5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 25 O.S. 2021, Section 307, as
5454 amended by Section 1, Chapter 182, O.S.L. 2022 (25 O.S. Supp. 2022,
5555 Section 307), is amended to read as follows:
5656 Section 307. A. No public body shall hold executive sessions
5757 unless otherwise specifically provided in this section.
5858 B. Executive sessions of public bodies w ill be permitted only
5959 for the purpose of:
6060 1. Discussing the employment, hirin g, appointment, promotion,
6161 demotion, disciplini ng or resignation of any individual sa laried

8989 2. Discussing negotiations concerning employees and
9090 representatives of employee g roups;
9191 3. Discussing the purchase or appraisal of rea l property;
9292 4. Confidential communications bet ween a public body and its
9393 attorney concerning a pending investigation, claim, or action if the
9494 public body, with the advice of its attorney, determines th at
9595 disclosure will seriously impair the ability of the public body to
9696 process the claim or conduct a pending investigation, litigation, or
9797 proceeding in the public interest;
9898 5. Permitting district boards of education to hear eviden ce and
9999 discuss the expulsion or suspension of a student when requested by
100100 the student involved or the student's parent, attorney or legal
101101 guardian;
102102 6. Discussing matters involving a specific handicapped child;
103103 7. Discussing any matter where disclosure of information would
104104 violate confidentiality requirements of state or federal la w;
105105 8. Engaging in deliberations or rendering a final or
106106 intermediate decision in an individual proceeding pursuant to
107107 Article II of the Administrative Procedures Act;
108108 9. Discussing matters involving s afety and security at state
109109 penal institutions or corr ectional facilities used to house state
110110 inmates;
111111 10. Discussing contract negotiation s involving contracts
112112 requiring approval of the State Board of Corrections, which shall be

139139 limited to members of the public body, the attorney for the public
140140 body, and the immediate staff of the public body. No person who may
141141 profit directly or indirectly by a proposed transaction which is
142142 under consideration may be present or participate in the executive
143143 session; or
144144 11. Discussing the following:
145145 a. the investigation of a plan or scheme to commit an act
146146 of terrorism,
147147 b. assessments of the vulnerability of government
148148 facilities or public improvements to an act of
149149 terrorism,
150150 c. plans for deterrence or prevention of or pro tection
151151 from an act of terrorism,
152152 d. plans for response or remediation after an act of
153153 terrorism,
154154 e. information technology of the public b ody but only if
155155 the discussion specifically identifies:
156156 (1) design or functional schematics t hat demonstrate
157157 the relationship or connections between devices
158158 or systems,
159159 (2) system configuration information,
160160 (3) security monitoring and response equipment

189189 components or devices,
190190 (5) system identification numbers, names, or
191191 connecting circuits,
192192 (6) business continuity and disaster planning, or
193193 response plans, or
194194 (7) investigation inform ation directly related to
195195 security penetrations or denial of services, or
196196 f. the investigation of an act of terrorism that has
197197 already been committed ; or
198198 12. Self-evaluation of the public body .
199199 For the purposes of this subsection, the term "terrorism" means any
200200 act encompassed by the definitions set forth in Section 1268.1 of
201201 Title 21 of the Oklahoma Statutes.
202202 C. Notwithstanding the provisions of subsection B of this
203203 section, the following public bodies may hold ex ecutive sessions:
204204 1. The State Banking Board, as provided for under Section 306.1
205205 of Title 6 of the Oklahoma Statutes;
206206 2. The Oklahoma Industrial Finance Authority, as provided for
207207 in Section 854 of Title 74 of the Oklahoma Statutes;
208208 3. The Oklahoma Dev elopment Finance Authority, as provided for
209209 in Section 5062.6 of Title 74 of the Oklahoma Statutes;

236236 4. The Oklahoma Center for the Advanc ement of Science and
237237 Technology, as provided for in Section 5060.7 of Title 74 of the
238238 Oklahoma Statutes;
239239 5. The Oklahoma Health Research Committee for purposes of
240240 conferring on matters pertaining to research and development of
241241 products, if public disclosu re of the matter discussed would
242242 interfere with the development of patents, copyrights, products, or
243243 services;
244244 6. The Workers' Compensation Commission for the purposes
245245 provided for in Section 20 of Title 85A of the Oklahoma Statutes;
246246 7. A review committe e, as provided for in Section 855 of Title
247247 62 of the Oklahoma Statutes;
248248 8. The Child Death Review Board for purposes of receiving and
249249 conferring on matters pertaining to materials declared confidential
250250 by law;
251251 9. The Domestic Violence Fatality Review Boa rd as provided in
252252 Section 1601 of Title 22 of the Oklahoma Statutes;
253253 10. The Opioid Overdose Fatality Review Board, a s provided in
254254 Section 2-1001 of Title 63 of the Oklahoma Statutes;
255255 11. All nonprofit foundations, boards, bureaus, commissions,
256256 agencies, trusteeships, authorities, councils, committees, public
257257 trusts, task forces or study groups supported in whole or par t by
258258 public funds or entrusted with the expenditure of public funds for
259259 purposes of conferring on matters pertaining to economic developme nt

286286 including the transfer of property, financing, or the creation of a
287287 proposal to entice a business to remain or to l ocate within their
288288 jurisdiction if public disclosure of the matter discussed would
289289 interfere with the development of products or services or if public
290290 disclosure would violate the confidentiality of the business;
291291 12. The Oklahoma Indigent Defense System B oard for purposes of
292292 discussing negotiating s trategies in connection with making possible
293293 counteroffers to offers to contract to provide l egal representation
294294 to indigent criminal defendants and indigent juveniles in cases for
295295 which the System must provide representation pursuant to the
296296 provisions of the Indigent Defense Act;
297297 13. The Quality Investment Committee for p urposes of discussing
298298 applications and confidential materials pursuant to the terms of the
299299 Oklahoma Quality Investment Act;
300300 14. The Oklahoma Municipal Power Authority established pursuant
301301 to Section 24-101 et seq. of Title 11 of the Oklahoma Statutes and
302302 in its role as an electr ic utility regulated by the federal
303303 government, for purposes of discussing security plans and procedures
304304 including, but not limited to, cybersecurity matters; and
305305 15. The Oklahoma Tax Commission for purposes of discussing
306306 confidential taxpayer matters as provided in Section 205 of Title 68
307307 of the Oklahoma Statutes, and in compliance with subsection E of
308308 this section.

335335 D. Except as otherwise specified in this subsection, an
336336 executive session for the purpose of discussing the purchase or
337337 appraisal of real pr operty shall be limited to members of the public
338338 body, the attorney f or the public body and the immediate staff of
339339 the public body. No landowner, real estate salesperson, broker,
340340 developer or any other person who may profit directl y or indirectly
341341 by a proposed transaction concerning real property which is under
342342 consideration may be present or participate in the executive
343343 session, unless they are operating under an existing agreement to
344344 represent the public body.
345345 E. No public body m ay go into an executive session unless the
346346 following procedures are strictly complied with:
347347 1. The proposed executive session is noted on the agenda as
348348 provided in Section 311 of this title;
349349 2. The executive session is authorized by a majority vote of a
350350 quorum of the members pr esent and the vote is a recorded vote; and
351351 3. Except for matters con sidered in executive sessions of the
352352 State Banking Board and the Oklahoma Tax Commission, and which are
353353 required by state or federal law to be confidential, any vo te or
354354 action on any item of business considered in an executive session
355355 shall be taken in public meeting with t he vote of each member
356356 publicly cast and recorded.
357357 F. A willful violation of the provisions of this section shall:

384384 1. Subject each member of th e public body to crimina l sanctions
385385 as provided in Section 314 of this title; and
386386 2. Cause the minutes and all other records of the execut ive
387387 session including tape recordings, to be immediately made public.
388388 SECTION 2. This act shall become effective November 1, 2023.
