40	40	An Act relating to nonprofit organizations; defining
41	41	term; restricting certain nonprofit organizations

43	43	other organizations as a condition of membership;
44	44	specifying applicability of provisions to current
45	45	members of certain nonprofit organization; providing
46	46	for codification; and declaring an emerge ncy.

52	52	BE IT ENACTED BY THE PEOPL E OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. NEW LAW A new section of law to be codified
54	54	in the Oklahoma Statutes as Section 869 of Title 18, unless there is
55	55	created a duplication in numbering, reads as foll ows:
56	56	A. As used in this section "nonprofit organization" means an
57	57	entity organized pursuant to the law of this state or which is
58	58	authorized to conduct nonprofit activity in th is state and a
59	59	majority of its members are comprised of certif ied teachers or other
60	60	music education service providers who, whether music education is
61	61	their exclusive area o f responsibility or the teacher or other
62	62	education service providers provide or assist in providing
63	63	instruction in other areas and subjec ts, and are primarily engaged

90	90	in providing music instructio n to students in grades one (1) through
91	91	twelve (12), or who provide instruction in connection with a student
92	92	band or orchestra supported in w hole or in part by funds of the
93	93	school district, or both such functions .
94	94	B. It shall be unlawful for a nonprofit organization as defined
95	95	by subsection A of this section to require its members to join,
96	96	support, become a membe r of, or to pay dues or membership fees to
97	97	any other nonprofit organization as a condition of joining or
98	98	remaining a member in good standing of the nonprofit organization.
99	99	C. The provisions of this secti on shall be applicable with
100	100	respect to the persons who are members of a nonp rofit organization
101	101	as defined by subsection A of this section as of the effective date
102	102	of this act.
103	103	SECTION 2. It being immediately necessary for the preservation
104	104	of the public peace, health or safety, an emergency is hereby
105	105	declared to exist, by reason whereof this act shall take effect and
106	106	be in full force from and after its passage and approval.
