38	47		An Act relating to agriculture; enacting the Oklahoma
39	48		Right to Garden Act of 20 23; defining terms;
40	49		providing the right to grow vegetables in a vegetable
41	50		garden for personal consumption ; providing that a
42	51		municipality, city, or town may enact certain
43	52		content-neutral ordinances regulating vegetable
44	53		gardens; providing for codification; a nd providing an
45	54		effective date.

50	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	60		SECTION 1. NEW LAW A new section of law to be codified
52	61		in the Oklahoma Statutes as Section 3031 of Title 2, unless there is
53	62		created a duplication in numbering, reads as fo llows:
54	63		This act shall be known and may be cited as the "Oklahoma Right
55	64		to Garden Act of 202 3".
56	65		SECTION 2. NEW LAW A new sect ion of law to be codified
57	66		in the Oklahoma Statutes as Section 3032 o f Title 2, unless there is
58	67		created a duplication in numbering, reads as follows:
59		-	As used in this act:
60		-	1. "Residential property " means real property on which there is
61		-	a dwelling unit with accommodations for four or fewer separate

	95	+	As used in this act:
	96	+	1. "Residential property " means real property on which there is
	97	+	a dwelling unit with accommodations for four or fewer separate
88	98		households and is further limited to the primary residence of a
89	99		person; and
90	100		2. "Vegetable garden" means a piece of property wholly located
91	101		within a person's residential property that is used to grow produce,
92	102		flowers, herbs, fungi, or grains for one's own consumption and
93	103		enjoyment and not for resale or distribution.
94	104		SECTION 3. NEW LAW A n ew section of law to be codified
95	105		in the Oklahoma Statutes as Section 3033 of Title 2, unless there is
96	106		created a duplication in numbering, reads as follows:
97	107		A. It shall be the right of citizens of the State of Oklahoma
98	108		to engage in growing their own vegetables in a vegetable garden on
99	109		their personal property for personal consumption, subject to
100	110		restrictions rationally related to a governmental p urpose.
101	111		B. Notwithstanding, this section shall not prohibit any
102	112		municipality, city, or town from enacting content -neutral ordinances
103	113		or regulations that address the following:
104	114		1. Limiting the size and proximity of g ardens to roadways,
105	115		structures, or other locations that impact healt h and safety; or
106	116		2. The enforcement of constitutional and lawful ordinances
107	117		adopted by municipalities that are in conformity with general powers
108	118		of municipal governments within this stat e that are of a general
109		-	nature that do not specifically ban gardening , including, but not
110		-	limited to, regulations and ordinances relating to water usage

139	150		SECTION 4. This act shall become effective November 1, 2023 .
