3059 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3260 SECTION 1. NEW LAW A new section o f law to be codified
3361 in the Oklahoma Statutes as Section 1-1990.8 of Title 63, unless
3462 there is created a duplication in numbering, reads as follows:

3663 This act shall be known and may be cited as the "Kasey Alert

4395 As used in the Kasey Alert Act:

4596 1. "Alert" or "Kasey Alert" means the statewide Kasey Al ert for
46-critically missing adults; ENR. H. B. NO. 1077 Page 2

4898 2. "Ashanti Alert" means the national communications network
4999 established by the Ashanti Alert Act of 2018, Sections 21901 through
50100 21907 of Title 34 of the United States Code;

52101 3. "Critically missing adult " means a person who is at least
53102 eighteen (18) and no older than fifty-nine (59) years of age, whose
54103 whereabouts are unknown and who is believed to have been abducted or
55104 taken against his or her will;

57105 4. "Law enforcement agency" means any law enforcement agency of
58106 the state or any political subdivision ther eof, including, but not
59107 limited to, any county sheriff 's office, the police departments of
60108 tribal governments, and municipal police departments;

62109 5. "Media outlet" includes, but is not limited to, radio
63110 stations, television stations, newspapers, social med ia, local
64111 support organizations, and other methods of communicating
65112 information to the public; and
66-
67113 6. "Not Invisible Act of 2019 " means the federal law enacted by
68114 United States Congress for the purpose of increasing
69115 intergovernmental coordination to ident ify and combat violent crime
70116 within Native American lands, Sections 2801 through 2815 of Title 25

73145 SECTION 3. NEW LAW A new section of law to be codified
74146 in the Oklahoma Statutes as Section 1-1990.10 of Title 63, unless
75147 there is created a duplication in numbering, reads as follows:

77148 The Department of Public Safety shall d evelop and implement a
78149 statewide Kasey Alert system to be activated on behalf of a
79150 critically missing a dult. The Kasey Alert system shall b e developed
80151 in cooperation with the Department of Transportation, the Department
81152 of Human Services, the Oklahoma Dep artment of Emergency Management
82153 and Homeland Security, tribal governments, the Oklahoma Association
83154 of Broadcasters, and any other state or local agency that the
84155 Department of Public Safety deems appropriate. The Kasey Alert
85156 system shall be developed with any coordination, training , and
86157 assistance available from the United States Department of Justice
87158 pursuant to the Ashanti Alert Act of 2018 and the Not Invisible Act
88159 of 2019.

91161 in the Oklahoma Statutes as Section 1-1990.11 of Title 63, unless
92162 there is created a duplic ation in numbering, reads as follows:

94163 A. The Commissioner of Public Safety shall be the statewide
95164 coordinator of the Kasey Alert system and shall coordinate with
96165 media outlets for the rapid and accurate announc ement of a Kasey
97166 Alert to the public.

99194 B. The Department of Public Safety shall promulgate rule s as
100195 necessary to implement this act, provided that the rules shall
101196 include the following:

103197 1. The procedure to be used by law enforcement agencies to
104198 verify whether an adult who has been reported missing is believed to
105199 be at risk of abduction or being tak en against his or her will;
106-
107200 2. The criteria for law enforcement agencies to consider in
108201 circumstances in which a missing person may not meet the definition
109202 of a critically missing adult b ut whose safety would be best
110203 protected by the issuance of a Kasey A lert;
111-
112204 3. The procedure for law enforcement agencies to follow in
113205 initiating a statewide Kasey Alert;
114-
115206 4. The method whereby information is distributed to statew ide
116207 media outlets;

118208 5. The procedure for the receipt and evaluation of information
119209 received from the public about a critically missing adult; and
120-
121210 6. The procedure for the termination of a Kasey Alert.

123211 SECTION 5. NEW LAW A new secti on of law to be codified
124212 in the Oklahoma Stat utes as Section 1-1990.12 of Title 63, unless

127214 A. When a law enforcement agency receives notice of a
128215 critically missing adult, the agency shall take the following

131244 1. Enter the missing individual into the National Crime
132245 Information Center (NCIC) database immediately upon obtaining the
133246 necessary information for NCIC pursuant to the guidance of the
134-Federal Bureau of Investi gation (FBI); ENR. H. B. NO. 1077 Page 4

136248 2. Conduct an investigation into the disappearance of the
137249 critically missing adult to determine wheth er the person has likely
138250 been abducted or taken against his or her will; and

140251 3. Collect identifying information and any other information
141252 about the critically m issing adult that might be useful to the
142253 general public for the safe recovery of the person.

144254 B. A Kasey Alert shall be activated if a law enforcement agency
145255 receives notice of a critically missing adult, takes the actions
146256 required in subsection A of this section, and determines that there
147257 is sufficient information to issue the Kasey Alert.

149258 SECTION 6. NEW LAW A new section of law to be codified
150259 in the Oklahoma Statutes as Section 1-1990.13 of Title 63, unless
151260 there is created a dupli cation in numbering, reads as follows:

153261 A Kasey Alert shall include:

155262 1. All appropriate information provided by a law enforcement
156263 agency that may lead to the safe recovery of the criticall y missing
157264 adult; and

159265 2. A statement instructing any person with inf ormation related
160266 to a missing Native American or Indigenous person to contact law
161267 enforcement or tribal authorities.

167298 A. Any law enforcement ag ency that issues a Kasey Alert shall
168299 terminate the alert when the notification period ends, as determined
169300 by a Department of Public Safety rule.

171301 B. Any law enforcement agency that locates a person who is t he
172302 subject of a Kasey Alert shall immediately noti fy the Department of
173303 Public Safety.
