AS INTRODUCED 
 
An Act relating to firearms; providing mandatory 
waiting period before delivery of a firearm; defining 
terms; making certain acts unl awful; providing 
penalties; providing for codification; and providing 
an effective date. 
 
 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Stat utes as Section 1288.1 of Title 21, unless there 
is created a duplication in numbering, reads as follows: 
A.  No seller of a firearm within the State of Oklahoma shall 
deliver a firearm to the p urchaser thereof until three (3) days, 
excluding weekends and legal holidays, have elapsed from the date of 
purchase. 
B.  As used in this section: 
1. "Firearm" means a rifle, pistol, or shotgun; and 
2.  "Seller" means and includes a licensed importer, licensed 
manufacturer, or licensed dealer engaged i n the business of making

firearm sales at retail or for distributi on, use, consumption, or 
storage. 
C.  1.  It shall be unlawful for an y seller, or any employee or 
agent of a seller, to deliver a firearm befor e the expiration of the 
three-day waiting period. 
2.  It shall be unlawful for a purchaser of a firearm to obtain 
delivery of a firearm by fraud, false pretense, or false 
representation. 
D.  Any person who violates the provisions of subsection C of 
this section shall, upon conviction, be guilty of a felony. 
SECTION 2.  This act shall become effective November 1, 2023.
