77	77	BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE
78	78	1ST SESSION OF THE 58TH OKLAHOMA LEGISLATURE:
79	79	SECTION 1. Pursuant to Section 3 of Article V of the Oklahoma
80	80	Constitution, there is hereby ordered the following legislative
81	81	referendum which shall be filed with the Secretary of State and
82	82	addressed to the Governor of the state, who shall submit the same to
83	83	the people for their approval or rejection at the next General
84	84	Election.
85	85	SECTION 2. AMENDATORY 63 O.S. 2011, Section 683.8, is
86	86	amended to read as follows:
87	87	Section 683.8. A. The Governor shall have general direction
88	88	and control of the Oklahoma Department of Emergenc y Management and

140	140	shall be responsible for carrying out the p rovisions of the Oklahoma
141	141	Emergency Management Act of 2003. In the event of an emergency that
142	142	exceeds local capability, the Governor may assume direct operational
143	143	control over all or any part of the emergency management functions
144	144	within this state.
145	145	B. The Governor shall have general direction and control of
146	146	emergency management within the state and all officers, boards,
147	147	agencies, individual or groups established under the Emergency
148	148	Operations Plan. The Governor shall have the authority pursuant to
149	149	the Oklahoma Emergency Management Act of 2003 to establish such
150	150	offices, boards, agencies, or positions as may be necessary to carry
151	151	into effect the Emergency Operations Plan.
152	152	C. The Governor is author ized to cooperate with the federal
153	153	government, with other st ates, and with private agencies in all
154	154	matters pertaining to the emergency management of this state and of
155	155	the nation.
156	156	D. To effect the policy and purpose of the Oklahoma Emergency
157	157	Management Act of 2003, the Governor is further authorized and
158	158	empowered to:
159	159	1. Make, amend, and rescind the necessary orders and rules to
160	160	carry out the provisions of the Oklahoma Emergency Management Act of
161	161	2003 within the limits of authority conferred upon the Govern or
162	162	herein, with due consideration of the emergency managemen t plans of
163	163	the federal government; provided, such orders shall not effect or

216	216	nonessential;
217	217	2. Cause to be prepa red and updated annually a comprehensive
218	218	plan and program for emergency mana gement of this state, such plans
219	219	and programs to be integrated into and coordinated with the plans of
220	220	the federal government and of other states to the fullest possible
221	221	extent, and to coordinate the preparation of plans and programs for
222	222	emergency management by the political subdivisions of this state;
223	223	3. Procure supplies and equipment in accordance with such plans
224	224	and programs, institute training programs and public information
225	225	programs, take all other preparatory steps, including the partial or
226	226	full activation of emergency management organizations in advance of
227	227	actual disaster, and to ensure the furnishing of adequately trained
228	228	and equipped personnel in time of need, during periods of national
229	229	emergency, or natural disasters that might occur in this state, or
230	230	which develop into emergency situations;
231	231	4. On behalf of this state, enter into mutual aid arrangements
232	232	with other states and coordinate mutual aid plans between political
233	233	subdivisions of this state;
234	234	5. Delegate any administrative authority vested in the Governor
235	235	pursuant to the Oklahoma Emergency Management Act of 2003, and
236	236	provide for subdelegation of any such authority;

289	289	recommendations of local authorities as provided in Section 683.1 1

291	291	7. Cooperate with the President of the United States and the
292	292	heads of the Armed Forces, the Federal Emergency Management Agency,
293	293	and other appropriate federal off icers and agencies, with the
294	294	officers and agencies of other states in matter s pertaining to the
295	295	emergency management of the state and nation, including the
296	296	direction and control of:
297	297	a. state emergency management activations and exercises ,
298	298	b. warnings for actual or exercise events and the
299	299	equipment to be used in connection therewit h,
300	300	c. the conduct of civilians and the movement of and
301	301	cessation of movement of pedestrians and vehicular
302	302	traffic during, prior and subsequent to natural and
303	303	man-made disasters and emergencies,
304	304	d. public meetings or gatherings, and
305	305	e. the evacuation and re ception of the civil population;
306	306	and
307	307	8. Prescribe uniform signals, warnings, alerts, credentials and
308	308	insignia.
309	309	E. In addition to prevention measures included in the state and
310	310	local comprehensive plans and programs for emergency management, the
311	311	Governor shall consider on a continuing basis steps that could be

364	364	natural disasters. At the Governor ’s direction and pursuant t o any
365	365	other authority specified by law, state agencies, including but not
366	366	limited to those charged with responsibilities in connection with
367	367	floodplain management, stream encroachment and flow regulation,
368	368	weather modification, fire prevention and control, a ir quality,
369	369	public works, land use and land use planning, and construction
370	370	standards, shall make studies of matters related to potential to
371	371	mitigate emergency and natural disasters. The Governor, from time
372	372	to time, shall make such recommendations to the L egislature, to
373	373	political subdivisions and to other appropriate public and pr ivate
374	374	entities as may facilitate measures for mitigation of the harmful
375	375	consequences of emergencies and natural disasters.
376	376	SECTION 3. This resolution shall become effective upon approval
377	377	by the people.
378	378	SECTION 4. The Ballot Title for the proposed act shall be in
