27	48		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:

29	49		SECTION 1. AMENDATORY 28 O.S. 2021, Section 86, is
30	50		amended to read as follows :
31		-
32	51		Section 86. A. Jurors shall be paid the following fees out of
33	52		the local court fund:
34		-
35	53		1. For each day's attendance before any court of record, Twenty
36	54		Dollars ($20.00) Fifty Dollars ($50.00); and
37		-
38	55		2. For mileage going to and returning from jury service each
39	56		day, pursuant to the provisions of the State Travel Reimbursement
40	57		Act.

42	58		B. The Court Fund Board of the district court may contract for
43	59		or provide reimbursement for pa rking for district court jurors to be
44	60		paid from the Court Fund. Parking so provided to jurors shall be in
45	61		lieu of any reimbursement to jurors for parking fees.

47	88		C. The provisions of this section shall not apply to any person
48	89		who is summoned for jury duty and who is excused from serving
49	90		pursuant to the provisions of subsection A of Section 28 of Title 38
50	91		of the Oklahoma Statutes, beginning on the day the person is excused
51	92		from service.

53	93		D. The Supreme Court shall promulgate rules to esta blish a
54	94		Lengthy Trial Fund that shall be used to provide full or partial
55	95		wage replacement or wage supplementation to jurors who serve as
56	96		petit jurors for more than ten (10) days.

58	97		1. The court rules s hall provide for the selection and
59	98		appointment of an Adm inistrator for the f und; procedures for the
60	99		administration of the fund, including payments of salaries of the
61	100		Administrator and other necessary personnel; procedures for the
62	101		accounting, auditing and i nvestment of money in the Lengthy Trial
63	102		Fund; and a report by the Supreme Co urt on the administration of the
64	103		Lengthy Trial Fund included in its annual report on the judicial
65	104		branch, setting forth the money collected for and disbursed from the
66	105		fund.

68	106		2. The clerk of the court shall collect from each attorney who
69	107		files a civil case, unless otherwise exempted under the provisions
70	108		of this section, a fee of Ten Dollars ($10.00) per case to b e paid
71	109		into the Lengthy Trial Fund. A lawyer will be deemed to have fil ed
72	110		a case at the time the first pleading or other filing on which an
73	111		individual lawyer's name appears is submitted to the court for

74	138		filing and opens a new case. All such fees shall be forwarded to
75	139		the Administrator of the Lengthy Trial Fund for deposit.

77	140		3. The Administrator shall use the fees deposited in the
78	141		Lengthy Trial Fund to pay full or partial wage replacement or
79	142		supplementation to jurors whose employers pay less than full regu lar
80	143		wages when the period of jury service lasts more than ten (10) days.

82	144		4. The court may pay replacement or supplemental wages of up to
83	145		Two Hundred Dollars ($200.00) per day per juror beginning on the
84	146		eleventh day of jury service. In addition, for any j urors who
85	147		qualify for payment by serving on a jury for more than ten (10 )
86	148		days, the court may, upon finding that such service po sed a
87	149		significant financial hardship to a juror, even in light of payments
88	150		made with respect to jury service after the tenth day , award
89	151		replacement or supplemental wages of up to Fifty Dollars ($50.00 )
90	152		per day from the fourth to the tenth day of jury servi ce.

92	153		5. Any juror who is serving or has served on a jury that
93	154		qualifies for payment from the Lengthy Trial Fund, provided the
94	155		service commenced on or after January 1, 2005, may submit a request
95	156		for payment from the Lengthy Trial Fund on a form provided by the
96	157		Administrator. Payment shall be limited to the difference between
97	158		the state-paid jury fee and the actual amount of wages a juror
98	159		earns, up to the maximum level payable, minus any amount the juror
99	160		actually receives from the employer during the same tim e period.
100	161		The form shall disclose the juror's regular wages, the amount the

101	188		employer will pay during the term of jury service s tarting on the
102	189		eleventh day and thereafter, the amount of replacement or
103	190		supplemental wages requested, and any other information the
104	191		Administrator deems necessary for proper payment. The juror shall
105	192		be required to submit verification from the employer as to the wage
106	193		information provided to the Administrator, including but not limited
107	194		to the employee's most recent earnings statemen t or similar
108	195		document, prior to initiation of payment from the fund. If an
109	196		individual is self-employed or receives compensation other than
110	197		wages, the individual may provide a sworn affidavit attestin g to his
111	198		or her approximate gross weekly income, togethe r with such other
112	199		information as the Administrator may require, in order to verify
113	200		weekly income.

115	201		6. The following attorneys an d causes of action are exempt from
116	202		payment of the Lengthy Trial Fund fee :

118	203		a. government attorneys entering appearances in the
119	204		course of their offici al duties,

121	205		b. pro se litigants,

123	206		c. cases in small claims court or the state equivalent
124	207		thereof, or

126	208		d. claims seeking Social Security disability
127	209		determinations, individual veterans ' compensation or
128	210		disability determinations, recoupment a ctions for
129	211		government backed educational loans or mortgages,

131	239		forma pauperis, and any other filings designated by
132	240		rule that involve minimal use of co urt resources and
133	241		that customarily are not afforded the opportunity for

136	243		7. Until June 30, 2021, the Office of Management and Enterprise
137	244		Services shall, at the request of the Administrative Director of the
138	245		Courts, transfer any monies from the Lengthy Trial Fund to the
139	246		Supreme Court Administrati ve Revolving Fund or the Interagency
140	247		Reimbursement Fund as necessary to perform the duties imposed upon
141	248		the Supreme Court, Court of Civil Appeals and district courts by
142	249		law.
