2853 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3054 SECTION 1. NEW LAW A new section o f law to be codified
3155 in the Oklahoma Statutes as Section 2-33 of Title 2, unless there is
3256 created a duplication in numbering, re ads as follows:

3457 A. The State Board of Agriculture shall be the official plant
3558 pest and disease control agency of the State of O klahoma. The Board
3659 shall have authority to promulgate and enforce rules governin g plant
3760 pests and plant protection, including q uarantine.

3961 B. In addition to other statutory authority, the state plant
4062 regulatory official, upon obtaining concurrence of the State Board
4163 of Agriculture, may issue emergency orders governing plants in order

4291 to protect the citizens and plants of the state from diseases and
4392 pests. The emergency order may:

4593 1. Prohibit or impose conditions o n importing plants or

4895 2. Require testing of pests or plants;

5096 3. Require any treatment of pests or plants;

5297 4. Prohibit or impose conditions on moving plants or implements
5398 of husbandry within the state;

5599 5. Issue stop movement orders for all plants in the state to
56100 determine the precise location of a plant pest or disease;

58101 6. Govern the disposition of plants; and

60102 7. Impose other measures governing plants to protect the
61103 citizens and plants of the state from disea ses and pests.

63104 C. Emergency orders issued pursuant to this section shall
64105 expire on the date set in the order or ninety (90) days after the
65106 date the order was issued ; however, the state plant regulatory
66107 official may renew the order for successive ninety –day periods.

68108 SECTION 2. This act shall become effective November 1, 2023.
