30	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

32	60		SECTION 1. NEW LAW A new section o f law to be codified
33	61		in the Oklahoma Statutes as Section 1-1990.8 of Title 63, unless
34	62		there is created a duplication in numbering, reads as follows:

36	63		This act shall be known and may be cited as the "Kasey Alert
37	64		Act".

39	65		SECTION 2. NEW LAW A new section of law to be codifie d
40	66		in the Oklahoma Statutes as Section 1-1990.9 of Title 63, unless

43	95		As used in the Kasey Alert Act:

45	96		1. "Alert" or "Kasey Alert" means the statewide Kasey Al ert for

48	98		2. "Ashanti Alert" means the national communications network
49	99		established by the Ashanti Alert Act of 2018, Sections 21901 through
50	100		21907 of Title 34 of the United States Code;

52	101		3. "Critically missing adult " means a person who is at least
53	102		eighteen (18) and no older than fifty-nine (59) years of age, whose
54	103		whereabouts are unknown and who is believed to have been abducted or
55	104		taken against his or her will;

57	105		4. "Law enforcement agency" means any law enforcement agency of
58	106		the state or any political subdivision ther eof, including, but not
59	107		limited to, any county sheriff 's office, the police departments of
60	108		tribal governments, and municipal police departments;

62	109		5. "Media outlet" includes, but is not limited to, radio
63	110		stations, television stations, newspapers, social med ia, local
64	111		support organizations, and other methods of communicating
65	112		information to the public; and

67	113		6. "Not Invisible Act of 2019 " means the federal law enacted by
68	114		United States Congress for the purpose of increasing
69	115		intergovernmental coordination to ident ify and combat violent crime
70	116		within Native American lands, Sections 2801 through 2815 of Title 25
71	117		of the United States Code.

74	146		in the Oklahoma Statutes as Section 1-1990.10 of Title 63, unless
75	147		there is created a duplication in numbering, reads as follows:

77	148		The Department of Public Safety shall d evelop and implement a
78	149		statewide Kasey Alert system to be activated on behalf of a
79	150		critically missing a dult. The Kasey Alert system shall b e developed
80	151		in cooperation with the Department of Transportation, the Department
81	152		of Human Services, the Oklahoma Dep artment of Emergency Management
82	153		and Homeland Security, tribal governments, the Oklahoma Association
83	154		of Broadcasters, and any other state or local agency that the
84	155		Department of Public Safety deems appropriate. The Kasey Alert
85	156		system shall be developed with any coordination, training , and
86	157		assistance available from the United States Department of Justice
87	158		pursuant to the Ashanti Alert Act of 2018 and the Not Invisible Act
88	159		of 2019.

91	161		in the Oklahoma Statutes as Section 1-1990.11 of Title 63, unless
92	162		there is created a duplic ation in numbering, reads as follows:

94	163		A. The Commissioner of Public Safety shall be the statewide
95	164		coordinator of the Kasey Alert system and shall coordinate with
96	165		media outlets for the rapid and accurate announc ement of a Kasey
97	166		Alert to the public.

100	195		necessary to implement this act, provided that the rules shall
101	196		include the following:

103	197		1. The procedure to be used by law enforcement agencies to
104	198		verify whether an adult who has been reported missing is believed to
105	199		be at risk of abduction or being tak en against his or her will;

107	200		2. The criteria for law enforcement agencies to consider in
108	201		circumstances in which a missing person may not meet the definition
109	202		of a critically missing adult b ut whose safety would be best
110	203		protected by the issuance of a Kasey A lert;

112	204		3. The procedure for law enforcement agencies to follow in
113	205		initiating a statewide Kasey Alert;
114		-
115	206		4. The method whereby information is distributed to statew ide
116	207		media outlets;

118	208		5. The procedure for the receipt and evaluation of information
119	209		received from the public about a critically missing adult; and

121	210		6. The procedure for the termination of a Kasey Alert.

123	211		SECTION 5. NEW LAW A new secti on of law to be codified
124	212		in the Oklahoma Stat utes as Section 1-1990.12 of Title 63, unless
125	213		there is created a duplication in numbering, reads as follows:

127	214		A. When a law enforcement agency receives notice of a
128	215		critically missing adult, the agency shall take the following

132	245		Information Center (NCIC) database immediately upon obtaining the
133	246		necessary information for NCIC pursuant to the guidance of the

136	248		2. Conduct an investigation into the disappearance of the
137	249		critically missing adult to determine wheth er the person has likely
138	250		been abducted or taken against his or her will; and

140	251		3. Collect identifying information and any other information
141	252		about the critically m issing adult that might be useful to the
142	253		general public for the safe recovery of the person.

144	254		B. A Kasey Alert shall be activated if a law enforcement agency
145	255		receives notice of a critically missing adult, takes the actions
146	256		required in subsection A of this section, and determines that there
147	257		is sufficient information to issue the Kasey Alert.

149	258		SECTION 6. NEW LAW A new section of law to be codified
150	259		in the Oklahoma Statutes as Section 1-1990.13 of Title 63, unless
151	260		there is created a dupli cation in numbering, reads as follows:

153	261		A Kasey Alert shall include:

155	262		1. All appropriate information provided by a law enforcement
156	263		agency that may lead to the safe recovery of the criticall y missing
157	264		adult; and

159	265		2. A statement instructing any person with inf ormation related
160	266		to a missing Native American or Indigenous person to contact law
161	267		enforcement or tribal authorities.

167	298		A. Any law enforcement ag ency that issues a Kasey Alert shall
168	299		terminate the alert when the notification period ends, as determined
169	300		by a Department of Public Safety rule.

171	301		B. Any law enforcement agency that locates a person who is t he
172	302		subject of a Kasey Alert shall immediately noti fy the Department of
173	303		Public Safety.
