5053 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5154 SECTION 1. AMENDATORY 3A O.S. 2021, Secti on 201, is
5255 amended to read as follows:
5356 Section 201. A. There is hereby created the Oklahoma Horse
5457 Racing Commission, which shall consist of the following nine (9)
5558 members:
5659 1. One member who shall be from the First Congressional
57-District, one member who shall be from the Fourth Congressional
58-District, and one member who shall be experienced in the ho rse
59-industry appointed by the Governor ;
60-2. One member who shall be from the Third Congressional
60+District appointed by the Governor;
61+2. One member who shall be fro m the Second Congressional
62+District appointed by the Governor;
63+3. One member who shall be from the Fifth Congressional

88-3. One member who shall be experienced in the horse industry
89-appointed by the Attorney General;
90-4. One member who shall be from the Second Congressional
91-District and one member who shall be experienced in the horse
92-industry appointed by the Speaker of the Oklahoma House of
93-Representatives; and
94-5. One member who shall be from the Fifth C ongressional
95-District and one member who shall be experienced in the horse
96-industry appointed by the President Pro Tempore of the Oklahoma
97-State Senate.
98-The members shall only be appointed with the advice and consent
99-of the Senate.
92+4. One member who shall be from the Fourth Congressional

96+6. Two members who shall be experienced in the horse industry

137-of the modified congressional districts is represented by a board
138-member.
139142 B. To be eligible for appointment to the Commission, a person
140143 shall:
141144 1. Be a citizen of the United States;
142145 2. Have been a resident of this state for five (5) years
143146 immediately preceding the appointment; and
144147 3. Not have been convicted of a felony pursuant to the laws of
145148 this state, the laws of any other state, or the laws of the United
146149 States as established by a national crimi nal history record check as
147150 defined by Section 150.9 of Title 74 of the Oklahoma Statutes.
148151 C. The term of office of a member of the Commis sion shall be
149152 for six (6) years and until a successor is appointed an d qualified.
150153 D. The Governor Each appointing authority may remove any the
151154 member of he or she appointed to the Commission for incompetence,
152155 neglect of duty, or malfeasance in office upon first giving the
153156 member a copy of the charges and an opportunity to b e heard. A
154157 vacancy on the Commission shall be fille d for the unexpired term by
155-appointment made by the Governor appropriate appointing authority.
156-SECTION 2. This act shall become effective July 1, 2023.
157-SECTION 3. It being immediately necessary for the preservation
158-of the public peace, health or safety, an emergency is hereby
158+appointment made by the Governor.
159+SECTION 2. This act shall become effective November 1, 2023.
