5350 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5451 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1272, is
5552 amended to read as follows :
5653 Section 1272.
5754 UNLAWFUL CARRY
5855 A. Notwithstanding any other provision of law, it shall be
5956 unlawful for any person to carry upon or about his or her person, or
6057 in a purse or other container belonging to the person, any pistol,
6158 revolver, shotgun or rifle whether loaded or unloaded or any
6259 blackjack, loaded cane, hand chain, metal knuckles, or any other
6360 offensive weapon, whether such weapon be concealed or unconcealed,
6461 except this section shall not prohibit:

9288 1. The proper use of guns and knives fo r self-defense, hunting,
9389 fishing, educational or recreational purposes;
9490 2. The carrying or use of weapons in a manner otherwise
9591 permitted by statute or authorized by the Oklahoma S elf-Defense Act;
9692 3. The carrying, possession and use of any weapon by a pe ace
9793 officer or other person authorized by law to carry a weapon in the
9894 performance of official duties and in compliance with the rules of
9995 the employing agency;
10096 4. The carrying or u se of weapons in a courthouse by a district
10197 judge, associate district judge or special district judge within
10298 this state, who is in possession of a valid handgun license issued
10399 pursuant to the provisions of the Oklahoma Self -Defense Act and
104100 whose name appears on a list maintained by the Administrative
105101 Director of the Courts;
106102 5. The carrying and use of firearms and other weapons provided
107103 in this subsection when used for the purpose of living history
108104 reenactment. For purposes of this paragraph, "living history
109105 reenactment" means depiction of historical characters, scenes,
110106 historical life or events for entertainment, education, or
111107 historical documentation through the wearing or use of period,
112108 historical, antique or vintage clothing, accessories, firearms,
113109 weapons, and other implements of the historical period; or
114110 6. The transporting by vehicle on a public roadway or the
115111 carrying of a firearm, concealed or unconcealed, loaded or unloaded,

143138 by a person who is twenty-one (21) years of age or older or by a
144139 person who is eighteen (18) years of age but not yet twenty-one (21)
145140 years of age and the person is a member or veteran of the United
146141 States Armed Forces, Reserves or National Guard or was discharged
147142 under honorable conditions from the United States Armed Forces,
148143 Reserves or National Guard, or meets the age requirement provided in
149144 the provisions of Section 1 of Article III of the Oklahoma
150145 Constitution and the person is otherwise not disqualified fr om the
151146 possession or purchase of a firearm under state or federal la w and
152147 is not carrying the firearm in furtherance of a crime.
153148 Except as provided in sub section B of Section 1283 of this
154149 title, a person who has been convicted of any one of the following
155150 offenses in this state or a violation of the equivalent law of
156151 another state:
157152 a. assault and battery pursuant to the provisions of
158153 Section 644 of this titl e which caused serious
159154 physical injury to the victim,
160155 b. aggravated assault and battery pursuant to th e
161156 provisions of Section 646 of this title,
162157 c. assault and battery th at qualifies as domestic abuse
163158 as defined in Section 644 of this title,
164159 d. stalking pursuant to the provisions of Section 1173 of
165160 this title,

193187 e. a violation of an order issued under the Pr otection
194188 from Domestic Abuse Act or a domestic abuse protection
195189 order issued by another state, or
196190 f. a violation relating to illegal drug use or possessio n
197191 under the provisions of the Uniform Controlled
198192 Dangerous Substances Act,
199193 shall be prohibited from ca rrying a firearm under the provisions of
200194 this paragraph. Any person who carries a firearm in the manner
201195 provided for in this paragraph shall be prohibite d from carrying the
202196 firearm into any of the places prohibited in subsection A of Section
203197 1277 of this title or any other place currently prohibited by law.
204198 Nothing in this section shall modify or otherwise change where a
205199 person may legally carry a firearm .
206200 B. Any person convicted of violating the foregoing provision
207201 shall be guilty of a misdemeanor punis hable as provided in Section
208202 1276 of this title.
209203 SECTION 2. AMENDATORY 21 O.S. 2021, Section 1290.8, is
210204 amended to read as follow s:

214208 A. Except as otherwise prohibited by law, an eligible person
215209 shall have authority to carr y a concealed or unconceale d handgun in

244237 1. The person has been issued a handgun license from the
245238 Oklahoma State Bureau of Investigation pursuant to the provisions of
246239 the Oklahoma Self-Defense Act, provided the person is in compliance
247240 with the provisions of the Okla homa Self-Defense Act, and the
248241 license has not expired or be en subsequently suspended or re voked;
249242 or
250243 2. The person is twenty-one (21) years of age or older, and is
251244 either:
252245 a. active military, or
253246 b. a member of the Reserve or Nat ional Guard to include
254247 Drill Status Guard and Reserve, Active Guard Reserves
255248 or Military Technicians,
256249 and presents a valid military identification card that shall be
257250 considered a valid handgun license issued pursuant to the Oklahoma
258251 Self-Defense Act; or
259252 3. The person meets the age requireme nt provided in the
260253 provisions of Section 1 of Article III of the Oklahoma Constitution.
261254 B. A person in possession of a valid handgun license or who
262255 meets the criteria and presents a valid military identification card
263256 as provided for in this section and in compliance with the
264257 provisions of the Oklahoma Self -Defense Act shall be authorized to
265258 carry such concealed or unconcea led handgun while scouting as it
266259 relates to hunting or fishing or while hunting or fishing.

294286 C. The person shall be required to have possession of his or
295287 her valid handgun license or valid military identification card as
296288 provided for qualified persons in t his section and a valid driver
297289 license or state photo identification at all times when in
298290 possession of an authorized pistol. The person shall display the
299291 handgun license or a valid milit ary identification card as provided
300292 for qualified persons in this se ction on demand of a law enforcement
301293 officer; provided, however, that in the absence of reasonable a nd
302294 articulable suspicion of other criminal activity, an individual
303295 carrying an unconceal ed or concealed handgun shall not be disarmed
304296 or physically restrained unless the individual fails to display a
305297 valid handgun license or a valid military identification card as
306298 provided for qualified persons in this section in response to that
307299 demand. Any violation of the provisions of this subsection may be
308300 punishable as a criminal offense as authorized by Section 1272 of
309301 this title or pursuant to any other applicable provision of law.
310302 Upon the arrest of any person for a violation of the provisions
311303 of this subsection, the person may show proof to the c ourt that a
312304 valid handgun license and the other required identification has been
313305 issued to such person and the person ma y state any reason why the
314306 handgun license, a valid military identification card as prov ided
315307 for qualified persons in this section or th e other required
316308 identification was not carried by the person as required by the
317309 Oklahoma Self-Defense Act. The court s hall dismiss an alleged

345336 violation of Section 1272 of this title upon payment of court co sts,
346337 if proof of a valid handgun license and oth er required
347338 identification is shown to the court within ten (10) days of the
348339 arrest of the person. The court shall repo rt a dismissal of a
349340 charge to the Bureau for consideration of administrative proceedings
350341 against the licensee.
351342 D. It shall be unlawful for any person to fa il or refuse to
352343 identify the fact that the person is in actual possession of a
353344 concealed or unconcea led firearm pursuant to the authority of the
354345 Oklahoma Self-Defense Act during the course of any arrest,
355346 detainment, or routine traffic s top. Said identific ation to the law
356347 enforcement officer shall be required upon the demand of the law
357348 enforcement officer. No person shall be required to identify
358349 himself or herself as a handgun licensee or as lawfully in
359350 possession of any other firearm i f the law enforcemen t officer does
360351 not demand the information. No person shall be required to identify
361352 himself or herself as a handgun licensee when no handgun is in the
362353 possession of the person or in any ve hicle in which the person is
363354 driving or is a passenger. Any violato r of the provisions of this
364355 subsection may be issued a citation for an amount not exceeding One
365356 Hundred Dollars ($100.00).
366357 E. Any law enforcement officer coming in contact with a person
367358 whose handgun license is suspended, revoked, or e xpired, or who is
368359 in possession of a handgun license which has not been lawfully

396386 issued to that person, shall confiscate the license and return it to
397387 the Oklahoma State Bureau of Investigation for appropriate
398388 administrative proceedings against the licensee when the license is
399389 no longer needed as evidence in any criminal proceeding.
400390 F. Nothing in this section shall be const rued to authorize a
401391 law enforcement officer to inspect any weapon properly concealed or
402392 unconcealed without probable cause that a crime has been committed.
403393 SECTION 3. AMENDATORY 21 O.S. 2021, Section 1290.9, is
404394 amended to read as follows:
405395 Section 1290.9
406396 ELIGIBILITY
407397 The following requirements shall apply to any person making
408398 application to the Oklahoma State Bureau of I nvestigation for a
409399 handgun license pursuant to the provisions of the Oklahoma Self -
410400 Defense Act. The person must :
411401 1. Be a citizen of the United States with established residency
412402 in the State of Oklahoma this state; or
413403 2. Be a lawful permanent resident in the United States and have
414404 established residency in the State of Oklahoma this state.
415405 For purposes of the Oklahoma Self-Defense Act:
416406 a. the term "residency" shall apply to any person who
417407 either possesses a valid Oklahoma driver license or
418408 state photo identification card, and physically
419409 maintains a residence in this state or to any person ,

447436 including the spouse of such person, who has permanent
448437 military orders within this state and possesses a
449438 valid driver license from another state where such
450439 person and spouse of such person claim residency, and
451440 b. the term "lawful permanent resident " shall mean a
452441 noncitizen who is lawf ully authorized to live
453442 permanently within the United States;
454443 3. Be at least:
455444 a. twenty-one (21) years of age, or
456445 b. eighteen (18) years of age but not yet twenty-one (21)
457446 years of age and the person is a member or veteran of
458447 the United States Armed Force s, the Reserves or
459448 National Guard, or the person was discharged under
460449 honorable conditions from the United States Armed
461450 Forces, Reserves or N ational Guard;
462451 4. Meet the age requirement provided in the provisions of
463452 Section 1 of Article III of the Oklahoma Constitution;
464453 5. Complete a firearms safety and training course and
465454 demonstrate competence and qualifications with the type of pisto l to
466455 be carried by the person as provided in Section 1290.14 of this
467456 title, and submit proof of training and qualification or an
468457 exemption for training and qualification as authorized by Section
469458 1290.14 of this title;

501489 SECTION 4. It being immediately necessary for the preservation
502490 of the public peace, health or safety, an emergency is hereby
503491 declared to exist, by reason whereof this act shall take effect and
504492 be in full force from and after its passage an d approval.
