26	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:

28	53		SECTION 1. AMENDATORY 69 O.S. 2021, Section 1913, is
29	54		amended to read as follows:

31	55		Section 1913. There is hereby established a fund within the
32	56		State Treasury to be known as the "Rural Economic Transportation
33	57		Reliability and Optimization Fun d" to be administered by the
34	58		Oklahoma Department of Transportation. The fund shall be a
35	59		continuing fund, not subject to fiscal year limitations, and shall
36	60		consist of any general revenues as may be dir ectly appropriated or
37	61		otherwise provided by law.

39	62		Any monies appropriated to the Rural Econo mic Transportation
40	63		Reliability and Optimization Fund shall n ot result in a decrease in

42	91		or be used to supplant or replace existing state funds used for
43	92		transportation purposes.

45	93		In order to ensure that the funds from the Rural Economic
46		-	Transportation Reliability and Optimization Fund are used to enhance ~~ENR. H. B. NO. 1025 (1ST EX. SESS.) Page 2~~
	94	+	Transportation Reliability and Optimization Fund are used to enhance
47	95		and not supplant stat e funding for the Department o f Transportation,
48	96		the State Board of Equalization shall examine and investigate the
49	97		funding levels as described. At the meeting of the State Board of
50	98		Equalization held within five (5) days after the monthly
51	99		apportionment in February of each year, the Stat e Board of
52	100		Equalization shall issue a finding and repor t which shall state
53	101		whether expenditures from the Rural Economic Transportation
54	102		Reliability and Optimization Fund were used to enhance or supplant
55	103		state funding for the De partment of Transportation. I f the State
56	104		Board of Equalization finds that state fund ing for the Department of
57	105		Transportation was supplanted by funds from the Rural Economic
58	106		Transportation Reliability and Optimization Fund, the Board shall
59	107		specify the amount by which such funding was s upplanted. In this
60	108		event, the Legislature shall not ma ke any appropriations for the
61	109		ensuing fiscal year until an appropriation in that amount is made to
62	110		replenish state funding for the Department of Transportation.

64	111		All monies accruing to the credit of the Rural Economic
65	112		Transportation Reliability and Optimiza tion Fund are hereby
66	113		appropriated and shall be used to assist the Department in the

67	140		equitable prioritization of construction, repair and maintenance of
68	141		state highways in rural areas where robust econom ic development has
69	142		resulted in traffic safety and circu lation difficulties attributed
70	143		to significant and unanticipated increases in traffic volumes and as
71	144		fully recorded and documented by the Department. "Robust economic
72	145		development", as used in this act, shall mean those conditions of
73	146		the highways of this st ate in counties with a population of less
74	147		than fifty thousand (50,000) seventy-five thousand (75,000) where
75	148		traffic volumes have increased to become so impaired or hazardo us as
76	149		to constitute a threat t o the safety of persons or property
77	150		traveling over or upon such highways.

79	151		When such traffic conditi ons as described may arise in rural
80	152		areas, the Department of Transportation shall e ngage the Oklahoma
81	153		Department of Commerce, t he Oklahoma Tax Commission or other
82	154		agencies or entities of the state, as necessary, to confirm the
83	155		relationship of traffic condi tions to robust economic development.
84	156		Once said relationship is confirmed and docu mented, the Department
85	157		of Transportation may utilize any proceeds from the Rural Economic
86	158		Transportation Reliability and Optimiza tion Fund in an amount not to
87	159		exceed fifty percent (50%) of the total project costs to incentivize
88	160		and leverage the acceleratio n and prioritization of improvement
89	161		projects existing in or to be incorpor ated into the Department's
90	162		Eight-Year Construction Work Plan.
