4040 An Act relating to inmates; amending 47 O.S. 2021,
4141 Section 6-105.3, as amended by Section 44, Chapter
4242 282, O.S.L. 2022 (47 O.S. Supp. 2022 , Section 6-
4343 105.3), which relates to the issuance of driver
4444 licenses; directing the Department of Corrections to
4545 coordinate with Service Oklahoma on issuing REAL ID
4646 Compliant identification cards and driver licenses;

4949 other driver licenses; authorizing the use of certain

6666 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6767 SECTION 1. AMENDATORY 47 O.S. 202 1, Section 6-105.3, as
6868 amended by Section 44, Chapter 282, O.S.L. 2022 (47 O.S. Supp. 2022,
6969 Section 6-105.3), is amended to read as follows:

9696 Section 6-105.3 A. In addition to the licenses to operate
9797 motor vehicles, Service Oklahoma may issue cards to Oklahoma
9898 residents for purposes of identification only . The identification
9999 cards shall be issued, renewed, replaced, canceled and denied in the
100100 same manner as driver licenses in this sta te. A licensee whose
101101 record reflects a notation of the person's proof of legal presence,
102102 verified by the U.S. Department of Homeland S ecurity, or proof of
103103 U.S. citizenship, may obtain a REAL ID Compliant Identification Card
104104 or a Noncompliant Identificatio n Card from a licensed operator or
105105 Service Oklahoma, regardless of the s tatus of the license held by
106106 the licensee. Provided, the licensee must comply with all REAL ID
107107 documentation requirements to obtain a REAL ID Compliant
108108 Identification Card. A person shall not apply for or possess more
109109 than one state-issued or territory-issued REAL ID Compliant
110110 Identification Card pursuant to the provisions of Section 6-101 of
111111 this title.
112112 The application for an identi fication card by any person under
113113 the age of eighteen (18) years shall be signed and verified by a
114114 custodial legal parent or legal guardian, either in person before a
115115 person authorized to administer oaths or electronically if
116116 completing an online applicati on, or a notarized affidavit signed by
117117 a custodial legal parent or legal guardian submitted before a person
118118 authorized to administer oaths by the person under the age of
119119 eighteen (18) years with the application. Except as otherwise

146146 provided in this sectio n, the identification cards shall be valid
147147 for a period of either four (4) years from the month of issuance or
148148 eight (8) years from the month of issuance; however, the
149149 identification cards issued to persons sixty-five (65) years of age
150150 or older shall be va lid indefinitely from the month of issuance.
151151 B. 1. The Department of Corrections shall coordinate with
152152 Service Oklahoma to provide REAL ID Compliant or REAL ID
153153 Noncompliant Identification Cards and REAL ID Compliant D river
154154 Licenses to all inmates who do not have a current state -issued
155155 identification card or driver license upon their release from
156156 custody. The identification cards and driver licenses for inmates
157157 shall be issued, replaced, canceled and denied in the same manner as
158158 driver licenses in this state.
159159 2. If an inmate is unable to provide a valid identification
160160 document and no other form of identification is available, Service
161161 Oklahoma shall allow the use of a Department of Corrections-issued
162162 consolidated record card to serve as a valid identification document
163163 to obtain a REAL ID Compliant or REAL ID Noncompliant Identification
164164 Card or REAL ID Compliant Driver License.
165165 3. REAL ID Compliant or REAL ID Noncompliant Identification
166166 Cards and REAL ID Compliant Driver Licenses issued with a
167167 consolidated record card fro m the Department of Corrections for
168168 inmates shall be valid for a period of four (4) years from the month

195195 of issuance for an allo wable fee to be determined by Service
196196 Oklahoma and are nonrenewable and nontransferable.
197197 4. The fee charged for the issuance or replacement of a REAL ID
198198 Compliant or REAL ID Noncompliant Identification Card or REAL ID
199199 Compliant Driver License pursuant to this subsection shall be
200200 deposited in the Department of Public Safety Revolving Fund through
201201 October 31, 2022. Beginning November 1, 2022, this fee shall be
202202 deposited in the Service Oklahoma Revolving Fund. Provided,
203203 however, REAL ID Compliant or REAL ID Noncompliant Identifi cation
204204 Cards and REAL ID Compliant Driver L icenses issued to individuals
205205 required to register pursuant to the Sex Offenders Registration Act
206206 shall only be valid for a period of one (1) year. No person sixty-
207207 five (65) years of age or older shall be charged a fee for a REAL ID
208208 Noncompliant Identification Card.
209209 5. Service Oklahoma is authorized to promulgate rules and
210210 procedures to implement the provisions of this subs ection.
211211 C. No person shall hold more than one state-issued or
212212 territory-issued REAL ID Compliant Driver License or REAL ID
213213 Compliant Identification Card, as defined in subsection G of Section
214214 6-101 of this title. Service Oklahoma shall not issue a REAL ID
215215 Compliant Identification Card to any applicant who has been
216216 previously issued a REAL ID Compliant Driver License or REAL ID
217217 Compliant Identification Ca rd unless such license or identification
218218 card has been surrendered to the Department by the applicant.

245245 Service Oklahoma may promulgate rules related to the issuance of
246246 replacement REAL ID Compliant Identification Cards in the event of
247247 loss or theft.
248248 D. The fee charged for the issuance or renewal of a REAL ID
249249 Compliant Identification Card shall be Twenty-five Dollars ($25.00)
250250 for a 4-year card and Fifty Dollars ($50.00) for an 8-year card.
251251 The fee charged for the issuance or renewal of a RE AL ID
252252 Noncompliant Identification Card pursuant to this section shall be
253253 Twenty-five Dollars ($25.00) for a 4-year card and Fifty Dollars
254254 ($50.00) for an 8-year card; however, no person sixty-five (65)
255255 years of age or older, or one hundred percent (100%) d isabled
256256 veteran described in subsection P of Section 6-101 of this title
257257 shall be charged a fee for an identification card. Of each fee
258258 charged pursuant to the provisions of this subsection:
259259 1. Seven Dollars ($7.00) of a 4-year card and Fourteen Dollars
260260 ($14.00) of an 8-year card shall be apportioned as provided in
261261 Section 1104 of this title;
262262 2. Three Dollars ($3.00) of a 4-year card and Six Dollars
263263 ($6.00) of an 8-year card shall be credited to the Department of
264264 Public Safety Computer Imaging System Rev olving Fund to be used
265265 solely for the purpose of the administration and mainten ance of the
266266 computerized imaging system of the Department through October 31,
267267 2022. Beginning November 1, 2022, Three Dollars ($3.00) of a 4 -year
268268 card and Six Dollars ($6.00) of an 8 -year card shall be credited to

295295 the Service Oklahoma Computer Imaging Syst em Revolving Fund to be
296296 used solely for the purpose of administration and maintenance of the
297297 computerized imaging system of Service Oklahoma ;
298298 3. Ten Dollars ($10.00) of a 4-year card and Twenty Dollars
299299 ($20.00) of an 8-year card shall be deposited in the Department of
300300 Public Safety Revolving Fund through October 31, 2022. Beginning
301301 November 1, 2022, this fee shall be deposited in the Service
302302 Oklahoma Revolving Fund;
303303 4. Three Dollars ($3.00) o f a 4-year card and Six Dollars
304304 ($6.00) of an 8-year card shall be deposited to the State Publi c
305305 Safety Fund created in Section 2-147 of this title; and
306306 5. Two Dollars ($2.00) for a 4-year card and Four Dollars
307307 ($4.00) for an 8-year card of the fee authorized by this subsection
308308 related to the issuance or renewal of a n identification card by a
309309 licensed operator that does process approved applications or
310310 renewals for REAL ID Compliant and REAL ID Noncompliant Driver
311311 Licenses or Identification Cards shall be retained by the licensed
312312 operator.
313313 E. The fee charged for replacement of a REAL ID Compliant
314314 Identification Card, or REAL ID Noncompliant Identification Card,
315315 shall be Twenty-five Dollars ($25.00); however, no person sixty -five
316316 (65) years of age or older shall be charged a fee for an
317317 identification card replacement. Of each fee charged pursuant to
318318 the provisions of this subsection:

355355 3. Ten Dollars ($10.00) shall be deposited in the Department of
356356 Public Safety Revolving Fund through October 31, 2022. Beginning
357357 November 1, 2022, this fee shall be deposited in the Service
358358 Oklahoma Revolving Fund;
359359 4. Three Dollars ($3.00) shall be deposited to the S tate Public
360360 Safety Fund created in Section 2-147 of this title; and
361361 5. Two Dollars ($2.00) of the fee authorized by this subsection
362362 related to the replacement of an identification card by a licensed
363363 operator that does process approved applications or renewals for
364364 REAL ID Compliant or REAL ID Noncompliant Driver Licenses or
365365 Identification Cards shall be retained by the licensed operator.
366366 F. The Oklahoma Tax Commission is hereby authorized to
367367 reimburse, from funds available to that agency, each licensed
368368 operator issuing an identification card to a person sixty-five (65)

395395 years of age or older, an amount not to exceed One Dollar ($1.00)
396396 for each card or driver license so issued. The Tax Commission shall
397397 develop procedures for claims for reimbursement.
398398 G. Notwithstanding any other provision of law, when a person
399399 makes application for a new identification card, or makes
400400 application to renew an identification card, and the person has been
401401 convicted of, or receive d a deferred judgment for, any offense
402402 required to register pursuant to the Sex Offenders Registration Act,
403403 the identification card shall be valid for a period of one (1) year
404404 from the month of issuance, but may be renewed yearly during the
405405 time the person is subject to registration on the Sex Offender
406406 Registry. The cost for such identification card shall be the same
407407 as for other identification cards and renewals.
408408 SECTION 2. AMENDATORY 57 O.S. 2021, Section 513.3, as
409409 amended by Section 1, Chapter 64, O.S.L. 2022 (57 O.S. Supp. 20 22,
410410 Section 513.3), is amended to read as follows:
411411 Section 513.3. A. When any inmate shall be discharged from an
412412 institution of the Department of Corrections and the intended
413413 residence designated by the i nmate is within this state, the
414414 Department of Corrections shall provide the inmate with relevant
415415 documentation to assist the inmate in obtaining post -release
416416 employment and shall coordinate with the Department of Publ ic Safety
417417 to provide a REAL ID Compliant or REAL ID Noncompliant
418418 Identification Card or a REAL ID Compliant Driver License if the

445445 inmate does not have a current state-issued identification card or
446446 driver license.
447447 B. 1. Within nine (9) months prior to the release of an inmate
448448 from custody, the Department of Corre ctions shall identify whether
449449 the inmate has a current form of state identification and begin the
450450 process of gathering the documentation r equired for the issuance of
451451 a REAL ID Compliant or REAL ID Noncompliant Identification Card
452452 pursuant to Section 6 -105.3 of Title 47 of the Oklahoma Statutes or
453453 a REAL ID Compliant Driver Lic ense pursuant to Section 6-101 of
454454 Title 47 of the Oklahoma Statutes . If an inmate has any valid form
455455 of a state-issued identification card or drive r license, the inmate
456456 may avail himself or herself of the provisions of this section.
457457 2. The Department of Corrections may utilize any funds
458458 available to cover the costs associated with the implementation and
459459 administration of this section and the purchas e of REAL ID Compliant
460460 or REAL ID Noncompliant Identification Cards or REAL ID Compliant
461461 Driver Licenses, including, but not limi ted to, inmate trust funds,
462462 existing funds of the Departmen t of Corrections and donations.
463463 3. The provisions of this section shall apply only to inmates
464464 who may receive a state-issued identification card pursuant to
465465 Section 1550.42 of Title 21 of the Okla homa Statutes.
466466 C. For purposes of assisting an inmate in o btaining post-
467467 release employment, the Department of Corrections sha ll provide the
468468 inmate with the following documentation:

495495 1. A copy of the vocational training recor d of the inmate, if
496496 applicable;
497497 2. A copy of the work record of the inmate, if applicable ;
498498 3. A certified copy of the birth certificate of the inmate, if
499499 obtainable;
500500 4. A Social Security card or a replacement Soci al Security card
501501 of the inmate, if obtai nable;
502502 5. A resume that includ es any trade learned by the inmate and
503503 the proficiency at t hat trade by the inmate; and
504504 6. Documentation that the inmate has completed a practice job
505505 interview.
506506 In addition, the Depart ment shall notify the inmate if he or sh e
507507 is eligible to apply for a li cense from a state entity charged with
508508 oversight of an occu pational license or certification.
509509 D. The following categories of inmates are not required to
510510 complete resumes or practice job interviews prior to their release
511511 from incarceration:
512512 1. Inmates sixty-five (65) years of age or older;
513513 2. Inmates releasing to medical parole or discharging from a
514514 prison infirmary setting;
515515 3. Inmates releasing from a Department of Corre ctions Mental
516516 Health Unit;
517517 4. Inmates releasing to the custody of another jurisdic tion on
518518 a warrant or detainer;

545545 5. Inmates returning to community supervision from an
546546 intermediate revocation facility; and
547547 6. Inmates that the Department determines would be physically
548548 or mentally unable to return to the workforce upon r elease from
549549 incarceration.
550550 E. The Department of Corrections is authorized to promulgate
551551 rules and procedures to implem ent the provisions of this section.
552552 SECTION 3. This act shall become effective November 1, 2023.
