15	44		Sections 18-308 and 18-309, which relate to the
16	45		Oklahoma Wheat Resources Act; removing fixed fee rate
17	46		for a bushel of wheat; providing that the Oklahoma
18	47		Wheat Association shall assess a fee upon all
19	48		marketed wheat; providing that a referendum may be
20	49		called to determine continuation of the fee assessed
21	50		by the Oklahoma Wheat Association; and providing an

29	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:

31	56		SECTION 1. AMENDATORY 2 O.S. 2021, Section 18 -308, is
32	57		amended to read as follows:
33		-
34	58		Section 18-308. A. There is hereby assessed The Oklahoma Wheat
35	59		Association shall assess a fee of two cents ($0.02) per bushel upon
36	60		all wheat marketed by wheat producers in this stat e and sold through
37	61		commercial channels. The fee is assessed and imposed on the
38	62		producer at the time of sale or delivery, and shall be collected and
39	63		remitted by the first purchaser to the Oklahoma Wheat Commission.
40	64		Under the provisions of the Oklahoma Whe at Resources Act, no wheat
41	65		shall be subject to a fee more than once.

43	93		B. The Commission shall allocate twenty percent (20%) of the
44	94		two-cent fee levied and collected pursuant to subsection A of this
45	95		section to the Oklahoma Wheat Research Foundation for the purpose of

47	97		utilization and educational projects, less the cost of collecting
48	98		the fee, such cost not to exceed fifty percent (50%) of the total of
49	99		the office rental and clerical costs, and the costs of supplies and
50	100		postage and such cost to be prorated on the basis of eighty percent
51	101		(80%) to the Commission and twenty percent (20%) to the Oklahoma
52	102		Wheat Research Foundation.

54	103		C. In order for the Oklahoma Wheat Research F oundation to
55	104		qualify for the alloc ation of twenty percent (20%) of collected
56	105		fees, the Commission shall appoi nt a member of the Oklahoma Wheat
57	106		Commission to the Oklahoma Wheat Research Foundation board of
58	107		directors.

60	108		D. Any unexpended balance contained in the revolving fund
61	109		designated for the Wheat Utilization, Research and Market
62	110		Development Commission as of Nov ember 1, 2016, shall be transferred
63	111		and deposited to the credit of the General Revenue Fund of the State
64	112		Treasury.

66	113		SECTION 2. AMENDATORY 2 O.S. 2021, Secti on 18-309, is
67	114		amended to read as follows:

69	115		Section 18-309. A. Producers may petition for a referendum at

71	144		Oklahoma Wheat Resources Act to determine if the a ssessment is to be

74	146		B. The President Commissioner of the State Board of Agriculture
75	147		shall call and conduct a referendum if the petitions bear signatures
76	148		of ten percent (10%) of the wheat producers. No more than one such
77	149		referendum shall be cond ucted in any one thirty-six-month period.
78	150		The State Board of Agriculture shall determine if the petition bea rs
79	151		the required number of valid signatures. The President Commissioner
80	152		shall announce the referendum at least thirty (30) days prior to the
81	153		day of voting. At least thirty (30) days be fore the referendum, th e
82	154		President Commissioner shall mail a notice of the referendum to all
83	155		known wheat producers in the State of Oklahom a who market wheat in
84	156		commercial quantities. The notice shall specify the dates , times,
85	157		and places for holding the re ferendum. The notice shall also
86	158		include a sample ballot with the follo wing wording:

95	164		shall be designated by the Agricultural Extension Division of
96	165		Oklahoma State Universi ty. Voting in each county shall be

101	196		D. The Oklahoma Wheat Commission shall ensure sufficient
102	197		ballots and supplies necessary for conducting the votin g and the

105	199		E. Certified results of the referendum i n each county shall be
106	200		transmitted within twenty-four (24) hours after voting ends to the
107		-	President Commissioner of the State Board of Agriculture. The
