5497 SECTION 2. From the funds appropria ted to the Oklahoma Health
5598 Care Authority in Enrolled House Bill No. 1004 of the 1st
5699 Extraordinary Session of the 59th Oklahoma Legislature, the sum of
57100 Forty-seven Million Seven Hundred Sixty-seven Thousand Four Hundred
58101 Fifty-eight Dollars ($47,767,458.00) shall be used to increase
59102 reimbursement to long-term care facilities by Thirty-five Dollars
60103 ($35.00) per day and reimbursement to intermediate care facilities
61104 for individuals with intellectual disabilities (ICF/IID) by
62105 Seventeen Dollars ($17.00) per day.

64106 SECTION 3. A. From the funds appropriated to the Oklahoma
65107 Health Care Authority in Enrolled House Bill No. 1004 of the 1st
66108 Extraordinary Session of the 59th Oklahoma Legislature, the sum o f
67109 Two Hundred Million Dollars ( $200,000,000.00) shall be used for one-
68110 time funding to critical access hospitals and hospitals
69111 participating in the Supplemental Hosp ital Offset Payment Program.

71112 B. The Authority shall work in conjunction with an Oklahoma-
72113 based association of hospitals to create the methodology for the
73114 disbursement of this funding.

75115 C. The Authority shall submit to the Senate Appropriations
76116 Committee Chair and the House of Representatives Appropriations and
77117 Budget Committee Chair a plan for the disbursement of the funds
78118 listed in this section by no later than July 31st, 2023.

80145 SECTION 4. A. The duties and compensation of employees, not
81146 otherwise prescribed by law, necessary to perform the duties imposed
82147 upon the Oklahoma Health Care Authority by law sh all be set by the
83148 Administrator of the Oklahoma Health Care Au thority.

85149 B. The Oklahoma Health Care Authority is authorized to:

87150 1. Pay professional expenses of the Administrator of the
88151 Authority including dues, licenses, professional memberships , and
89152 continuing education classes conducted in this state; and

93153 2. Pay professional expenses of any employee including dues,
94154 licenses, professional membersh ips, continuing medical education
95155 classes conducted in this state, and medical malpractice insurance
96156 provided he or she is a full-time employee of the Authority in
97157 accordance with subsection B of Section 5006 of Title 63 of the
98158 Oklahoma Statutes and is utilizing those professional skills in the
99159 performance of his or her job duties.

101160 SECTION 5. In order to facilitate cash management of federal
102161 grant receipts and disbursements, the Office of Management and
103162 Enterprise Services shall transfer monies between the Oklahoma
104163 Health Care Authority federal and revolving funds in amounts
105164 requested by the Oklahoma Health Care Authority.

107165 SECTION 6. The Oklahoma Health Care Authority is authorized to
108166 transfer funds from Fund 205 and Fund 270 to Fund 200 and Fund 340
109167 to satisfy claims made to the Authority under the Suppleme ntal
110168 Hospital Offset Payment Progr am Act.

112195 SECTION 7. The Administrator of the Oklaho ma Health Care
113196 Authority may request, in the manner provided in this section, that
114197 receipt and expenditure of unanticipated federal funds awarded after
115198 July 1, 2023, be exempt from expendit ure limitations and from
116199 budgetary limitations.

118200 1. The Administrator shall make a request for exemption to the
119201 Office of Management and Enterprise Services in writing and f ile a
120202 revised budget program.

122203 2. The Administrator shall also file copies of the r equest for
123204 exemption and budget work program revisions with the Senate
124205 Appropriations Committee Chair and the House of Representatives
125206 Appropriations and Budget Committee Chair. The Senate
126207 Appropriations Committee Chair and/or the House Appropriati ons and
127208 Budget Committee Chair shall notify the Office of Ma nagement and
128209 Enterprise Services of any noncompliance of the request with
129210 legislative intent within twelve (12) calendar days of receipt of
130211 the exemption request. The Office of Management and Enterprise
131212 Services shall approve the request for exemption unless both the
132213 Chair and Vice Chair of the Legislative Oversight Committee on State
133214 Budget Performance provide written notification to the Office of
134215 Management and Enterprise Services within twe lve (12) calendar days

137216 of the Committee’s receipt of the exemption request th at the
138217 exemption subverts the intention and objectives of the Legislature

140245 Enterprise Services shall give written notice of approval or
141246 disapproval of each exemption to the agency, the Govern or, the Chair
142247 of the Senate Appropriations Committee , and the Chair of the House
143248 Appropriations and Budget Committee within eighteen (18) calendar
144249 days of receiving the request.

146250 SECTION 8. A. The Director of the Office of Management and
147251 Enterprise Services shall transfer monies appropriated from the
148252 General Revenue Fund and the Health Care Enhancement Fund to the
149253 Oklahoma Health Care Authority disbursing funds in the amounts and
150254 ratios requested by the Authority, except that the cumulative
151255 amounts transferred shall not exceed the cumulative amounts of equal
152256 monthly allotments of the appropriat ions from the General Revenue
153257 Fund and Health Care Enhancement Fund.

155258 B. Monies appropriated or collected for the fiscal year ending
156259 June 30, 2024, may be transferred to these disbursing funds for the
157260 fiscal year ending June 30, 2023, to satisfy encumbrance s and
158261 obligations of such fiscal year; provided, that monies equal in
159262 amount are transferred from appropriations or collections for the
160263 fiscal year ending June 30, 2023, to the disbursing fund for the
161264 fiscal year ending June 30, 2024, to satisfy encumbranc es and
162265 obligations of such fiscal year. All transfer requests shall be in
163266 writing to the Director of the Office of Management and Enterprise

166294 C. The Oklahoma Health Care Authority shall maintain records of
167295 the inter-year transfers.

169296 SECTION 9. The Administrator of the Oklahoma Health Care
170297 Authority may request, through the Director of the Office of
171298 Management and Enterpris e Services, the early transfer by the
172299 Oklahoma Tax Commission of tax collections to the General Revenue
173300 Fund for the purpose of early allocation to the agency’s disbursing
174301 funds to alleviate ca sh-flow problems.

176302 SECTION 10. Appropriations made b y Enrolled House Bill No. 1004
177303 of the 1st Extraordinary Session of the 59th Oklahoma Legislature ,
178304 not including appropriations made for capital outlay purposes, may

181305 be budgeted for the fiscal year ending June 30, 2024 (hereafter FY -
182306 24), or may be budgeted for the fiscal year ending June 30, 2025
183307 (hereafter FY-25). Funds budgeted for FY -24 may be encumbered on ly
184308 through June 30, 2024, and must be expended by November 15, 2024.
185309 Any funds remaining after November 15, 2024, and not budgete d for
186310 FY-25, shall lapse to the credit of the proper fund for the then
187311 current fiscal year. Funds budgete d for FY-25 may be encumbered
188312 only through June 30, 2025. Any funds remaining after November 15,
189313 2025, shall lapse to the credit of the proper fund f or the then
190314 current fiscal year. These appropriations may not be budgeted in
191315 both fiscal years simultaneo usly. Funds budgete d in FY-24, and not
192316 required to pay obligations for that fiscal year, may be budgeted
193317 for FY-25, after the agency to which the fun ds have been
