Supp. 2022, Section 1104), which relates to apportionment of fees; requiring certain mo nthly reporting; directing certain appo rtionment; amending 47 O.S. 2021, Section 1135.5, as last amended by Section 23 of Enrolled Senate Bill No. 782 of the 1st Session of the 59th Oklahoma Legislature (47 O.S. Supp. 2022, Section 1135.5), which relates to special license plates; modifying cer tain fee retention by licensed operators; amending 47 O.S. 2021, Section 1140, as amended by Section 174, Chapter 282, O.S.L. 2022 (47 O.S. Supp. 2022, Section 1140), whic h relates to qualifications for licensed opera tors; prescribing certain method of pay ment for licensed operators; amending 47 O.S. 2021, Section 1141.1, as last amended by Section 177, Chapter 282, O.S.L. 2022 (47 O.S. Supp. 2022, Section 1141.1), which re lates to retention of taxes and fees; modifyin g certain fee retention by licensed ope rators; repealing 47 O.S. 2021, Section 1132.5, which relates to additional registration fees; providing an effective date; and declaring an emergency. SUBJECT: Service Oklahoma BE IT ENACTED BY THE PEOPLE OF TH E STATE OF OKLAHOMA: SECTION 1. AMENDATORY 47 O.S. 2021, Section 2 -147, is amended to read as follow s: Section 2-147. A. There is hereby created in the State Treasury a fund to be designated as the “State Public Safety Fund”. The fund shall be sub ject to legislative appropriation and sha ll consist of revenues deposited to such fund by Section 1113.2 of Title 47 of the Oklahoma Statutes and of such other revenues as may be provided by law. ENR. S. B. NO. 37x Page 3 B. The State Public Safety Fund shall be utilized by the Legislature through appropriations to suppo rt public safety in Oklahoma and the services offered by Servic e Oklahoma. SECTION 2. AMENDATORY Section 1, Chapter 282, O.S.L. 2022 (47 O.S. Supp. 2022, Section 3-101), is amended to read as follows: Section 3-101. A. Service Oklahoma, a division of the Office of Management and Enterpris e Services, is hereby created, which shall consist of the Executive Director of Service Oklahoma and such divisions, sections, committees, offices, boards , and positions as may be established by the Executive Director of Service Oklahoma or by law. The applicable powers, duties, and responsibilities exercised by the Driver License Services Division of the Departmen t of Public Safety shall be fully transferr ed to Service Oklahoma on November 1, 2022. All employees of the Department of Public Safety whose d uties are transferred under this act shall be transferred to Service Oklahoma. The applicable powers, duties, an d responsibilities exercised by the Motor Services Division of the Oklahoma Tax Comm ission shall be fully transferred to Service Oklahoma on Ja nuary 1, 2023. All employees of the Oklahoma Tax Commission whose dut ies are transferred under this act shall be transferred to Service Oklahoma. B. 1. Beginning November 1, 2023, Service Oklaho ma shall cease to be part of or a division of the Office o f Management and Enterprise Services and shall be deemed to be a sepa rate and distinct agency, to be known as Serv ice Oklahoma. Service Oklahoma and the Director of Service Oklahoma shall continue to exercise their statutory powers, duties, and contractua l responsibilities. All records, property, equipment, assets, monies, financial interests, liabilities, matters p ending, and funds of the division shall be transferred to Service Oklahoma. 2. Service Oklahoma shall succeed to any contractual rights or responsibilities incurred by the Office of Management and Enterprise Services pertaining to licensed operators. ENR. S. B. Rules promulgated by the Office of Manageme nt and Enterprise Services pertaining to Service Oklahoma that are in effect on the effective date of this act shall be immediately adopted and enforced by the Executive Director of Service Oklahoma. The Executive Director maintains the authority to furth er promulgate and enforce rules. 4. The Office of Management and Enterprise Services and Servic e Oklahoma may enter into an agreement for the transfer of person nel from the Office of Management and Enterprise Ser vices to Service Oklahoma. No employee sha ll be transferred to Service Oklahoma except on the freely given written consent of the employee . All employees who are transferred to Service Oklahoma shall no t be required to accept a lesser grade or salary tha n presently received. All employees shall retain leave, sick, and annual time earne d, and any retirement and longevity benefits which have accrued during their tenure with the Office of Management and En terprise Services. The transfer of personnel betwee n the state agencies shall be coordinated with the Office of Management and Enterpri se Services. 5. The expenses incurred by Service Okla homa as a result of the transfer required by this subsection shall be paid by Service Oklahoma. 6. The division withi n the Department known as Service Oklahoma shall be abolished by the Office of Manag ement and Enterprise Services after the transfer has been completed. 7. The Office of Management and Enterprise Services sha ll coordinate the transfer of records, property , equipment, assets, funds, allotments, pur chase orders, liabilities, outstanding financial obligations, or encumbrances provided for in this subsection. SECTION 3. AMENDATORY Sec tion 3, Chapter 282, O.S.L. 2022 (47 O.S. Supp. 202 2, Section 3-103), is amended to read as follows: Section 3-103. A. The Executive Director of Service Oklahoma shall be appointed by the Governor with the a dvice and consent of the Senate. The Executive Director shall serve at the pleasure of the Governor and may be removed or replaced without c ause. ENR. S. B. NO. 37x Page 5 Compensation for the Executive Director shall be determined pursuant to Section 3601.2 of Title 74 of the Ok lahoma Statutes. The Executive Director may be removed from office by a two -thirds (2/3) vote of the members elected to and constituting eac h chamber of the Oklahoma Legislature. B. The Executive Director of Service Oklahoma shal l be the chief executive officer of Service Oklahoma and shall act for Service Oklahoma in all matters except as may be oth erwise provided by law. The powers and duties of the Executive Director shall include, but not be limited to: 1. Organize Service Oklahoma in a manner to ef ficiently achieve the objectives of Service Oklahoma; 2. Supervise all activities of Service Okla homa; 3. Administer programs and policies of Service Oklahoma; 4. Employ, discharg e, appoint, contract, and fix duties and compensation of employees at the discretion of the Executive Director; 5. Appoint assistants, deputies, officers, investigators, attorneys, and other employees as may be nec essary to carry out functions of Service Oklahoma; 6. Prescribe rules and regulatio ns for the operation of Service Oklahoma; 7. Provide input and recommendations to the Service Oklahoma Operator Board on all mat ters including branding and physical standardization requirements, customer service metrics, analysis, and improvement process es for licensed operators, and p rocesses for termination of licensed operators for failure to comply with the customer service met rics; 8. Establish internal policies and p rocedures; 9. Prescribe and provide suit able forms deemed necessary to carry out the functions of Service Oklahoma and any other laws the ENR. S. B. NO. 37x Page 6 enforcement and administration of which are vested in Service Oklahoma; 10. Establish such divisions, sections, comm ittees, advisory committees, offices, and positions in Service Oklahoma as the Executive Director deems necessary t o carry out the functions of Service Oklahoma; 11. Accept and disburse grants, allotments, gift s, devises, bequests, funds, appropriations, and other property made or offered to Service Oklahoma; and 12. Create the budget for Service Oklahoma to be submi tted to the Legislature each year. C. The salary and other expenses for the Executive Director shall be budgeted as a separate line item thr ough the Office of Management and Enterpr ise Services Service Oklahoma. The operating expenses of Service Oklahoma shall be set by the Executive Director and shall be budgeted as a separate line item through the Office of Management and Enterprise Service s Service Oklahoma. D. 1. The Executive Director of Service Oklahoma shall direct all purchases, hiring, procurem ent, and budget for Service Oklahoma of the Office of Management and Enterprise Services and establish, implement, and enforce policies and p rocedures related thereto, consistent with the Oklahoma Central Purchasing A ct. Service Oklahoma and the Executive Director shall be subject to the requirements of the Public Competitive Bidding Act of 1974, t he Oklahoma Lighting Energy Conservation Act, and the Public Building Construction and Planning Facilities Act. 2. The Executive Director of Service Oklahoma, o r any employee or agent of the Executive Director of Service Oklahoma acting within the scope of delegated authority, shall have the same pow er and authority related to purchases, hi ring, procurement, and budget for Service Oklahoma as outlined in paragrap h 1 of this subsection for Service Oklahoma as the State Purchasing Director has for all acquisitions used or consumed by state agencies as e stablished in the Oklahoma Central Purcha sing Act. Such authority shall, consistent with the authority granted to the State Purchasing Director pursuant to Section 85.10 of Title 74 of the Oklahoma ENR. S. B. NO. 37x Page 7 Statutes, include the power to designate financial or pro prietary information submitted by a bidde r confidential and reject all requests to disclose the information so desi gnated, if the Executive Director of Service Oklahoma requires the bidder to submit the financial or proprietary information with a bid, prop osal, or quotation. E. Service Oklahoma shall determine the compensation to be retained by licensed operators. 1. Before the last day in September in every even -numbered year, Service Oklahoma shall review the c ompensation paid to licensed operators and, if necessary, change the compensation. Service Oklahoma shall engage an independent third party to evaluate the compensation paid to licensed operators who shall provide any recommendations no later than Novembe r 1 in the even-numbered year. Any recommended change in licensed operator compensa tion shall be finalized by Service Oklahoma no later than the third Tuesda y of November in the even-numbered year. Notice of such recommendation shall be provided to the G overnor, the President Pro Tempore and the Chair of the Appropriations Committee of the Senate, and the Speaker and the Chair of the Appropriations and Budget Committee of the House of Representatives. 2. Any change in licensed operator c ompensation, unless rejected or amended as provided by this subsection, shall become effective on July 1 of the following calendar y ear. Any amendment passed by a majority vo te of each house of the Legislature shall become effective as provided by the amen dment unless vetoed by the Governor. SECTION 4. AMENDATORY Section 6, Chap ter 282, O.S.L. 2022 (47 O.S. Supp. 2022, Section 3 -106), is amended to re ad as follows: Section 3-106. A. There is hereby created in the State Treasury a revolving fund for Service Oklahoma to be designated the “Service Oklahoma Revolving Fund ”. The fund shall be a continuing fund, not subject to fiscal year limitations. Al l monies accruing to the credit of said the fund are hereby appropriated and shall be budgeted and expended by Service Oklahoma for the restr icted purposes of the monies as prescribe d by law. Expenditures from said ENR. S. B. NO. 37x Page 8 the fund shall be made upon warrants iss ued by the State Treasurer against claims filed as prescribed by law with the Director of the Office of Management and Enterprise Services fo r approval and payment. B. There is hereby created in the State Trea sury a revolving fund for Service Oklahoma to be designated the “Service Oklahoma Reimbursement Fund”. The fund shall be a continuing fund, not subject to fiscal year limitations. All m onies accruing to the credit of said the fund are hereby appropriated and shall be budgeted and expended by Service Oklahoma for the restricted purposes of the monies as prescribed by law. Expenditures from said the fund shall be made upon warrants issued by the State Treasurer against claims filed as prescribed by law wit h the Director of the Office of Management and Enterprise Services for approval and payment. C. There is hereby created in the State Treasury a revolving fund for Service Oklahoma, to be designated the “Service Oklahoma Computer Imaging System Revolving Fund”. The fund shall be a continuing fund not subject to fiscal year limitations. All monies accruing to the credit of said the fund are hereby appropriated and shall be budgeted and ex pended by Service Oklahoma for the purpos e of implementing, developi ng, administering, and maintaining the computer imaging system of Service Oklahoma. Expenditures from said the fund shall be made upon warrants issued by the State Treasurer against claims filed as prescribed by law with the Dir ector of the Office of Management and Enterprise Serv ices for approval and payment. D. There is hereby created in the State Treasury a revolving fund for Service Oklahoma to be designated the “Licensed Operator Performance Fund”. This fund shall be a con tinuing fund not subject to fiscal year limitations. All monies accruing to the credit of the fund are hereby appropriated an d shall be budgeted and expended by Service Oklahoma for the restricted purposes of the m onies as prescribed by law. Expenditures from the fund shall be made upon warrants issued by the State Treasurer a gainst claims filed as prescribed by law with the Di rector of the Office of Management and Enterprise Services for approval and payment. ENR. S. B. NO. 37x Page 9 1. The Licensed Operator Performance Fund sh all be distributed to licensed operators in accordance with the applicable metrics determined by Service Oklahoma. 2. In the event that excess funds exist in the Licensed Operator Performance Fund after distributio n to licensed operators pursuant to this subsection, the remainin g funds are authorized to be expended for the purp ose of purchasing back a licensed operator license from a licensed operator, pursuant to Section 1 140 of this title. SECTION 5. AMENDATORY 47 O.S. 2021, Section 6-101, as last amended by Section 37, Chapter 282, O.S.L. 2022 (47 O.S. Supp. 2022, Section 6-101), is amended to read as follows: Section 6-101. A. No person, excep t those hereinafter expressly exempted in Sections 6-102 and 6-102.1 of this title, shall operate any moto r vehicle upon a highway in this state unless the person has a valid Oklahoma driver license for the class of vehicle being operated under the provisi ons of this title. No person shall be permitted to possess more than one valid lice nse at any time, except as provided in paragraph 4 of subsection F of this section. B. 1. No person shall operate a Class A commercial motor vehicle unless the person is eighteen (18) years of age or old er and holds a valid Class A commercial license, ex cept as provided in paragraph 5 of this subsection and subsection F of thi s section. Any person holding a valid Class A commercial license shall be permitted to operate mo tor vehicles in Classes A, B, C a nd D, except as provided for in paragraph 4 of this subsection. 2. No person shall operate a Class B commercial motor vehicl e unless the person is eighteen (18) years of age or older and holds a valid Class B commercial li cense, except as provided in para graph 5 of subsection F of this section. Any perso n holding a valid Cl ass B commercial license shall be permitted to operate motor vehicles in Classes B, C and D, except as provided for in paragraph 4 of this subsection. 3. No person shall operate a Clas s C commercial motor vehicle unless the person is e ighteen (18) years of age or older and holds a ENR. S. B. NO. 37x Page 10 valid Class C commercial li cense, except as provided in subsection F of this section. Any person holding a valid Class C com mercial license shall be permitte d to operate motor vehicles in Classes C and D, except as provided for in paragraph 4 of this subsection. 4. No person under twenty-one (21) years of age shall be licensed to operate any motor vehicle which is required to be placarded for hazardous materi als pursuant to 49 C.F.R., Part 172, subpart F, except as provided in subsection F of this section; provided, a person eighte en (18) years of age or older may be licensed to operate a farm vehicle which is required to be pl acarded for hazardous materials p ursuant to 49 C.F.R., Part 172, subpart F, except as provided in subsection F of this section. 5. A person at least seventee n (17) years of age who successfully completes all examinations required by law may be issued by Service Oklahoma: a. a restricted Class A commercial license which shall grant to the licensee the privilege to operate a Class A or Class B commercial motor v ehicle for harvest purposes or a Class D motor vehicle, or b. a restricted Class B commercial lice nse which shall grant to the licensee the privilege to operate a Class B commercial motor vehicle for harvest purposes or a Class D motor vehicle. 6. No person shall operate a Class D motor vehicle unless the person is sixteen (16) years of age or older a nd holds a valid Class D license, except as provided for in Section 6 -102 or 6-105 of this title. Any person holding a valid Class D license shall be permitted to operate motor vehicles in Class D only. C. Any person issued a driver license pursuant to t his section may exercise the priv ilege thereby granted upon all streets and highways in this state. D. No person shall operate a motorcycle or motor -driven cycle without having a valid Class A, B, C or D license with a motorcycle endorsement. Except as o therwise provided by law, any new applicant for an original driver license shall be required to successfully ENR. S. B. NO. 37x Page 11 complete a written examination, vision examinatio n and driving examination for a motorcycle as prescribed by the Department of Public Safety, in co njunction with Service Oklahoma, and a certified state-approved motorcycle basic rid er course approved by the Department, in conjunction with Service Oklahoma , if the applicant is seventeen (17) years of age or younger to be eligible for a motorcycle endorsement thereon. The written exam ination and driving examination for a motorcycle sh all be waived by Service Oklahoma upon verification that the person has su ccessfully completed a certified Motorcycle Safety Foundation rider course approved by the Department, in conjunction with Service Oklahoma. E. Except as otherwise provided by law, any person who lawfully possesses a valid Oklahoma driver license which is eligible for renewal shall be required to successfully complete a written examination, vision exa mination and driving examination for a motorcycle as prescribed by the Department, i n conjunction with Service Oklahoma, and a certified state -approved motorcycle basic rider course approved by the Department, in conjunction with Service Oklahoma, if the person is seventeen (17) years of age or younger to be eligible for a motorcycle endo rsement. The written examination and driving examination for a motorcycle shall be waived by Service Oklahoma upon verification that the person has successfully completed a certified Motorcycle Safety Fou ndation rider course approved by the Department, in conjunction with Service Oklahoma. F. 1. Any person eighteen (18) years of age or older may apply for a restricted Class A, B or C commercial learner permit. Service Oklahoma, after the applicant has p assed all parts of the examination for a Class D li cense and has successfully passed all parts of the examination for a Class A, B or C commercial license other than the driving examination, may issue to the applicant a commercial learner permit which shal l entitle the person having immediate lawful posses sion of the commercial learner permit and a valid Oklahoma driver license or provisional driver license pursuant to Section 6-212 of this title to operate a Class A, B or C commercial motor vehicle upon th e public highways solely for the purpose of behind-the-wheel training in accordance with rules promulgated by the Department. 2. This commercial learner permit shall be issued for a period as provided in Section 6 -115 of this title of one hundred eighty ENR. S. B. NO. 37x Page 12 (180) days, which may be renewed one time for an add itional one hundred eighty (180) days; provided, such commercial learner p ermit may be suspended, revoked, canceled, denied or disqualified at the discretion of the Departm ent, with notice to Service Oklah oma, for violation of the restrictions, for failing to give the required or correct information on the application or for vio lation of any traffic laws of this state pertaining to the operation of a motor vehicle. Except as otherwise provided, the lawful possessor of a commercial learner permit who has be en issued a commercial learner permit for a minimum of fourteen (14) days may have the restriction requiring an accompanying driver removed by satisfactorily completing a driver’s examination; provided, th e removal of a restriction shall not authorize the operation of a Class A, B or C commercial motor vehicle if such operation is otherwise prohibited by law. 3. No person shall apply for and Service Oklahoma shall not issue an original Class A, B or C driv er license until the person has been issued a comme rcial learner permit and held the permit for at least fourteen (14) days. Any person who currently holds a Class B or C license and who wishes to apply for another class o f commercial driver license shall be required to apply for a commercial learner perm it and to hold the permit for at least fourteen (14) days before applying for the Class A or B license, as applicable. Any person who currently holds a Class A, B or C license and who wishes to add an end orsement or remove a restriction for which a skills examination is required shall be required to apply for a commercial learn er permit and to hold the permit for at least fourteen (14) days before applying for the endorseme nt. 4. A commercial learner perm it shall be issued by Service Oklahoma as a separat e and unique document which shall be valid only in conjunction with a vali d Oklahoma driver license or provisional driver license pursuant to Section 6 -212 of this title, b oth of which shall be in the poss ession of the person to whom they have been issued whenever that person is operating a commercial motor vehicle as provided i n this subsection. 5. After one renewal of a commercial learner permit, as provided in paragraph 2 of this subsection, a commercia l permit shall not be renewed again. Any person wh o has held a commercial learner permit for the initial issuance period and one renewal ENR. S. B. NO. 37x Page 13 period shall not be eligible for and Service Oklahoma shall not issue another renewal of the permit; provided, the per son may reapply for a new commercial learner permit , as provided for in this subsection. G. 1. For purposes of this title: a. “REAL ID Compliant Driver License” or “Identification Card” means a driver license or identific ation card issued by the State of Oklahoma this state that has been certified by the United States Department of Homeland Security (USDHS) as compliant with t he requirements of the REAL ID Act of 2005, Public Law No. 109-13. A REAL ID Compliant Driver Lic ense or Identification Card and the process through which it is issued incorporate a variety of security measures designed to protect the integrity and trustw orthiness of the license or card. A REAL ID Compliant Driver License or Identification Card will be clearly marked on the face indicating th at it is a compliant document, and b. “REAL ID Noncompliant Driver Licen se” or “Identification Card” means a driver license or identification card issued by the State of Oklahoma this state that has not been certi fied by the United States Department of Hom eland Security (USDHS) as being compliant with the requirements of the REAL ID Act of 2005. A REAL ID Noncompliant Driver License or Identification Card will be clearly marked on the face indicating that it is no t compliant with the federal REAL ID Act of 2005 and is not acceptable for official federal purposes. The driver license or identification card will have a unique design or color indicator that clearly distinguishes it from a compliant license or card. 2. Original Driver License and Identificatio n Card Issuance: a. Application for an original REAL ID Compliant or REAL ID Noncompliant Driver Li cense or Identification Card shall be made to Service Oklahoma. ENR. S. B. NO. 37x Page 14 b. Service Oklahoma employees shall perform all do cument recognition and other requirements n eeded for approval of an original REAL ID Compliant or REAL ID Noncompliant Driver License or Ident ification Card application. c. Upon approval of an original REAL ID Compliant or REAL ID Noncompliant Driver Licen se or Identification Card application, the applicant may take the appro ved application document to a licensed operator to receive a temporary driver license or identification card. d. The licensed operator shall process the approved REAL ID Compliant or REAL ID Noncompliant Driver License or Identification Card application an d upon payment shall provide the applicant a temporary driver license o r identification card. A temporary driver license or identification card shall afford the holder the privileges otherwise granted by the specific class of driver license or identificat ion card for the period of time listed on the temporary driver license or identification card or the period of time prior to the applicant receiving a REAL ID Compliant or REAL ID Noncompliant Driver License or Identification Ca rd, whichever time period is shorter. 3. REAL ID Compliant Driver License and Identification Card Renewal and Replacement: a. Application for renewal or replacement of a REAL ID Compliant Driver License or Identi fication Card may be made to Service Oklaho ma or to a licensed operator ; provided, such licensed operator is authorized to process application for REAL ID Compliant Driver Licenses and Identification Cards. A licensed operator may process the voluntary do wngrade of a REAL ID Compliant Commercial D river License to any lower class license upon request of the licensee; provided, no additional endorsements or restrictions are placed on the license. ENR. S. B. NO. 37x Page 15 b. Service Oklahoma employees or authorized licensed operators shall perform all document recognition and other requirements needed f or approval of a renewal or replacement REAL ID Compliant Driver Licens e or Identification Card application. c. Upon approval of a renewal or replacement REAL ID Compliant Driver Licens e or Identification Card application, the applicant may receive a tempo rary driver license or identification card from Service Oklahoma or an authorized licensed operator. d. A temporary driver license or identification card acquired under the provisions o f this paragraph shall afford the holder th e privileges otherwise grant ed by the specific class of driver license or identification card being renewed or replaced for the period of time listed on the temporary driver license or identification card or the p eriod of time prior to the applicant receiving a REAL ID Compliant Driv er License or Identification Card, whichever time period is shorter. e. For purposes of this title, an application for a REAL ID Compliant Driver License or Identification Card by an individual with a valid Oklahoma -issued driver license or identification card shall be considered a renewal of a REAL ID Compliant Driver Licens e or Identification Card. 4. REAL ID Noncompliant Driver License and Identification Card Renewal and Replacement: a. Application for renewal or replacement of a REAL ID Noncompliant Driver License or Identification Card may be made to Service Oklahoma or to a licensed operator. A licensed operator may process the voluntary downgrade of a REAL ID Noncompliant Commerc ial Driver License to any lower class licen se upon request of the licensee; provided, no additional endorsements or restrictions are added to the license. ENR. S. B. NO. 37x Page 16 b. Service Oklahoma employees or licensed operators shall perform all document recognition and other requirements needed for approval of a renew al or replacement REAL ID No ncompliant Driver License or Identification Card application. c. Upon approval of a renewal or replacement REAL ID Noncompliant Driver License or Identification Card application, the applicant may receive a temporary driver license or identification card f rom Service Oklahoma or a licensed operator. d. A temporary driver license or identific ation card acquired under the provisions of this paragraph shall afford the holder the privileges otherwise granted by the specific class of driver license or identifica tion card being renewed or replaced for the peri od of time listed on the temporary driv er license or identification card or the period of time prior to the applicant receiving a REAL ID Noncompliant Driver License or Identificat ion Card, whichever time per iod is shorter. H. 1. The fee charged for an a pproved application for an original Oklahoma REAL ID Compliant or REAL ID Noncompliant Driver License or an approved application for the addition of an endorsement to a current val id Oklahoma REAL ID Complia nt or REAL ID Noncompliant Driver License shall b e assessed in accordance with the following schedule: Class A Commercial Learner Permit $25.00 Class A Commercial License $25.00 Class B Commercial Learner Permit $15.00 Class B Commercial License $15.00 Class C Commercial Learner Permit $15.00 ENR. Notwithstanding the provisions of Section 1104 of this title, all monies collected from the fees cha rged for Class A, B and C commercial licenses pursuant to the provisions of this subsection shall be deposited in t he General Revenue Fund of this state. I. The fee charged for any failed examination shall be Fou r Dollars ($4.00) for any license classific ation. Notwithstanding the provisions of Section 1104 of this title, all mo nies collected from such examination fees pursuant to the provisions of this subsection shall be deposited in the General Revenue Fund of this state. J. In addition to any fee cha rged pursuant to the provisions of subsection H of this section, the fee cha rged for the issuance or renewal of a REAL ID Noncompliant Driver License shall be in accordance with the following schedule; provided, t hat any applicant who has a CDL Learner Per mit shall be charged only the replacement fee for the issuance of the licens e: License Class 4-year 8-year Class A Commercial Learner Permit $56.50 $113.00 Class A Commercial License $56.50 $113.00 Class B Commercial Learner Permit $56.50 $113.00 Class B Commercial License $56.50 $113.00 Class C Commercial Learner Permit $46.50 $93.00 Class C Commercial License $46.50 $93.00 ENR. In addition to any fee charged pursuant to the provisions of subsection H of this section, the fee c harged for the issuance or renewal of a REAL ID Compliant Driver License sha ll be in accordance with the following schedule; provided, that any applicant who has a CDL Learner Permit shall be charged only the repl acement fee for the issuance of the license : License Class 4-year 8-year REAL ID Compliant Class A Commercial Learner Permit $56.50 $113.00 REAL ID Compliant Class A Commercial License $56.50 $113.00 REAL ID Compliant Class B Commercial Learner Permit $56.50 $113.00 REAL ID Compliant Class B Commercial License $56.50 $113.00 REAL ID Compliant Class C Commercial Learner Permit $46.50 $93.00 REAL ID Compliant Cla ss C Commercial License $46.50 $93.00 REAL ID Compliant Class D License $38.50 $77.00 L. A commercial learner permit may be renewed one ti me for a period of one hundred eighty (180) days. The cost for the renewed permit shall be the same as for the origi nal permit. M. Notwithstanding the provisions of Section 1104 of this title, of each fee charged pursuant to the provisions of subsection s J, K and L of this section: 1. Five Dollars and fifty cents ($5.50) of a 4 -year license or Eleven Dollars ($11.00) of an 8-year license shall be deposited to ENR. S. B. NO. 37x Page 19 the Trauma Care Assistance Revolving Fund created in Se ction 1- 2530.9 of Title 63 of the Oklah oma Statutes; 2. Six Dollars and seventy-five cents ($6.75) of a 4 -year license or Thirteen Dollars and fifty cents ($ 13.50) of an 8-year license shall be deposited to the Department of Public Safety Computer Imaging System Revolving Fund to be used sole ly for the purpose of administrat ion and maintenance of the computerized imaging system of the Department through Octobe r 31, 2022. Beginning November 1, 2022, Six Dollars and seventy -five cents ($6.75) of a 4-year license or Thirteen Dollars and fifty ce nts ($13.50) of an 8-year license shall be deposited to the Service Oklahoma Computer Imaging System Revolving Fund to b e used solely for the purpose of administration and maintenance of the computerized imaging system of Service Oklahoma; 3. Ten Dollars ($10.00) of a 4-year license or Twenty Dollars ($20.00) of an 8-year license shall be deposited to the Department of Public Safety Revolving Fund for all original or renewal issuances of licenses through October 31, 20 22. Beginning November 1, 2022, Ten Dollars ($10.00) of a 4-year license or Twenty Dollars ($20.00) of an 8-year license shall be deposited to the Service Oklahoma Revolving Fund for all original or renewal issuances of licenses; and 4. Five Dollars ($5. 00) of a 4-year license or Six Dolla rs ($6.00) of an 8-year license shall be deposited to the State Public Safety Fund created in Section 2 -147 of this title. N. All original and renewal driver licenses shall expire as provided in Section 6 -115 of this title. O. 1. Any Through May 31, 2025, any person sixty-two (62) to sixty-four (64) years of age or older during the calendar year of issuance or renewal of a Class D license or motorcycle endorsement shall be charged the following prorated fee: 4-year 8-year Age 62 $21.25 $42.50 Age 63 $17.50 $35.00 ENR. S. B. NO. 37x Page 20 Age 64 $13.75 $27.50 Age 65 -0- 2. Any person sixty-five (65) years of age or older during the calendar year of issuance or renewal of a Class D license or motorcycle endorsement shall not be charged a fee. P. No person who has been h onorably discharged from active service in any branch of the Armed Forces of the United States or Oklahoma National Guard and who h as been certified by the United States Department of Veterans Affairs, its successor or the Armed Forces of the United States to be a disabled veteran in receipt of compensation at the one-hundred-percent rate for a permanent disability sustained through m ilitary action or accident resulting from disease contracted while in such active service and regi stered with the veterans re gistry created by the Oklahoma Department o f Veterans Affairs shall be charged a fee for the issuance, replacement or renewal of an Oklahoma driver license; provided, that if a veteran has been previously exempt from a fee pursua nt to this subsection, no registration with the veterans registry shal l be required. Q. In accordance with the provisions of subsection G of this section, Service Oklahoma is authorized to promulgate rules for the issuance and renewal of driver licenses a uthorized pursuant to the provisions of Sections 6-101 through 6-309 of this title; provided, that no such rules applicable to the issuance or renewal of REAL ID Noncompliant Driver Licenses shall create more stringent standards than such rules applicable as of January 1, 2017, unl ess directly related to a specific change in statutory law concerning standards for REAL ID Noncompliant Driver Licenses. Applicati ons, upon forms approved by Service Oklahoma, for such licenses shall be handled, in accordance with the provisions of subse ction G of this section, by the licensed operator; provided, Service Oklahoma is authorized to assume these duties in any county of this state. Each licensed operator accepting applications for driver licenses shall receive Six Dollars ($6.00) for a 4 -year REAL ID Noncompliant Driver License or Twelve Dollars ($12.00) for an 8-year REAL ID Noncompliant Driver License or Ten Dollars ($ 10.00) for a 4-year REAL ID Compliant Driver License or Twenty Dollars ($20.00) for an 8 -year REAL ID ENR. S. B. NO. 37x Page 21 Compliant Driver Licen se to be deducted from the total collected f or each license or renewal application accepted through June 30, 2023 . Beginning July 1, 2022, and ending on June 30, 2023, each motor license agent or licensed operator accepting appli cations for driver licenses for individuals over the age of sixty-five (65) years or for applications for drivers pursuant to subsection P of this section shall receive Six Dollars ($6.00) for a 4 -year driver license or Twelve Dollars ($12.00) for an 8 -year driver license to be deducted daily by the motor license agent or licensed operator receipts. Beginning July 1, 2023, these fees shall be retained by the licensed operator pursuant to subsection E of Section 1141.1 of this title. The fees received by t he licensed operator, auth orized by this subsection, shall be used for operating expenses. The amount retained pursuant to this subsection shall not be retai ned by any state agency. The fees received by the licensed operator, authorized by this subsectio n, shall be used for opera ting expenses. For purposes of this subsection, “licensed operator” shall mean an individual who obtains a license from the Service Oklahoma Operator Board to operate a designated Service Oklahoma location and offers third-party fulfillment of designated services to be rendered by Service Oklahoma. R. Notwithstanding the provisions of Section 1104 of this title and subsection Q of th is section and except as provided in subsections H and M of this section, the first Sixty Thousand Dollars ($60,000.00) of all monies collected pursuant to this section shall be paid by the Oklahoma Tax Commission to the State Treasurer to be deposited in the General Revenue Fund of the State Treasury. The next Five Hundred Thousand Dollars ($500,000.0 0) of monies collected pursuant to this section shall be paid by the Tax Commission to the State Treasurer to be deposited each fiscal year under the provisions of this section to the credit of the Department of Public Safety Restricted Revolving Fund for the purpose of the Statewide Oklahoma Law Enforcement Communications Telecommunications System. All other monies collected in excess of Five Hundred Sixty Thousand Dollars ($560,000.00) each fiscal year shall be apportioned as provided in Section 1104 of this title, except as ot herwise provided in this section. ENR. S. B. NO. 37x Page 22 S. Service Oklahoma shall retain the images displayed on licenses and identification cards issued p ursuant to the provisions of Sections 6-101 through 6-309 of this title which may be used only: 1. By a law enforcement agency for purposes of criminal investigations, missing perso n investigations or any law enforcement purpose which is deemed necessary by the Commissioner of Public Safety; 2. By the driver licensing agency of another state for its official purpose; and 3. As provided in Se ction 2-110 of this title. All agencies approved by the Oklahoma Law Enforcement Telecommunications System (OLETS) or the National Law Enforcement Telecommunications System (NLETS) to receive photographs or computerized images may obtain them through OLETS or through NLETS. Photographs or comput erized images may be obtained by law enforcement one inquiry at a time. The computer system and related equipment acquired for this purpose must conform to industry standar ds for interoperability and open architecture. The Department of Public Safety may promulgate rules to implement the provisions of this subsection. T. No person may hold more than one state-issued or territory- issued REAL ID Compliant Driver License or R EAL ID Compliant Identification Card from O klahoma or any other state or territory. Service Oklahoma shall not issue a REAL ID Compliant Driver License to a person who has been previously issued a REAL ID Compliant Driver License or REAL ID Compliant Iden tification Card until such license or identification card has been surrendered to Se rvice Oklahoma by the applicant. Service Oklahoma may promulgate rules related to the issuance of replacement REAL ID Compliant Driver Licenses in the event of loss or the ft. U. Upon the effective date of this act Beginning May 24, 2021, and ending on April 30, 2023 June 30, 2023, in addition to the amounts provided in subsect ion Q of this section, a licensed operator shall receive Five Dollars ($5.00) for each processed ENR. S. B. NO. 37x Page 23 application for a REAL ID Compliant 4-year Driver License and Ten Dollars ($10.00) for each processed application f or a REAL ID Compliant 8-year Driver License. Any additional amounts provided pursuant to this subsection shall not be retained by Service Oklahoma. SECTION 6. AMENDATORY 47 O.S. 2021, Section 6 -105.3, as last amended by Section 1 , Chapter 65, O.S.L. 2022 (47 O.S. Supp. 2022, Section 6-105.3), is amended to read as follows: Section 6-105.3. A. In addition to the lice nses to operate motor vehicles, the Departm ent of Public Safety may issue cards to Oklahoma residents for purposes of identification only. The identification cards shall be issued, renewed, replaced, canceled and denied in the same manner as driver licens es in this state. A licensee whose record reflects a notation of the person’s proof of legal presence, verified by the U.S. Department of Homeland Security, or proof of U.S. citizenship, may obtain a REAL ID Compliant Identification Card or a Noncompliant Identification Card from a motor license a gent or the Department of Public Safety, regardless of the status of the license held by the licensee. Provided, the licensee must comply with all REAL ID documentation requirements to obtain a REAL ID Compliant Identification Card. A person shall not apply for or possess more than one state-issued or territory-issued REAL ID Compliant Identification Card pursuant to the provisions of Section 6-101 of this title. The application for an identification card by any person under the age of eighteen (18) years shall be signed and verified by a custodial legal parent or legal guardian, either in person before a person authorized to administer oaths or electronically if completing an online application, or a notarized af fidavit signed by a custodial legal parent or legal guardian submitted before a person authorized to administer oaths by the person under the age of eighteen (18) years with the application. Except as otherwise provided in this section, the identification cards shall be valid for a period of eithe r four (4) years from the month of issuance or eight (8) years from the month of issuance; however, the identification cards issued to persons sixty-five (65) years of age or older shall be valid indefinitely from the month of issuance. ENR. S. B. NO. 37x Page 24 B. 1. The Department of Corrections shall coordinate with the Department of Public Safety to provide REAL ID Noncompliant Identification Cards to all inmates who do not have a current state - issued identification card or driver lic ense upon their release from custody. The identification cards shall be issued, replaced, canceled and denied in the same manner as driver licenses in this state. 2. The Department of Public Safety shall allow the use of a certified copy of a birth certi ficate coupled with a Department of Corrections-issued consolidated record card to serve as a valid form of photo identification documentation to obtain a REA L ID Noncompliant Identification Card. 3. REAL ID Noncompliant Identification Cards issued with a consolidated record card from the Departme nt of Corrections for inmates shall be valid for a period of four (4) years from the month of issuance for an allow able fee to be determined by the Department of Public Safety and are nonrenewable and nontransfera ble. 4. The fee charged for the issuance o r replacement of a REAL ID Noncompliant Identification Card pursuant to this subsection shall be deposited in the D epartment of Public Safety Revolving Fund. Provided, however, REAL ID Noncompliant Identification Cards issued to individuals required to re gister pursuant to the Sex Offenders Registration Act shall only be valid for a period of one (1) year. No person sixty-five (65) years of age or older shall be charged a fee for a REAL ID Noncompliant Identifica tion Card. 5. The Department of Public Saf ety is authorized to promulgate rules and procedures to implement the provisions of this subsection. C. No person shall hold more than one state-issued or territory-issued REAL ID Compliant Driver License or REAL ID Compliant Identification Card, as defin ed in subsection G of Section 6-101 of this title. The Department shall not issue a REAL ID Compliant Identificati on Card to any applicant who has been previously issued a REAL ID Compliant Driver License or REAL ID Compliant Identification Card unless su ch license or identification card has been surrendered to the Department by the applicant. The Department may promulgate rules related to the issuance of ENR. S. B. NO. 37x Page 25 replacement REAL ID Compliant Identification Cards in the event of loss or theft. D. The fee charged for the issuance or renewal of a REAL ID Compliant Identification Card shall be Twenty -five Dollars ($25.00) for a 4-year card and Fifty Dollars ($50.00) for an 8 -year card. The fee charged for the issuance or r enewal of a REAL ID Noncompliant Identifica tion Card pursuant to this sect ion shall be Twenty-five Dollars ($25.00) for a 4 -year card and Fifty Dollars ($50.00) for an 8-year card; however, no person sixty -five (65) years of age or older, or one hundred pe rcent (100%) disabled veteran described in subsection P of Section 6-101 of this title shall be charged a fee for an identification card. Of each fee charged pursuant to the provisions of this subsection: 1. Seven Dollars ($7.00) of a 4 -year card and Fourteen Dollars ($14.00) of an 8-year card shall be apportioned as provided in Section 1104 of this title; 2. Three Dollars ($3.00) of a 4 -year card and Six Do llars ($6.00) of an 8-year card shall be credited to the Department of Public Safety Computer Imag ing System Revolving Fund to be used solely for the purpose of the adminis tration and maintenance of the computerized imaging system of the Department; 3. Ten Dollars ($10.00) of a 4-year card and Twenty Dollars ($20.00) of an 8-year card shall be deposit ed in the Department of Public Safety Revolving Fund; 4. Three Dollars ($ 3.00) of a 4-year card and Six Dollars ($6.00) of an 8-year card shall be deposited to the State Public Safety Fund created in Section 2 -147 of this title; and 5. Two Dollars ($2.00 ) for a 4-year card and Four Dollars ($4.00) for an 8-year card of the fee authorized by this subsection related to the issuance or renewal of an identificati on card by a motor license agent that does process approved applications or renewals for REAL ID C ompliant and REAL ID Non -Compliant Driver Licenses or Identification Card s shall be retained by the motor license agent licensed operator through June 30, 202 3. Beginning July 1, 2023, these monies shall be retained by the licensed operator pursuant to su bsection E of Section 1141.1 of this title . ENR. S. B. NO. 37x Page 26 E. The fee charged for repl acement of a REAL ID Compliant Identification Card, or REAL ID Non -Compliant Identification Card, shall be Twenty-five Dollars ($25.00); however, no person sixty -five (65) years of age or older shall be charged a fee for an identification card replacement. Of each fee charged pursuant to the provisions of this subsection: 1. Seven Dollars ($7.00) shall be apportioned as provided in Section 1104 of this title; 2. Three Dollars ($3.0 0) shall be credited to the Department of Public Safety Computer Imaging S ystem Revolving Fund to be used solely for the purpose of the administration and maint enance of the computerized imaging system of the Department; 3. Ten Dollars ($10.00) shall be deposited in the Department of Public Safety Revolving Fund; 4. Three Dollars ($3.00) shall be deposited to the State Public Safety Fund created in Section 2 -147 of this title; and 5. Two Dollars ($2.00) of the fee authorized by this subsection related to the replacement of an identification card by a motor license agent that d oes process approved applications or renewals for REAL ID Compliant or REAL ID Non -Compliant Driver Licenses or Identification Cards shall be retained by the motor license agent licensed operator through June 30, 2023. Beginning July 1, 2023, these monies shall be retained by the licensed operator pursuant to subsection E of Section 1141.1 of this title. F. The Oklahoma Tax Commission is hereby authorized to reimburse, from fund s available to that agency, each motor license agent issuing an identification card to a person sixty-five (65) years of age or older, an amount not to exceed One D ollar ($1.00) for each card or driver license so issued through June 30, 2023 . The Tax Commission shall develop procedures for claims for reimbursement. G. Notwithstanding any other provision of law, when a person makes application for a new identificati on card, or makes application to renew an identification card, and the person has been ENR. S. B. NO. 37x Page 27 convicted of, or received a deferred judgment for, any offense required to register pursuant to the Sex Offenders Registration Act, the identification card shall be vali d for a period of one (1) year from the month of issuance, but may be renewed yearly during the time the person is subject to registration on the Sex Offender Registry. The cost for such identification card shall be the same as for other identification ca rds and renewals. H. Nothing in this section requires or authorizes the Department of Public Safety to issue a REAL ID Noncompliant Identification Card without the docum entation required by the provisions of paragraph 9 of subsection A of Section 6 -103 of this title. SECTION 7. AMENDATORY 47 O.S. 2021, Section 6 -114, as amended by Section 54, Chapter 282, O.S.L. 2 022 (47 O.S. Supp. 2022, Section 6-114), is amended to read as follows: Section 6-114. A. 1. In the event that a dri ver license is lost, destroyed, or requires the updating of any informa tion, restriction or endorsement displayed thereon, the person to whom such license was issued may obtain a rep lacement thereof pursuant to the provisions of subsection G of Section 6 -101 of this title, and upon payment of the required fee. If the person is an alien, the person shall appear before Service Oklahoma or a lice nsed operator and, after furnishing prima ry and secondary proofs of identity as required in this section, shall be issued a replacement driver license for a period which does not exceed the lesser of: a. the expiration date of the license being replaced, o r b. the expiration date on the valid doc umentation authorizing the presence of the person in the United States, as required by paragraph 9 of subsection A of Section 6-103 of this title. 2. The cost of a replacement license shall be Twenty -five Dollars ($25.00), of which: a. Two Dollars ($2.00) shall be apportioned as provided in Section 1104 of this title, ENR. S. B. NO. 37x Page 28 b. Three Dollars ($3.00) shall be remitted to the State Treasurer to be credited to the General Revenue Fund, c. Five Dollars ($5.00) shall be credite d to the Department of Public Safety Comp uter Imaging System Revolving Fund to be used solely for the purpose of administering and maintaining the computer imaging system of the Departme nt through October 31, 2022. Beginning November 1, 2022, Five Dollars ($5.00) shall be credited to the Service Oklahoma Computer Imaging System Revolving Fund to be used solely for the purpose of administering and maintaining the computer imaging system of Service Oklahoma, d. Ten Dollars ($10.00) shall be credited to the Revolving Fund of the Department of Public Safety through October 31, 2022. Beginning November 1, 2022, the Ten Dollars ($10.00) shall be credited to the Service Oklahoma Revolving Fund, e. Three Dollars ($3.00) shall be deposited to the State Public Safety Fund created in Section 2 -147 of this title, and f. (1) Two Dollars ($2.00) of the fee authorized by this paragraph related to the replacement of a driver license by a licensed operato r that does not process approved applications or renewals for REAL ID Compliant Driver Licenses or Identification Cards shall be deposited, in addition to the amount authorized by subpa ragraph e of this paragraph, to the State Public Safety Fund created in Section 2-147 of this title, or (2) Two Dollars ($2.00) of the fee au thorized by this paragraph related to the replacement of a driver license by a licensed operator that does process approved applications or renewals for REAL ID Compliant Driver Licenses or Identification Cards shall be retained by the licensed operator through June 30, 2023. Beginning July 1, 2023, these monies shall be retained by the licensed ENR. S. B. NO. 37x Page 29 operator pursuant to s ubsection E of Section 1141.1 of this title. 3. Service Oklahoma shall promulgate rules prescribi ng forms of primary and secondary identific ation acceptable for replacement of an Oklahoma driver license; provided, however, a valid and unexpired U.S. passport shall be acceptable as both primary and secondary identification. B. Any person desiring to a dd or remove an endorsement or endorsements or a restriction or restrictions to any existing driver license, when authorized by Service Oklahoma, shall obtain a replacement license with the endorsement or endorsements or the restriction or restrictions cha nge thereon and shall be charged the fee for a replacement license as provided in su bsection A of this section. SECTION 8. AMENDATORY 47 O.S. 2021, Section 6-117, as amended by Section 57, Chapter 28 2, O.S.L. 2022 (47 O.S. Supp. 2 022, Section 6-117), is amended to read as follows: Section 6-117. A. Service Oklahoma shall file every application for a driv er license or identification c ard received by Service Oklahoma and shall maintain suitable indexes conta ining: 1. All applications denied and on each thereof note the rea sons for the denial; 2. All applications granted; 3. The name of every person whose driving privilege has been suspended, revoked, canceled, or disqualified by Service Oklahoma and after each such name note the reasons for the action. Any notation of suspension of the driving privilege of a pe rson for reason of nonpayment of a fine shal l be removed from the driving record after the person has paid the fine and the driving privilege of the person is reinstated as provided for by law; 4. The county of res idence, the name, date of birth, and mailing address of each person residing in that county who is eighteen (18) years of age or older, and who is the holder of a current driver license or a current identification card issued by ENR. S. B. NO. 37x Page 30 Service Oklahoma for the pu rpose of ascertaining names of all persons qualified for jury service as required by Section 18 of Title 38 of the Oklahoma Statutes; and 5. The name, driver license number, and maili ng address of every person for the purpose of giving notice, if necessar y, as required by Section 2 -116 of this title. B. Service Oklahoma shall file all co llision reports and abstracts of court records of convictions received by it pursuant to the laws of this state and maintain con venient records of the records and reports or make suitable notations in order that an individual record of a person showing the convictions of the person and the traffic collisions in which the person has been involved shall be readily ascertainable and a vailable for the consideration of Service Oklahoma upon any application for a driver license or renewal of a driver license and at other suitable times. Any abstract, index or other entry relating to a driving record according to the licensing authority i n another state or a province of Canada may be posted upon the driving record of any resident of this state when notice thereof is received by documentation o r by electronic transmission. The individual record of a person sha ll not include any collision r eports and abstracts of court records involving a collision in which the person was not issued a citation or if a citation is is sued and the person was not co nvicted. C. 1. Service Oklahoma may designate and is hereby autho rized to prepare under the seal of Service Oklahoma and deliver upon request a copy of any collision report on file with the Department, charging a fee of: a. beginning on July 1, 2011, thr ough June 30, 2013, Fifteen Dollars ($15.00), of which Eight Dolla rs ($8.00) shall be deposited by the Commissioner to the credit of the Department of Public Safety Revolving Fund and, in addition to other purposes authorized by law, the expenditures from that fund of monies derived from the Eight Dollars ($8.00) pursuan t to this subparagraph shall be used to fund any Oklahoma Highway Patrol Trooper Academy provided by the Department of Public Safety. Any remaining funds shall be deposited in an account to be utilized ENR. S. B. NO. 37x Page 31 exclusively for future expenses directly related to the operation of an Oklahoma High way Patrol Academy, and b. beginning on July 1, 2013, and any year thereafter, Seven Dollars ($7.00). However, Service Oklahoma shall not be required to furni sh personal information from the collision report which is contr ary to the provisions of the Drive r’s Privacy Protection Act, 18 United States Code, Sections 2721 through 2725. 2. Notwithstanding the provisions of paragraph 1 of this subsection, Service O klahoma is authorized to enter into contracts to supply information regarding vehicles reported to be involved in collisions. For each vehic le, the information shall be limited to that which only describes the vehicle and the collision. Service Oklahoma shall not be required to provide any information regarding the owner or operator of the vehicle or any information which would conflict with Section 2-110 or Section 1109 of this tit le. D. Service Oklahoma or any licensed ope rator upon request shall prepare and furnish to any authorized person a Motor Vehicle Report of any person subject to the provis ions of the motor vehicle laws of this state. However, Service Oklahoma shall not b e required to furnish personal information f rom a driving record contrary to the provisions of the Driver’s Privacy Protection Act, 18 U nited States Code, Sections 2721 thr ough 2725. The Motor Vehicle Report shall be a summary of the driving record of the person and shall include the enumeration of any motor vehicle collisions, reference to convictions for violations of motor vehicle laws , and any action taken against the privilege of the person to operate a motor vehicle, as shown by the files of Service Oklahoma for the three (3) years preceding the date of the request. The M otor Vehicle Report, to include any record or information asso ciated with the Motor Vehicle Report, shall not be deemed a “public civil record” as defined in Section 18 of Title 22 o f the Oklahoma Statutes, and shall not be subject to expungement. Service Oklahoma shall not be required to release to any person, in w hole or in part and in any format, a driving index, as described in subsection A of this section, except as otherwise pr ovided for by law. For each Motor Vehicle Report furnished by Service Okl ahoma, Service Oklahoma shall ENR. S. B. NO. 37x Page 32 collect the sum of Twenty -five Dollars ($25.00), Twenty Dollars ($20.00) of which shall be deposited in the Gen eral Revenue Fund and Five Dollars ($5.00) shall be deposited in the Department of Pu blic Safety Revolving Fund thr ough October 31, 2022. Beginning November 1, 2022, the Five Dollars ($5.00) shall be deposited in the Service Oklahoma Revolving Fund. For each Motor Vehicle Report furnished by a licensed operator, the licensed operator sha ll collect the sum of Twenty-five Dollars ($25.00), Eighteen Dollars ($18.00) of which shall be paid to the Oklahoma Tax Commiss ion for deposit in the General Revenue Fund in the State Treasury, Five Dollars ($5. 00) shall be deposited in the Department of Public Safety Revolving Fund and Two Dollars ($2.00) of which shall be retained by the licen sed operator through October 31, 202 2. Beginning November 1, 2022, for each Motor Vehicle Report furnished by a license d operator, the licensed operator shall coll ect the sum of Twenty -five Dollars ($25.00), Eighteen Dollars ($18.00) of which shall be pai d to the Oklahoma Tax Commission for deposit in the General Revenue Fund in the State Treasury, Five Dollars ($5.00) sha ll be deposited in the Service Oklahoma Revo lving Fund, and Two Dollars ($ 2.00) shall be retained by the licensed operator through June 30, 2025. Beginning July 1, 2025, Eighteen Dollars ($18.00) of the fee shall b e paid to the Oklahoma Tax Commission for deposit in the General Revenue Fund in the State Treasury, Five Dollars ( $5.00) shall be deposited in the Service Oklahoma Revolving Fu nd, and Two Dollars ($2.00) shall be retained by the licensed operator pursuant to subsection E of Section 1141.1 of thi s title. Persons sixty-five (65) years of age or older shall not be requi red to pay a fee for their own Motor Vehicle Report furnished by Service Oklahoma or a licensed op erator. For purposes of this subsection, a Motor Vehicle Report shall include a report which indicates that no driving record is on file with Service Oklahom a for the information received by Service Oklahoma in the requ est for the Motor Vehicle Report. E. Service Oklahoma may develop procedures w hereby an acting agent of an employer or an employer of a person: 1. Who has a Class A, B, C or D driver license; and 2. Who operates a commercial, company -owned or personal motor vehicle during the course of bu siness in the course of his or her employment with the employer, may automatically b e notified, pursuant to a fee schedule esta blished by Service Oklahoma, sh ould ENR. S. B. NO. 37x Page 33 the driving record of a person reflect a traffic convi ction in any court or an administrative action by Service Oklahoma which alters the status of the commercial driving privil eges of the person, or any other change to the driving status. The notifi cation system shall include electronic delivery of a Motor Vehicle Report at least annually for any employee who is a commercial driver licen see or who operates a commercial motor ve hicle, as required by 49 C.F.R., Section 391.25, or who operates a company -owned or personal motor vehicle during the course of busin ess. All monies received by the Commissioner of Public Safety and the officers an d employees of the Department pursuant to this subsection shall be deposited in the Department of Public Safety Res tricted Revolving Fund through October 31, 2022. Beginning November 1, 2022, all monies received by the Director of Service Oklahoma and the officers and employees of Service Oklahoma pursuant to this subsection shall be dep osited in the Service Oklahoma Revolving Fund. For each Motor Vehicle Report furnished by Service Oklahoma, through the electron ic notification system, Service Oklahoma sh all collect the sum of Twenty-five Dollars ($25.00), Eighteen Dollars ($18.00) of wh ich shall be deposited in the G eneral Revenue Fund in the State Treasury. Five Dollars ($ 5.00) shall be deposited in the Departm ent of Public Safety Revolving Fund through October 31, 2022. Beginning November 1, 2022, for each Motor Vehicle Report furnis hed by Service Oklahoma, through the electronic notification system, Service Oklahoma shall collect the sum of Twenty -five Dollars ($25.00), Eighteen Dollars ($18.00) of wh ich shall be deposited in the General Revenue Fund in the State Treasury, Five Dolla rs ($5.00) shall be deposited in the Service Oklahoma Revolving Fund. Two Dollars ($2.00) shall be retained by Service Oklahoma or its authorized agent for the purpose of development and maintenance of the electronic notification system. F. Service Oklahoma is authorized to establish a procedure for reviewing the driving records of state res idents who are existing policyholders of any insurance company licensed to operate in this state during specified periods of time and producing a repo rt which identifies the policyholders which have had violation and/or status changes to their driving reco rds during such time period. Service Oklahoma may sell such report to the insuranc e company or its agent at a fee to be set by Service Oklahoma. Any such report sold by Service Oklahoma shall only consist of information otherwise lawfully obtainable by t he insurance company or its agent. The fee ENR. S. B. NO. 37x Page 34 shall be sufficient to recover all cost s incurred by Service Oklahoma and ensure that there will be no net revenue loss to the state. Such fee shall be d eposited in the Department of Public Safety Revolving Fund through October 31, 2022. Beginning No vember 1, 2022, such fee shall be deposited in the Service Oklahoma Revolving Fund. G. All monies received by the Commissioner of Public Safety or Service Oklahoma and the officers and employees of the Department shall be remitted to the State Treasurer t o be credited to the General Revenue Fund i n the State Treasury except as otherwise provided for by law. SECTION 9. AMENDATORY 47 O. S. 2021, Section 1103, is amended to read as follows: Section 1103. A. It is the intent of the L egislature that the owner or owners of ever y vehicle in this state shall posse ss a certificate of title as proof of ownership and that every vehic le shall be registered in the name of the owner or owners thereof. All registration and license fees and mile age taxes imposed by this act the Oklahoma Vehicle License and Registration A ct shall be for the purpose of providing funds for the general governmental funct ions of the state, counties, municipal ities and schools and for the maintenance and upkeep of the avenues of public access of this state. Such registration and license fees shall ap ply to every vehicle operated upon, over, al ong or across any avenue of pu blic access within this state and when paid in full, shall be in lieu of all other taxes, general and local, unless otherwise specifically provided. B. Unless otherwise provided, al l fees to be retained by the licensed operator pursuant to the Oklahoma Ve hicle License and Registration Act, sh all be retained by the licensed operator pursuant to subsection E of Section 1141.1 of this title. 1. This section shall apply to subsection H of Section 1105, Section 1115, 1132, 1132.1 , 1132.4, 1135.1, 1135.2, 1135. 3, subsection H of Section 1140, and Section 1151 of this title, and Section 2103 of Title 68 of the Oklahoma Statutes , beginning July 1, 2023. ENR. S. B. NO. 37x Page 35 2. This section shall apply to subsec tions G, L, M, N, and R of Section 1105, Sections 1107.4, 1110, 1116, 1126 , 1135.4, 1135.7, 1135.9, and 1143 of this title, and Section 4021 of Title 63 of the Oklahoma Statutes, beginning July 1, 2025. SECTION 10. AMENDATORY 47 O. S. 2021, Section 1104, as last amended by Section 1, Chapter 363, O.S.L. 2 022 (47 O.S. Supp. 2022, Section 1104), is amended to read as follows: Section 1104. A. Unless otherwise provided by law, all fees, taxes and penalties collected or received pursua nt to the Oklahoma Vehicle License and Regist ration Act or Section 1 -101 et seq. of this title shall be apportioned and dist ributed monthly by the Oklahoma Tax Commission in accordance with this section. Service Oklahoma shall provide to the Oklahoma Tax Comm ission monthly reports of motor vehicle collection information, including, but not limited to, motor vehicle monthly apportionment information, refunds, canceled vouchers, waste tire collections, organ donor program amounts, driver license records, prorat e amounts, and sales tax amounts. The reports shall be delivered elect ronically pursuant to the current calendar year apportionment disbursement schedule provided to Service Oklahoma by the Oklahoma Tax Commission on or before December 1st annually. One percent (1%) of fees collected shall be apportio ned to the Licensed Operator Performance Fund created in Section 3 -106 of this title, in accordance with the applicable m etrics determined by Service Oklahoma. B. 1. The following percentages of the monies referred to in subsection A of this section shal l be apportioned to the various school districts in accordance with para graph 2 of this subsection: a. from October 1, 2000, until June 30, 2001, thirty -five and forty-six one-hundredths percent (35.46%), b. for the year beginning July 1, 2001, and ending June 30, 2002, thirty-five and ninety-one one-hundredths percent (35.91%), ENR. S. B. NO. 37x Page 36 c. for the year beginning July 1, 2002, throug h the year ending on June 30, 2015, t hirty-six and twenty one- hundredths percent (36.20%), d. for the year beginning July 1, 2015, thro ugh the year ending on June 30, 2019, thirty-six and twenty one- hundredths percent (36.20%), but in no event shall the amount apportioned in any fiscal year p ursuant to this subparagraph exceed the total amount apportioned for the fiscal year ending on Jun e 30, 2015. Any amounts in excess of such limitation shall be place d to the credit of the General Revenue Fund, and e. for the year beginning July 1, 2019, a nd all subsequent years, thirty -six and twenty one-hundredths percent (36.20%), but in no event sh all the amount apportioned in any fiscal year pursuant to this subparagraph exceed the total amount apportioned for the fiscal year ending on June 30, 2015. Any amounts in excess of such limitation shall be placed to the credit of the Rebuilding Oklahoma Access and Driver Safety Fund created in Section 1521 of Title 69 o f the Oklahoma Statutes. 2. The monies apportioned pu rsuant to subparagraphs a through e of paragraph 1 of this subsection shall be apportioned to the various school districts so that each district shall receive an amount based upon the proportion that e ach district’s average daily attendance bears to the to tal average daily attendance of those districts entitled to receive funds pursuant to this section as certified by the State Department of Education. Each district’s allocation of funds shall be remit ted to the county treasurer of the county wherein the ad ministrative headquarters of the dist rict are located. No district shall be eligible for the funds herein provided unless the district makes an ad valorem tax levy of fifteen (15) mills and maintains nine (9) years of instruction and pursuant to the rules of the State Board of Education, is a uthorized to maintain ten (10) years of instruction. ENR. S. B. NO. 37x Page 37 C. The following percentages of the monies r eferred to in subsection A of this section shall be remitted to the State Treasurer to be credited to the General Revenue Fund of the State Treasury: 1. From October 1, 2000, until June 30, 2001, forty -five and ninety-seven one-hundredths percent (45.97%) ; 2. For the year begin ning July 1, 2001, and ending June 30, 2002, forty-five and twenty-nine one-hundredths percent (4 5.29%); 3. For the year beginning Ju ly 1, 2002, and for the subsequent fiscal years ending June 30, 2007, forty -four and eighty-four one- hundredths percent (4 4.84%); 4. For the year beginning July 1, 2007, and ending June 30, 2008, thirty-nine and eighty-four one-hundredths percent (39.84%) ; 5. For the year beginning July 1, 2008, and ending June 30, 2009, thirty-four and eighty-four one-hundredths percent (3 4.84%); 6. For the period beginning July 1, 2009, and ending December 31, 2012, twenty-nine and eighty-four one-hundredths percent (29.84%); 7. For the period beginning January 1, 2013, and ending June 30, 2013, twenty-nine and thirty-four one-hundredths percent (29.34%); 8. For the year beginning July 1, 2013, and ending June 30, 2014, twenty-six and eighty-four one-hundredths percent (26.84%); and 9. For the year beginning July 1, 2014, through the year ending June 30, 2019, twenty-four and eighty-four one-hundredths percent (24.84%). D. The following percentages of the monies referred to in subsection A of this section shall be re mitted to the State Treasurer to be credited to the State Transportation Fund: ENR. S. B. NO. 37x Page 38 1. From October 1, 2000, until June 30, 20 01, thirty one- hundredths percent (0.30%); 2. For the year beginning July 1, 2001, through the y ear ending on June 30, 2015, thirty-one one-hundredths percent (0.31%); 3. For the year beginning July 1, 2015, through the year endin g on June 30, 2019, thir ty-one one-hundredths percent (0.31%), but in no event shall the amount apportioned in any fiscal year pursuant to this paragraph exceed the total amount apportioned for the fiscal year ending on June 30, 2015. Any amounts in exces s of such limitation shall be placed to the credit of the General Revenue Fund; and 4. For the year beginning July 1, 20 19, and all subsequent years, thirty-one one-hundredths percent (0.31%), but in no event shall the amount apportioned in any fiscal yea r pursuant to this paragraph exceed the total amount apportioned for the fiscal year ending on June 30, 2015. Any amount s in excess of such limitatio n shall be placed to the credit of the Rebuilding Oklahoma Access and Driver Safety Fund created in Sectio n 1521 of Title 69 of th e Oklahoma Statutes. E. 1. The following percentages of the monies referred to in subsection A of this section shall be appo rtioned to the various counties as set forth in paragraph 2 of this subsection: a. from October 1, 2000, u ntil June 30, 2001, seve n and nine one-hundredths percent (7.09%), b. for the year beginning July 1, 2001, and ending Jun e 30, 2002, seven and eightee n one-hundredths percent (7.18%), c. for the year beginning July 1, 2002, through the year ending on June 30, 2015, seven and twen ty-four one- hundredths percent (7.24%), d. for the year beginning July 1, 2015, through the year ending on June 30, 2019, seve n and twenty-four one- hundredths percent (7.24%), but in no event shall the amount apportioned in any fisc al year pursuant to this ENR. S. B. NO. 37x Page 39 subparagraph exceed the total amount apportioned for the fiscal year ending on June 30, 2015. A ny amounts in excess of such limitation shall be placed to the credit of the General Revenue Fund, and e. for the year beginning July 1 , 2019, and all subsequent years, seven and twenty-four one-hundredths percent (7.24%), but in no event shall the amount apportioned in any fiscal yea r pursuant to this subparagraph exceed the total amount apportioned for the fiscal year ending on June 30, 2015. Any amounts in excess of such limitation shall be placed to the credit of the Rebuilding Oklahoma Access and Driv er Safety Fund created in Sec tion 1521 of Title 69 of the Oklahoma Statutes. 2. The monies apportioned pursuant to subparagraphs a thr ough e of paragraph 1 of this subsection shall be apportioned as follows: forty percent (40%) of such sum shall be distri buted to the various counties in that proportion which the county road mileage of each county bears to the entire state road mileage as certified by the Transportation Commission and the remaining sixty percent (60%) of such sum shall be distributed to the various counties on the basi s which the population and area of each county bears to the total population and area of the state. The p opulation shall be as sh own by the last Federal Decennial Census or the most recent annual estimate provided by the Unite d States Bureau of the Census . The funds shall be used for the purpose of constructing and maintaining county highways; provided, howe ver, the county treasure r may deposit so much of the funds in the sinking fund as may be necessary for the retirement of interest and annual accrual o f indebtedness created by the issuance of county or township bonds for road purposes. Such deposits to the sinking fund shall not exceed forty percent (40%) of the funds allocated to a county pursuant to this paragraph. F. 1. The following percentages o f the monies referred to in subsection A of this section shall be remitted to the county treasurers of the respective counties and by them deposited in a separate special revenue fund to be used by the county commissioners in accordance with paragraph 2 of this subsection: ENR. S. B. NO. 37x Page 40 a. from October 1, 2000, until June 30, 2001, two and fifty-three one-hundredths percent (2.53%), b. for the year beginning July 1, 2001, and ending June 30, 2002, two and fifty -six one-hundredths percent (2.56%), c. for the year beginnin g July 1, 2002, through the year ending on June 30, 2015, two and fifty -nine one- hundredths percent (2.59% ), d. for the year beginning July 1, 2015, through the year ending on June 30, 2019, two and fifty -nine one- hundredths percent (2.59%), but in no even t shall the amount apportioned in any fiscal year pursuant to this subparagraph exceed the total amount ap portioned for the fiscal year ending on June 30, 2015. Any amounts in excess of such limitation shall be placed to the credit of the General Revenue Fund, and e. for the year beginning July 1, 2019, and all subsequent years, two and fifty -nine one-hundredths percent (2.59%), but in no event shall the amount apportioned in any fiscal year pursuant to this subparagraph exceed the total amount apportioned for the fiscal year ending on June 30, 2015. Any amounts in excess of such limitation shall be placed to the credit of the Rebuilding Oklahoma Access and Driver Safety Fund created in Section 1521 of Title 69 of the Oklahoma Statutes. 2. The monies apportioned pursuant to subparagraphs a through e of paragraph 1 of this subsection shall be used for the prim ary purpose of matching federal funds for the construction of federal aid projects on county roads, or constructing and m aintaining county or township highways and permanent bridges of such counties. The distribution of monies apportioned by this paragrap h shall be made upon the basis of the current formula based upon road mileage, area and population as related to county r oad improvement and maintenan ce costs. Provided, however, the Department of Transportation may update the formula factors from time to time as necessary to ac count for changing conditions. ENR. S. B. NO. 37x Page 41 G. 1. The following percentages of the monies referred to in subsection A of this section sha ll be transmitted by the Tax Commission to the various counties as set forth in paragraph 2 of this subsection: a. from October 1, 2000, until June 30, 2001, three and fifty-five one-hundredths percent (3.55%), b. for the year beginning July 1, 2001, and e nding June 30, 2002, three and fifty -nine one-hundredths percent (3.59%), c. for the year beginning July 1 , 2002, through the year ending on June 30, 2015, three and sixty -two one- hundredths percent (3.62%), d. for the year beginning July 1, 2015, through the year ending on June 30, 2019, three and sixty -two one- hundredths percent (3.62%), but in no event shal l the amount apportioned in any fiscal year pursuant to this subparagraph exceed the total amount apportioned for the fiscal year ending on June 30, 2 015. Any amounts in excess of such limitation shall be placed to the credit of the General Revenue Fund, and e. for the year beginning July 1, 2019, and all subsequent years, three and sixty -two one-hundredths percent (3.62%), but in no event shall the am ount apportioned in any fiscal year pursuant to this subparagraph exceed the total amount apportioned for the fiscal year ending o n June 30, 2015. Any amounts in excess of such limitation shall be placed to the credit of the Rebuilding Oklahoma Access and Driver Safety Fund created in Section 1521 of Title 69 of the Oklahoma Statutes. 2. The monies apportion ed pursuant to subparagr aphs a through e of paragraph 1 of this subsection shall be transmitted to the various counties on the basis of a formula to b e developed by the Department of Transportation. Such formula shall be similar to that currently used for the distribution of Cou nty Bridge Program Funds, ENR. S. B. NO. 37x Page 42 but also taking into consideration the effect of terrain and traffic volume as related to county roa d improvement and maintenance costs. Provided, however, the Department of Transportation may update the formula factors from time to time as necessary to account for changing conditions. The funds shall be transmitted to the various county treasurers to be deposited in the county highway fund of their respective counties. H. 1. The following percentages of the monies referred to in subsection A of this section shall be apportioned to the various counties as set forth in para graph 2 of this subsection: a. from October 1, 2000, until June 30, 2001, eighty -one one-hundredths percent (0.81%), b. for the year beginning July 1, 2001, an d ending June 30, 2002, eighty-two one-hundredths percent (0.82%), c. for the year beginning July 1, 2002, through the year ending on June 30, 2015, eighty-three one-hundredths percent (0.83%), d. for the year beginning July 1, 2015 , through the year ending on June 30, 2019, eighty-three one-hundredths percent (0.83%), but in no event shall the amount apportioned in any fi scal year pursuant to this subparagraph exceed the total amount apportioned for the fiscal year ending on June 30 , 2015. Any amounts in excess of such limitation shall be placed to the credit of the General Revenue Fund, and e. for the year beginning July 1, 2019, and all subsequent years, eighty -three one-hundredths percent (0.83%), but in no event shall the amount apportioned in any fiscal year pursuant to this subparagraph exceed the total amount apportioned for the fiscal year ending on June 30, 2015. Any amounts in exces s of such limitation shall be placed to the credit of the Rebuilding Oklahoma Access and Dri ver Safety Fund created in Section 1521 of Title 69 of the Oklahoma Statutes. ENR. S. B. NO. 37x Page 43 2. The monies apportioned pursuant to subp aragraphs a through e of paragraph 1 of thi s subsection shall be apportioned to the various counties based upon the proportion that eac h county’s population bears to the total state population. Each county’s allocation of funds shall be remitted to the various county treasurers to be deposited in t he general fund of the county and used for the support of county government. I. 1. The following percentages of the monies referred to in subsection A of this section shall be apportioned to the various cities and incorporated towns as set forth in parag raph 2 of this subsection: a. from October 1, 2000, until June 30, 2001, three and four one-hundredths percent (3.04%), b. for the year beginning July 1, 2001, and ending June 30, 2002, three and eight one -hundredths percent (3.08%), c. for the year beginning July 1, 2002, through the year ending on June 30, 2015, three and ten one -hundredths percent (3.10%), d. for the year beginning July 1, 2015, through the year ending on June 30, 2019, three and ten one -hundredths percent (3.10%), but in no event shall the amount apportioned in any fiscal year pursuant to this subparagraph exceed the total amo unt apportioned for the fiscal year ending on June 30, 2015. Any amounts in excess of such limitation shall be placed to the credit of the General Revenue Fund, an d e. for the year beginning July 1, 2019, and all subsequent years, three and ten one -hundredths percent (3.10%), but in no event shall the amount apportioned in any fiscal year pursuant to this subparagraph exceed the total amount app ortioned for the fisc al year ending on June 30, 2015. Any amounts in excess of such limitation shall be placed t o the credit of the Rebuilding Oklahoma Access and Driver Safety Fund ENR. S. B. The monies apportioned pursu ant to subparagraphs a through e of paragraph 1 of this subsection shall be apportioned to t he various cities and incorporated towns based upon the proportion that each city or incorporated town ’s population bears to the total population of all cities and incorporated towns in the state. Such funds shall be remitted to the various county treasur ers for allocation to the various cities and incorporated towns. All such funds shall be used for the construction, main tenance, repair, improvement and lighting o f streets and alleys. Provided, however, the governing board of any city or town may, with the approval of the county excise board, transfer any surplus funds to the general revenue fund of such city or town when ever an emergency requ ires such a transfer. J. The following percentages of the monies referred to in subsection A of this section sha ll be remitted to the State Treasurer to be credited to the Oklahoma Law Enforcement Retirement Fund: 1. From October 1, 2000, until June 30, 2001, one and twenty - two one-hundredths percent (1.22%); 2. For the year beginning July 1, 2001, and ending June 30, 2002, one and twenty-three one-hundredths percent (1.23%); and 3. For the year beginning July 1, 2002, and all subs equent years, one and twenty-four one-hundredths percent (1.24%). K. Three one-hundredths of one percent (3/100 of 1%) of the monies referred to in subsection A of this section shall be remitted to the State Treasurer to be credited to the Wildlife Conser vation Fund. Seventy-five percent (75%) of the funds shall be used for fish habitat restoration and twenty -five percent (25%) of the f unds shall be used in the fish hatchery system for fish production. L. 1. For the year beginning July 1, 2007, and endi ng June 30, 2008, five percent (5%) of moni es referred to in subsection A of this section shall be remitted to the State Treasurer to b e credited ENR. S. B. NO. 37x Page 45 to the County Improvements for Roads and Bridges Fund as created in Section 507 of Title 69 of the Oklahoma St atutes. 2. For the year beginning July 1, 2008, and ending June 30, 2009, ten percent (10%) of monies referred to in subsection A of this section shall be remitted to the State Treasurer to be credited to the County Improvements for Roads and Bridges Fund as created in Section 507 of Title 69 of t he Oklahoma Statutes. 3. For the period beginning July 1, 2009, and ending December 31, 2012, fifteen percent (15%) of monies referred to in subsection A of this section shall be remitted to the State Treasurer t o be credited to the County Improvements fo r Roads and Bridges Fund as created in Section 507 of Title 69 of the Oklahoma Statutes. 4. For the period beginning January 1, 2013, and ending June 30, 2013, fifteen and fifty one -hundredths percent (15.50%) of monies referred to in subsection A of this section shall be remitted to the State Treasurer to be credited to the County Improvements for Roads and Bridges Fu nd as created in Section 507 of Title 69 of the Oklahoma Statutes. 5. For the year beginning Jul y 1, 2013, and ending June 30, 2014, eighteen percent (18%) of monies referred to in subsection A of this section shall be remitted to the State Treasurer to b e credited to the County Improvements for Roads and Bridges Fund as created in Section 507 of Tit le 69 of the Oklahoma Statutes. 6. For the year beginning July 1, 2014, twenty percent (20%) of monies referred to in subsection A of this section shall be re mitted to the State Treasurer to be credited to the County Improvements for Roads and Bridges Fun d as created in Sectio n 507 of Title 69 of the Oklahoma Statutes. 7. For the year beginning July 1, 2015, through the year ending on June 30, 2019, twenty per cent (20%) of monies referred to in subsection A of this section shall be remitted to the State Treasurer to be credite d to the County Impro vements for Roads and Bridges Fund as created in Section 507 of Title 69 of the Oklahoma Statutes, but in no event s hall the total amount apportioned in any fiscal year pursuant to this paragraph exceed One Hundre d Twenty Million Dollars ($120,000,000.00). Any amounts in excess of One ENR. S. B. NO. 37x Page 46 Hundred Twenty Million Dollars ($120,000,000.00) shall be pla ced to the credit of the General Revenue Fund. 8. a. Except as provided in subparagraph b of this paragraph, for the year beginning July 1, 201 9, and all subsequent years, twenty percent (20%) of monies referred to in subsection A of this section shall be remitted to the State Tr easurer to be credited to the County Improvements for Roads and Bridges Fund as created in Section 507 of Title 69 of t he Oklahoma Statutes, but in no event shall the total amount apportioned in any fiscal year pursuant to this paragraph exceed the fiscal year limitations provided in subparagraph c of this paragraph. Any amounts in excess of the fiscal year limitations pr ovided in subparagraph c of this paragraph shall be placed to the credit of the Rebuilding Oklahoma Access and Driver Safety Fund created in Section 1521 of Title 69 of the Oklahoma Statutes, b. (1) for the fiscal year beginning July 1, 2021, through the fiscal year ending Jun e 30, 2026, the Oklahoma Tax Commission shall remit twenty -five percent (25%) of the monthl y allocation, otherwise scheduled to be credited to the County Improvements for Roads and Bridges Fund, to the various counties of the state. The Commission shall distribute such funds monthly to each county treasurer as follows: (a) one-third (1/3) of such funds shall be distributed to the various counties in the proportion which the area of each county bears to the total a rea of the state, (b) one-third (1/3) of such funds shall be distributed to the various counties in the proportion which the certifi ed county road miles of each county bear to the total sum of county road miles in the state, and ENR. S. B. NO. 37x Page 47 (c) one-third (1/3) of such funds shall be distributed to the various counties in the proportion which the total replacement cost for obsolete or deficient br idges according to the most recent ODOT yearly Bridge Summary Report for County Bridges for each county bears to the total am ount of such cost for all such county bridg es in the state, and (2) for the fiscal year beginning July 1, 2026, and all subsequent fiscal years thereafter, the Oklahoma Tax Commission shall remit twenty -five percent (25%) of the monthly allocation, otherwise scheduled to be credited to the County Improvements for Roads and Bridges Fund, to the various counties of the state. The Comm ission shall distribute such funds monthly to each county treasurer as follows: (a) one-third (1/3) of such funds shall be distributed to the various counties in the proportion which the area of each county bears to the total area of the state, (b) one-third (1/3) of such funds shall be distributed to the various counties in the proportion which the certified county road miles of each county bear to the total sum of county road miles in the state, and (c) one-third (1/3) of such funds shall be distributed to the various counties in the proportion which the number of county bridges in each county according to the ODOT 2020 Bridge Summary Report for County Bridges bears to the total sum of county bridges in the state according to such report. Each county treasurer shall deposit such funds to the county’s county highway fund and such funds shall be used ENR. S. B. NO. 37x Page 48 for maintenance and operations. In no event shall the total amount apportioned in any fiscal year pursuant to the provisions of subparagraphs a and b of thi s paragraph exceed the fiscal yea r limitations provided in subparagraph c of this paragraph, and c. the total amount apportioned e ach fiscal year pursuant to this paragraph shall be limited as follows: (1) for fiscal years 2020 through 2022 $120,000,000.00, (2) for fiscal year 2023 $125,000,000.00, (3) for fiscal year 2024 $130,000,000.00, (4) for fiscal year 2025 $135,000,000.00, (5) for fiscal year 2026 $140,000,000.00, (6) for fiscal year 2027 $145,000,000.00, (7) for fiscal year 2028 and all subsequent fiscal years thereafter $150,000,000.00. M. Twenty-four and eighty-four one-hundredths percent (24.84%) of the monies referred to in subsection A of this section shall be remitted to the State Treasurer to be credited to the Rebuilding Oklahoma Access and Driver S afety Fund created in Se ction 1521 of Title 69 of the Oklahoma Statutes. N. Monies allocated to counties by this section may be estimated by the county excise boar d in the budget for the county as anticipated revenue to the extent of ninety percent (90%) of the previous year’s income from such source; provided, not more than fifteen percent (15%) can be encumbered during an y month. ENR. S. B. NO. 37x Page 49 O. Notwithstanding any other prov isions of this section, for the fiscal year beginning July 1, 2003, t he first One Hundred Thousand Dollars ($100,000 .00) of the monies collected or received by the Tax Commission pursuant to the registration of mo torcycles and mopeds in this state shall be placed to the credit of the Oklahoma Tax Commission Revolving Fund. SECTION 11. AMENDATORY 47 O.S. 2021, Section 1135.5, as last amended by Section 23 of Enrolled Senate Bill No. 782 of the 1st Session of the 59th Oklahoma Legislature (47 O.S. Supp. 2022, Section 1135.5), is amended to read as fol lows: Section 1135.5. A. Service Oklahoma is h ereby authorized to design and issue appropriate official special license p lates to persons wishing to demonstrate support and provide finan cial assistance as provided by this section. Special license plate s shall not be transferred to any other person but shall be removed from the vehicle upon transfer of ownership and retained . The special license plate may then be used on another vehicle b ut only after such other vehicle has been registered for the curre nt year with a licensed op erator. Special license plates shall be renewed each year by Service Oklahoma or a licensed opera tor, unless authorized b y Service Oklahoma to be renewed for a peri od greater than one (1) year. Service Oklahoma shall notify by m ail all persons issued spec ial license plates. The notice shall contain all necessary information and shall contain instruc tions for the renewal pr ocedure upon presentation to a licensed ope rator or Service Oklahoma. The license plates shall be issued on a staggered system. Service Oklahoma is hereby dir ected to develop and implement a system whereby licensed operators are p ermitted to accept applications for special license plates authorize d under this section. The licensed operator shall confirm the a pplicant’s eligibility, if applicable, collect and d eposit any amount specifically authorized by law, accept and process the necessary information directly into such system and generate a rece ipt accordingly. For performance of these duties, licensed oper ators shall retain the fee p rovided in Section 1141. 1 of this title for registration of a motor vehicle through June 30, 202 5. The licensed ENR. S. B. NO. 37x Page 50 operator fees for acceptance of applications and re newals shall be paid out of the Tax Commission Reimbursement Fun d. Beginning January 1, 2023, Through June 30, 2025 , the licensed operator fees for acceptance of applications and renewals shall be paid out of the Service Oklahoma Reimbursement Fund. Beginning July 1, 2023, fees shall be retained by the licensed opera tor pursuant to subsection E of Section 1141.1 of th is title. If fewer than one hundred of any type of special license plate s authorized prior to Jan uary 1, 2004, are issued prior to January 1 , 2006, Service Oklahoma shall discontinue issuance and renewal of that type of special lice nse plate. Any such aut horized special license plate registrant shall be allowed to display the license plate upon the designated vehicle until the registration ex piration date. After such time the expired special license pla te shall be removed from the vehicle. For special license plates authorized on or after July 1, 2004, no special license pla tes shall be developed or issued by Service Oklahoma until Service Ok lahoma receives one hundred prepaid applications therefor. Th e prepaid applications must be received by Service Oklahoma within one hundred eighty (180) days of the effective date of the authorization or the auth ority to issue shall be null and void. In the event one hundred prepaid applications are not received by Service Oklahoma within such prescribed time period any payment so received shall be refunded accordingly. B. The special license plates provided by this section are as follows: 1. University or College Supporter License Plate - such plates shall be designed and issued to any person wishing to demonstrate support to any state-supported or private university or college. As provided in this section, an amount of the fee collected shall be apportioned as provided in Section 1104.1 of this title; 2. Environmental Awareness License Plat e - such plates shall be designed, subject to the criteria to be presented to Service Oklahoma by the Department of Envir onmental Quality in consultation with the Oklahoma Arts Council, and issued to any person wishi ng to demonstrate support to implement t he statewide general pub lic Environmental Education Program created pursuant to the provisio ns ENR. S. B. NO. 37x Page 51 of the Oklahoma Environmen tal Quality Code. Such plates shall be designed and issued to any person in any combination of numbers and letters from one to a maxim um of seven, as for pers onalized license plates. A dealer’s license plate issued pursuant t o Section 1116.1 or 1128 of this title may be designated an Environmenta l Awareness License Plate upon payment of the fee im posed by this section and any other registration fees required b y the Oklahoma Vehicle License and Registration Act. As provided in this section, an amount of t he fee collected shall be apportioned pursu ant to Section 1104.2 of this title; 3. Firefighter License Plate - such plates shall be de signed for any career or retired firefighter, volunteer or paid. Firefighters may apply fo r firefighter plates for up to four vehicles with a rated capacity of one (1) ton or less or for a motorcycle upon proof of a fire department membership by either an identification card or letter from the chief of the fire department. Retirees who are eli gible for such plates shall pr ovide proof of eligibility upon initial app lication, but shall not be required to provide proof of eligibility annually. The surviving spouse of any deceased firefighter, if the spouse has not since remarried, may apply for a firefighter license plate for one vehicle with a rated carrying capacity of one (1) ton or less or for a motorcycle upon proof that the deceased firefighter was a m ember of a fire department by either an identification card or letter from the chief of the fire department. The license plate shall be designed in consultation with the Oklahoma State Firefighters Association. As provided in this section, an amount of th e fee collected shall be deposited to the Oklahoma State Firemen ’s Museum Building & Memorial Fund for support of the Okl ahoma State Firefighters Museum and the Oklahoma Fallen and Living Firefighters Memorial; 4. Wildlife Conservation License Plate - such plates shall be designed, subject to the criteria to be presented to Service Oklahoma by the Department of Wildlife Con servation in consultation with the Oklahoma Arts Council, and issued to any person wishing t o demonstrate support for wildlife conserva tion in this state throu gh the Wildlife Diversity Fund, provided for in Section 3 -310 of Title 29 of the Oklahoma Statute s. Such plates may be designed and issued to any person as for personalized license plates. ENR. S. B. NO. 37x Page 52 As provided in this section, an amount of the fee collected shall be apportioned pursuant to subsection D of Section 3 -310 of Title 29 of the Oklahoma Statutes; 5. Child Abuse Prevention License Plate - such plates shall be designed, subject to the cri teria to be presented to Service Oklahoma by the Office of Child Abus e Prevention in the State Department of Health and the Child Abuse Prevention Action Committee, and issued to any person wishing to demonstr ate support for the prevention of child abuse. As provided in this section, an amount of the fee collected shall be deposited in the Child Abuse Prevention Fund; 6. United States Olympic and Paralympic Committee Supporter License Plate - such plates shall be designed and issued to any person wishing to demonstrate support for the United States O lympic and Paralympic Committee. The plates shall be issued to any person in any combination of numbers and letters from one to a maximum of seven, as for personal ized license plates. The plate shall contain the official United States Olympic and Paralym pic Committee logo. Service Oklahoma shall be authorized, if necessary, to enter int o a licensing agreement with the Uni ted States Olympic and Paralympic Committee for any licensing fees which may be required in order to use the United States Olympic and Paralympic Committee logo or design. The licensing agreement shall provide for a pay ment of not more than Twenty-five Dollars ($25.00) for each license plate issued; 7. Oklahoma History License Plate - such plates shall be designed and issued to any pers on wishing to demonstrat e interest in Oklahoma history. As provided in this section , an amount of the fee collected shall be deposited to the Oklahoma Historical S ociety Revolving Fund to be used for educati onal purposes; 8. Historic Route 66 License Pla te - such: a. vehicle plates shall be designed to honor historic Route 66, also known as the “Mother Road”. As provided in this section, an amount of the fee collected for each vehicle license plate shall be apportioned to the Oklahoma Historical Society ENR. S. B. NO. 37x Page 53 Revolving Fund to be dis tributed to the Oklahoma Route 66 Museum located in Clinto n, Oklahoma, and b. motorcycle plates shall be designed in consultation with the Oklahoma Route 66 Association, Inc. Servi ce Oklahoma shall be authorized to enter into a lic ensing agreement with the Oklahoma Route 66 Association, Inc., for any licensing fees which may be required in order to use the Oklahoma Route 66 Association, Inc., logo or design. The licensing agreement shall provide for a payment to the Oklahoma Route 66 Association, Inc., of not more than Twenty Dollars ($20.00) for each motorcycle license plate issued; 9. Heart of the Heartland License Plate - such plates shall be designed and issued to any person w ishing to honor the victims of the terrorist bombing attack on the Alfred P. Murrah Federal Building in downtown Oklahoma City on Ap ril 19, 1995. As provided in this section, an amount of the fee collected shall be deposited in the Heart of the Heartland Scholarship Fund, as established in Section 2282 of Title 70 of the Oklahoma Statutes; 10. Emergency Medical Technician License Pl ate - such plates shall be designed and is sued to any person who is an emergency medical technician. Such persons may apply for an emergency medical technician license plate fo r each vehicle with a ra ted carrying capacity of one (1) ton or less upon proof of an emergency medical technician’s license. The license plate shall be designed i n consultation with the Oklahoma Emergency Med ical Technicians Association. As provided in this section, an amount of the fee collected shall be apportioned to the Emerge ncy Medical Personnel Death Benefit Revolv ing Fund created in Section 1 -2505.2 of Title 63 of the Oklahoma Statutes; 11. Fight Breast Cancer License Plate - such plates shall be designed to demonstrat e support for the prevention and treatment of breast cancer in this state; 12. Crime Victims Awa reness License Plate - such plates shall be designed and issued to any person wishing t o demonstrate awareness of and support for victi ms of crimes. The licen se plates shall be designed in consultation with the Crime Victims ENR. S. B. NO. 37x Page 54 Compensation Program. As prov ided in this section, an amount of the fee collected shall be apportioned to the Attorn ey General’s Revolving Fund for the Office of th e Attorney General, whic h is hereby directed to use such funds to contract wi th a statewide nonprofit organization to pro vide services to crime victims; 13. Safe Kids Oklahoma License Plate - such plates shall be designed and issued to any person wishing to demonstrate support a nd awareness of the Safe Kids Oklahoma. The license plate shall be designed in consultation with the Oklahoma Safe Kids Association. As provided in this section, an amount of the fe e collected shall be deposited in the Children ’s Hospital - Oklahoma Safe Kids Association Revolving Fund to be distributed t o the Safe Kids Oklahoma program; 14. Oklahoma Four-H Club License Plate – such plates shall be designed, subject to criteria to be presented to Service Oklahoma by the Four-H Foundation, and issued to a ny person wishing to demonstrate support of the Okl ahoma Four-H Club. Such plates may be designed and issued to any person as for personali zed license plates. As provided in this s ection, an amount of the fee collected shall be apportioned to the OSU Ext ension Service License Plate Revolving Fund created in Section 1104.4 of this title; 15. Agricultural Awareness License Plate – such plates shall be designed, subject to criteria t o be presented to Service Oklahoma, by the Oklahoma Department of Agricultu re, Food, and Forestry in consultation with the Ok lahoma Arts Council, and issued to any person wishing to demonstrate support of the Depart ment’s Ag in the Classroom Education Prog ram. As provided in this section, an amount of the fee collected shall be apportioned as provided in Section 1104.3 of this title; 16. Oklahoma Statehood Centennial Licen se Plate – such plates shall be designed an d issued to any person wishing to commem orate the centennial of Oklahoma ’s admission to statehood in 1907. The license plates shall be designed in consultation with the Oklahoma Capitol Complex and Centennial Com memoration Commission. As provided in this section, an amount of the fee collected shall be deposited in the Oklahoma Department of Co mmerce Revolving Fund created in Section 5012 of Title 74 of the Oklahoma Statutes; ENR. S. B. NO. 37x Page 55 17. Support Education License Plate – such plates shall be designed, subject to criteria to be presented to Service Ok lahoma by the State Department of Education in consul tation with the Oklahoma Arts Council, and issued to any person wishing to demonstrate support for education in this stat e. All licensed operators shall display a sample of the Support Education License plate in the area of the business accessed by the pu blic. Twenty-three Dollars ($23.00) of the fee collected shall be appor tioned as follows: a. five percent (5%) shall be deposited to the Education Reform Revolving Fund, b. five percent (5%) shall be deposited to the Oklahoma State Regents for Higher Educ ation Revolving Fund, c. five percent (5%) shall be deposited to the State Career-Technology Fund, and d. eighty-five percent (85%) shall be deposited to the Teachers’ Retirement Benefit Fund as set forth in Section 17-108 of Title 70 of the Oklahoma Statu tes. However, when the Teachers’ Retirement Benefit Fund attains a seventy percent (70%) funded ratio based on an annual actuarial valuation as required by law, the amount of the fee shall be apportioned equally pursuant to subparagraphs a, b and c of this paragraph; 18. Retired Oklahoma Highway Patrol Officers License Plate – such plates shall be designed and issued to any retired officer of the Oklahoma Highway Pa trol. The license plate shall ha ve the legend “Oklahoma” and shall contain, in the center o f the plate, the Highway Patrol Officers patch using the same colo rs and pattern as used in the patch. Centered on the b ottom of the license plate shall be the word “Retired”. The letters “TRP” shall be used in combination with three numbers on either si de of the insignia or emblem. The color of the letters and number s shall be brown. Retirees who are eligible for such p lates shall provide proof of eligibility upon initial application, but shall not be required to provide proof of eligibility annually. The surviving spouse of any deceased retired officer of the Oklah oma Highway Patrol, if the spouse has not since remarri ed, or if remarried, the remarriage is ENR. S. B. NO. 37x Page 56 terminated by death, divorce, or annu lment, may apply for a Retired Oklahoma Highway Patrol Offi cers license plate. As provided in this section, an amount of the fee collected shall be deposited into the Oklahoma Law Enforcement Retirement Fund; 19. Boy Scouts of America Supporter License Plate – such plates shall be designed and issued to any pers on wishing to demonstrat e support for the Boy Scouts of America. The plates shall be issued to any person in any combina tion of numbers and letters fr om one to a maximum of seven, as for personal ized license plates. The plate shall contain the official B oy Scouts of America log o. Service Oklahoma shall be authorized, if necessary, to enter into a licensing agreement with the Boy Scouts of America for any licensing fees which may be required in o rder to use the Boy Scouts of America logo or design. The l icensing agreement shall provide for a payment to the Boy Scouts of America of not more than Twenty Dollars ($20.00) for each license plate issued; 20. Urban Forestry and Beautification License Plate – such plates shall be designed, subject to criteria to be presented to Service Oklahoma, by the Oklahoma Department of Agriculture, Food, and Forestry in consultation with non profit organizations in this state that develop and operate programs to en courage urban forestry and beautification, and issued to any person wishing to demons trate support of such programs. As prov ided in this section, an amount of the fee collected shal l be apportioned as provided in Section 1104.5 of this title; 21. Oklahoma State Parks Supporter License Plate – such plates shall be designed, subject to cri teria to be presented to Serve Oklahoma by the Oklahoma Tourism and Recreation Department, and issued to any person wishing t o demonstrate support for the Oklahoma state parks system. Twenty -three Dollars ($23.00) of the fee collected shall be deposited i n the Oklahoma Tourism and Recreation Department Revolving Fund. Such money shall be designated for and may only be expended for the support of Oklahoma state parks; 22. Adoption Creates Families License Plate – such plates shall be issued to any person wishing to demonstrate support of preg nant women who are committed to placing their children for adoption and wishing to provide assistance to guardians, adoptive parent s and other created families to assist in the adoption and plac ement of ENR. S. B. NO. 37x Page 57 children in permanent, safe homes. The license plate s shall be designed and final terminology delivered in cons ultation with the Oklahoma Adoption Coalition and the Department of Huma n Services. Twenty-five Dollars ($25.00) of the fee collected shall be deposited in a revolving fund established in the Stat e Treasury for and to be used by the Department of Human Se rvices for the implementati on of the Investing in Stronger Oklahoma Fami lies Act specifically for created families; 23. Choose Life License Plate – such plates shall be designed, subject to criteria presented to Service Oklahoma, by Choose Life America, Inc., and issued to any per son who wishes to demonstrate support of organizations that encourage adoption as a positive choice for women with unplanned pregnanc ies. As provided in this section, an amount of the fee collected shall be deposited in the Choose Life Assistance Program Revolving Fund established in Section 1104.6 of this title; 24. Future Farmers of America License Plate – such plates shall be designed and issued to persons wishing to demonstrate support for the Oklahoma FFA Association (formerly known as Future Farmer s of America). The license plates shall be d esigned in consultation with the Oklahoma FFA Association Board o f Directors. As provide d in this section, an amount of the fee collected shall be apportioned as provided in Section 110 4.7 of this title; 25. Lions Club License Plate – such plates shall be designed and issued to persons wishing to demonstrate support f or the Lions Clubs of Oklahoma. The plates shall be issued to any person in any combination of numbers and letters from one to a maximum of seve n, as for personalized license plates. The l icense plates shall be designed in consultation with the Oklahoma Lions Service Foundation and shall contain the official logo of the International Association of Lions Clubs. Service Ok lahoma shall be authoriz ed to enter into a licensing agreement with t he Oklahoma Lions Service Foundation. The licensing agreement sha ll provide for a payment to the Oklahoma Lions Service Foundation of not more than Ten Dollars ($10.00) for each license plate issued; 26. Girl Scouts of the United States o f America Supporter License Plate - such plates shall be designed and issued to any person wishing to demonstrate support for the Girl Sc outs of the United States of America. The plates shall be issued to any person in any combination of numbers and lette rs from one to a maxi mum of seven, as for personalized license plates. The plate shall contain the official Girl Scouts of the United St ates of America logo. Service Oklahoma shall be authorized, if necessary, to enter into a licensing agreement with the Girl Scouts of the U nited States of America for any licensing fees which may be required in order to use the Girl Scouts of the United S tates of America logo or design. The licensing agreement shall provide for a payment to the Magi c Empire Council of Girl Scouts, acting on behalf of all Oklahoma G irl Scout councils, of not more than Twenty Dollars ($20.00) for eac h license plate issued; 28. Oklahoma City Memorial Marathon License Plate – such plates shall be designed and issued to any person wishing to demonstrate support for the Oklahoma City Me morial Marathon. The plate shall be designed in consultation with th e Oklahoma City Memorial Marathon. Service Oklahoma shall be authorized to enter into a licensing agreement with the Okl ahoma City Memorial M arathon for any licens ing fees which may be required in order to use the Oklahoma City Memorial Marathon logo or d esign. The licensing ag reement shall provide for a payment to the Oklahoma City Memorial Marathon of not more than Twenty Dollars ($20.00) fo r each license plate i ssued; 29. Oklahoma Scenic Rivers License Plate – such plates shall be designed to demonstr ate support for the Grand River Dam Authority. The plates shall be designed in consultation with the Grand River Dam Authority. Twenty-five Dollars ($25.00) of th e fee shall be apportioned to the Grand River Dam Authority; 30. Fight Cancer License Plate – such plates shall be designed to demonstrate support for the Oklahoma Central Cancer Registry. The plate shall contai n the American Cancer Society logo. The ENR. S. B. NO. 37x Page 59 American Cancer Society logo shall be used in accordance with the American Cancer Society ’s branding guidelines and sh all only be utilized to support the Oklahoma Central Cancer Registry. Twenty Dollars ($20.00) of the fee shall be apportioned to the Oklaho ma Central Cancer Registry Revolving Fund; 31. Animal Friendly License Plate – such plates shall be designed and issued to any person wishing to demonstrate support for controlling the overpopulation of dogs and cats through educational and sterilization efforts. The plates shall be designed in consultation with the Veterinary Medical Associati on. Twenty Dollars ($20.00) of the fee collected shall be designated by the purchaser of the plate to be deposited in th e Oklahoma Pet Overpopulation Fund created in Section 2368.13 of Title 68 of the Oklahoma Statutes or the Animal Friendly Revolving Fun d created in Section 1104.10 of this title; 32. Patriot License Plate - such plates shall be designed in consultation with the Military Department of the State of Oklahoma and issued to any person wishing to demonstrate support for Oklahoma residents who are members of the Oklah oma National Guard and deployed on active duty. The plates shall be issued to any person in any combination of numbers and letters from one to a maximum of seven, as for personalized license plates. As provided in this section, a portion of the fee colle cted shall be deposited in the Patriot License Plate Revolving Fund created in Section 1104.11 of this title; 33. Global War on Terrorism L icense Plate - such plate shall be designed in consultation with the Military Department of the State of Oklahoma and issued to any person wishing to demonstrate support for Oklahoma residents who are members of t he Armed Forces of the United States or Okl ahoma National Guard that have served in the Global War on Terrorism. The plate shall be is sued to any person in any combination of numbers and letters from one to a maximum of six. As provided in this section, a portion of the fee collected shall be deposited in the Oklahoma National Guard Museum Fund created in Section 235.1 of Title 44 of th e Oklahoma Statutes; 34. Boys and Girls Clubs of America Supporter License Plate – such plates shall be designed and iss ued to any person wishing to demonstrate support for the Boys and Girls Clubs of America. The ENR. S. B. NO. 37x Page 60 plates shall be issued to any person in any combination of numbe rs and letters from one to a maximum of seven, as for personalized license plates. The plate sha ll contain the official Boys and Girls Clubs of America logo. Service Oklahoma, if necessary, may enter into a licensing agreement wit h the Boys and Girls Clu bs of America for any licensing fees which may be required in order to use the Boys and Girls Clubs of America logo or design. The licensin g agreement shall provide for a payment to the Boys and Girls Clubs of America of not more t han Twenty Dollars ($20. 00) for each license plate issued; 35. Oklahoma Quarter Horse License Plate – such plates shall be designed and issued to any person wishing to demonstrate support for the American Quarter Horse in this state. The plate shall be designed in consultation with the Oklahoma Quarter Horse Association. As provided in this section, a portion of the fee collected shall be deposited in the Oklahoma Quarter Horse Revolving Fund created in Section 1104.12 of this title; 36. Oklahoma Associ ation for the Deaf Licen se Plate – such plates shall be designed in consultation with the Oklahoma Association for the De af and issued to any person wishing to demonstrate support for Oklahoma residents who are deaf. The plates shall be issued to any pers on in any combination of numbers and letters from one to a maximum of seven, as for personalized license plates. As provided in this section, a portion of the fee collected shall be deposited in the Oklahoma Association for the Deaf License Plate Revolving Fund created in Sectio n 1104.15 of this title; 37. Oklahoma City Zoo License Plate – such plates shall be issued to any person wishing to demonstrate support for the Oklahoma City Zoo. The license plates shall be designed in consultation with the Oklahoma Zoological Society, Inc. As provided in this section, an amount of the fee collected shall be deposited in the Oklah oma Zoological Society Revolving Fund creat ed in Section 1104.13 of this title; 38. March of Dimes License Plate – such plates shall be issued to persons wishing to demonstrate support for the March of Dimes mission to improve the health of babies by prev enting birth defects, premature birth and i nfant mortality. The license plates shall be designed in consultation with the Oklahoma Cha pter March of Dimes. ENR. S. B. NO. 37x Page 61 As provided in this section, an amount of the fee collected shall be deposited in the Oklahoma Prev ent Birth Defects, Premature Birth and Infant Mortality Fund established in Section 1104.14 of this title; 39. Support Our Troops Supp orter License Plate – such plates shall be designed and issued to any person wishing to demonstrate support for Support O ur Troops Incorporated. The plates shall b e issued to any person in any combination of numbers and letters from one to a maximum of si x. The plate shall cont ain the official Support Our Troops Incorporated logo which includes the mark “Support Our Troops” across the bottom of the plate. Service Oklahoma, if necessary, may enter into a licensing agreement with Support Our Troops Incorpo rated for any licensing fees which may be required in order to use the Support Our Troops Incorporated logo or design. The licensing agreement shall provide for a payment to Support Our Troops Incorporated of Twenty -five Dollars ($25.00) for each license plate issued; 40. Folds of Honor Supporter License Plate – such plates shall be authorized to be designed and issued to any person wishing to demonstrate support f or the Oklahoma City Chapter of Folds of Honor Incorporated, a nonprofit charitable organiza tion exempt from taxation pursuant to the provisions of the Internal Revenue Code, 26 U.S.C., Section 501(c)(3), providin g educational scholarships to spouses and children of America’s fallen and disabled military service members. The plates shall be issu ed to any person in any combination of numbers and letters from one to a maximum of six. Such person may apply for a Fol ds of Honor Supporter license plate for a motorcycle; provided, the license plate for motorcycles may be of similar design to the licen se plate for motor vehic les or may be a new design in order to meet space requirements for a motorcycle license plate. The plate shall be designed in consultation with the Oklahoma City Chapter of Folds of Honor Incorporated and shall contain the official Folds of Honor Incorpor ated logo which includes the mark “Folds of Honor” across the bottom of the plate. Service Oklahoma, if necessary, may enter into a licensi ng agreement with Folds of Honor Incorporated for any licensing fees which may be required in order to use the Folds of Honor Incorporated logo or design. The licensing agreement shall provide for a payment to Folds of Honor Incorporated of Twenty -five Dollars ($25.00) for each license plate issued. Subject to the provisions of subsection A of ENR. S. B. NO. 37x Page 62 this section, the Folds of Honor Supporter License Plate is hereby reauthorized effective November 1, 2019; 41. Armed Forces Veterans Motorcycle License Plate – such plates shall be designed for use on a motorcycle in consultation with A Brotherhood Aimin g Toward Education of Ok lahoma, Inc. (ABATE), and issued to any honorably discharged former member of the United States Armed Forces wishing to demonstrate support for the Oklahoma National Guard Museum. Persons applying for such license plate must show proof of past military se rvice. As provided in this section, a portion of the fee collected shall be deposited in the Oklahoma National Guard Museum Fund created in Section 235.1 of Title 44 of the Oklahoma Statutes; 42. Buffalo Soldier License Plate - such plates shall be issue d to any person wishing to honor and celebrate the history and contribution of the Buffalo Soldie rs. The license plates shall be designed in consultation with the Lawton -Fort Sill Chapter of the Buffalo Soldiers 9th and 10th (Horse ) Cavalry National Assoc iation. As provided in this section, an amount of the fee collected shall be deposited in the Buffalo Soldier License Plate Revolving Fund created in Section 1104.16 of this title; 43. Prevent Blindness Oklahoma License Plate - such plates shall be issued to any person wishing to provide financial support for vision screening of school age children in this state. The license plates shall be designed in consultation with Prevent Blindness Oklahoma. As provided in this section, an amount of the fee collected shall be deposited in the Prevent Blindness Oklahoma License Plate Revolving Fund created in Section 1104.17 of this title; 44. Oklahoma State Capitol Restoration License Plate - such plates shall be designed and issued to any person wishing to demonstrate support for restoration of the Oklahoma State Capitol building. The license plates shall b e designed in consultation with the Friends of the Capitol corporation, created pursuant to Section 15.4 of Title 73 of the Oklahoma St atutes and the State Cap itol Preservation Commission created pursuant to Section 4102 of Title 74 of the Oklahoma Statute s. As provided in this section, an amount of the fee collected shall be deposited in the Oklahoma Friends of the ENR. S. B. NO. 37x Page 63 Capitol License Plate Revolving Fund establis hed in Section 1104.18 of this title; 45. Eastern Red Cedar Tree License Plate – such plates shall be designed, subject to criteria to be p resented to Service Oklahoma and issued to any person wishing to demonstrate support for the removal of Eastern Redc edar trees from lands in the state and to develop marketable uses for the harvested trees. The l icense plate shall be designed in consultat ion with the Oklahoma Department of Agriculture, Food, and Forestry. Twenty -three Dollars ($23.00) of the fee collected shall be deposited in the Eastern Redcedar Revolving Fund created in Section 18 -407 of Title 2 of the Oklahoma Statutes. The money sha ll be designated for and may only be expended for the purposes as set forth in the Eastern R edcedar Management Act; 46. Pancreatic Cancer Research License Plate - such plates shall be issued to any person wishing to provide financial support for the University of Oklahoma Foundation, Pancreatic Cancer Research Fund. The plates shall be issued t o any person in any combination of numbers and letters from one to a maximum of six. The license plates shall be designe d in consultation with the University of Oklahoma Foundation, Pancreatic Cancer Research Fund. As provided in this section, an amount of the fee collected sha ll be deposited in the Pancreatic Cancer Research License Plate Revolving Fund created in Section 1104.19 of this title; 47. Alzheimer’s Research License Plate - such plates shall be issued to any person wishing to provide financia l support for the Oklahoma Chapter of the Alzheimer’s Association. The license plates shall be designed in consultation with the Oklahoma Chapter of the Alzheimer’s Association. As provided in this section, an amount of the fee collected shall be deposit ed in the Alzheimer’s Research License Plate Revolving Fund created in Section 1104.20 of this title; 48. Hospice and Palliative Care License Plate - such plates shall be issued to any person wishing to provide financial support for the Oklahoma Hospice a nd Palliative Care Ass ociation. The license plates shall be designed in consultation with the Oklahoma Hospice and Palliative Care Association. As provided in thi s section, an amount of the fee collected shall be deposited in the ENR. S. B. NO. 37x Page 64 Hospice and Palliative C are License Plate Revo lving Fund created in Section 1104.21 of this title; 49. Juvenile Diabetes Research License Plate - such plates shall be issued to any person wishing to provide financial support for the Oklahoma Chapters of the Juvenile Diabetes Res earch Foundation. The license plates shall be designed in consultation with the Oklahoma Chapters of the Juvenile Diabet es Research Foundation. As provided in thi s section, an amount of the fee collected shall be deposited in the Juvenile Diabetes Resear ch License Plate Revolving Fund created in Section 1104.22 of this title; 50. Deer Creek Schools Foundation License Plat e - such plates shall be issued to any pers on wishing to provide financial support for the Deer Creek Schools Foundation. The license plates shall be designed in consultation with the Deer Creek Schools Foundati on. The plates shall be issued to any perso n in any combination of numbers and letters from one to a maximum of seven, as for personalized license plates. As provided in this se ction, an amount of the fee collected shall be deposited in the Deer Creek Sc hools Foundation License Plate Revolving Fun d created in Section 1104.23 of this title; 51. Lupus Awareness and Education License Plate - such plates shall be issued to any perso n wishing to provide fin ancial support for the Oklahoma Chapter of the Lupus Foundation of America. The license plates shall be designed in consultation with the O klahoma Chapter of the Lupus Foundation of America. As provided in this section, an amount of the fee collected sha ll be deposited in the Oklahoma Lupus License Plate Revolving Fund created in Section 1104.24 of this title. Subject to the provisions of s ubsection A of this section, the Lupus Awareness and Education License Plate is hereby reauthorized effective Novemb er 1, 2018; 52. Chiefs of Police License Plate - such plates shall be issued to any person wishi ng to provide financial support for the Oklahoma Association of Chiefs of Police for a vehicle or motorcycle in any combination of numb ers and letters from one to a maximum of seven, as for personalized license plates. The license plates shall be designed in consultation with the Oklahoma Associa tion of Chiefs of Police. The license plate for a motorcycle may be of similar ENR. S. B. NO. 37x Page 65 design as space permits or a new desi gn in order to meet the space requirements of a mot orcycle license plate. Service Oklahoma shall be authorized to enter into a licensing a greement with the Oklahoma Association of Chiefs of Police for any licensing fees which may b e required in order to u se the association’s logo or design. The licensing agreement shall provide for a payment to the Oklahoma Association of Chiefs of Police o f not more than Twenty Dollars ($20.00) for each license plate issued. Subject to the provis ions of subsection A of this section, the Chiefs of Police License Plate is hereby reauthorized effective November 1, 201 5; 53. Crossings Christian School Licens e Plate – such plates shall be designed and issued to any person wishing to demonstrate support for Crossings Christia n School located in Oklahoma City. The license plates shall be designed in consultation with the administration of Crossings Christian Sc hool. Service Oklahoma shall be authorized to enter into a licensing agreement with Crossings Christian School for an y licensing fees which may be required in order to use the school’s logo or design. The licensin g agreement shall provide for a payment t o the Crossings Christian School of not more than Twenty Dollars ($20.00) for each license plate issued; 54. Hilldale Education Foundation License Plate – such plates shall be designed and issued to any person wish ing to demonstrate support for the Hilld ale Education Foundation. The license plates shall be designed in consultation with the admini stration of the Hilldale Education Foundation. Service Oklahoma shall be authorized to enter into a licensing agreement with the Hilldale Education Foundation for any licensing fees which may be required in order to use the foundation’s logo or design. T he licensing agreement s hall provide for a payment to the Hilldale Educat ion Foundation of not more than Twenty Dollars ( $20.00) for each license plate issued; 55. Oklahoma Nurses License Plate – such plates shall be issued to any person licensed pursuant to the Oklahoma Nursing Practice Act and providing such documentation o f current licensure as may be required by Service Oklahoma. The license plates shall be designed in consultation with the Oklahoma Nurses Association. As provided in this section, an amount of the fee colle cted shall be deposited in the Oklahoma Nurses L icense Plate Revolving Fund created in Section 1104.26 of this title; ENR. S. B. NO. 37x Page 66 56. Oklahoma Sports Hall of Fame License Plate – such plates shall be issued to any person wishing to demonstrate support for the Oklahoma Sports Hall of Fame. The license plates shal l be designed in consultation with the administrat ion of the Oklahoma Sports Hall of Fame. Service Oklahoma shall be authorized to enter into a licensing agreement with the Oklahoma Sp orts Hall of Fame for an y licensing fees which may be required in order to use the Hall of Fame’s logo or design. The li censing agreement shall provide for a payment to the Oklahoma Sports Hall of Fame of not more than Twenty Dollars ($20.00) for each lic ense plate issued; 57. Childhood Cancer Awareness License Plate – such plates shall be issued to any person wishing to d emonstrate support for the Oklahoma Children’s Cancer Association. The license plates shall be designed in consultation with the admin istration of the Oklahom a Children’s Cancer Association. Service Okla homa shall be authorized to enter into a licensing agreement with the Oklahoma Children ’s Cancer Association for any licensing fees which may be required in order to use the Oklahoma Chi ldren’s Cancer Association’s logo or design. The licensing agreement shall provide for a payment to the Oklahoma Children’s Cancer Association of not more th an Twenty Dollars ($20.00) for each license plate issued; 58. Oklahoma Educational Television Aut hority License Plate – such plates shall be designed and issued to an y person wishing to demonstrate support for the Okla homa Educational Television Authority and such plates shall be designed in consultation with the Authority. As provided in this sectio n, an amount of the fee collected shall be deposited in The Education al Television Authority Revolving Fund created in Se ction 156 of Title 62 of the Oklahom a Statutes; 59. Remembering Fallen Heroes License Plate – such plates shall be designed and issued to any person wishing t o demonstrate support for Concerns of Police Survivors, Inc. Such plates shall be designed in consultation with the Oklahoma Chapter of Concerns of Police Survivors, Inc. As provided in this section, an amount of the fee collected shall be deposited in t he Oklahoma Concerns of Police Survivors License Plate Revolving Fund created in Section 1104.27 of this title; ENR. S. B. NO. 37x Page 67 60. Disabled American Veterans License Plate – such plates shall be designed in consultation with the Disabled American Veterans of Oklahoma an d issued to any member of the organization wishing to demonstrate support. Service Oklahoma shall be authorized to enter into a li censing agreement with the Disabled American Veterans of Oklahoma for any licensing fees which may be required in order to us e the organization’s logo or design. The licensing agreement shall provide for a payment to the Disabled American Veterans of Okla homa of not more than Twenty Dollars ($20.00) for each license plate issued. The plates shall incorporate a numbering system agreed upon by the Disabled American Veterans of Oklahoma and Service Oklahoma; 61. Owasso Rams Supporter License Plate - such plates shall be designed and issued to any person wishing to demonstrate support for the Owasso Rams, and shall be designed in consultation with representatives of Owasso Public Schools. The plates shall be issued to any person in any combination of number s and letters from one to a maximum of seven, as for personalized license plates. As provided in this section, an amount of the fee collected shall be deposited in the Education Reform Revolving Fund created in Section 34.89 of Title 62 of the Oklahoma St atutes; 62. Collinsville Cardinals Supporter License Plate - such plates shall be designed and issued to any person wishing to demonstrate support for the Collinsville Cardinals, and shall be designed in consultation with representatives of Collinsville Public Schools. The plates shall be issued to any person in any combination of numbers and letters fro m one to a maximum of seven, as for personalized license plates. As provided in this section, an amount of the fee colle cted shall be deposited in the E ducation Reform Revolving Fund created in Section 34.89 of Title 62 of the Oklahoma Statutes; 63. Sperry Pirates Supporter License Plate - such plates shall be designed and issued to any person wishing to demonstrate suppor t for the Sperry Pirates, and s hall be designed in consultation with representatives of Sperry Schools. The plates shall be issued to any person in any com bination of numbers and letters from one to a maximum of seven, as for personalized license plates. As provided in this section, an amount of the fee collected shall be deposited ENR. S. B. NO. 37x Page 68 in the Education Reform Revolving Fund created in Secti on 34.89 of Title 62 of the Oklahoma Statutes; 64. Skiatook Bulldogs Supporter License Plate - such plates shall be designed and issued to any person wishing to demonstrate support for the Skiatook Bulldogs, and shall be designed in consultation with repr esentatives of Skiat ook Public Schools. The plates shall be issued to any person in any combination of numbers and letters from one to a maximum of se ven, as for personalized license plates. As provided in this section, an amount of the fee collected shall be deposited in t he Education Reform Revolving Fund created in Section 34.89 of Title 62 of the Oklahoma Statutes; 65. Rejoice Christian Eagles Su pporter License Plate - such plates shall be designed and issued to any person wishing to demonstrate support for the Rejoice Christian Eagles, and shall be designed in consultation with representatives of Rejoice Christian Schools. The plates shall be is sued to any person in any combination of numbers and letters from one to a maximum of seven, as for personalized license plates. As provided in this section, an amount of the fee collected shall be deposited in the Education Reform Revolving Fund created in Section 34.89 of Title 62 of the Oklahoma Statutes; 66. East Central Cardinals Supporter License Plate - such plates shall be designed and issued to any person wishing to demonstrate support for the East Central Cardinals, and shall be designed in consultation with representatives of East Central High School. The plates shall be issued to any person in an y combination of numbers and letters from one to a maximum of seven, as for personalized license plates. As provided in this section, an amount of the fee collected shall be deposited in the Education Reform Revolving Fund created in Section 34.89 of Titl e 62 of the Oklahoma Statutes; 67. Southeast Spartans Supporter License Plate - such plates shall be designed and issued to any person wishing to d emonstrate support for the Southeast Spartans, and shall be designed in consultation with the Southeast High School Alumni Association. The plates shall be issued to any person in any combination of numbers and letters from one to a maximum of seven, as f or personalized license plates. As provided in this section, an amount of the fee ENR. S. B. NO. 37x Page 69 collected shall be deposi ted in the Education Reform Revolving Fund created in Section 34.89 of Title 62 of the Oklahoma Statutes; 68. Sooner State ABATE License Plate - such plates shall be issued to any person wishing to provide financial support for Sooner State ABATE (A Broth erhood Against Totalitarian Enactments). The license plates shall be designed in consultation with Sooner State ABATE. The plates shall be issued to any person in any combination of numbers and letters from one to a maximum of seven, as for personalized plates. The license plate for a motorcycle may be of similar design as space permits or a new design in order to meet th e space requirements of a motorcycle license plate. Service Oklahoma shall be authorized to enter into a licensing agreement with Soon er State ABATE for any licensing fees, which may be required in order to use the association ’s logo or design. The licen sing agreement shall provide for a payment to Sooner State ABATE of not more than Twenty Dollars ($20.00) for each license plate issued . Subject to the provisions of subsection A of this section, the Sooner State ABATE License Plate is hereby reauthorized effective November 1, 2019; 69. Oklahoma License to Educate License Plate – such plates shall be designed and issued to any person wi shing to demonstrate support for Oklahoma educators. Such plates shall be designed in consultation with the State Depart ment of Education. As pr ovided in this section, an amount of the fee collected shall be deposited in the Oklahoma Teacher Recruitment Revolving Fund created in Section 6-132 of Title 70 of the Oklahoma Statutes; 70. Piedmont Education Foundation License Plate – such plates shall be designed and issued to any person wishing to demonstrate support for the Piedmont Public Schools Education Foundation. Such plates shall be designed in consultation with the Foundation. As provided in this section, an amount of the fee collected sha ll be deposited in the Piedmont Public Schools Education Foundation License Plate Revolving Fund created in Sec tion 1104.28 of this title; 71. The Pride of Oklahoma License Plate - such plates shall be designed and issued to any pe rson wishing to demonst rate support for the Pride of Oklahoma marching band and shall be designed in consultation with the Pride of Okl ahoma marching band. Service ENR. S. B. NO. 37x Page 70 Oklahoma shall be authorized to enter into a licensing agreement with the University of Okl ahoma or the Pride of O klahoma marching band for any licensing fees which may be required in order to use the applicable logo or design . The licensing agreement shall provide for a payment to the Pride of Oklahoma Fund at the University of Oklahoma Founda tion, Inc. of not more than Twenty Dollars ($20.00) for each license plate issued; 72. Jenks Trojans License Plate - such plates shall be designed and issued to any person wishing to demonstrate support for the Jenks school district. The license plates s hall be designed in consultation with the administration of the Jenks school district. Service Oklahoma shall be authorized to enter i nto a licensing agreement with the Jenks school district for any licensing fees which may be required in order to use the school district’s logo or design. The licensing agreement shall provide for a payment to the Jenks school district of not more than T wenty Dollars ($20.00) for each license plate issued; 73. Bixby Spartans License Plate - such plates shall be designed and issued to any pers on wishing to demonstr ate support for the Bixby school district. The license plates shall be designed in consultation with the administration of the Bixby school district. Service Oklahoma shall be authorized to enter into a licensin g agreement with the Bixby school district for any licensing fees which may be required in order to use the school district ’s logo or design. The licensing agreement shall provide for a payment to the Bixby school district o f not more than Twenty Dollars ($20.00) for each license plate issued; 74. Oklahoma Department of Aerospace and Aeronautics License Plate - such plates shall be desi gned and issued to any person wishing to demonstrate support for the Oklahoma aviation industry and to promote awareness of aviation and aero space. Such plates shall be designed in consultation with the Oklahoma Department of Aerospace and Aeronautics and shall be issued to any person in any combination of numbers and letters from one to a maximum of seven, as for personalized license plates. Twenty-four Dollars ($24.00) of the fee collected shall be deposited in the Oklahoma Department of Aerospace and Aeronautics Revolving Fund, for expenditure as provided in Section 91 of Title 3 of the Oklahoma Statutes; ENR. S. B. NO. 37x Page 71 75. Ducks Unlimited License Plate – such plates shall be designed and issued to any person wishing to demonstrate support for Ducks Unlimited. Such plates shall be designed in consultation with Ducks Unlimited. Service Oklahoma shall be authorized to enter into a licensing agreement with Ducks Unlimited for an y licensing fee which may be required in order to use the Ducks Unlimited logo or design. The licensing agreement shall provide for a payment to Ducks Unlimited of not more than Twenty Dollars ($20.00) for each license plate issued; 76. Prisoner of War a nd Missing in Action License Plate - such plates shall be issued to any person wishing to in crease awareness of those who are currently prisoners of war or missing in action and provide financial support for curre nt veterans. The license plates shall be designed in consultation with Rolling Thunder Oklahoma. As provided in this section, an amou nt of the fee collected shall be deposited in the Prisoner of War and Missing in Action License Plate Revolving Fund created in Section 1104.29 of this title; 77. Woodward Boomers License Plate – such plates shall be designed and issued to any person wish ing to demonstrate support for the Woodward school district. The license plates shall be designed in consultation with t he administration of the Woodward school district. Service Oklahoma shall be authorized to enter into a licensing agreement with the W oodward school district for any licensing fees which may be required in order to use the school district’s logo or design. The licensing agreement shall provide for a payment to the Woodward school district of not more than Twenty Dollars ($20.00) for eac h license plate issued; 78. Clinton Public School Foundation License Plate – such plates shall be designed and issued to any person wishing to demonstrate support for the Clinton Public School Foundation. The license plates shall be designed in consultat ion with the Clinton Public School Foundation. Service Oklahoma shall be authorized to enter into a licensing agreement with the Clinton Public School Foundation for any licensing fees which may be required in order to use the school foundation ’s logo or design. The licensing agreement shall provide for a payment to the Clinton Public School Foundation of not more than Twe nty Dollars ($20.00) for each license plate issued; ENR. S. B. NO. 37x Page 72 79. Navajo School Foundation License Plate – such plates shall be issued to any person wishing to demonstrate support for the Navajo School Foundation. The license plates shall be designed in consultation with the administration of the Navajo Sc hool Foundation. Service Oklahoma shall be authorized to enter into a licensing agreement w ith the Navajo School Foundation for any licensing fees which may be required in order to use the Foundation’s logo or design. The licensing agreement shall provid e for a payment to the Navajo School Foundation of not more than Twenty Dollars ($20.00) for each license plate issued; 80. Oklahoma Music Hall of Fame Inc. License Plate – such plates shall be designed in consul tation with the Oklahoma Music Hall of Fame Inc. and issued to any member of the organization wishing to demonstrate support. Service Oklahoma shall be authorized to enter into a licensing agreement with the Oklahoma Music Hall of Fame Inc. for any licens ing fees which may be required in order to use the organization’s logo or design. The licensing agreement shall provide for a payment to the Oklahoma Music Ha ll of Fame Inc. of not more than Twenty Dollars ($20.00) for each license plate issued. The plat es shall incorporate a numbering system agreed upon by the Oklahoma Music Hall of Fame Inc. and Service Oklahoma. Subject to the provi sions of subsection A of this section, the Oklahoma Music Hall of Fame Inc. License Plate is hereby reauthorized effectiv e November 1, 2019; 81. Techlahoma Foundat ion License Plate – such plates shall be issued to any person wishing to provide financial s upport for the Techlahoma Foundation. The license plate shall be designed in consultation with the Techlahoma Foundation . The plate shall be issued to any person in any combination of numbers and letters from one to a maximum of seven, as for personalize d license plates. Service Oklahoma shall be authorized to enter into a licensing agreement with the Techlahoma Foundatio n for any licensing fees, which may be required in order to use the association ’s logo or design. The licensing agreement shall provid e for a payment to the Techlahoma Foundation of not more than Twenty Dollars ($20.00) for each license plate issued; 82. Bethany Public Schools Foundation License Plate – such plates shall be issued to any person wishing to demonstrate support for the Bethany Public Schools Foun dation. The license plates shall ENR. S. B. NO. 37x Page 73 be designed in consultation with the administration of the Beth any Public Schools Foundation. Service Okl ahoma shall be authorized to enter into a licensing agreement with the Bethany Public School s Foundation for any lic ensing fees which may be required in order to use the Foundation’s logo or design. The licensing agreement shall provide for a payment to t he Bethany Public Schools Foundation of not more than Twenty Dollars ($20.00) for each licen se plate issued; 83. Cystic Fibrosis Foundation License Plate – such plates shall be issued to any person wishing to dem onstrate support for the Cystic Fibrosis Foundation. The license plates shall be designed in consultation with the administration of t he Cystic Fibrosis Foundation. Service Oklahoma shall be authorized to enter into a licensing agreement with the Cystic Fibrosis Foundation for any licensing fees which may be required in order to use the Foundation’s logo or design. The licensing agreem ent shall provide for a payment to the Cystic Fibrosis Foundation of not more than Twenty Dollars ($20.00) for each licen se plate issued; 84. Down Syndrome Associa tion of Central Oklahoma License Plate - such plates shall be designed and issued to any per son wishing to demonstrate support for the Down Syndrome Association of Central Oklahoma. Such plates shall be designed in consultation with the Association. As provided in this section, an amount of the fee collected shall be deposited in the Down Syndr ome Association of Central Oklahoma License Plate Revolving Fund created in Section 1104.30 of this title; 85. Elk City Education Foundation License Plate – such plates shall be designed and issued to any person wishing to demonstrate support for the Elk City Education Foundatio n. Such plates shall be designed in consultation with the Foundation. As provided in this section, an amount of the fee collected shall be deposited in the Elk City Education Foundation License Plate Revolving Fund created in Section 1104.31 of this titl e; 86. A Brotherhood Aiming Toward Education of Oklahoma (ABATE) License Plate – such plates shall be designed and issued to any person wishing to provide financial support for ABATE of Oklahoma. Such plates shall be designed in consultation with ABATE o f Oklahoma. The plates shall be issued to any person in any combination of number s and letters from one to a maximum of seven, ENR. S. B. NO. 37x Page 74 as for personalized plates. The license plate for a motorcycle may be of similar design as space perm its or a new design in ord er to meet the space requirements of a motorcycle license plate. Service Oklahoma shall be authorized to enter into a licensing agreement with ABATE of Oklahoma for any licensing fees which may be required in order to use the ABA TE of Oklahoma logo or des ign. The licensing agreement shall provide for a payment to ABATE of Oklahoma of not more than Twenty Dollars ($20.00) for each license pla te issued; 87. Downed Bikers Association License Plate - such plates shall be designed for a vehicle or motorcycle in any combination of numbers and letters from one to a maximum of seven, as for personalized license plates, and issued to any person wishi ng to demonstrate support for the Downed Bikers Association, a nonprofit charitable organization exempt from taxatio n pursuant to the provisions of the Internal Revenue Code, 26 U.S.C., Section 501(c)(3), which provides emotional and financial support for downed bikers. The license plate shall be designed in consultation with the Central Oklahoma Chapter of the Downed Bikers Association and shall contain any official logo or design of the organization. The license plate for a motorcycle may be of similar design as space permits or a new design in order to meet the space requirements of a motorcycle license plate. Serv ice Oklahoma, if necessary, may enter into a licensing agreement with the Downed Bikers Associati on for any licensing fees which may be requ ired in order to use the organization’s logo or design. The licensing agreement shall provide for a payment to the Downed Bikers Association of not more than Twenty Dollars ($20.00) for each license plate; 88. Eagle Scout License Plate – such plates shall be designed to demonstrate support for Eagle Scouts of the Boy Scouts of America and shall include the Eagle Scout logo. Plates may be issued to any person who can show proof of having obtained the rank of Eagl e Scout. Service Oklahoma shall be authori zed to enter into a licensing agreement with the various Oklahoma local councils for any licensing fees which may be required in order to use the applicable logo or design. The licensing agreement shall provide f or a payment of not more than Twenty Dollar s ($20.00) for each license plate issued to the specific Oklahoma local area council designated by the applicant; ENR. S. B. NO. 37x Page 75 89. Extraordinary Educators License Plate – such plates shall be designed and issued to any person wishing to provide financial support for common education in this state. Such plates shall be designed in consultation with the State Department of Education. The plates shall be issued to any person in any combination of numbers and letters from one to a maximum of seven, as for personalized license plates. As provided in this section, an amount of the fee collected shall be dep osited in the Extraordinary Educators License Plate Revolving Fund created in Section 1104.32 of this title; 90. Former Oklahoma Legislator License Plate - such plates shall be designed and issued to any person who previously served as a member of the House of Representatives or Sena te. The license plates shall be designed in consultation with the Oklahoma Historical Society. As provided in this section, an amount of t he fee collected shall be deposited in the Oklahoma Historical Society Capital Improvement and Operations Revolving Fund created in Section 1.10a of Title 53 of the Oklahoma Statutes. Service Oklahoma shall create and maintain a list of former members of the House of Representatives and Senate eligible to be issued such plates; provided, that no former member of the Ho use of Representatives and Senate shall be eligible to possess more than two of such plates at any one time. Service Oklahoma shall confer as needed with the Chief Clerk of the House of Representatives and the Secretary of th e Senate to confirm that such list is complete and accurate; 91. Monarch Butterfly License Plate - such plates shall be designed and issued to any person wishing to demo nstrate support for the operations of The Nature Conservancy of Oklahoma. Such plate s shall be designed in consulta tion with the Oklahoma Chapter of The Nature Conservancy. Service Oklahoma shall be authorized t o enter into a licensing agreement with The Nature Conservancy of Oklahoma for any licensing fees which may be required in order to use the foundation’s logo or design. The plates shall be issued to any person in any combination of numbers and letters fro m one to a maximum of seven, as for persona lized license plates. The licensing agreement shall provide for a payment to The Nat ure Conservancy of Oklahoma of not more than Twenty Dollars ($20.00) for each license plate issued; ENR. S. B. NO. 37x Page 76 92. Oklahoma Tennis Foundat ion License Plate – such plates shall be designed and issued to any person wishing to demonstrate support for the Oklahoma Tenn is Foundation. The license plates shall be designed in consultation with the Oklahoma Tennis Foundation. Service Oklahoma shall be authorized to enter into a licensing agreement with the Oklahoma Tennis Foundation for any licensing fees which may be requ ired in order to use the foundation’s logo or design. The licensing agreement shall provide for a payment to the Oklahoma Tennis Foundation of not more than Twenty Dollars ($20.00) for each license plate issued; 93. Oklahoma Veterans of Foreign Wars Lic ense Plate - such plates shall be designed to honor the Oklahoma Veterans of Foreign Wars Chapters and shall be issued to any resi dent of this state upon proof of membership in the Oklahoma Veterans of Foreign Wars organization. The license plates shall b e designed in consultation with the Oklahoma Veterans of Foreign Wars organization. Service Oklahoma shall be authorized to enter into a licensing agreement with the Oklahoma Veterans of Foreign Wars organization for any licensing fees which may be requir ed in order to use the organization’s logo or design. The licensing agreement shall provide for a payment to the Oklahoma Veteran s of Foreign Wars organization of not more than Twenty Dollars ($20.00) for each license plate issued. Service Oklahoma shall reinstate any Veterans of Foreign Wars license plates issued prior to November 1, 2021, and shall reimburse any individual who he ld a Veterans of Foreign Wars License Plate on October 31, 2021, for fees incurred for the replacement of such plate; 94. Oklahoma Women Veterans Organization License Plate – such plates shall be designed and issued to any female veteran of any branch of the United States Armed Forces wishing to d emonstrate support for the Oklahoma Women Veterans Organization. The license plates shall be designed in consultati on with the Oklahoma Women Veterans Organization. Service Oklahoma shall be authorized to enter into a licensing agreement with the Oklahom a Women Veterans Organization for any licensing fees which may be required in orde r to use the organization’s logo or design. The licensing agreement shall provide for a payment to the Oklahoma Women Veterans Organization of not more than Twenty Dollars ( $20.00) for each license plate issued; ENR. S. B. NO. 37x Page 77 95. FIRST (For Inspiration and Recognitio n of Science and Technology) in Oklahoma License Plate - such plates shall be issued to any person wishing to demonstrate support f or FIRST in Oklahoma Robotics programs. The license plates shall be designed in consultation with the administration of FIRS T in Oklahoma. Service Oklahoma shall be authorized to enter into a licensing agreement with FIRST in Oklahoma for any licensing f ees which may be required in order to use the FIRST in Oklahoma logo or design. The licensing agreement shall provide for a payment to FIRST in Oklahoma of not more than Twenty Dollars ($20.00) for each license plate issued; 96. Pittsburg State Universi ty License Plate – such plates shall be designed and issued to any person wishing to demonstrate support for the Pittsburg St ate University. The license plates shall be designed in consultation with Pittsburg State University. Service Oklahoma shall be a uthorized to enter into a licensing agreement with Pittsburg State University for any licensing fees which may be required in order to use the school foundation ’s logo or design. The licensing agreement shall provide for a payment to the Pittsburg State U niversity of not more than Twenty Dollars ($20.00) for each license plate issued; 97. Greenwood Historical District License Plate – such plates shall be issued to persons wishing to demonstrate support for the Tulsa Juneteenth Festival held in the Greenw ood Historical District in Tulsa, Oklahoma. T he plates shall be issued to any person in any combination of numbers and lette rs from one to a maximum of seven, as for personalized license plates. The license plates shall be designed in consultation with t he Black Wall Street Chamber of Commerce. Service Oklahoma shall be authorized to enter into a licensing agreement with the Tulsa Juneteenth Festival for any licensing fees which may be required in order to use the Festival ’s logo or design. For each lic ense plate issued, the licensing agreement shall provide for a payment of Twenty -five Dollars ($25.00) of the fee collected t o the Tulsa Juneteenth Festival and an additional Two Dollars ($2.00) of the fee collected shall be deposited in the Public School Classroom Support Revolving Fund, for expenditure as provided in Section 1 -123 of Title 70 of the Oklahoma Statutes; 98. Oklahoma Veterans of Foreign Wars Auxili ary Chapters License Plate - such plates shall be designed to honor the Oklahoma ENR. S. B. NO. 37x Page 78 Veterans of Foreign Wars Auxiliary Chapters and issued to a ny resident of this state upon proof of membership in the Oklahoma Veterans of Foreign Wars Auxiliary organization in this state. The license plates shall be designed in consultation with the Oklahoma Veterans of Foreign Wars Auxiliary organization. Serv ice Oklahoma shall be authorized to enter into a licensing agreement with the Oklahoma Veterans of Foreign Wars Auxi liary organization for any licensing fees which may be required in order to use the organization’s logo or design. The licensing agreement shall provide for a payment to the Oklahoma Veterans of Foreign Wars Auxiliary organization of not more than Twenty Dollars ($20.00) for each license plate issued; 99. Transportation to Transportation Licens e Plate – such plates shall be designed and issu ed to persons wishing to support county roads and bridges. The license plate s shall be designed in consultation with the Association of County Commissioners of Oklahoma. Twenty Dollars ($20.00) of the fee c ollected shall be paid to the county treasurer f or the county in which the license plate was purchased to be credited to the county highway fund created pursuant to Section 1503 of Title 69 of the Oklahoma Statutes; 100. Blue Star Mothers License Plate – such plates shall be designed and issued to any person showing proof of membership in an Oklahoma Chapter of Blue Star Mothe rs of America, Inc. The license plates shall be designed in consultation with Blue Star Mothers of America, Inc., Oklahoma Chapter One. Service Oklahoma shall be authorized to enter into a licensing agreement with Blue Star Mothers of America, Inc., Okla homa Chapter One for any licensing fees which may be required in order to use the Blue Star Moth ers of America logo or design. The licensing agreement shall provide for a payment to Blue Star Mothers of America, Inc., Oklahoma Chapter One of not more than Twenty Dollars ($20.00) for each licens e plate issued; 101. Oklahoma Golf License Plate – such plates shall be designed and issued to any person wishing to demonstrate support fo r the sport of golf in this state. The license plates shall be designed in consultation with the South Central Sect ion of the Professional Golfers’ Association of America and issued to any person wishing to demonstrate support for the sport of golf in thi s ENR. S. B. NO. 37x Page 79 state. Service Oklahoma shall be authorized to enter into a licensing agreement with the South Central Section of the Professional Golfers’ Association of America for a ny licensing fees which may be required in order to use the organization ’s logo or design. The licensing agreement shall provide for a payment to the South Central Section of the Professional Golfers ’ Association of America of not more than Twenty Dollars ($20.00) for each license plate issued; 102. Paramedic License Plate - such plates shall be designed and issued to any person who is a paramedic. Such perso ns may apply for a paramedic license plate for each vehicle with a rated carrying capacity of one (1) ton or less or a motorcycle u pon proof of a paramedic license. The license plat es shall be designed in consultation with the Oklahoma State University -Oklahoma City Paramedicine program and the Oklahoma Emergency Medical Technicians Association. The letters “PM” shall be placed on t he plate followed by four random numbers, or such n umbers as requested by such persons applying for the plate. Twenty Dollar s ($20.00) of the fees collected shall be deposited in the Emergency Medical Personnel Death Benefit Revolving Fund created in Sect ion 1-2505.2 of Title 63 of the Oklahoma Statutes. Subject to the provisions of subsection A of this section, the Paramedic License Plate is hereby reauthorized effective November 1, 2022; 103. National Defense Service Medal License Plate – such plates shall be designed and issued to those persons who ha ve received the National Defense Service Medal and wish to demonstrate su pport for the Oklahoma Department of Vetera ns Affairs. The license plates shall be designed in consultation with the Oklahoma Depa rtment of Veterans Affairs. Service Oklahoma shall be authorized to enter into a licensing agreement with the Oklahoma Depar tment of Veterans Affairs for any licensing fees which may be required in order to use the Department’s logo or design. The licens ing agreement shall provide for a payment to the Okl ahoma Department of Veterans Affairs of not more than Twenty Dollars ($20 .00) for each license plate issued; 104. University of Oklahoma RUF/NEKS License Plate – such plates shall be designed and issued to any past or present member of the University of Oklahoma RUF/NEKS upon providing proof of membership in the organization as may be required b y Service ENR. S. B. NO. 37x Page 80 Oklahoma. The license plates shall be designed in consultation wi th the University of Oklahoma RUF/N EKS. Service Oklahoma shall be authorized to enter i nto a licensing agreement with the University of Oklahoma RUF/NEKS for a ny licensing fees wh ich may be required in order to use the organization’s logo or design. The licensing agreement shall provide f or a payment to the Mike James RUF/NEKS Memorial Scholarship of not more than Twenty Dollars ($20.00) for each license plate issued; 105. Tulsa Community College Licens e Plate – such plates shall be issued to persons wi shing to support Tulsa Community Co llege. The plates shall be designed in consultation w ith Tulsa Community College. Service Oklahoma shall be authorized to e nter into a licensing agreement with Tulsa Co mmunity College for any licensing fees which may be required in order to use the organ ization’s logo or design. The licensing agreement sha ll provide for a payment to Tulsa Community College of not more than Tw enty Dollars ($20.00) for each license plate issued; 106. Street Kings Car Club License Plate – such plates shall be designed and issued to any person wishing to demonstrate support fo r the Street Kings Car Club in Guthrie. The license plates shall be designed in consultatio n with the Street Kings Car Club. Service Oklahoma shall be authorized to enter into a licensing agreement with the Street Kings Car Club for any licensing fees wh ich may be required in order to use the organization ’s logo or design. The licensing agreement shall provide for a payment to the Street Kings Car Club of not more t han Twenty Dollars ($20.00) for eac h license plate issued; 107. Epilepsy Foundation Licen se Plate – such plates shall be designed and issued to any person wis hing to demonstrate sup port for the Epilepsy Foundation. The license plates shall be designed i n consultation with the Epilepsy Fo undation of Oklahoma. Service Oklahoma shall be authori zed to enter into licensing agreements with the Epilepsy Foundation f or any licensing fees w hich may be required in order to use the organization’s logo or design. The licensing agreement shall provi de for a payment to the Epilepsy Foundation of not more than Twenty Dollars ($20.00) for each license plate issued; 108. America First License Plat e – such plates shall be designed and issued to any person wishing to de monstrate support for ENR. S. B. NO. 37x Page 81 the proclamation of “America First”. The license plates shall be designed in consultation with Warriors for Freedom and the Honoring America’s Warriors Foundatio ns. Service Oklahoma sh all be authorized to enter into licensing agreem ents with the Warriors for Freedom and Honoring America’s Warriors Foundations for any licensing fees which may be required in order to use the Foundations’ logos or designs. The lice nsing agreements shall provide for a payment to the Honoring America ’s Warriors Foundation of not more than Ten Dollars ($10.00) and a payment to the Warriors for Freedom Foundation of not more than Ten Dollars ($10.00) for each license plate issued; 109. Diabetes Awareness Lice nse Plate – such plates shall be designed and issued to any person wishing to prov ide financial support for Diabetes Solutions of Oklahoma. The license plates shall be designed in consultation with Diabetes Solutions of Oklahoma. Service Oklahoma shall b e authorized to enter into licensing agreements with Diabetes Solutions of Oklahom a for any licensing fees which may be required in order to use the Diabetes Solutions of Oklahoma logos or designs. The lice nsing agreements shall provide for a deposit to t he Diabetes Awareness License Plate Revolving Fund established in Section 1104.33 of this title; 110. Alliance of Mental Health Providers o f Oklahoma License Plate – such plates shall be designed and issued to any person wishing to demonstrate support for the Alliance of Mental Health Providers of Oklahoma. The license plates shall b e designed in consultation with the Alliance of Mental Heal th Providers of Oklahoma. Service Oklahoma shall be authorized to enter into licensing agreements with the Alliance of Mental Health Providers of Oklahoma for any licensing fees which may be requi red in order to use the organization ’s logo or design. The licensing agreement shall provide for a payment to the Alli ance of Mental Health Providers of Oklahoma of not more than Twenty Dollars ($20.00) for each license plate issued; and 111. Stillwater Public Schools License Plate - such plates shall be designed and issued to any person wishing to demonstrate support for the Stillwater School District . The license plates shall be designed in consultation with th e administration of the Stillwater School District. Service Oklahoma shall be authorized to enter into a licensing agreement with the Stillwater School Distric t ENR. S. B. NO. 37x Page 82 for any licensing fees which ma y be required in order t o use the school district’s logo or design. The licensing agreement shall provide for a payment to the Stillwater School District of not mo re than Twenty Dollars ($20.00) for each license plate issu ed. C. The fee for such plates s hall be Thirty-five Dollars ($35.00) per year of renewal and s hall be in addition to all other registration fees provided by the Oklahoma Vehicle License and Registration Act. The fee shall be apportioned as follows through June 30, 2023: 1. Twenty Dollars ($20.00) per year of renewal or any other amount as provided in this title of the fee shall be appo rtioned as provided or deposited in a fund as specified within the paragraph authorizing the special license plate; 2. Eight Dollars ($8.00) per year of renewal of the fee shall be deposited in the Tax Commission Reimbursement Fund to be used for the administration of the O klahoma Vehicle License and Registration Act. Beginning January 1, 2023, Eight Dollars ($8.00) pe r year of renewal of the fee shall be deposited in the Servic e Oklahoma Reimbursement Fund to be used for the administration of the Oklaho ma Vehicle License and Registration Act; and 3. Any remaining amounts of the fee shall be apportioned as provided in Section 1104 of this title. SECTION 12. AMENDATORY 47 O.S. 2021, Section 1140, as amended by Section 174, Chapt er 282, O.S.L. 2022 (4 7 O.S. Supp. 2022, Section 1140), is amende d to read as follows: Section 1140. A. The Service Oklahoma Operator Board shall adopt rules prescribing minimum q ualifications and requirements for locating Service Oklahoma locations and for persons applying f or a license to operate a designated Servic e Oklahoma location. Such qualifications and requirements shall include, but not be limited to, the following: 1. Necessary job skills and experience; 2. Minimum office hours; ENR. S. B. NO. 37x Page 83 3. Provision for sufficient staff ing, equipment, office space and parking to provide maximum efficiency and maximum convenience to the public; 4. Obtainment of a faith ful performance surety b ond as provided for by law; 5. That the applicant has not been convi cted of a felony and that no felony charges are pending against the app licant; 6. That the location specified in the individual ’s application for a license to ope rate a designated Servic e Oklahoma location not be owned by a member of Service Oklahoma or an employee of Service Oklahoma or any person related to a member of Ser vice Oklahoma or an employee of Service Oklahoma within the third degree by consanguinity, marriage, or adoption and that the location not be within a three-mile radius of an existing licensed operator unless the applicant is assuming the location of an op erating licensed operator; 7. That a single website, designated by Service Oklahoma, will be used for the distribut ion of services provided by Service Oklahoma with motor vehicle ser vices to be fulfilled by licen sed operators; 8. That licensed operators will attend all required training provided by Service Oklahoma; and 9. That there should be at least one Service Ok lahoma location in each county. B. 1. Any person making applic ation to the Service Oklahoma Operator Board for the purpose of obtaining a license to operate a designated Service Oklahoma location shall pay, when submitting the application, a nonrefundabl e application fee of One Hundred Dollars ($100.00). All such ap plication fees shall be deposited in the Oklahoma Tax Commission Revolving Fund. Beginning January 1, 2023, all such application fees shall be deposited in the Service Oklahoma Revolving Fund. 2. Any person making application to the Service Oklahoma Operator Board for the purpose of obt aining a license to operate a ENR. S. B. NO. 37x Page 84 designated Service Oklahoma location must meet standardization and branding requirements established by t he Service Oklahoma Oper ator Board, upon recommendations from Service Oklahoma. Upon a pproval, the person must either pa y a fee to Service Oklahoma for all costs related to meeting the standardization and branding requirements or obtain approval from the Service Oklahoma Operato r Board that the location meets all standardization and brandin g requirements. All such fees shall be deposited in the Service Oklahoma Rev olving Fund. The amount of the license fee will be determined by the Service Oklahoma Operator Board. This provisi on shall not apply to any existing Service Oklahoma location. C. Upon application by a person to serve as a licensed operator, the Service Oklahoma Operator Board is authorized to make a determination whether such person and such l ocation meets the criteria and guidelines established by the Service Oklahoma Operator Board and, if such be the case, ma y issue a license to operate a designated Service Oklahoma location. D. 1. A licensed operator may be permitted, upon application, to sell or transfer an exi sting license to operate a designated Service Oklahoma locati on. Any sale or transfer of a licen se is subject to approval of the Service Ok lahoma Operator Board. In order to sell or transfer an existing licensed operator license, the licensed operator sh all meet the following guidelines and requirements: a. the licensed operator shall be in good sta nding with the Service Oklahoma Operator Bo ard, b. the licensed operator shall have held a licensed operator license, issued by the Ser vice Oklahoma Operator Board, for a minimum of five (5) years, and c. the licensed operator shall provide the Service Oklahoma Operator Board evidence that the prop osed buyer or transferee of the licensed operator licensee meets the qualifications and requ irements set forth in subsection A of this section, has the ability to meet all financial requirements and terms of any c urrent existing contract between the licens ed operator and Service Oklahoma, and agrees to the onboarding and ENR. S. B. NO. 37x Page 85 training requirements of Service Oklahoma, as established by Service Oklahoma and the Service Oklahoma Operator Board. 2. The purchase price of a licensed operator license shall be agreed upon by the licensed operator and the individual purchasing the license to operate a designa ted Service Oklahoma loc ation. However, the purchaser or transferee agrees to pa y a transfer fee to Service Oklahoma in the amount of three percent (3%) of the las t annual gross revenue from fees retained at the Service Oklahoma location to be purchased, not to exceed Fifteen Th ousand Dollars ($15,000.00). The transfer fee shall be d eposited in the Service Oklahoma Revolving Fund. 3. Upon receipt of the applicatio n to sell or transfer an existing licensed operator license, the Service Oklahoma Operator Board will determine whet her the licensed operator license may be sold or transferred on the condition that the existing l ocation is in good standing and the new lic ensee meets the requirements outlined in Section 1140 et seq. of this title. 4. The Service Oklahoma Operator Board may, at its discretion, buy back a licensed operator l icense from a licensed operator who desires to sell or transfer its licensed operator license but has held a licensed operator license issued by Service Oklahoma for less than five (5) years. The purc hase price for such a license will be one-half (1/2) times the most recent annual gross revenue f rom fees retained of that Service Oklahoma location, not to exceed Two Hundred Thousand Dollars ($200,000.00). The purchase price shal l be paid out of the excess funds available in the Licensed Operator Performance Fund, created in Section 3 -106 of this title, after distribution to licensed operat ors, pursuant to Section 3 -106 of this title. E. 1. Licensed operators shall be subject to all laws relating to licensed operators and shall be subject to removal for c ause by the Service Oklahoma Operator Board . Any action taken by Service Oklahoma to revoke a license shall be pursuant to and in accordance with the provisions of the Administr ative Procedures Act. F or the purposes of this section, “for cause” shall be defined as follows: ENR. S. B. NO. 37x Page 86 a. repeated violations of written contracts, rules, regulations and statutes pertaining to licensed operators after written warning by the Service Oklahoma Operator Board and an oppo rtunity to correct such violations, b. failure of the licensed operator to promptly remit funds owed to Service Oklahoma upon written demand , c. being charged with a felony crime involving dishonesty or moral turpitude, d. failure to timely file state and federal income tax returns, or e. any act of official misconduct as set forth in Section 93 of Title 51 of the Oklahoma Statutes. In the event a license is revoked by the Service Oklahoma Operator Board for cause, the Service Oklaho ma location operated by the licensed operator will be permanently closed and the licensed operator shall not be entitled to any compensation. Motor license agents a nd licensed operators in good standing as of November 1, 2022, shall be exempt from the bran ding and physical standardization requirements to be established by the Service Oklahoma Operator Board, with the recomme ndation of the Director of Service Oklahoma. 2. A license to operate a designated Service Oklahoma location may be revoked by the Serv ice Oklahoma Operator Bo ard for failure to meet the standards for cust omer satisfaction established by the Service Oklahoma Operator Board. In the event of revocat ion, the licensed operator shall sell his or her license to operate a Service Oklahoma location to Service Oklahoma at a rate of one-half (1/2) times the most recent annual gross revenue from fees retained of that Service Oklahoma location, not to exceed T wo Hundred Thousand Dollars ($200,000.00). The purchase price shall be paid out of the excess funds available in th e Licensed Operator Performance Fund, created in Section 3-106 of this title, after distribution to licensed operators, pursuant to Section 3-106 of this title. ENR. S. B. NO. 37x Page 87 F. All licensed operators shall be licensed by and under the supervision of Service Oklahoma; provided, any agent authorized to issue registrations pursuant to the International Registration Plan shall also be under the supervision of the Corporation Commission, subject to rules promulgated by the Corporation Commission purs uant to the provisions of subsection E of Section 1166 of this title. Service Oklahoma shall be the holder of all licens es and has the right to approve and revoke such licenses. After obtaining a license, any such licensed operator shall furnish and file with Service Oklahoma a bond in such amount as may be fixed by Servi ce Oklahoma. Such licensed operator shall be remova ble at the will of Service Oklahoma. Such licensed operator shall perform all duties and do such things in the administration of the l aws of this state as shall be enjoined upon and required by the Servi ce Oklahoma Operator Board. Provided, Service Oklah oma may operate a Service Oklahoma location in any county where a vacancy occurs, as determined by Service Oklahoma. G. In the event of a vacancy due to the d eath of a licensed operator, the licensed op erator’s designee or a licensed operator location employee shall immediately notify Service Okla homa. A licensed operator may designate an individual to continue to operate the Service Oklahoma location upon the death of the licensed operator. The design ee shall apply to obtain a license to operate the vacant licensed operator location with the Ser vice Oklahoma Operator Board within thirty (30) days of the licensed operator ’s death. In the event that no designe e is designated or that the designee fails to apply to be a licensed operator with Service Oklahoma within thirty (30) days, Service Oklahom a may take any and all action it deems appropriate in order to provide for the orderly transition and the maintenanc e of operations of the Service Oklahoma location, as permitted by law. H. When an application fo r registration is made with Service Oklahoma, the Corporation Commission or a licensed operator, a registration fee of One Dollar and s eventy-five cents ($1.75) shall be collected for each license plate or decal issued. Such fees shall be in addition to t he registration fees on motor vehicles and when an application for registration is made to the licensed operator, such licensed operato r shall retain a fee as provided in Section 1141.1 of this title through June 30, 2023. Beginning July 1, 2023, the fee shall be retained by the licensed operator pursuant ENR. S. B. NO. 37x Page 88 to subsection E of Section 1141.1 of this title . When the fee is paid by a person making application direc tly with Service Oklahoma or the Corporation Commission, as applicable, the registration fees shall be in the same amount as provided for li censed operators and the fee provided by Section 1141.1 of this title shall be deposited in the Oklahoma Tax Commiss ion Revolving Fund or as provided in Section 1167 of this title, as applicable. Beginning Januar y 1, 2023, the fee provided by Section 1141 .1 of this title shall be deposited in the Service Oklahoma Revolving Fund or as provided in Section 1167 of this ti tle, as applicable. Service Oklahoma shall prepare schedules of registration fees and charges fo r titles which shall include the fees for s uch licensed operators and all fees and charges paid by a person shall be listed separately on the application and registration and totaled on the application and registration. The licensed operators shall charge only such fees as are specifically provide d for by law, and all such authorized fees shall be posted in such a manner that any person shall have notice of all fees that are imposed by law. I. Any licensed operator shall be responsible for all costs incurred by Service Oklahoma when relocating an existing Service Oklahoma location. The Service Oklahoma Operator Board may waive payment of such costs in case of unforeseen business or emergency conditions beyond the control of the licensed operator. J. Any existing contracts by or between any motor license agent and the Oklahoma Tax Commission shall be assigned to Service Oklahoma. All existing motor license age nts in good standing with the Oklahoma Tax Commission will be offered a subsequent contract from Service Oklahoma to become a licensed opera tor to take effect on January 1, 2023. The contract between existing motor license agents and Service Oklahoma shal l be agreed to no later than December 31, 2022. In the event an existing motor license agent declines to enter into the subsequent contract with Service Oklahoma to become a licensed operator, that motor license agent may continue to conduct business purs uant to the existing contract through December 31, 2025, so long as that motor license agent rema ins in good standing with Service Oklahoma in accordance with the terms of the existing contract. ENR. S. B. NO. 37x Page 89 SECTION 13. AMENDATORY 47 O.S. 2021, Section 1141.1, as last amended by Section 177, Chapter 282, O.S.L. 2022 (47 O.S. Supp. 2022, Section 1141.1), is amended to read as follow s: Section 1141.1. A. Each licensed operator shall be entitled to retain the following amounts from the taxes and fees collected by such licensed operato r to be used to fund the operation of the office of such licensed operator subject to the provisions of Sections 1140 through 1147 of this title: 1. Beginning July 1, 2006, through December 31, 2021 June 30, 2023, Three Dollars and fifty-six cents ($3.56) for each vehicle registered and for each special license plate issued pursuant to the Oklahoma Vehicle License and Registration Act; 2. Beginning on or after January 1, 2022 , and for all subsequent years through June 30, 2023, if a special or personali zed license plate is issued pursuant to Sections 1135.1 thro ugh 1135.7 of this title and remittance is combined with the registration required pursuant to Section 1132 of this title, Seven Dollars and twelve cents ($7.12). Beginning July 1, 2023, through June 30, 2025, Three Dollars and fifty -six cents ($3.56) for each special license plate issued pursuant to Sections 1135.1 through Section 1135.7 of this title ; 3. One Dollar and twenty -five cents ($1.25) for each certificate of title issued for boats and motors pursuant to the Oklahoma Statutes; 4. For each certificate of registration issued for boats an d motors pursuant to the Oklahoma Statutes, an amount determined pursuant to the prov isions of subsection B of this section; 5. Two Dollars and twenty-five cents ($2.25) for each certificate of title issued pursu ant to the Oklahoma Vehicle License and Registration Act. Provided, the fee retention amount for certificates of title issued p ursuant to the provisions of subsection H of Section 1105 of this title, in which an insurer pays the optional twenty-two-dollar-fee amount, is Four Dollars and fifty cents ($4.50); ENR. S. B. NO. 37x Page 90 6. Beginning October 1, 2000, three percent (3%) of the vehicle excise tax collected pursuant to Section 2103 of Title 68 of the Oklahoma Statutes. Beginning July 1, 2001, each licensed operator shall be entitled to retain three and one hundre d twenty-five one- thousandths percent (3.125%) of the vehicle excise tax collected pursuant to Section 2103 of Title 68 of the Oklahoma Statutes. Beginning July 1, 2002 through June 30, 2023 , and for all subseque nt years, each licensed operator shall be e ntitled to retain three and twenty-five one-hundredths percent (3.25%) of the vehicle excise tax collected pursuant to Section 2103 of Title 68 of the Oklahoma Statutes. However, beginning July 1, 2003, the Legis lature shall annually review the percentage to be retained by the licensed operators pursuant to this paragraph to determine whether su ch percentage should be adjusted; 7. Four percent (4%) of the excise tax collected on the transfer of boats and motors p ursuant to the Oklahoma Statutes through June 30, 2025; 8. Two Dollars ($2.00) for each driver license, endorsement, identification license, or renewal or dup licate issued pursuant to Section 6-101 et seq. of this title through June 30, 2023 ; 9. Two Dollars ($2.00) for the recording of security i nterests as provided in Section 1110 of this title; 10. Two Dollars ($2.00) for each inspec tion conducted pursuant to subsection L of Section 1105 of this title; 11. Three Dollars ($3.00) for each inspection con ducted pursuant to subsection M of Section 1105 of this title; 12. One Dollar ($1.00) for each certificate of ownership filed pursuant to subsection R of Sect ion 1105 of this title; 13. One Dollar ($1.00) for each temporary permit issued pursuant to Section 1124 of this title; 14. One Dollar and fifty cents ($1.50) for processing each proof of financial responsibility, driver license i nformation, insurance verification information, and other additional information as provided in Section 7 -602 of this title; ENR. S. B. NO. 37x Page 91 15. The mailing fees and registration fees provided in Sections 1131 and 1140 of this title; 16. The notary fee provided in Secti on 1143 of this title; 17. Three Dollars ($3.00) for each lien entry form completed and recorded on a certificate of tit le pursuant to subsection G of Section 1105 of this title; 18. Seven Dollars ($7.00) for each notice of transfer as provided by subsection B of Section 1107.4 of this title; 19. Seven Dollars ($7.00) for each certificate of title or each certificate of registration issued for repossessed vehicles pursuant to Section 1126 of this title; 20. Any amount specifically authorized by law to b e retained by the licensed operator for the furnishing of a summary of a traffic record; 21. Beginning July 1, 2009 and through June 30, 2023 , each licensed operator shall also be entitled to a portion of the penalties for delinquent registration or paym ent of excise tax as provided for in subsection C of Section 1115, subsection F of Section 1132 and subsection C of Sectio n 1151 of this title and of subsection A of Section 2103 of Title 68 of the Oklahoma Statutes; 22. Beginning January 1, 2023, each li censed operator shall be entitled to retain Three Dollars and fifty -six cents ($3.56) for each electric vehicle registered pursuant to the provisions of this act and such amount shall be in addition to any other amount otherwise authorized by this section to be retained with respe ct to a vehicle though June 30, 2025; and 23. Beginning January 1, 2023 and through June 30, 2023, each licensed operator shall be entitled to retain three and twenty -five hundredths percent (3.25%) of the vehicle excise tax colle cted pursuant to Section 2103 of Title 68 of the Oklahoma Statutes for each electric vehicle but such amount shall not be in addition to any other amount otherwise a uthorized by this section to be retained with respect to a vehicle. ENR. S. B. NO. 37x Page 92 The balance of the fund s collected shall be remi tted to Service Oklahoma as provided in Section 1142 of this title to be apportioned pursuant to Section 1104 of this title. B. For Through June 30, 2025, each certificate of registration issued for boats and motors, each licensed operator shall be entitled to retain the greater of One Dollar and twenty -five cents ($1.25) or an amount to be determine d by Service Oklahoma according to the provisions of this subsection. At the end of fiscal year 1997 and each fiscal year thereafter, Service Oklahoma shall c ompute the average amount of registration fees for all boats and motors registered in this state during the fiscal year and shall multiply the result by six and twenty -two one-hundredths percent (6.22%). The resulting product shal l be the amount which may be retained by each licensed operator for each certificate of registration for boats and motors issued during the following calendar year. C. When an application for registration is made with Service Oklahoma, the Corporation Com mission or a licensed ope rator, a registration fee of One Dollar and seventy -five cents ($1.75) shall be collected for eac h license plate or decal issued. Such fees shall be in addition to the registration fees on motor vehicles and when an application fo r registration is made to the licensed operator such licensed operator shall retain a fee as provided in Section 1141.1 of this title through June 30, 2023. Beginni ng July 1, 2023, the fee shall be retained by the licensed operator pursuant to subsection E of Section 1141.1 of th is title. When the fee is paid by a person making application directly with Service Oklahoma or the Corporation Commission, as applicable, the registration fees shall be in the same amount as provided for licensed operators and the fee provided by Section 1141.1 of this title this section shall be deposited in the Service Oklahoma Revolving Fund or a s provided in Section 1167 of this title, a s applicable. Service Oklahoma shall prepare schedules of registration fees and charges fo r titles, which shall include the fees for licensed operators, and all fees and charges paid by a person shall be listed s eparately on the application and registrati on and totaled on the application and registration. Unless otherwise provided, beginning July 1, 2025, the provisions related to the reimburse ment, retention, apportionment, or distribution of funds to or by licensed operators as outlined in this section shall be retained by the licensed operator pursuant to Subsection E of this section. E. Beginning July 1, 2023, unle ss otherwise provided, lic ensed operators compensation shall be fixed by Service Oklahoma pursuant to Section 3-103 of this title. 1. For fiscal year beginning July 1, 2023, through the fiscal year ending on June 30, 2025: a. licensed operators shall b e entitled to retain nineteen percent (19%) of all fees collected related to registrations provided by the Oklahoma Vehicle License and Registration Act, pursuant to sub section A of Section 1132 of this title, subsection A of Section 1132.1 of this title, subsection A of Section 1132. 4 of this title, and subsection H of 1140 of this title, and b. licensed operators shall be entit led to retain forty percent (40%) of all fe es collected related to the issuance of Class A, Class B, Class C, and Class D driver licenses, permits, and identif ication cards, including REAL ID Compliant and REAL ID Noncompliant credentials, pursuant to Sect ion 6-101 et seq. of this title. 2. All other fees directed by this section shall default back to the apportionment outlined i n Section 1104 of this title. SECTION 14. REPEALER 47 O.S. 2021, Section 1132.5 , is hereby repealed. SECTION 15. This act shall become effective July 1, 2023 . SECTION 16. It being immediately necessary for the preservation of the public peace, health or safety, an emergency is hereby ENR. S. B. NO. 37x Page 94 declared to exist, by reason whereof this act shall take effect and be in full force from and after its passage and approval. ENR. S. B.
