5457 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5558 SECTION 1. AMENDATORY 10A O.S. 2021, Section 1 -4-704, is
5659 amended to read as f ollows:
5760 Section 1-4-704. A. The Department of Human Services or
5861 licensed child-placing agency shall prepare and maintain a written
5962 individualized servi ce plan for any child that has been adjudicated
6063 to be a deprived child.
6164 B. The plan shall be furnished to the court within thirty (30)
6265 days after the adjudication of the child and shall be made available
6366 to counsel for the parties and any applicable tribe by the

9094 Department or the licensed child -placing agency having cus tody of
9195 the child or responsibility for the supervision of the case.
9296 C. 1. The individualized service plan shall be based upon a
9397 comprehensive assessment and evaluation of the child and fa mily and
9498 shall be developed with the participation of the parent, legal
9599 guardian, or legal custodian of the child, the attorney for the
96100 child, the guardian ad litem for the child, if any, the child 's
97101 tribe, and the child, if appropriate. The health and sa fety of the
98102 child shall be the paramount concern in the developmen t of the plan.
99103 2. If any part of the plan is disputed or not approved by the
100104 court, an evidentiary hearing may be held and at its conclusion, the
101105 court shall determine the content of the in dividualized service plan
102106 in accord with the evidence presented an d the best interests of the
103107 child.
104108 3. When approved by the court, each individualized service plan
105109 shall be incorporated and made a part of the dispo sitional order of
106110 the court.
107111 4. The plan shall be signed by:
108112 a. the parent or parents or legal guardian o f the child,
109113 b. the attorney for the parent or parents or legal
110114 guardian of the child,
111115 c. the child's attorney,
112116 d. the guardian ad litem of the child, which may be a
113117 court-appointed special advocate,

140145 e. a representative of the child 's tribe,
141146 f. the child, if possible, and
142147 g. the Department or other responsible agency.
143148 D. 1. Every service plan prepared shall be individualized and
144149 specific to each child and the family of the child.
145150 2. The individualized service plan shall be written in simple
146151 and clear English. If English is not the principal language of the
147152 parent, legal guardian, or custodian of the child, and such person
148153 is unable to read or compreh end the English language, to the extent
149154 possible the plan shall be written in the principal language of th e
150155 person.
151156 3. The individualized service plan may be modified based on
152157 changing circumstances consistent with the correction of the
153158 conditions that led to the adjudication of the child or ot her
154159 conditions inconsistent with the health, safety, or welfare of the
155160 child.
156161 4. The individualized service plan shall be measurable,
157162 realistic and consistent with the requirements of other court
158163 orders.
159164 E. The individualized service plan shall include, but not be
160165 limited to:
161166 1. A history of the child and family, incl uding identification
162167 of the problems or conditions leading to the deprived child

189195 adjudication and the changes the parent or parents must make in
190196 order for the child to safely remain in or re turn to the home;
191197 2. Identification of time -limited reunification services to be
192198 provided to the parent, legal guardian, or legal custodian,
193199 stepparent, other adult person living in the home, or other family
194200 members;
195201 3. Identification of the specific ser vices to be provided to
196202 the child including, but not limited to, e ducational, vocational
197203 educational, medical, drug or alcohol abuse treatment, or counseling
198204 or other treatment services. The most recent available he alth and
199205 educational records of the chil d shall be provided to the court upon
200206 the court's request including:
201207 a. the names and addresses of the child's health and
202208 educational providers,
203209 b. the child's grade-level performance,
204210 c. the child's school record,
205211 d. a record of the child 's immunizations,
206212 e. the child's known medical problems, including any
207213 known communicable diseases,
208214 f. the child's medications, and
209215 g. any other relevant health and education information;
210216 4. A schedule of the frequency of services a nd the means by
211217 which delivery of the se rvices will be assured or, as necessary, the

238245 proposed means by whi ch support services or other assistance will be
239246 provided to enable the parent or the child to obtain the services;
240247 5. The name of the social worker a ssigned to the case;
241248 6. A projected date for the completion of the individualized
242249 service plan;
243250 7. Performance criteria that will measure the progress of the
244251 child and family toward completion of the individualized service
245252 plan including, but not limited to, time frames for achieving
246253 objectives and addressing the identified problems;
247254 8. The name and busines s address of the attorney representing
248255 the child;
249256 9. If the child is placed outside the home, the individualized
250257 service plan shall further provide:
251258 a. the sequence and time frame for servi ces to be
252259 provided to the parent, the child, and if the child is
253260 placed in foster care, the foster parent, to
254261 facilitate the child's return home or to another
255262 permanent placement,
256263 b. a description of the child 's placement and explanation
257264 about whether it is the least-restrictive placement
258265 available and in as close proxim ity as possible to the
259266 home of the parent or parents or legal guardian of the
260267 child when the case plan is reunification, and how the

288296 special needs of the child,
289297 c. a description of any services or resourc es that were
290298 requested by the child or the parent or legal guardian
291299 of the child since the date of the child 's placement,
292300 and whether those services o r resources were provided
293301 and if not, the basis for the denial of the services
294302 or resources,
295303 d. efforts to be made by the parent of the child and the
296304 Department to enable the child to return to his or her
297305 home,
298306 e. a description of the transition planning f or a
299307 successful adulthood for a child ag e fourteen (14) or
300308 older that includes how the following objective s will
301309 be met:
302310 (1) education, vocational, or employment planning,
303311 (2) health care planning and medical coverage,
304312 (3) transportation including, where a ppropriate,
305313 assisting the child in obtai ning a driver
306314 license,
307315 (4) money management,
308316 (5) planning for housing,
309317 (6) social and recreational skills, and

336345 (7) establishing and maintaining connections with the
337346 child's family and community,
338347 f. for a child in placement due solely or in part to the
339348 child's behavioral health or medical health issues,
340349 diagnostic and assessment information, specific
341350 services relating to meeting the applicable behavioral
342351 health and medical care needs of the child, and
343352 desired treatment outcomes,
344353 g. a plan and schedule for re gular and frequent
345354 visitation for the child and the child 's parent or
346355 parents or legal guardian and siblings, unless the
347356 court has determined that visitation, even if
348357 supervised, would be harmful to the child, and
349358 h. a plan for ensuring the educational sta bility of the
350359 child while in out-of-home placement, including:
351360 (1) assurances that the placement of the child
352361 considers the appropriateness of the current
353362 educational setting and the proximity to the
354363 school in which the child was enrolled at the
355364 time of placement, and
356365 (2) where appropriate, an assurance that the
357366 Department has coordinated with appropriate local
358367 educational agencies to ensure that the child

385395 remains in the school in which the child was
386396 enrolled at the time of placement, or
387397 (3) if remaining in the school in which the child was
388398 enrolled at the time of placeme nt is not in the
389399 best interests of the child, assurances by the
390400 Department and the local educational agencies to
391401 provide immediate and appropriate enr ollment in a
392402 new school with all of the educational records of
393403 the child provided to the school; and
394404 10. The permanency plan for the child, the reason for selection
395405 of that plan and a description of the steps being taken by the
396406 Department to finalize the plan.
397407 a. When the permanency plan is ado ption or legal
398408 guardianship, the Department shall describe, at a
399409 minimum, child-specific recruitment efforts such as
400410 relative searches conducted and the use of state,
401411 regional, and national adoption exchanges to
402412 facilitate the orderly and timely placement of the
403413 child, whether in or outside of the state.
404414 b. When the child is age fourteen (14) or older, the
405415 permanency plan and any revision or addition to the
406416 plan, shall include planning for the transition of the
407417 child to a successful adulthood.

434445 F. Each individualized service plan shall specifically provide
435446 for the safety of the child, in accordance with state and federal
436447 law, and clearly define what actions or precautions will, or may, be
437448 necessary to provide for the s afety and protection of the child.
438449 G. The individualized service plan shall include the following
439450 statement:
440451 TO THE PARENT: THIS IS A VERY IMPORTANT DOCUMENT. ITS PURPOSE
441452 IS TO HELP YOU PROVIDE YOUR CHILD WITH A SAFE HOME WITHIN THE
442453 REASONABLE PERIOD SP ECIFIED IN THE PLAN. IF YOU ARE UNWILLI NG OR
443454 UNABLE TO PROVIDE YOUR CHILD WITH A SAFE HOME OR ATTEND COUR T
444455 HEARINGS, YOUR PARENTAL AND CUSTODIAL DUTIES AND RIGHTS MAY BE
445456 RESTRICTED OR TERMINATED OR YOUR CHILD MAY NOT BE RETURNED TO YOU.
446457 H. Whenever a child who is subject to the provisions of t his
447458 section is committed for inpatient behavioral health or substa nce
448459 abuse treatment pursuant to the Inpatient Mental Health and
449460 Substance Abuse Treatment of Minors Act, the individualized service
450461 plan shall be amended as necessary and appropriate, includ ing, but
451462 not limited to, identification of the treatment and servi ces to be
452463 provided to the child and the child's family upon discharge of the
453464 child from inpatient behavioral health or substance abuse treatment.
454465 I. Prior to adjudication, a parent or legal guardian may
455466 voluntarily participate in services related to the b ehaviors and
456467 conditions that led to t he filing of a deprived petition.
457468 Participation in such services is not an admission of guilt and
