17	45		plant pest and disease control agency; providing
18	46		Board has authority to promulgate and enforce rules;
19	47		providing for issuance of emergency orders; providing
20	48		for expiration of emergency orders; providing for
21	49		codification; and providing an effective date.

28	53		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

30	54		SECTION 1. NEW LAW A new section o f law to be codified
31	55		in the Oklahoma Statutes as Section 2-33 of Title 2, unless there is
32	56		created a duplication in numbering, re ads as follows:

34	57		A. The State Board of Agriculture shall be the official plant
35	58		pest and disease control agency of the State of O klahoma. The Board
36	59		shall have authority to promulgate and enforce rules governin g plant
37	60		pests and plant protection, including q uarantine.

39	61		B. In addition to other statutory authority, the state plant
40	62		regulatory official, upon obtaining concurrence of the State Board
41	63		of Agriculture, may issue emergency orders governing plants in order

42	91		to protect the citizens and plants of the state from diseases and
43	92		pests. The emergency order may:

45	93		1. Prohibit or impose conditions o n importing plants or
46		-	implements of husbandry into the state; ENR. H. B. NO. 1456 Page 2

	94	+	implements of husbandry into the state;
48	95		2. Require testing of pests or plants;
49		-
50	96		3. Require any treatment of pests or plants;
51		-
52	97		4. Prohibit or impose conditions on moving plants or implements
53	98		of husbandry within the state;

55	99		5. Issue stop movement orders for all plants in the state to
56	100		determine the precise location of a plant pest or disease;

58	101		6. Govern the disposition of plants; and
59		-
60	102		7. Impose other measures governing plants to protect the
61	103		citizens and plants of the state from disea ses and pests.

63	104		C. Emergency orders issued pursuant to this section shall
64	105		expire on the date set in the order or ninety (90) days after the
65	106		date the order was issued ; however, the state plant regulatory
66	107		official may renew the order for successive ninety –day periods.

68	108		SECTION 2. This act shall become effective November 1, 2023.
