4045 An Act relating to medical marijuana; amending 63
4146 O.S. 2021, Section 427.13, as amended by Section 14,

6067 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6168 SECTION 1. AMENDATORY 63 O.S. 2021, Section 427.13, as
6269 amended by Section 14, Chapter 251, O.S.L. 2022 (63 O.S. Supp. 2022,
6370 Section 427.13), is amended to read as follows:
64-Section 427.13 A. All medical marijuana and medical marijuana
65-products shall be purchased solely from a state-licensed medical
66-marijuana business, and shall not be purchased from any out-of-state
67-providers.

98+Section 427.13 A. All medical marijuana and medical marijuana
99+products shall be purchased solely from a state-licensed medical
100+marijuana business, and shall not be purchased from any out-of-state
101+providers.
94102 B. 1. The Oklahoma Medical Marijuana Authority shall have
95103 oversight and auditing re sponsibilities to ensure that all marijuana
96104 being grown in this state is accounted for and shall implement an
97105 inventory tracking system. Pursuant to these duties, the Authority
98106 shall require that each medical marijuana business, medical
99107 marijuana research facility, medical marijuana education fa cility
100108 and medical marijuana waste disposal facility keep records for every
101109 transaction with another medical marijuana business, patient or
102110 caregiver. Inventory shall be tracked and updated after each
103111 individual sale and reported to the Authority.
104112 2. The inventory tracking system licensees use shall allow for
105113 integration of other seed-to-sale systems and, at a minimum, shall
106114 include the following:
107115 a. notification of when marijuana seeds and clones are
108116 planted,
109117 b. notification of when marijuana plants are harvested
110118 and destroyed,
111119 c. notification of when marijuana is transported, sold,
112120 stolen, diverted or lost,
113-d. a complete inventory of all marijuana, seeds, plant
114-tissue, clones, plants, usable marijuana or trim,
115-leaves and other plant matter, batches of ex tract, and
116-marijuana concentrates,

148+d. a complete inventory of all marijuana, seeds, plant
149+tissue, clones, plants, usable marijuana or trim,
150+leaves and other plant matter, batches of ex tract, and
151+marijuana concentrates,
143152 e. all samples sent to a testing laboratory, an unused
144153 portion of a sample returned to a licensee, all
145154 samples utilized by licensee for purposes of
146155 negotiating a sale, and
147156 f. all samples used for quality testing by a lice nsee.
148157 3. Each medical marijuana business, medical marijuana research
149158 facility, medical marijuana education facility and medical marijuana
150159 waste disposal facility shall use a seed-to-sale tracking system or
151160 integrate its own seed-to-sale tracking system wi th the seed-to-sale
152161 tracking system established by the Authority.
153162 4. These records shall include, but not be limited to, the
154163 following:
155164 a. the name and license number of the medical marijuana
156165 business that cultivated, manufactured or sold the
157166 medical marijuana or medical marijuana product,
158167 b. the address and phone number of the medical marijuana
159168 business that cultivated, manufactured or sold the
160169 medical marijuana or medical marijuana product,
161170 c. the type of product received during the transaction,
162171 d. the batch number of the marijuana plant used,
163-e. the date of the transaction,
164-f. the total spent in dollars,
165-g. all point-of-sale records,
166-h. marijuana excise tax records, and

199+e. the date of the transaction,
200+f. the total spent in dollars,
201+g. all point-of-sale records,
202+h. marijuana excise tax records, and
193203 i. any additional information as ma y be reasonably
194204 required by the Executive Director of the Oklahoma
195205 Medical Marijuana Authority.
196206 5. All inventory tracking records retained by a medical
197207 marijuana business, medical marijuana research facility, medical
198208 marijuana education facility or medical marijuana waste disposal
199209 facility containing medical marijuana patient or caregiver
200210 information shall comply with all relevant state and federal laws
201211 including, but not limited to, the Health Insurance Portability and
202212 Accountability Act of 1996 (HIPAA).
203213 C. 1. Upon the effective date of this act, the Authority shall
204214 have thirty (30) business days to issue a request for prop osals and
205215 select through a competitive bidding process, pursuant to Section
206216 85.7 of Title 74 of the Oklahoma Statutes, a vendor that shall
207217 provide a seed-to-sale inventory tracking system for medical
208218 marijuana business licensees. The contract may be a multi-year
209219 contract or renewable annually, in accordance with any applicable
210220 guidelines or procedures required by the Authority.
211221 2. The Authority shall be responsible for all costs ass ociated
212222 with the seed-to-sale tracking system chosen by the Authority. The
213-seed-to-sale inventory tracking s ystem shall feature a software
214-infrastructure that provides maximum flexibility for the exchange of
215-data between the Authority and m edical marijuana business licensees.
216-The seed-to-sale inventory tracking system shall allow the medical

250+seed-to-sale inventory tracking s ystem shall feature a software
251+infrastructure that provides maximum flexibility for the exchange of
252+data between the Authority and m edical marijuana business licensees.
253+The seed-to-sale inventory tracking system shal l allow the medical
243254 marijuana business licensees to submit data to the Authority
244255 directly through an application program interface (API), data
245256 interchange service tool, or by means of a process and technology
246257 acceptable to the Authority. If the Authority selects a vendor
247258 whose proprietary software requires the utilization of barcodes,
248259 radio-frequency identification tags (RFID), or quick response (QR)
249260 codes to manage data entry , the Authority shall be responsible for
250261 purchasing the equipment necessary for medical marijuana business
251262 licensees to interface wit h the software of the seed-to-sale
252263 inventory tracking system.
253264 3. Upon selecting a vendor and prior to implementation of the
254265 seed-to-sale inventory tracking system, the Authority shall be
255266 responsible for providing sufficient training and training materials
256267 to medical marijuana business licensees. Any administrative costs
257268 related to training and training materials shall be the sole
258269 responsibility of the Authority.
259270 SECTION 2. REPEALER 63 O.S. 2021, Section 427.13, as
260271 amended by Section 7, Chapter 584, O.S.L. 2021, is hereby repealed.
261272 SECTION 3. It being immediately necessary for the preservation
262273 of the public peace, health or safety, an emergency is hereby
263-declared to exist, by reason whereof this act shall take effe ct and
264-be in full force from and after its passage and approval.
