1443 An Act relating to agriculture; amending 2 O.S. 2021,
1544 Sections 18-308 and 18-309, which relate to the
1645 Oklahoma Wheat Resources Act; removing fixed fee rate
1746 for a bushel of wheat; providing that the Oklahoma
1847 Wheat Association shall assess a fee upon all
1948 marketed wheat; providing that a referendum may be
2049 called to determine continuation of the fee assessed

3156 SECTION 1. AMENDATORY 2 O.S. 2021, Section 18 -308, is
3257 amended to read as follows:

3458 Section 18-308. A. There is hereby assessed The Oklahoma Wheat
3559 Association shall assess a fee of two cents ($0.02) per bushel upon
3660 all wheat marketed by wheat producers in this stat e and sold through
3761 commercial channels. The fee is assessed and imposed on the
3862 producer at the time of sale or delivery, and shall be collected and
3963 remitted by the first purchaser to the Oklahoma Wheat Commission.
4064 Under the provisions of the Oklahoma Whe at Resources Act, no wheat
4165 shall be subject to a fee more than once.

4393 B. The Commission shall allocate twenty percent (20%) of the
4494 two-cent fee levied and collected pursuant to subsection A of this
4595 section to the Oklahoma Wheat Research Foundation for the purpose of

4797 utilization and educational projects, less the cost of collecting
4898 the fee, such cost not to exceed fifty percent (50%) of the total of
4999 the office rental and clerical costs, and the costs of supplies and
50100 postage and such cost to be prorated on the basis of eighty percent
51101 (80%) to the Commission and twenty percent (20%) to the Oklahoma
52102 Wheat Research Foundation.

54103 C. In order for the Oklahoma Wheat Research F oundation to
55104 qualify for the alloc ation of twenty percent (20%) of collected
56105 fees, the Commission shall appoi nt a member of the Oklahoma Wheat
57106 Commission to the Oklahoma Wheat Research Foundation board of

60108 D. Any unexpended balance contained in the revolving fund
61109 designated for the Wheat Utilization, Research and Market
62110 Development Commission as of Nov ember 1, 2016, shall be transferred
63111 and deposited to the credit of the General Revenue Fund of the State

74146 B. The President Commissioner of the State Board of Agriculture
75147 shall call and conduct a referendum if the petitions bear signatures
76148 of ten percent (10%) of the wheat producers. No more than one such
77149 referendum shall be cond ucted in any one thirty-six-month period.
78150 The State Board of Agriculture shall determine if the petition bea rs
79151 the required number of valid signatures. The President Commissioner
80152 shall announce the referendum at least thirty (30) days prior to the
81153 day of voting. At least thirty (30) days be fore the referendum, th e
82154 President Commissioner shall mail a notice of the referendum to all
83155 known wheat producers in the State of Oklahom a who market wheat in
84156 commercial quantities. The notice shall specify the dates , times,
85157 and places for holding the re ferendum. The notice shall also
86158 include a sample ballot with the follo wing wording:

101196 D. The Oklahoma Wheat Commission shall ensure sufficient
102197 ballots and supplies necessary for conducting the votin g and the
103198 tabulation of returns.

105199 E. Certified results of the referendum i n each county shall be
106200 transmitted within twenty-four (24) hours after voting ends to the
107-President Commissioner of the State Board of Agriculture. The
108-ballots shall be transmitted to the President Commissioner within
109-forty-eight (48) hours. Ba llots shall be preserved by the President
110-Commissioner for a period of at least t hree (3) months.
