplies and equipment in accordance with such plans
224224 and programs, institute training programs and public information
225225 programs, take all other preparatory steps, including the partial or
226226 full activation of emergency management organizations in advance of
227227 actual disaster, and to ensure the furnishing of adequately trained
228228 and equipped personnel in time of need, during periods of national
229229 emergency, or natural disasters that might occur in this state, or
230230 which develop into emergency situations;
231231 4. On behalf of this state, enter into mutual aid arrangements
232232 with other states and coordinate mutual aid plans between political
233233 subdivisions of this state;
234234 5. Delegate any administrative authority vested in the Governor
235235 pursuant to the Oklahoma Emergency Management Act of 2003, and
236236 provide for subdelegation of any such authority;

288288 6. Confirm the appointment of qualified emergency man agers upon
289289 recommendations of local authorities as provided in Section 683.1 1
290290 of this title;
291291 7. Cooperate with the President of the United States and the
292292 heads of the Armed Forces, the Federal Emergency Management Agency,
293293 and other appropriate federal off icers and agencies, with the
294294 officers and agencies of other states in matter s pertaining to the
295295 emergency management of the state and nation, including the
296296 direction and control of:
297297 a. state emergency management activations and exercises ,
298298 b. warnings for actual or exercise events and the
299299 equipment to be used in connection therewit h,
300300 c. the conduct of civilians and the movement of and
301301 cessation of movement of pedestrians and vehicular
302302 traffic during, prior and subsequent to natural and
303303 man-made disasters and emergencies,
304304 d. public meetings or gatherings, and
305305 e. the evacuation and re ception of the civil population;
306306 and
307307 8. Prescribe uniform signals, warnings, alerts, credentials and
308308 insignia.
309309 E. In addition to prevention measures included in the state and
310310 local comprehensive plans and programs for emergency management, the
311311 Governor shall consider on a continuing basis steps that could be

363363 taken to mitigate the harmful consequences of emergencies and
364364 natural disasters. At the Governor ’s direction and pursuant t o any
365365 other authority specified by law, state agencies, including but not
366366 limited to those charged with responsibilities in connection with
367367 floodplain management, stream encroachment and flow regulation,
368368 weather modification, fire prevention and control, a ir quality,
369369 public works, land use and land use planning, and construction
370370 standards, shall make studies of matters related to potential to
371371 mitigate emergency and natural disasters. The Governor, from time
372372 to time, shall make such recommendations to the L egislature, to
373373 political subdivisions and to other appropriate public and pr ivate
374374 entities as may facilitate measures for mitigation of the harmful
375375 consequences of emergencies and natural disasters.
376376 SECTION 3. This resolution shall become effective upon approval
377377 by the people.
378378 SECTION 4. The Ballot Title for the proposed act shall be in

383383 This measure prohibits the Governor from deeming any business in
384384 Oklahoma as essential or nonessential. This measure adds an

447447 SECTION 4 hereof, with the Secretary of State and one copy with the
448448 Attorney General.
