50	53		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	54		SECTION 1. AMENDATORY 3A O.S. 2021, Secti on 201, is
52	55		amended to read as follows:
53	56		Section 201. A. There is hereby created the Oklahoma Horse
54	57		Racing Commission, which shall consist of the following nine (9)
55	58		members:
56	59		1. One member who shall be from the First Congressional
57		-	District~~, one member who shall be from~~ the ~~Fourth Congressional~~
58		-	~~District, and~~ one member who shall be ~~experienced in~~ the ~~ho rse~~
59		-	~~industry~~ appointed by the Governor ;
60		-	2. One member who shall be from the ~~Third~~ Congressional

	62	+	District appointed by the Governor;
	63	+	3. One member who shall be from the Fifth Congressional

96		-	industry appointed by the President Pro Tempore of the Oklahoma
97		-	State Senate.
98		-	The members shall only be appointed with the advice and consent
99		-	of the Senate.

	99	+	appointed by the President Pro Tempore of the Oklahoma State Senate
	100	+	with the advice and consent of the Senate .
100	101		At least one member shall be appointed from each c ongressional
101	102		district, and at least three of the remaining members shall be
102	103		experienced in the horse industry and shall be appointed from the
103		-	state at large. However, when When congressional districts are
104		-	redrawn, each member appointed prior to July 1 of the year in which
105		-	such modification becomes effective shall complete the curren t term
106		-	of office, and appointments made after July 1 of the year in wh ich
107		-	such modification becomes effective shall be based on the redrawn
108		-	districts. Appointments made after July 1 of the year in which such
109		-	modification becomes effective shall be from an y redrawn districts
110		-	which are not represented by a board member until such time as each

137		-	of the modified congressional districts is represented by a board
138		-	member.
139	142		B. To be eligible for appointment to the Commission, a person
140	143		shall:
141	144		1. Be a citizen of the United States;
142	145		2. Have been a resident of this state for five (5) years
143	146		immediately preceding the appointment; and
144	147		3. Not have been convicted of a felony pursuant to the laws of
145	148		this state, the laws of any other state, or the laws of the United
146	149		States as established by a national crimi nal history record check as
147	150		defined by Section 150.9 of Title 74 of the Oklahoma Statutes.
148	151		C. The term of office of a member of the Commis sion shall be
149	152		for six (6) years and until a successor is appointed an d qualified.
150	153		D. The Governor Each appointing authority may remove any the
151	154		member of he or she appointed to the Commission for incompetence,
152	155		neglect of duty, or malfeasance in office upon first giving the
153	156		member a copy of the charges and an opportunity to b e heard. A
154	157		vacancy on the Commission shall be fille d for the unexpired term by
155		-	appointment made by the Governor appropriate appointing authority.
156		-	SECTION 2. This act shall become effective July 1, 2023.
157		-	SECTION 3. It being immediately necessary for the preservation
158		-	of the public peace, health or safety, an emergency is hereby
	158	+	appointment made by the Governor.
	159	+	SECTION 2. This act shall become effective November 1, 2023.
