49	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
50	53		SECTION 1. AMENDATORY 12 O.S. 2021, Section 95, is
51	54		amended to read as follows:
52	55		Section 95. A. Civil actions other than for the recovery of
53	56		real property can only be brought within the following periods,
54	57		after the cause of action shall have accrued, and not afterwards:
55	58		1. Within five (5) years: An action upon any contract,
56	59		agreement, or promise in writing;
57	60		2. Within three (3) years: An action upon a contract express
58	61		or implied not in writing; an action upon a li ability created by
59	62		statute other than a forfeiture or penalty; and an action on a
60	63		foreign judgment;

87	91		3. Within two (2) years: An action for trespass u pon real
88	92		property; an action for taking, detaining, or injuring personal
89	93		property, including actions for the specific recovery of personal
90	94		property; an action for injury to the rights of another, not arising
91	95		on contract, and not hereinafter enumerated; an action for relief on
92	96		the ground of fraud - the cause of action in such case shall not be
93	97		deemed to have accrued until the discovery of the fraud;
94	98		4. Within one (1) year: An action for libel, slande r, assault,
95	99		battery, malicious prosecution, or false impr isonment; an action
96	100		upon a statute for penalty or forfeiture, except where the statute
97	101		imposing it prescribes a different limitation;
98	102		5. An action upon the official bond or undertaking of an
99	103		executor, administrator, guardian, sheriff, or any other officer , or
100	104		upon the bond or undertaking given in attachment, injunction,
101	105		arrest, or in any case whatever requir ed by the statute, can only be
102	106		brought within five (5) years after the cause of action shall h ave
103	107		accrued;
104	108		6. An action based on intentional conduct b rought by any person
105	109		for recovery of damages for injury suffered as a result of childhood
106	110		sexual abuse incidents or sexual exploitation as defined by Section
107	111		1-1-105 of Title 10A of the Oklahoma Statutes or incest against the
108	112		actual perpetrator shall be co mmenced by the forty -fifth birthday of
109	113		the alleged victim. If the person committing the act of sexual
110	114		abuse against a child was employed by an institution, agency, firm,

137	142		business, corporation or other publ ic or private legal entity that
138	143		owed a duty of care to the victim, or the accused and the child were
139	144		engaged in some activity over which the legal entity h ad some degree
140	145		of responsibility or control, the action must be brought against
141	146		such employer or lega l entity within two (2) five (5) years;
142	147		provided, that the time limit for commencement of an action pursuant
143	148		to this paragraph is tolled for a child until the child reaches the
144	149		age of eighteen (18) years. No action may be brought against the
145	150		alleged perpetrator or the estate of the alleged perpetrator af ter
146	151		the death of such alleged perpetrator, unless the perpetrator was
147	152		convicted of a crime of sexual abus e involving the claimant. An
148	153		action pursuant to this paragraph must be based upon objective
149	154		verifiable evidence in order for the victim to recover dam ages for
150	155		injuries suffered by reason of such sexual abuse, exploitation, or
151	156		incest. The victim need not establish which act in a series of
152	157		continuing sexual abuse incidents, exploitation incidents, or ince st
153	158		caused the injury complained of;
154	159		7. An action based on intentional conduct brought by any person
155	160		for recovery of damages for injury suffered as a resul t of criminal
156	161		actions, as defined by the Oklahoma Statutes, may be brought against
157	162		any person incarcerated or under the supervision of a state, federal
158	163		or local correctional facility on or after November 1, 2003:
159	164		a. at any time during the incarceration of the offender
160	165		for the offense on which the action is based, or

187	193		b. within five (5) years after the perp etrator is
188	194		released from the custody of a state, f ederal or local
189	195		correctional facility, if the defendant was serving
190	196		time for the offense on which the act ion is based;
191	197		8. An action to establish paternity and to enforce support
192	198		obligations can be brought any time before the child reaches the age
193	199		of eighteen (18);
194	200		9. An action to establish paternity can be brought by a child
195	201		in accordance with Section 7700 -606 of Title 10 of the Oklahoma
196	202		Statutes;
197	203		10. Court-ordered child support is owed until it is paid i n
198	204		full and it is not subject to a statute of limit ations;
199	205		11. All actions filed by an inmate or by a person based upon
200	206		facts that occurred while the perso n was an inmate in the custody of
201	207		one of the following:
202	208		a. the State of Oklahoma,
203	209		b. a contractor of the State of Oklahoma, or
204	210		c. a political subdivisi on of the State of Oklahoma,
205	211		to include, but not be limited to, the revocation of earned credits
206	212		and claims for injury to the rights of another, shall be commenced
207	213		within one (1) year after the cause of act ion shall have accrued;

235	242		12. An action for rel ief, not hereinbefore provided for, can
236	243		only be brought within five (5) years after the cause of action
237	244		shall have accrued.
238	245		B. Collection of debts owed by inmates who have received damage
239	246		awards pursuant to Section 566.1 of Title 57 of the Oklahoma
240	247		Statutes shall be governed by the time limitations imposed by that
241	248		section.
242	249		SECTION 2. This act shall become effective November 1, 2023.
