HOUSE BILL 1040 By: Randleman and Boles
AS INTRODUCED
An Act relating to school athletics; defining terms;
directing school athletic association to establish a
new category of competition; permitting certain
schools to elect to compete in new category;
specifying composition of existing category;
prescribing frequency for category election;
declaring applicability of election ; providing for
codification; and providing an effective date.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 27-201 of Title 70, unless there
is created a duplication in number ing, reads as follows:
A. As used in this section:
1. "Schools of restricted enrollment " means schools that:
a. admit students based on entrance requirements
established by the school for admission and
enrollment,

b. decline enrollment of students based on standards
which differ from those established by the State
Department of Education ,
c. control enrollment size for the maintenance of a
maximum size standard, and
d. use tuition or costs of attendance as factors for
admission and enrollment; and
2. "Schools of unrestricted enrollment" means schools that:
a. admit all students for enrollment and attendance who
live within the established boundaries of the school s,
b. may accept transfer students who are living outside
the established boundaries of the sc hools,
c. follow residency rules of the State Department of
Education for school district residents and transfe r
students, and
d. do not collect tuition and fees for enro llment or
attendance.
B. Beginning with the 202 4-2025 school year, a school athletic
association, as defined in Section 27-102 of Title 70 of the
Oklahoma Statutes, shall establish a new category of competition for
schools of restricted enrollment. Schools of restricted enrollment
may elect to compete in the schools of restricted enrollme nt
category by requesting a move pursuan t to guidelines determined by
the school athletic association.

C. The existing alignment of classifications within the school
athletic association shall be in a category known as school s of
unrestricted and restrict ed enrollment and shall include schools of
unrestricted enrollment and schools of restricted enrollment .
Existing standards of enrollment size divisions for classes of
competition established by the school athletic associatio n shall
remain in effect for the schools of unrestricted and restricte d
enrollment.
D. Schools of restricted enrollment shall elect once every four
(4) years in which category they want to compet e. The election
shall be applicable to all competitions which are governed by the
school athletic association.
SECTION 2. This act shall become effective November 1, 2023.
