2652 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:

2853 SECTION 1. AMENDATORY 69 O.S. 2021, Section 1913, is
2954 amended to read as follows:

3155 Section 1913. There is hereby established a fund within the
3256 State Treasury to be known as the "Rural Economic Transportation
3357 Reliability and Optimization Fun d" to be administered by the
3458 Oklahoma Department of Transportation. The fund shall be a
3559 continuing fund, not subject to fiscal year limitations, and shall
3660 consist of any general revenues as may be dir ectly appropriated or
3761 otherwise provided by law.

3962 Any monies appropriated to the Rural Econo mic Transportation
4063 Reliability and Optimization Fund shall n ot result in a decrease in

4593 In order to ensure that the funds from the Rural Economic

4795 and not supplant stat e funding for the Department o f Transportation,
4896 the State Board of Equalization shall examine and investigate the
4997 funding levels as described. At the meeting of the State Board of
5098 Equalization held within five (5) days after the monthly
5199 apportionment in February of each year, the Stat e Board of
52100 Equalization shall issue a finding and repor t which shall state
53101 whether expenditures from the Rural Economic Transportation
54102 Reliability and Optimization Fund were used to enhance or supplant
55103 state funding for the De partment of Transportation. I f the State
56104 Board of Equalization finds that state fund ing for the Department of
57105 Transportation was supplanted by funds from the Rural Economic
58106 Transportation Reliability and Optimization Fund, the Board shall
59107 specify the amount by which such funding was s upplanted. In this
60108 event, the Legislature shall not ma ke any appropriations for the
61109 ensuing fiscal year until an appropriation in that amount is made to
62110 replenish state funding for the Department of Transportation.

64111 All monies accruing to the credit of the Rural Economic
65112 Transportation Reliability and Optimiza tion Fund are hereby
66113 appropriated and shall be used to assist the Department in the

67140 equitable prioritization of construction, repair and maintenance of
68141 state highways in rural areas where robust econom ic development has
69142 resulted in traffic safety and circu lation difficulties attributed
70143 to significant and unanticipated increases in traffic volumes and as
71144 fully recorded and documented by the Department. "Robust economic
72145 development", as used in this act, shall mean those conditions of
73146 the highways of this st ate in counties with a population of less
74147 than fifty thousand (50,000) seventy-five thousand (75,000) where
75148 traffic volumes have increased to become so impaired or hazardo us as
76149 to constitute a threat t o the safety of persons or property
77150 traveling over or upon such highways.

79151 When such traffic conditi ons as described may arise in rural
80152 areas, the Department of Transportation shall e ngage the Oklahoma
81153 Department of Commerce, t he Oklahoma Tax Commission or other
82154 agencies or entities of the state, as necessary, to confirm the
83155 relationship of traffic condi tions to robust economic development.
84156 Once said relationship is confirmed and docu mented, the Department
85157 of Transportation may utilize any proceeds from the Rural Economic
86158 Transportation Reliability and Optimiza tion Fund in an amount not to
87159 exceed fifty percent (50%) of the total project costs to incentivize
88160 and leverage the acceleratio n and prioritization of improvement
89161 projects existing in or to be incorpor ated into the Department's
90162 Eight-Year Construction Work Plan.
