BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPR ESENTATIVES OF THE 2ND SESSION OF THE 58TH OKLAHOMA LEGISLATURE: SECTION 1. The Secretary of State shall refer to the peo ple for their approval or rejection, as and in the m anner provided by law, the following proposed amendment to Section 30 of Article II of the Oklahoma Constitution to read as follows: Section 30. The right of the people to be secure in their persons, houses, electronic data and electronic communications, papers, and effects against unreasonable searches or seizures shall not be violated; and no warrant shall issue but upo n probable cause supported by oath or affirmation, describing as particularly as may be the place to be searched and the person or thing to be seized. The Ballot Title for the propo sed Constitutional amendment as set forth in SECTION 1 of this resolution shall be in the following form: BALLOT TITLE Legislative Referendum No. ____ State Question No. ____ THE GIST OF THE PROPOSITION IS AS FOLLOWS: This measure amends Section 30 of Article 2 of the Oklahoma Constitution. This section protects the rights of the people against unreasonable searches and seizures. This measure would add electronic data and communications to the list of items that require a warrant based on probabl e cause to search for or seize such items. SHALL THE PROPOSAL BE APPROVED?
