40	62		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

42	63		SECTION 1. There is hereby appropriated to the Health Care
43	64		Workforce Training Commission from any monies not otherwise
44	65		appropriated from the Statewi de Recovery Fund of the State Treasury
45	66		created in Enrolled House Bill No. 3349 of the 2nd Session of the
46	67		58th Oklahoma Legislature the sum of Five Hundred Thousand Dollars
	68	+	($500,000.00) or so much thereof as may be necessary to establish a

51	96		purpose of recruiting, educating, and stabilizing Oklahoma’s health
52	97		care workforce. Such funds shall be utilized in a manner consis tent
53	98		with the recommendations adopted by the Joint Committee on Pandemic
54	99		Relief Funding on May 19, 2023.

56	100		SECTION 2. A. There is hereby created in the State Treasury a
57	101		Statewide Recovery Special Account for the Health Care Workforce
58	102		Training Commission for the appropriated monies provided for in
59	103		Section 1 of this act. The duration of such account shall continue
60	104		for the period of time that monies related to the American Rescue
61	105		Plan Act of 2021 are being budgeted, expended, or managed in the
62	106		state. The ending of such period shall be determined by the State
63	107		Treasurer and shall result in the closing of such account as a
64	108		matter of law. Such account shall be a continuing account as
65	109		otherwise provided in this section, not subject to fiscal year
66	110		limitations, and shall exclusively consist of monies related to the
67	111		relevant appropriation made in this act and as otherwise directed by
68	112		law. All monies deposited to the credit of such account are hereby
69	113		appropriated and may be budgeted and expended by the Health Care
70	114		Workforce Training Commission in accordance with the provisions of
71	115		this act. Expenditures from s uch account shall be made upon
72	116		warrants issued by the State Treasurer against claims filed as
73	117		prescribed by law wi th the Director of t he Office of Management and
74	118		Enterprise Services for approval and payment.

76	145		B. The Health Care Workforce Training Commissio n is authorized
77	146		to request in writing that the monies appropriated by the provisions
78	147		of this act be deposited or transferred to the account created
79	148		pursuant to subsection A of this section. No later than seven (7)
80	149		calendar days from the date of such reque st, the Director of the
81	150		Office of Management and Enterprise Services shall comply with such
82	151		request and verify to the requesting agency that such deposit or
83	152		transfer has been completed.

85	153		SECTION 3. The Health Care Workforce Training Commission may
86	154		enter into memorandums of understanding with o ther agencies of the
87	155		State of Oklahoma for the auditing, documentation, evaluation,
88	156		implementation, oversight, reporting, and management of funds and
89	157		associated efforts related to the appropriation made in this act;
90	158		provided, no such memorandum of un derstanding shall require or

93	159		include, as an option or condition, the direct or practical transfer
94	160		or relinquishment of control by the agency appropriated such funds
95	161		to budget, expend, allocate, and request the distribution of the
96	162		funds appropriated by this act.

98	163		SECTION 4. The Health Care Workforce Training Commissio n may
99	164		promulgate rules, utilize existing rules, establish procedures, and
100	165		utilize existing procedure s to implement the provisions of this act,
101	166		provided such rules and procedures do not conflict with or impede
102	167		the provisions of this act.

104	194		SECTION 5. The Health Care Workforce Training Commission shall
105	195		retain no more than two percent (2%) of the fund s appropriated by
106	196		Section 1 of this act to reimburse:

108	197		1. Costs incurred by the Health Care Workforce Training
109	198		Commission; or

111	199		2. Costs incurred on t he agency’s behalf,
112		-
113	200		associated with the a dministration of the appropriated funds and
114	201		programming required by the Health Care Workforce Training
115	202		Commission under the provisio ns of this act; provided, no funds
116	203		shall be retained that would be disallowabl e under the provisions of
117	204		the American Rescue Plan Act of 2021.

119	205		SECTION 6. A. The Health Care Workforce Training Commission
120	206		shall:

122	207		1. Submit to the chairs of the Joint Committee on Pandemic
123	208		Relief Funding, or any successor of the Oklahoma State Senate or
124	209		Oklahoma House of Representatives legislative committee or joint
125	210		committee, as designated by the President Pro Tempore of the
126	211		Oklahoma State Senate and the Speaker of the Oklahoma House of
127	212		Representatives:

129	213		a. a written or electronic quarterly report detailing the
130	214		budgeting, expenditure, and management of all monies
131	215		appropriated in this act, and

133	216		b. a copy of all memorandums of underst anding and
134	217		contracts with third parties entered into by the

139	246		provided to the Health Care Workforce Training

142	248		2. At the Joint Committee on Pandemic Relief Funding’s request,
143	249		appear before the Joint Committee no later than six (6) months after
144	250		the effective date of this act, and as otherwise requested by the
145	251		Joint Committee to provide a status update regarding the
146	252		implementation of the provisions of this act.

148	253		B. The provisions of subsection A of this section shall remain
149	254		applicable for the period of time that monies appropriated under
150	255		this act are being budgeted, expended, or managed in the state. The
151	256		ending of such period shall be determined by the State Treasurer,
152	257		and shall be reported to the Governor, President Pro Tempore of the
153	258		Oklahoma State Senate and the Speaker of the Oklahoma House of
154	259		Representatives.

156	260		SECTION 7. It being immediately necessary for the preservation
157	261		of the public peace, health or safety, an emergency is hereby
158	262		declared to exist, by reason whereof this act shall t ake effect and
159	263		be in full force from and after its passage and approval.
