AS INTRODUCED 
 
An Act relating to amusements and sports; amending 3 A 
O.S. 2021, Section 201, which relates to the Oklahoma 
Horse Racing Commission; modi fying appointment of 
members of the Commission; and providing an effective 
date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     3A O.S. 2021, Secti on 201, is 
amended to read as follows: 
Section 201. A.  There is hereby created the Oklahoma Horse 
Racing Commission, which shall consist of the following nine (9) 
members: 
1. One member who shall be from the First Congressional 
District appointed by the Governor; 
2.  One member who shall be fro m the Second Congressional 
District appointed by the Governor; 
3. One member who shall be from the Fifth Congressional 
District appointed by the Lieutenant Governor;

4. One member who shall be from the Fourth Congressional 
District appointed by the Attorney General; 
5. One member who shall be from the Third Congressional 
District appointed by the Labor Commissioner; 
6. Two members who shall be experienced in the horse industry 
appointed by the Speaker of the Oklahoma House of Representatives; 
7. Two members who shall be experienced in the horse industry 
appointed by the President Pro Tempore of the Oklahoma State Senate 
with the advice and consent of the Senate . 
At least one member shall be appointed from each c ongressional 
district, and at least three of the remaining members shall be 
experienced in the horse industry and shall be appointed from the 
state at large.  However, when congressional districts When 
Congressional Districts are redrawn, each member appointed prior to 
July 1 of the year in which such modification becomes effective 
shall complete the curren t term of office, and appointments made 
after July 1 of the year in which such modifi cation becomes 
effective shall be based on the redrawn districts.  A ppointments 
made after July 1 of the year in which such modification becomes 
effective shall be from an y redrawn districts which are no t 
represented by a board member until such time as ea ch of the 
modified congressional districts Congressional Districts is 
represented by a board member.

B.  To be eligible for appointment to the Commission, a person 
shall: 
1.  Be a citizen of the United States; 
2.  Have been a resident of this state for five (5) years 
immediately preceding the appointment; and 
3.  Not have been convicted of a felony pursuant to the laws of 
this state, the laws of any other state, or the laws of the United 
States as established by a national crimi nal history record check as 
defined by Section 150.9 of Title 74 of the Oklahoma Statutes. 
C.  The term of office of a member of the Commis sion shall be 
for six (6) years and until a successor is appointed an d qualified. 
D.  The Governor Each appointing authority may remove any the 
member of he or she appointed to the Commission for incompetence, 
neglect of duty, or malfeasance in office upon first giving the 
member a copy of the charges and an opportunity to b e heard.  A 
vacancy on the Commission shall be fille d for the unexpired term by 
appointment made by the Governor. 
SECTION 2.  This act shall become effective November 1, 2023.
