53	50		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
54	51		SECTION 1. AMENDATORY 21 O.S. 2021, Section 1272, is
55	52		amended to read as follows :
56	53		Section 1272.
57	54		UNLAWFUL CARRY
58	55		A. Notwithstanding any other provision of law, it shall be
59	56		unlawful for any person to carry upon or about his or her person, or
60	57		in a purse or other container belonging to the person, any pistol,
61	58		revolver, shotgun or rifle whether loaded or unloaded or any
62	59		blackjack, loaded cane, hand chain, metal knuckles, or any other
63	60		offensive weapon, whether such weapon be concealed or unconcealed,
64	61		except this section shall not prohibit:

92	88		1. The proper use of guns and knives fo r self-defense, hunting,
93	89		fishing, educational or recreational purposes;
94	90		2. The carrying or use of weapons in a manner otherwise
95	91		permitted by statute or authorized by the Oklahoma S elf-Defense Act;
96	92		3. The carrying, possession and use of any weapon by a pe ace
97	93		officer or other person authorized by law to carry a weapon in the
98	94		performance of official duties and in compliance with the rules of
99	95		the employing agency;
100	96		4. The carrying or u se of weapons in a courthouse by a district
101	97		judge, associate district judge or special district judge within
102	98		this state, who is in possession of a valid handgun license issued
103	99		pursuant to the provisions of the Oklahoma Self -Defense Act and
104	100		whose name appears on a list maintained by the Administrative
105	101		Director of the Courts;
106	102		5. The carrying and use of firearms and other weapons provided
107	103		in this subsection when used for the purpose of living history
108	104		reenactment. For purposes of this paragraph, "living history
109	105		reenactment" means depiction of historical characters, scenes,
110	106		historical life or events for entertainment, education, or
111	107		historical documentation through the wearing or use of period,
112	108		historical, antique or vintage clothing, accessories, firearms,
113	109		weapons, and other implements of the historical period; or
114	110		6. The transporting by vehicle on a public roadway or the
115	111		carrying of a firearm, concealed or unconcealed, loaded or unloaded,

143	138		by a person who is twenty-one (21) years of age or older or by a
144	139		person who is eighteen (18) years of age but not yet twenty-one (21)
145	140		years of age and the person is a member or veteran of the United
146	141		States Armed Forces, Reserves or National Guard or was discharged
147	142		under honorable conditions from the United States Armed Forces,
148	143		Reserves or National Guard, or meets the age requirement provided in
149	144		the provisions of Section 1 of Article III of the Oklahoma
150	145		Constitution and the person is otherwise not disqualified fr om the
151	146		possession or purchase of a firearm under state or federal la w and
152	147		is not carrying the firearm in furtherance of a crime.
153	148		Except as provided in sub section B of Section 1283 of this
154	149		title, a person who has been convicted of any one of the following
155	150		offenses in this state or a violation of the equivalent law of
156	151		another state:
157	152		a. assault and battery pursuant to the provisions of
158	153		Section 644 of this titl e which caused serious
159	154		physical injury to the victim,
160	155		b. aggravated assault and battery pursuant to th e
161	156		provisions of Section 646 of this title,
162	157		c. assault and battery th at qualifies as domestic abuse
163	158		as defined in Section 644 of this title,
164	159		d. stalking pursuant to the provisions of Section 1173 of
165	160		this title,

193	187		e. a violation of an order issued under the Pr otection
194	188		from Domestic Abuse Act or a domestic abuse protection
195	189		order issued by another state, or
196	190		f. a violation relating to illegal drug use or possessio n
197	191		under the provisions of the Uniform Controlled
198	192		Dangerous Substances Act,
199	193		shall be prohibited from ca rrying a firearm under the provisions of
200	194		this paragraph. Any person who carries a firearm in the manner
201	195		provided for in this paragraph shall be prohibite d from carrying the
202	196		firearm into any of the places prohibited in subsection A of Section
203	197		1277 of this title or any other place currently prohibited by law.
204	198		Nothing in this section shall modify or otherwise change where a
205	199		person may legally carry a firearm .
206	200		B. Any person convicted of violating the foregoing provision
207	201		shall be guilty of a misdemeanor punis hable as provided in Section
208	202		1276 of this title.
209	203		SECTION 2. AMENDATORY 21 O.S. 2021, Section 1290.8, is
210	204		amended to read as follow s:

214	208		A. Except as otherwise prohibited by law, an eligible person
215	209		shall have authority to carr y a concealed or unconceale d handgun in
216	210		this state when:

244	237		1. The person has been issued a handgun license from the
245	238		Oklahoma State Bureau of Investigation pursuant to the provisions of
246	239		the Oklahoma Self-Defense Act, provided the person is in compliance
247	240		with the provisions of the Okla homa Self-Defense Act, and the
248	241		license has not expired or be en subsequently suspended or re voked;
249	242		or
250	243		2. The person is twenty-one (21) years of age or older, and is
251	244		either:
252	245		a. active military, or
253	246		b. a member of the Reserve or Nat ional Guard to include
254	247		Drill Status Guard and Reserve, Active Guard Reserves
255	248		or Military Technicians,
256	249		and presents a valid military identification card that shall be
257	250		considered a valid handgun license issued pursuant to the Oklahoma
258	251		Self-Defense Act; or
259	252		3. The person meets the age requireme nt provided in the
260	253		provisions of Section 1 of Article III of the Oklahoma Constitution.
261	254		B. A person in possession of a valid handgun license or who
262	255		meets the criteria and presents a valid military identification card
263	256		as provided for in this section and in compliance with the
264	257		provisions of the Oklahoma Self -Defense Act shall be authorized to
265	258		carry such concealed or unconcea led handgun while scouting as it
266	259		relates to hunting or fishing or while hunting or fishing.

294	286		C. The person shall be required to have possession of his or
295	287		her valid handgun license or valid military identification card as
296	288		provided for qualified persons in t his section and a valid driver
297	289		license or state photo identification at all times when in
298	290		possession of an authorized pistol. The person shall display the
299	291		handgun license or a valid milit ary identification card as provided
300	292		for qualified persons in this se ction on demand of a law enforcement
301	293		officer; provided, however, that in the absence of reasonable a nd
302	294		articulable suspicion of other criminal activity, an individual
303	295		carrying an unconceal ed or concealed handgun shall not be disarmed
304	296		or physically restrained unless the individual fails to display a
305	297		valid handgun license or a valid military identification card as
306	298		provided for qualified persons in this section in response to that
307	299		demand. Any violation of the provisions of this subsection may be
308	300		punishable as a criminal offense as authorized by Section 1272 of
309	301		this title or pursuant to any other applicable provision of law.
310	302		Upon the arrest of any person for a violation of the provisions
311	303		of this subsection, the person may show proof to the c ourt that a
312	304		valid handgun license and the other required identification has been
313	305		issued to such person and the person ma y state any reason why the
314	306		handgun license, a valid military identification card as prov ided
315	307		for qualified persons in this section or th e other required
316	308		identification was not carried by the person as required by the
317	309		Oklahoma Self-Defense Act. The court s hall dismiss an alleged

345	336		violation of Section 1272 of this title upon payment of court co sts,
346	337		if proof of a valid handgun license and oth er required
347	338		identification is shown to the court within ten (10) days of the
348	339		arrest of the person. The court shall repo rt a dismissal of a
349	340		charge to the Bureau for consideration of administrative proceedings
350	341		against the licensee.
351	342		D. It shall be unlawful for any person to fa il or refuse to
352	343		identify the fact that the person is in actual possession of a
353	344		concealed or unconcea led firearm pursuant to the authority of the
354	345		Oklahoma Self-Defense Act during the course of any arrest,
355	346		detainment, or routine traffic s top. Said identific ation to the law
356	347		enforcement officer shall be required upon the demand of the law
357	348		enforcement officer. No person shall be required to identify
358	349		himself or herself as a handgun licensee or as lawfully in
359	350		possession of any other firearm i f the law enforcemen t officer does
360	351		not demand the information. No person shall be required to identify
361	352		himself or herself as a handgun licensee when no handgun is in the
362	353		possession of the person or in any ve hicle in which the person is
363	354		driving or is a passenger. Any violato r of the provisions of this
364	355		subsection may be issued a citation for an amount not exceeding One
365	356		Hundred Dollars ($100.00).
366	357		E. Any law enforcement officer coming in contact with a person
367	358		whose handgun license is suspended, revoked, or e xpired, or who is
368	359		in possession of a handgun license which has not been lawfully

396	386		issued to that person, shall confiscate the license and return it to
397	387		the Oklahoma State Bureau of Investigation for appropriate
398	388		administrative proceedings against the licensee when the license is
399	389		no longer needed as evidence in any criminal proceeding.
400	390		F. Nothing in this section shall be const rued to authorize a
401	391		law enforcement officer to inspect any weapon properly concealed or
402	392		unconcealed without probable cause that a crime has been committed.
403	393		SECTION 3. AMENDATORY 21 O.S. 2021, Section 1290.9, is
404	394		amended to read as follows:
405	395		Section 1290.9
406	396		ELIGIBILITY
407	397		The following requirements shall apply to any person making
408	398		application to the Oklahoma State Bureau of I nvestigation for a
409	399		handgun license pursuant to the provisions of the Oklahoma Self -
410	400		Defense Act. The person must :
411	401		1. Be a citizen of the United States with established residency
412	402		in the State of Oklahoma this state; or
413	403		2. Be a lawful permanent resident in the United States and have
414	404		established residency in the State of Oklahoma this state.
415	405		For purposes of the Oklahoma Self-Defense Act:
416	406		a. the term "residency" shall apply to any person who
417	407		either possesses a valid Oklahoma driver license or
418	408		state photo identification card, and physically
419	409		maintains a residence in this state or to any person ,

448	437		military orders within this state and possesses a
449	438		valid driver license from another state where such
450	439		person and spouse of such person claim residency, and
451	440		b. the term "lawful permanent resident " shall mean a
452	441		noncitizen who is lawf ully authorized to live
453	442		permanently within the United States;
454	443		3. Be at least:
455	444		a. twenty-one (21) years of age, or
456	445		b. eighteen (18) years of age but not yet twenty-one (21)
457	446		years of age and the person is a member or veteran of
458	447		the United States Armed Force s, the Reserves or
459	448		National Guard, or the person was discharged under
460	449		honorable conditions from the United States Armed
461	450		Forces, Reserves or N ational Guard;
462	451		4. Meet the age requirement provided in the provisions of
463	452		Section 1 of Article III of the Oklahoma Constitution;
464	453		5. Complete a firearms safety and training course and
465	454		demonstrate competence and qualifications with the type of pisto l to
466	455		be carried by the person as provided in Section 1290.14 of this
467	456		title, and submit proof of training and qualification or an
468	457		exemption for training and qualification as authorized by Section
469	458		1290.14 of this title;
